  • Property giant Evergrande has filed for bankruptcy protection in the US as the real estate crisis in China deepens.
    It will allow the heavily-indebted company to protect its assets in the US as it works on a multi-billion dollar deal with creditors.
    Evergrande defaulted on its huge debts in 2021, which sent shockwaves through global financial markets.
    The group's real estate unit has more than 1,300 projects in more than 280 Chinese cities, according to its website.

    Chapter 15 law needs changing. Evergrande has not filed for bankruptcy in China, they should not be able to file here. They are trying to make their US creditors bear the brunt of their poor decisions & their country's policies.

      Technically Americans aren’t allowed to hold Chinese stocks directly. They purchase shares in a foreign holding company for Chinese stocks. So good luck with that.

    Why are Chinese corporations listed on US exchanges to raise capital from US investors NOT required to have their accounts audited the same way every other foreign and US corporation is audited?
    As usual, the US investors are screwed, thanks to the greed of the US establishment who allowed this.

      Because the US and China rely on each other, economically. Moreover, the rest of the world relies on there being a stable economic relationship between the two.

      Supposedly they have a few billion dollars in US assets they're trying to protect from creditors. Doubt it does anything for their Chinese operations, although they'll probably get some sort of massive debt restructuring from China as well. It'll mainly lead to an overall economic collapse for the entire world though, not just due to Evergrande, but due to the $20 trillion in collective handouts to people in every country leading to what is right now the single largest bubble in human history across the board.

      Not saying any of those systems were good, but it's quite cheap to retroactively call everyone stupid for failing to properly identify and quantify risk. If all of you that pretend this would be easy, were smart enough to see this coming, then you probably are now all millionaires, having profited from the 2008 crash like Michael Burry did. And all of you probably became billionaires by shorting the Chinese housing market stocks, just in time. I have an inkling that you probably didn't make much money out of these events at all, if any.

      It’s allowed for every company, airlines like Philippine Airlines, LATAM have filed for chapter 11 bankruptcy in a US court because the condition are more favorable for the company than other countries

      Some Chinese companies have had crazy good periods, and they have a massive moat because the Chinese government allows certain companies to monopolise this giant market representing a quarter of the world. Better investors than you (like Charlie Munger) have invested in Chinese companies, although self-admittedly, that was one of his worst career moves. I have been eyeing Alibaba quite a bit, but I saw the CCP as a too great risk to invest in what is otherwise a much better investment than a Amazon, which people seem to be quite keen to buy (the company did extremely well, obviously, but at the price it's just not a rational investment)

      Profit. Chinese real estate was a profitable market for decades. And it may be correlated/uncorrelated to your other investments. And it is a market with rather high capitalization, being able to take up a lot of capital. It was also rather liquid. Not everybody wants to invest everything they own into the US market, and especially for big funds, you need to look somewhere else.

    I have been following the Evergrande struggle for the past two years. The situation is only getting worse as time goes by. Several more Chinese developers are also on the brink of collapse. Get out of ANY China-related stocks, ETFs or trust funds ASAP! You may lose some money getting out now, but it's better than losing it all.

    China will have to dump all of its foreign currency reserves and foreign bonds to save its economy. Even with all that, its economy will mirror Japan's "Bubble Economy" of the 80's. When that bubble burst, Japan went into a decades long recession and deflation. Of course, Japan was in a much better position to weather the downturn than China because its economy was based on manufacturing quality and efficiency as well as developing some of the most novel and valuable technology in the world. China's economy, on the other hand, is based on cheap labor manufacturing, property speculation, and infrastructure overbuilding. On top of that, a big chunk is based on fraud and IP theft of all kinds. Thus, it is a house of cards that is collapsing.

    Evergande has overseas debts about $31.7 billion (bonds, collateral and repurchase obligations). File for bankruptcy protection means a company's finance is in ICU on life support. To say it is not the same as bankruptcy is theoretically correct. But it is a pointless argument over semantics. But in practical terms, it means the company is finished. Evergrande all along was hoping that China Government will bail it out as "too big to fail". Xi JP has mismanaged China economy.

    I understand peoples concern of a foreign company filing for Chapter 15 in the US but not in their country is a bad deal for US investors. But let’s be clear , the US investors decided to take a gamble in Chinese companies despite the opaque laws/standards and forgo investing back into the US . I say , these investors played a game and lost - why should we be concerned?

    China was quite condescending towards the west for the financial crisis of 2007. The funny thing is that is precisely when they stimulated their economy with nonstop stimulus and easy money. They’re more able to rollover and obscure problems that pure market economies are, abs accordingly their problems are now much larger.

    They're using funds from new customers' deposits and payments to build or complete construction for previous customers. The company is operating entirely on debts, basically borrowing from new customers to pay for the old. Their debt has grown so great this has became a death spiral as they need increasing new money to pay off old debt and liabilities.

      2008 was massively destructive because of the multiplier effect of Credit Default Swaps. Don’t believe the Chinese property market has quite the same risk, and in any case it’s the poor Chinese home-owners that will be the ones to lose out.

