      Suchindranath Aiyer fully agreed... gst is not coming with same platform as the idea was expected... some things are smoother...but a lot things are messy...and I personally feel gst will also cause cascading...

      +pawarvs I would never vote Khangress. Raoul or anybody. Please remember that GST passed with the support of the Khangress Parivar that loots together to stay together. Modi's deliberative democracy, Padma vi Bhushan to Sharad Pawar, induction of SM Krishna giving Jailtey yet another barrel to fire from, non prosecution of VIPs for corruption and so on are signs of Modi becoming another Khangress clone. One looks from pig to man and man to pig and cannot say which is which.

    Both the opposition and the government agreed to each and every article of the GST. The Congress and the opposition were trying to get this tax reform on the floor from the past 10 years.
    The only problem with this tax is, that it is almost leak proof, so no hiding tax. That's the pain.
    The positive thing is that the near future it will reduce the burden of the salaried middle class class by expanding the tax net.

      and many more are very loyal to the nation than to their religion.
      the only solution to this is.. to be stronger than the enemy at all point of time.

      for a diverse Country like India only a Saintly person can be a good monarch.
      who has the qualities like.
      #1.No pride *(of race language cast creed or any identity)
      #2. absolute Selflessness.
      #3. he/she has to be a Bhramachari.*(no child or spouse)
      #4. should consider all country and its people as his own blood relative and should not be biased to anyone.
      #5. Only Justice and well being of citizens should be his life motive.
      #6. should have *absolute zero 0* attractions towards wealth, fame, sex, selfrespect, food and any other kind of pleasure.
      #7 should be of sound mind with a lot of wisdom and good health to perform his duty.
      if any one have such qualities only then he/she has capacity to be a King this nation or else not.

    I am astonished to hear this from Datar. He has clearly not understood what CST is all about, and so have the majority of commentators on this video. in essence, both you and Mr Datar have failed to see the bigger picture in the Indian context of simplyfying the tax, removing the bottlenecks in the transport of goods across the country, the elimination of corruption at these toll nakas and bringing a sense on oneness amongst Indians. I am on the winning side, you are on the losing side in this debate, live with it. And now that CST is operational, embrace it and move forward WITH the country.

    The economy is so down today, the reason can be easily connected to GST, its compliance issues, the government has gone thinking that the high rate would budget its expenses, what actually happened was that it reduced the demand so much that we are heading into recession...... Let Mukeshbhai (RIL) run the tax department, I am sure that he shall reduce rates and increase volume and remove compliance bottlenecks to spurt the economy back on track....

    There are problems of implementation and filling returns but not agreed with him totally.. Their might be initial hiccups but going farward it can be customised....5 slabs 0 to 28 % can easily be reduced to 3 but keeping grain and SUV in same tax slab cannot make a sense...tax evaders will never like it at all..

    A dissenting view always needs serious consideration. But, prospect of living with 30 plus VAT laws is worse than GST's problems. Perhaps the government can reduce monthly returns to quarterly returns for reducing the compliance burden.

    I 100% convinced by Mr. Datar. In my opinion State VAT Laws are not success and GST is nothing new but it is a Nationwide VAT. State VAT laws are unsuccessful in absence of proper infrastructure i.e. Computerization. Our view is, Center must go through the reasons of failure of State wide VAT system thereafter introduce GST.

    Dear Mr. Aarvind Datar. Current VAT system is already very complicated. Whatever i learnt about GST so far will solve many problems for businessmen doing business in Intrastate will eventually grow intrastate trading. Yes off course GST could have been much better but our Indian founder politicians made our country so politically divided that it is now like a dream to implement that kind of GST which other progressing country are following.

    Around 6 minutes 30 seconds, you compared Post-GST's 49 (36 GST + 12 TDS + 1 Annual) returns vs Pre-GST's 2 (2 Service Tax) returns in case of a service provider. I would like to point out that Pre-GST returns were 6 (2 Service Tax and 4 TDS) and not 2.

