I'm actually SURPRISED that she was even allowed to step into a casino. When I banned myself, I was told I would be charged with trespassing if I stepped into ANY Ontario casino. That woman should of gone to the States to gamble. Costly lesson learned. I think.

In my town they opened a casino and it has ruined many people in town. The financial losses have cause at least two suicides and three business owners to go bankrupt. Had there been no casino none of those things would have happened. I knew personally one of the store owners he lost over a million dollars, he died in a crappy little apartment divorced and broken, he had a heart attack. The government doesn't care who it ruins as long as they get your money.
so you are saying that it is the casnio's fault and that individual had no responsibility? I am not saying it is not sad. Addiction is a disease but you can't blame the casino for just being there. Do you blame lcbo for all the alcoholics who have a drinking problem? Also if that casino wasn't there, that individual would have probably travelled to another casino and the result would have been the same.
She probably would not be so desperate for the 12000 dollars if she did not gamble. She probably buys a lot of lottery tickets too.
I would never expect to be paid a jackpot if I wasn't supposed to be there in the first place.
Nor should you expect them too take your money when your name flashes up on the membership screen saying gambling commission banned.

I don't feel bad for this person. She had a gambling problem. I am sure they explained to her when you sign this form you could be arrested for criminal trespassing. I am pretty sure somewhere on that form it says you are not allowed to be on any casino property. So, if you aren't allowed to be on the property why would you be able to play and win your jackpot lol. She knows what the deal is.
It's simple, if they take her money they need to pay out on the winnings or refund her every penny she has gambled there from the moment she signed that paper. The refund will most likely be more than the winning.

LlpzJr Wrong, they have two options, option 1 pay the win, option 2 refund every penny from date she signed the paper. They can not accept her money if they are not going to pay out, where as they are not going to pay out they must issue a refund of all money spent since the signing, where as they had no intention of paying out.
They would be justified had they withheld all winning, but they did not. They paid out on the small wins, and then on the big win refused to pay out, only when they were taking a lose.

If you're on the self-exclusion, you're not suppose to be there gambling. She broke the rule being they. In America, when I signed up for it, they said if I was caught there before the 1 year ban was up that I signed, I could be arrested. She's lucky she's not arrested. They said it's trespassing if you're caught there. That's why you never check the box that says indefinitely.

That's the whole point of that punishment. Everyone is right, they can't card everyone and keep track of everywho is not supposed to be in there because of self exclusion. So one way to keep you deterred from coming back is knowing that you can't collect if you win big and you may be arrested for being on the property. She chose to sign that list and they make the rules PERFECTLY clear. They also ask you numerous times if you are sure. She wanted to quit gambling and asked their help. Too bad lady, you made your bed now lie in it
They CAN and SHOULD card everyone, that's actually how it works in most (european) casino's.
She signed it alot of the casino have this system and you have to follow law pepole sneak in all the time and will be escorted out when caught..

John Burgess ..because it's just fine for them to take her money, but adhere to their policy of "not allowing her to get money she won". That is bullcrap and I would raise hell until I recieved my winnings, esp if they cannot show me said policy on paper!
They did show it to her. She self excluded meaning if she is identified on the property she has given them authority to criminally trespass her because she has a gambling problem and needs help.
Maybe this will be the lesson she needs to quit gambling, but I doubt it. Even if she wins a hand pay, they can tell her "nope, can't pay you it, you aren't supposed to be on the property and trespassing, would you like us to call the police for you?"
I'm not saying it's right, but I'm saying legally, they could do it and not pay her and tell her to go away and fulfill her wishes for not being allowed on the property.

The only way the casinos know you're in there are if you use your card, if they card you at the door, or if you win a hand pay. It would be too time consuming to run everyone's ID's into their machine before they let you in, so people can just sneak through. It's not the casinos fault. She went in there fully aware that she wasn't allowed to gamble. That's the whole point of the self-exclusion list, is for people with a gambling addiction to be banned so they can't lose anymore money. If you still go there after you sign, you are stupid. They tell you before you sign all the rules you have to follow. If you can't follow a simple rule of staying out of the casino, then don't sign the dang paper. Also they should never and I mean never check the indefinitely box. I put myself on the self-exclusion list at a casino and checked the 1 year box. My options were 1 year, 5 years or life.

