    I live in Illinois and I am licensed to Concealed Carry (CC). When I was shopping for my first CC firearm, I looked at several to get a feel for the grip and the trigger break as my hands are not large but they are thick and meaty. Do your research and compile a list of quality firearms before you go shopping. My list consisted of 17 to choose from and even though the gun store that I went to did not have every one of them on my list, I still had a wide variety to look at.
    Don't buy a SIG, Glock, Walther or Hellcat because John or Jane said so. Find one that fits you as you will be the primary user of your next firearm. After you have narrowed down your search from your list to just a few, only then can you choose by price, if that's what you wish, as you know that you will also have a quality firearm that fits your hands.
    I eventually decided upon a red dot optics ready M&P 9 Shield Plus with a 4" barrel for CC and I also purchased 2 more 13 round mags for when I'm at the range. I picked it up on Nov. 20, 2021 and I have not yet been to the range but I will soon enough. My only current problem is the ability to find a decent holster that comfortably fits my fatness. lol

    Glad I have my license to carry, from Colorado. I'll be traveling through Illinois soon and from reading the laws, spread out over various Acts, I will be able to carry the gun on my person, with 15 round mag, legally, while in the car (whew, that was a mouthful). From reading the various Acts: if you are carrying legally, in the proviso above, and you leave the vehicle, you must leave the loaded firearm in a concealed compartment (glove box is a valid compartment) or a locked case, out of sight, within your locked vehicle. Thanks for the vid.
    I guess people without permits should follow Federal transport law which means, unloaded, locked in a case. Ammunition locked in a separate case. Both cases located outside of the cabin of the vehicle (trunk works).

      It should be pointed out that no conceal carry license is required in Colorado to conceal carry within your own vehicle. So technically, a Colorado resident should be able to conceal carry within Illinois, while in their vehicle, with a CCW permit. And as you pointed out, once outside the vehicle, the firearm needs to remain within the vehicle, with the details you already provided in regards to storing it securely.

    So if I have my gun unlaoaded, no mag in the well, and a fully loaded mag in the same gun case. Does it matter where I have the “container”? Does that still have to be out of arms reach?

    This glove box thing doesnt work with crooked cops. They unlocked the box. Loaded the gun. Charged me with a felony. Dont listen to this advice if your in chicago.

    Well, I hate to tell you that I have an active CCW from the state of Florida, I have always been a resident of the state of FL, and LAWFULLY carrying a loaded firearm IN MY CAR when I was pulled over for a brake light that was out. Once LEO was in formed I had a firearm, I was thrown with my face to the ground, my vehicle was searched without my permission and was arrested and spent thousands of dollars defending myself until charges were dropped by DA. And now I have to spend EVEN MORE MONEY TO SUE. Just because it’s legal, doesn’t mean it won’t cost you money to defend yourself and pursue legal action after a cop who has been promoted to his highest level of incompetence arrests you. Oh yeah, my car incurred damages while being towed too! So, you better have 50k laying around to pay for attorneys.

    in southern IL. is there any laws restricting a person from having 2 or more concealed pistols if a person has there ccw permit.

      jeff012361 the law in Illinois does not limit the number of concealed firearms you can have on you as long as you have your license

    I have a FOID Card. Not a concealed carry license. Can I carry my Colt M4 in the trunk unloaded in a carry Bag, and have loaded magazines in a separate gun case ? Do I have to put a lock through the rifle like a hand gun ? Thankyou for any answers.

    If I stay in a hotel, how do I proceed? Does a hotel policy hold the weight of law? If there is no policy against guns, can it remain in a locked container inside a suitcase?

      Now im no lawyer but to my understanding a purchased hotel room is a temporary domicile. If you are legal to own said firearms you can set it wherever you like, including easily accessible locations i.e in the open

      Again, thats up to the cop's interpretation of "Out of Reach", but yes.
      However, you are more likely to have to battle that in court if you run into a cop who is a stickler.
      If you put your gun in the trunk, you should have no issues. Sucks, but legally safer.