      The following are the specified person (s) who are liable to deduct TDS:
      An Individual or an H.U.F. is not liable to deduct TDS on such payment except where the individual or H.U.F. is carrying on a business/profession where accounts are required to be audited u/s 44AB, in the immediately preceding financial year.
      A person is liable to get its accounts audited u/s 44AB if during the relevant financial year its gross sales, turnover or gross receipts exceeds Rs. 1 Crore in case of a business, or Rs. 50 lacs in case of a profession.

      CA. Anirudh Bagai ACA, LLB sir you're partly correct, the TDS returns you mentioned are the ones under the IT act, which have to be filed by all tax audit persons be it a manufacturer, retailer, wholesaler or service provider.
      but here, the 12 TDS returns are under the GST act, which is applicable only for supply of goods/services above 2.5 lakhs and only for specific goods/services, yet to be notified.
      these two TDS return types are completely distinct, please don't merge them together.

    If a Government wants to raise revenue, tax the sources of wealth; not the average person with GST. Put a tax of 1 cent or 1 penny on every stock exchange transaction and watch the money flow in.

    I do agree with Dattar. in a country where the infrastructure in data management is in a primitive stage and even the submission of vat reports are difficult the introduction of GSTwill meet its own fate. the poor business men will lose their business and will get succumbed to the giant foreign multinational business houses who exploit the indian business men by charging more than 20% as commission. for just procuring orders without knowing such facts Indians get themselves cheated with exorbitant rate for their own Indian products.

    What you said is right that total number of e-filing returns and TDS filing will increase. But, how many are paying taxes, how many are coming forward to pay. Leave this topic.
    What people do is they don't/never show they earnings and pay taxes. At the end of every year, they say that they didn't had any profits and they don't have to pay any taxes. Now, lets say they have to show and file your taxes, now if anyone is caught or interrogated they will get complete track of the business.
    Presenter is worried about number of e-filings. What might be the problem for presenter is people might have to show all earnings and file returns and TDS continuously, that people are not interested to save BM.

    Gst will spoil the small scale business's and service providers also.. the way it was implemented is totally wrong they have kept different taxes on different products and services instead of implementing the same taxes on all the products and services, and it is deniable fact that we are all going to suffer with this.The govt should fullfill the promises they made during elections.Sabka saath sabka vikas is only for politicians, millionares and billionares not for middle class people who worked hard to leave a simple life.

    In the present VAT, the Tax structure on a particular product differed from State to State, whereas under the GST the Tax is uniform of any particular product. There were any number of other Taxes levied b the State and Central Govts., Under the GST the uniform VAT rate and all other service taxes etc and duties have been consolidated oin the GST.
    The wisdom of the GST Council comprising of all Sates and the Centre has been challenged by the personal opinion of an individual... Comparing the GST of Singapore, a city State and the GST of India which has 29 States and the Central Government...
    The earlier UPA Govt at the Centre attempted but due to resistance of some State Govts, the GST could not be passed in the Parliament and the State Assemblies.
    Finally, during the present NDA Govt., all State Govts (comprising of various political parties) and the Centre (NDA) managed to pass the GST Bill.

    I wish Jetley listened to these taxation discourses rather than munching nuts in any meeting and growing fatter and foolish of his faulty knowledge of laws and their practical impact on the society and biz.He should keep in touch with the real stalwarts in law than Modi who is ruining this country with little legal knowledge.Modi should be taxed presumptively for his luxurious way of life.BJP 's only aim is tax everything and every one to the hilt.Another fallacy is that Modi presumes everyone in India has digital literacy,computers,internet connections,wifi,credit and debit cards and so on including those most backward rural Indians.He lives a grand dream and makes India one big taxed country of the world.

    Looks like Aravind ji is more concerned about businessmen might now won't take CA/Consultants help since the process is being made so easy that after initial hiccups majority would be filing their GST on their own. He might be putting logical reasoning but those running the govt are also pretty highly qualified and debating GST from last 15 years. You might be thinking from your client's POV but Govt has to consider the consensus on Pan India Scale.