      2008 was on steroid because of derivatives. Chinese banks are not as greedy as US bankers because they are mostly state owned.

      @@nsebast No, 2007/8 was disastrous because credit agencies like S&P and Moody’s were endorsing collateralised mortgages which had no chance of ever being paid back as “sure thing” AAA bonds. Banks across the world bought into these bonds, including the bank I previously banked with, RBS in Scotland. You’d be naiive to think the banking sector in china, albeit state-controlled, isn’t designed to make money. The problem is the whole World economy is shrinking because of various combinations of inflation/recession/deflation throughout Europe, US, Asia and the Middle East. Do you not wonder why things are more expensive now comparatively to 2-4 years ago?

      The last fact's number becomes meaningless as countries like Tuvalu has only $0.07 Billion USD.
      As an example, I could argue, "$81 Billion USD is like GDP of about 1000 Tuvalus... etc etc."

      My understanding of China is that the *land* always belongs to the government. It is *leased* for up to a hundred years to developers. So real estate contracts need to be written to account for this. @@jacksmith-mu3ee

    I need to research how bankruptcy laws work. Do we offer a legal umbrella for businesses in default to prevent them from being sued because it would create chaos and dysfunction if a bunch of the people they owed money to but could never pay started suing for those debts (that would never be paid) and claiming them as credit for other investments? That’s the only reason I can think of yet for there to be laws like this

      There are lots of videos on this topic. But mainly the bancruptcy procedure is meant to ensure that creditors get as much of their money as possible, according to some prioritization, and maybe even save the company and its jobs (not the case here).

      Yes companies under bankruptcy process cannot be sued or have their assets seized. They either make a deal with their creditors, usually erasing some debt but promising to pay the rest, or they can't agree to any restructuring plan and sell off all the company assets to pay back as much debt as possible.

    I always wonder why a Chinese need to go overseas and raise capital from US capital markets. Given there are approximately 1.4b people in China you would there would be enough savers who would happily lend their money. I suspect the answer maybe so they can default(embezzle or squander) behind corporate bankruptcy law and not pay back the money owed without penalty.

      Because raising capital in China isn't as easy as one may like, the Chinese stock market almost doesn't move. Getting loans from banks isn't easy, banks would rather to lend money to SOEs. Also, for some companies, such as Alibaba, they have agreement with investors, that they could eventually get listed in exchange market oversea, so that the investors could cash in the profit.

    What is happening in China now is what happened in Japan 30 years ago.
    China's economy has been bloated by the supply of funds by its 1.4 billion people, whose only surefire means of accumulating wealth is real estate.
    Like the Japanese 40 years ago, the Chinese believed that real estate would rise in value forever, so they borrowed money at high interest rates and bought properties at ridiculous prices.
    Over the last 30 years, real estate values ​​have continued to rise,
    and nouveau riche have been wasting lots of money in America and Europe , just like the Japanese did in the late 80's.
    However, when they built condominiums for twice the population all over the country, huge ruins appeared here and there, and the population growth slowed down, they realized that the asset value that had been inflated with debt was actually an illusion.
    The Chinese have noticed.
    The Ponzi scheme that makes the Chinese happy may have continued if the spell hadn't broken.
    It is domestic gold that has inflated the Chinese economic bubble, just like the old Japanese bubble. I don't think China's bubble burst will have that much of an impact on other countries.
    Despite the tremendous pain, the Chinese government has no choice but to burst the bubble as soon as possible and reduce the value of people's assets to the lowest level. Perfect if possible without damaging government finances.

      I did a junior maths sum.... 1 person can have around 27 properties... lol.... And I presume that, each of those properties... is an actual high rise. So... say.. each high rise.. is around or can house around 800 people... So each person inside China... can have around... 21,600 rooms. (800 x 27).... lol.....     The most crucial thing is that China is not facing any homelessness crisis, which is a good thing.
    It's all about supply and demand. China already has tens, if not hundreds, of millions of buildings that are not being use. Homeless is pretty uncommon over there, which is already an impressive accomplishment by itself.
    Obviously they do not need any more houses. But if they do, it's always available. They are just so affluent; imagine having a hundred million backup homes.
    Construction projects are currently not high priority. The funds instead will be allocated to the military industry and space programs.
    An example is China's proposed of 500+ J-20s by 2025 and two of China's mega constellation projects that will light up the entire lower earth orbit and sun synchronous orbit with 13,000 satellites from the Guowang constellation and another 12,000 more satellites from the G60 Starlink mega constellation. I have immense respect for them. I am so grateful to experience all their wonderful projects they have accomplished in the last 23 years and I can't wait to see all the magnificent projects they are currently working on to unfold.

    Western investors are paying China's defaults, after years of constructing Toofoo buildings. Simultaneously China is selling US bonds to purchase tons of gold and silver, while the US Fed and major Banks are repressing the gold and silver price with uncovered paper transactions, so nobody realizes that the US dollar is falling and losing its reserve currency status. How ridiculous can you get? Who will end up on top?