      +Raul Garcia years back, when I was a active duty mp, we were told "lunging distance". or if you could reach up or back & have access to it(control). to be honest, many cops & state troopers lie or distort where a firearm is then use that to press drivers in traffic stops. DV scenes & court actions have shown that. a ex nfl player faced a gun charge in Orlando but his case was dismissed. he had a valid ccw license & was later shot in a un-related dispute.

    I live in IN and have a CCW permit and was wondering can I carry a loaded gun in my car (under seat or glove compsrtment)??

      According to the firearm concealed carry act, 430 ilcs 66/40, a non-resident may carry a loaded firearm in their vehicle as long as it is concealed and it as long as they are licensed by their home state to carry a concealed firearm. Based upon what you are saying, you are good to go, but remember that the gun must remain in the car and concealed. If you remove the gun from your car, it must be first unloaded and put into a container or case.

    My instructor from my class yesterday informed us that the car is not a storable place for the gun can you confirm or specify a way in which the gun can be stored in the vehicle when the driver is not the carrier is not in it

      Either something is getting confused, or your instructor is not correct. aside from nuclear and federal facilities, which are referred to in paragraph 22 in paragraph 23, I am pasting below the law that tells you that you indeed can store your gun in your car. It is 430 ILCS 66/65 (b)
      (b) Notwithstanding subsections (a), (a-5), and (a-10) of this Section except under paragraph (22) or (23) of subsection (a), any licensee prohibited from carrying a concealed firearm into the parking area of a prohibited location specified in subsection (a), (a-5), or (a-10) of this Section shall be permitted to carry a concealed firearm on or about his or her person within a vehicle into the parking area and may store a firearm or ammunition concealed in a case within a locked vehicle or locked container out of plain view within the vehicle in the parking area. A licensee may carry a concealed firearm in the immediate area surrounding his or her vehicle within a prohibited parking lot area only for the limited purpose of storing or retrieving a firearm within the vehicle's trunk. For purposes of this subsection, "case" includes a glove compartment or console that completely encloses the concealed firearm or ammunition, the trunk of the vehicle, or a firearm carrying box, shipping box, or other container.

    What are the rules for if you are visiting someone in IL, in particular, Chicago and wish to take your gun (that's in a locked container) with you into the home you are visiting?
    What are the rules of staying in a hotel in IL if you are visiting or traveling? or any home in general?

      in a hotel there really isn't no gun laws stating u can/cannot have a firearm in a hotel u have to ask the owner(i got a book that says it for 2017 it's white and blue.it's about the 10-15th page in..written by a lawyer) like im really going to wake up the owner at 3 am?....with illinois cc rules there must b a sighn posted on the door and the sighn must 4×6 with a 9mm berreta in the center with a circle with a line (like a no smoking sighn)..and the code in the bottom right corner...that's a no no...amd illinois don't honor no other states...if the homeowner allows u to take into there home u can do it if not u have to leave it in ur car..amd if someone walks around ur car they should not b able to see ur firearm at all...Diggins case also says that it doesn't have to b in ur glove box or center..it's can b locked in ur car with something covering it or just locked in ur car.

      No, the law only requires that the gun be unloaded and in a container, that the glove box or center console qualifies as. It does not say that the container has to be locked. That is a popular misconception.

    Hi mike i have a friend who has a FOID card but no CCL. He was carrying his firearm with live ammo but both were in same case but chamber and mag was not inserted. It also had a combination lock on it but police said it was still accessible and charged him with UUW. Another gun dealer told me under passenger seat is still accessible your thougjts did cop make right decision?

      I am not a lawyer, but from what you are describing it was perfectly legal because it was unloaded and enclosed in a container. he will need a lawyer, but on the paperwork it will show what statute he was charged under. Under the statute it clearly states that unloaded and enclosed in a container is not a violation of unlawful use of a weapon. As long as the container was closed, even if it's not locked, he will get off.