    GST is introduced by Jetley, who is a political enemy of Mr.Modi. He is doing everything to make Mr.Modi unpopular. First demonetization, then GST.
    People have endured Demonetization, suffered terribly for months for very little outcome. No action was taken on the black money coming back to India through Mauritius as foreign investments. No action was taken on 380 wilful defaulters as said by the Supreme Court. No action was taken against the people who sent away $2600 billions to Swiss Banks.
    if Mr.Modi wants to survive, he must sack jetley and the advisers of the finance Ministry including Jayanta Sinha, one of the creator of the Mauritius loop along with his father Yaswant Sinha and his wife.

    Nicely explained..
    I have a question and i would like answer on it. Let me put up my question through an example to simplify it.
    I went to a hotel for a coffee. The rate was INR 40/-. This incident I want to explain is when the GST was implemented and the GST was 18% (9% local + 9% center). I got the bill of 40 + 7.20 = 47.20 total. I paid the bill at counter and asked how old was the menu card printed and the rate not being changed. I came to know it was about 2 yrs old.
    Now I want to understand that when that menu card was printed there was no GST implemented. But on products like coffee, sugar, milk there must be some sort of taxes like excise, VAT, octroi (where applicable). So the question that came to my mind was why the actual product rate never decrease as those taxes are now out and if GST has simplified and lessen the tax burden than that coffee rate should be like 30 to 35 and than 18% GST implemented.
    Still today I see the rates are same as before the GST and on top of that GST is implemented. When will the actual effect of GST come in play and which government body or sub-body is responsible and on the field to that and show the result in numbers.

    A person who is comparing India with Singapore should not be listened to in the first place.
    Secondly, being a lawyer representing big firms and cashing in on big fat paychecks fighting for cases for them, Mr Aravind Datar is placed correctly and his statements make complete sense.
    Thirdly Any person who justifies the logic that GST should be a single tax system and justifies that the merc/bmw cars should be taxed in the same rate as the bread and butter is as wrong as it gets; and he is doing only so because he is earning crores and crores of rupees and he is justifying in other way to have "proportional taxation in India".
    Fourthly: About plugging the loopholes in the taxation system, he wants that the loopholes should exist as is and The govt should not plug the loopholes once they are discovered by the IT officers. Any person who justifying this logic is basically earning the money because of these loopholes. All the systems around the world have loopholes and governments just catches up on that, so that the government does not lose out on revenue after discovering such holes.
    If we go by his understanding the FDI in India should be decreasing, but to all our disbelief it is increasing year after year.
    He has won cases in Supreme Court ('good for him'), but how he does not say that the big companies who have hired him as the tax lawyer are basically earning huge amounts from India, and they are not willing to pay the taxes due to these companies. If it was upto Mr Datar, and his logic he would not tax the companies at all. After all his is just doing his job as a tax lawyer of big companies. ( Apne namak ka karz ada kar rahe hain Mr Datar).

    he may b right wid certain points but the truth is some of d business entities are jst for the purpose of doing hawala dealings... these entities as under d pre GST scenario they ve to file the returns for twice or thrice a year, they gets ample amount of time to receive the unaccounted money from various sources show it as the revenue from sales contrary that the actual sales never took place and then again return that laundered money in white nd get commission on it. If 1 has to file a return in such a small window of time, then it wud become very difficult to launder the money as they ve to show the revenue generated from sales for a very short period of time and any uncertainty in the filed returns would alarm the agencies and then finding the abnormalities wud also be easier for them.. I myself only ve a pinch of knowledge abt taxes, but since I'm​ trying to get into d business world these r a very few things I got to know... please let me know if I'm right or wrong about it

    GST is a technology enabled tax in which there would be no Revenue Leakages... This is a major major advantage as compared to existing law... There may be some hiccups in GST but Rome was not built in a night sir...

      Name me one govt website, which has the server capability to handle that sort of traffic!
      His basis that GST only succeeds when there is one GST for one country is absolutely correct. What is the point of having new taxes when they do not simplify the taxation regime.
      As far as revenue leakages are concerned, believe you me, they will continue to happen. It is the inherent nature of taxation, you cannot change it.

      Dats the problem with the India. People start to defend/oppose anything without knowing any ground realities. You are absolutely right, technology plays an important factor this time. Govt. has learned from previous technological shortcomings or failures and deployed excellent IT infrastructure required to run GST 24*7.
      This guy(Aravind Datar) is highly polarized and trying to enforce some political agenda towards the audience. Comparing Singapore/Aus GST's to India is totally absurd. The amount of direct taxes collected in these countries is way higher than we can ever imagine. If GST needs improvement it should be done but negating it totally is just a sign of immaturity.

      Yup, lets call the expert 'polarised' because we do not agree with his totally valid comparison with GST being implemented in other countries! (Although the govt probably did heavy research into those countries' gst implementation but how dare he compare us with them!)
      As far as the amount of direct taxes collected is concerned, the quantity is immaterial!!
      Infact if I am to take the GST implementation in India, one of the reasons' the GOI wants it implemented is to increase the collection of direct taxes!
      So your rationale that GST in those countries is different and gets more direct taxes, while our GST is different because we do not get the same amount of direct taxes is flawed, because we precisely as a country, want to end up in a scenario where our collection of direct taxes is exponentially increased!
      As far as the IT infrastructure is concerned, we shall have to wait and see for the first couple of quarters after its implementation.
      But a govt. that still hasn't been able to cure the problems of its railway booking website during peak 'tatkaal' time, does not inspire much hope.

He qoted Dr. Ambedkar, now how ambedkar is relevant as fara as economic reforms are concerned. Ambedkar also made smoe very imp. point about reservation, did we followed them?

    If it is the most terrible thing that ever happened to a country, how so many countries have implemented it successfully? There are around 160 countries in the world that have GST already in place. India is implemented the GST Law 2017 from July 1st and it has adopted the Dual GST model, the one followed by Canada. Canada successfully implemented it, but in India you want to make everything fail, because the BJP is in power.

    Who said there is just one GST in Canada. They also have multiple tax system like GST which levied by the federal government and HST which is levied by some of the States like Ontario. And then we have some other taxes specified to some states. Plz don't spread rumors people of this country are too naive to understand the benefits of GST. I believe some of your points are valid and I am quite sure that the Government must have studied and evaluated these points to simplify them.

    I think reasoning provided by the erudite speaker is incorrect. First he says why not single tax rate, then he goes on explaining why different states having different requirements still gst has same tax rates for all. isn't the same reasoning valid for different tax rates on different goods as all goods and services are not same. Some goods which are necessary for everybody shouldn't be taxed lesser than sin and luxury goods keeping in view regressive nature of indirect taxes? In case of states, uniform tax rates provides a level playing field so that a company does not have lower tax rate as a consideration for establishing their business in a particular state only. It is not difficult to understand that richer states could have more leverage in this regard if uniform rates are not replied, which is one of the factor of some states advancing quicker than other states. Further he is talking about filing returns and stating a number of returns are to be filed by the units. In this regard, I request the worthy speaker and those consuming this content to please check the law and system first. Most of the returns are auto populated and there are in reality only a few returns to be filed. Moreover, saying that 20 lakhs threshold will have more mushrooming of fake industries in comparison to 10 lakhs is completely irrational. Further if the people are faking earnings isn't it a flaw in people's ethics rather than a lacking of GST? Actually after this I skipped watching this manipulated and technically flawed video. The case presented by the speaker, in my opinion, is pointing towards an agenda to intimidate the industrialist so that they run to consultants and chartered accountants etc. for even those things which are done for free by the taxation department. take for example migration. CBEC does it for free but the consultants and accountants have been able to show the same as cumbersome so the small traders and dealers rushed to them for migration for which they are charging as much as Rs. 6000/-. Causing fear of returns is just nurturing consultancy business and nothing else. No hard feelings towards anyone. Just my opinion.

      For Regular GST Tax Assesses, Monthly 1 GSTR3B, 1 GSTR1, 1 GSTR2 & 1 GSTR3 = Total 4 x 12 = 48 Returns + 1 Annual Return = 49. If the Tax Assessee has branches in multiple States then 49 should be multiplied by the number of States. Thank you.