      @@jackomalley3687 the Illinois supreme Court ruled in people vs diggins that a container, such as the center console or the glove box, is legal. There are three tests for the gun to be legal. Not immediately accessible is only one of those three tests. The other is if it is unloaded and enclosed in a container.I would be shocked if the prosecutor doesn't drop the charges when he shows up for his first court date.

    @Mike what if you live in a permitless/ constitutional carry state that doesn't require permits? Could it still be transported loaded? I'm referring to (e)(2)
    430 ILCS 66/40
    (e) Nothing in this Act shall prohibit a non-resident from transporting a concealed firearm within his or her
    vehicle in Illinois, if the concealed firearm remains within his or her vehicle and the non-resident:
    (1) is not prohibited from owning or possessing a firearm under federal law;
    (2) is eligible to carry a firearm in public under the laws of his or her state or territory of residence, as
    evidenced by the possession of a concealed carry license or permit issued by his or her state of
    residence, if applicable; and
    (3) is not in possession of a license under this Act. If the non-resident leaves his or her vehicle
    unattended, he or she shall store the firearm within a locked vehicle or locked container within the vehicle in
    accordance with subsection (b) of Section 65 of this Act. (Source: P.A. 98-63, eff. 7-9-13.

      xTHELxVADAMEEx Yes! A FOID card allows you to have an UNLOADED gun in a container, including the glovebox or center console. If you don't have a Concealed Carry License, a loaded gun in the car is a felony.

      Jorge Montero non residents with a license or permit from their home state may have a loaded handgun in their car, as long as it is concealed. But it must remain in the vehicle. If you exit your vehicle with the firearm, it must be unloaded first. So you can carry a concealed firearm, on the basis of the permit from your home state, but only within the confines of your vehicle.

    what if i take the slide off of my pistol but have a mag in the well? I am down to about 1/4 sec to put the side on and chamber the 1st round.

      loaded magazine in mag well = legal trouble without CCW permit (from any state). Regardless of slide location.
      Can carry only in car if you have out of state CCW permit.

      I am not a lawyer, but I would not put a mag in the well. Faster to have loaded mag next to unloaded gun. That is legal.

    hi I have a question, for example if someone is traveling to illinois to become a resident and that person is a retired Police Officer from another state, Can the retired officer conceal carry in Illinois ?

      You can apply for a Federal license, under LEOSA that, technically, allows nationwide concealed carry, including D.C. and the Territories. In practice, not so much. New York City, for example, has arrested officers carrying under an LEOSA license. Good luck!

      If you are in a position that you reasonably feel your life is in immediate danger of death or great bodily harm, are you really going to worry about the legality vs someone beating your head to a pulp with a baseball bat, or firing rounds at you to kill you and take your possessions?

    What about a long gun? Can you have a long gun in a case with a loaded magazine in the case, but store it in your trunk or bed of the pick up?

      +Curt Gramm I am not a lawyer. That being said, I believe it is legal because the law says the gun must be one of the following: 1) unloaded and enclosed in a container, OR 2) disassembled, OR 3) not immediately accessible.... This is from the Unlawful Use of a Weapon statute. The operative thing is the word "OR" tells you that if the gun is not immediately accessible, it needn't be unloaded and encased nor does it need to be disassembled.

    So this may be a far off question but I'm curious. Illinois only issues non-resident permits to people who have permits from states with substantially similar laws, Virginia is included on that list...I am from NYS so I have NY State Pistol license plus a non-resident Virginia concealed handgun permit. Would Illinois require me to be a resident of Virginia in order to get a non-resident permit? Just curious...Illinois charges a lot for permits but I may undertake additional training and if that training were to meet the standards set by the ISP I figure why not, I'm currently in Wisconsin so I guess that is why I am curious. Maybe I should call the ISP.

      Yeah seams to be the case :/ I guess I am grateful I am able to carry in the car legally. I love the beautiful parts of Chicago, but like my hometown of Milwaukee, there are places you do NOT EVER want to even get near and they can pop up quickly. Thankfully when I visit Milwaukee (which is in Wisconsin), they recognize my NYS and VA carry permits (but not my FL one) which is useful. Part of my family grew up around where the Milwaukee riots were before it changed so much, we visited before they burned down everything but it's nice to have a backup plan.

      misdemeanor involving the threat of physical force or violence to any
      person within the past 5 years.I do not have 2 or more violations related to
      driving while under the influence of alcohol, other drugs, intoxicating
      compounds within the past 5 years.I am not subject to a pending arrest warrant,
      prosecution or proceeding for an offense or action that could lead to
      disqualification to own or possess a firearm.I have not been in a residential or court-ordered
      treatment for alcoholism, alcohol detoxification, or drug treatment
      within the past 5 years.You may be eligible if you satisfy the above and no objections are filed by law enforcement. (Section 15)

      Yes, please check with the ISP, as they have just recently changed the states that qualify for being able to get non-resident licenses. Never a dull moment here in Illinois!

      handgunlaw.us is a helpful free resource. many state ags & public safety are now mandating you have a resident ccw not just a non resident license. these laws & state agreements change often. be aware of new statues. also police officers & troopers are not lawyers. They do not make laws or statues.

    I have a FOIDS card and I'm an Illinois resident. My dad owns a business in cicero, IL. I'll be taking carry conceal class in a couple weeks. But in the meantime with the FOIDS can I carry my gun in my dads business??

      if on private property, it is up to the owner of that property to say if they allow a firearm in their building.

      If you are on your own property, or on the private property of another person at their invitation and with their permission, you can carry. However only on that property.

    I am just getting started with hunting and i have applied for FOID in illinois. Once i receive FOID, i take it i am legal to carry rifle, as long as it is in the trunk, and unloaded? I have also hear someone say that ammo, has to be in a separate box from rifle and both should be locked with a lock. No idea how true this is.

      If you have a FOID card, then as long as the gun is unloaded and in a case, you are perfectly within the law. The law does not state that it must be in the trunk, but that's always a good idea for the police..... 720 ILCS 5/24 is the applicable law. Paragraph 4 explains that it must be unloaded and in a container, OR not immediately accessible (most think of that as in the trunk), OR disassembled in a non firing state...

    So what would you need prior to actually buying the gun? Could you buy it, take it home , and then take the Concealed carry lessons later? Or do you have to take the courses before anything else

      In Illinois you need to have an FOID acard to purchase and possess a firearm or ammunition. You can actually take the class without having the FOID card, as you can always borrow a gun from the instructor at the range.

      Jake Grady yes. The FOID act allows a cardholder to possess ammunition. Also, as long as the gun is UNLOADED, the magazine can be with the gun in the glovebox or container. You can verify this on the ILLINOIS State Police website. The magazine can have bullets in it, but the magazine with bullets cannot be in the gun or it is a felony.

      jeff012361 you do not need a CCW permit to do that. There is no law that prohibits you from having a rifle in your trunk, especially if it is unloaded.

    Hello Mike Bius. I recently got pulled over for no reason and I had my gun in my car unloaded in the glove compartment and the chicago police officer stated that he could have took me to jail for having it in the glove compartment. Is this true?

      +Jeremiah Coleman Not according to the supreme court. They've defined the law to include the glove box and center console (as long as they latch, locking them isn't necessary) as valid "containers" to store firearms. As are shipping boxes, actual gun cases that the firearm comes with new, other aftermarket gun cases, etc, as long as they latch, zip, or button closed.
      That cop was just on a power trip, making you feel like you're lucky that he's such a nice guy. Or he was clearly ignorant of the actual law and then broke the law himself for not taking you in. Sadly they are ignorant of various laws fairly often and have to rely on their dispatchers and other officers to forward the correct legal info to them.
      This is only true if the firearm was unloaded, no round chambered, magazine out of the gun. It can be legally stored in the same case as the firearm, but I myself don't like doing that, just to avoid legal arguments with a shaky Officer Newbie.

      jehuty47 I am not a lawyer, but my take is 1) if you are not a resident of Chicago or Cook County (which have "assault weapon" bans), then you can travel through those banned communities with your gun. 2) Though the trunk is "not immediately accessible" and therefore legal, many police would tell you that, even in the trunk, it must be unloaded. Though I would disagree, you might end up needing a lawyer... ( Plus, check what other cities may have assault weapon bans.)

      Giuseppe Buttitta yes you can. With a concealed carry license there is no limit to the number of guns you can carry or have in your car.

      Read 430 ILCS 66/40 and you will see that a nonresident who is licensed by their home state, can carry concealed in their car (and only in their car) while visiting Illinois.

      You have to have a curio and relic license. SBR's appear to be restricted only to collectors in IL. That and law enforcement.

    Hi Mike. One thing I would like to point out that you didn't mention. The law that allows a non-resident of Illinois to have a loaded firearm in their vehicle if the non-resident has a carry permit from their home state has a caveat to it. The law says, "within his or her vehicle". Well this has been interpreted by the ISP to mean it has to be a vehicle that is actually owned by the person carrying. I drive a semi-truck and I am in and through Illinois quite a lot and this what I was told by a state trooper. I was told that even though I have my carry permit from my home state I could not carry it loaded in the semi-truck I drive since the vehicle is owned by someone else other than me. In this case the truck is owned by my employer. The trooper was very clear that I would be subject to arrest if I did carry my firearm loaded in the truck I drive.

      +John William Wernicke Well, I believe that the law clearly allows a loaded gun that is not immediately accessible. That being said, I would not want to be in a position to have to educate a police officer who doesn't know the law. They barely know that concealed carry is legal here in Illinois!

      +MarineForceRecon1BN If you have an Illinois CC permit, you may carry IN your car, or on your person, as long as it's not in/on a prohibited area (govt. building, airport, school, public park, ect.).       Scroll about half way down to section 65 to find the list of prohibited areas.

      According to 430 ILCS 66/40 if you are licensed by your home state to carry a concealed firearm, then you can have a loaded gun in your car only while you are in Illinois. The gun must be concealed and if you take it out of the car it must be unloaded and enclosed in a container. If you leave it in the car it must go from merely being concealed to being put into a container, such as a glove box or center console.

    If a police officer "interprets" the law, He/She is violating separation of powers constitutional law by assuming judicial powers. A police officer is a member of the executive branch of government and has the authority to enforce the law. A judge (who is a member of the "Judicial" branch) has the authority to interpret the law. So, if a police officer, or any other member of the Executive branch of government assumes to interpret the law, they are in violation.

      2. Police officers making "judgement calls" that may or may not be lawful opens up a whole world of possibilities. Some may be good, but some may be very bad. As I'm sure you are aware, 1 bad judgement call will cancel out 1000 good ones.

    I have a valid carry permit from Indiana and will be traveling through Illinois heading West. I will be on a motorcycle and am curious if I can have a loaded firearm in my tourpak or saddle bag as I travel through. We are only planning on stopping for gas/food and will not be staying over. My saddle bags and tourpak can be locked if I need to walk away from the motorcycle.

      Which is why you just keep driving through Illinois until you hit a neighboring free state :D Its a lot better than the previous situation where handguns were banned (SCOUTUS overturned it) and there was no carry provision. I just drove from NYS to Wisconsin and had to drive through Chicago, it was nice being able to have my carry gun on my hip without having to put it in the trunk and wake up the dogs doing it.

      I guess car carry is better than nothing. NYS has practically no provisions for you to even POSESS a firearm in the state without a pistol license for which they are practically no issue for non-residents (unless you lived in a conservative county and moved to another state and changed the address and the Judge likes 2A rights or are a wealthy business owner). My buddy who had lived in NYS longer than me can not even bring any handguns to NYS despite serving in the Military, same with his father who served for 30 years.

      This is very interesting. According to federal law, you cannot purchase a firearm from a dealer if you are a habitual user of a controlled substance. The form that any dealer is required to have you fill out specifically asks about this. The federal government considers cannabis a controlled substance, and it asks you that question when you fill out your form at the gun dealer. However, Illinois allows you to have medical marijuana and not interfere with your second amendment rights, so I believe the only way to purchase a firearm is if it was a used gun purchase from a private party where no federal firearms licensee has to fill out paperwork ( in other words, purchased in the same state). But be very careful, if you have a friend to go to a gun shop and buy you a gun and then he comes home and immediately transfers it to you, that is a federal offense, called a straw purchase. He was purchasing the gun for you but he, in this example, was clearly buying it so he can transfer it to you. I am not a lawyer, and I would advise you to exercise caution in this area so you do not inadvertently break any laws.

      Based upon the text of 430 ILCS 66/40, I believe so. However, you can Google it and read for yourself...I am not a lawyer and can't guarantee a police officer would know that section. I would suggest you Google and print out 430 ILCS 66/40 and highlight paragraph "e"... it says that you would have to have a license issued by your home state, if applicable. I believe, and I am not a lawyer, that the interpretation would suggest that in states where licenses are not required and then having a license is not necessary.

      Only in your vehicle, Illinois does not recognize any CCW permit outside Illinois beyond that.
      I'm a resident of Illinois living in South Dakota (military). I have my CCW permit for SD but I unload it and lock my EDC in the trunk before I cross the border just to stay on the safer side because I am in fact, an IL resident. SUCKS, I know. But no problems so far.

      Yes, in Illinois a non-resident can have a loaded gun in their car, as long as they have a permit from their home state. You can carry within the confines of your car, but not outside of your car. If you leave your car, you need to unload your gun and transport it in a case.

    They want your guns... Not the one's who have different agendas with the guns other than protection legally... They should allow felons to own guns. They are getting them anyway... The one's that are doing the murders with a firearm; and attempt killings with a firearm illegally should not be able to own a gun for 7 years upon getting off of parole... Everyone has a right to protect themselves so why should not a so called convicted felon have the right to protect him or herself? This is why there is a gun problem because the one's that can not get an Foid card are in the shadows, and the guns cannot be traced etc. Just as soon as so called felons other than the one's who used a gun to kill someone illegally, can get a foid card just like the rest of the citizens gun violence just might decrease... Can not promise you, but it will sure in the hell make one more liable and detectable person and gun... When you shoot someone in self defense you have to call cops anyway. So now when one kills someone they must show self defense... You know where I'm getting at with this one... People with foid cards, and they shoot someone are more than likely to call police to report the shooting... Simply put, they can program a so called non convicted felon, but they can't program a so called convicted felon... People... They want everyone's guns. They just started with so called blacks then convicted felons. You white people can not see what they are doing. Now it's time to come after the white people guns. This is why they use WHITE people in massive shooting scenarios. They want your guns white folks... Remember they took black people's guns, and now they use white rich people to shoot up schools and concerts... FISHY!

      Actually section 90 of the firearm concealed carry act, which is 430 ilcs 6 6 / 90, is entitled preemption. Preemption means that the state law preempts any city or county or other local firearms laws for concealed carry, so in Illinois you need to know only the one law.

      Looks like the Preemption clause also strikes down local ordinances related to handguns (but NOT long guns). This is welcome news for magazine capacity disparities, which I would suspect, interfered with transport of loaded handguns.

      From what I've read, you can even conceal carry a loaded gun on you as you drive around but the moment you leave the car, you can just hide it inside the car since the entire car is considered a locked container at that point