Not all casinos have that. Some of the smaller ones don't. I know that for a fact, because I have a friend that works security at Hollywood Casino in Grantville, PA. I go there all the time and I saw a gambler there quite a bit that was self-excluded and still came everyday and was never turned away. He complained to me once when I was sitting beside him because he never won a hand pay. He won a bunch of money though but always under $1000, but he would bet minimum, so he could still win and not get noticed. No one ever stopped him from coming in, and my friend said they didn't care because he was spending money. They let him gamble as long as it wasn't a hand pay. Honestly, I'd rather win several small hits of $1000 than 2 $1200 hand pays. I don't like Uncle Sam getting any of my money.

Cut and dry. It’s 100% on her and all in the fine print. If you self exclude, you SELF exclude. YOU are telling the casino to a) remove you from the premises up to trespassing charges if they find you there and 2) take all winnings if they find you there. Anyone entering a casino who’s self excluded should know that if they win a handpay they are immediately screwed. If you want to take a risk and enter, you can as long as you don’t get checked an ID and win a handpay. But you can’t expect to win 11k and get away with it. Very simple.
She's lucky she didn't go to jail. Most casinos will send you to jail for trespassing after you have signed that and decide to come back before you are allowed.
My question is, Why on earth did the security and surveillance teams not identify her and inform her that she self excluded herself and shouldn't be on property at all? At least that's what happens locally where I'm at. Security and Surveillance departments are made aware of individuals that have self banishment's/exclusions or any other banishment imposed by the Casino; they are not allowed to be on premises at all and they make sure it's enforced.

If the self exclusion she signed stated the loss of any wins and a possible trespassing charge she agreed to then there is no obligation to pay her that win.

This is pathetic on both sides. The lady signed the self exclusion contract which clearly states that if you return you can be arrested for trespassing and if you gamble and happen to win they will NOT pay your jackpot. The casino is in the right about this, however, they took her picture during the exclusion process so they know who she is. The casino should have arrested her upon entrance and shouldn't of allowed her to play. It's their fault also. Casinos turn the other way when they a self exclusion customer cause they know their money is a for sure thing for them. So sad.

At casinos in the D if you sign yourself out of them, you can't claim no prize and if they notice you then you will be walked out. Can't even be on the premises.

I get that the casino should at least give her back what she put in cause that's not fair but I agree with them not giving her winnings. You need to keep problem gamblers away. They sign this waiver but if they do go back they aren't likely to get kicked out so by taking away their chance to win it big it definitely deters them. There us a process to get out of self exclusion if you really want to gamble that bad go through that first.

It's for her best she didn't get the 12k. I have a friend that won big, not that big, but large enough that he spiraled out of control in more gambling and doing drugs. If she self-excluded, that means she has a problem. Giving her a big win like that would guarantee she lose it all and more in the long run.

It actually does say that you will not get your winnings when you sign your self exclusion form. You’re not eligible to win once you’re banned from the casino - since you shouldn’t be there to begin with. Just like a minor wouldn’t get their prize

bo steele She obviously put her self in debt, or gambled needed money, felt ashamed and had one of those break downs where she chose to exclude, than next day she woke up refreshed and said "casino". These people have been gambling for years and some daily, its an addiction like any other one that can be beat if you reach for help and want it bad enough even though its still very hard but regardless even if got awarded the money, shed be playing at another location and losing it all once again. Its karma and she needs to face reality.

It sounds like there’s no point to putting yourself on the self exclusion list because apparently you can still go in and gamble as long as you’re losing. She is ridiculous!! There are signs EVERYWHERE in Casinos here in Canada that say exactly that: "If you are self-excluded you are NOT entitled to jackpots, hand-payouts, or progressive prizes." If she was ignorant of the rules she can't blame them after the fact, anymore than I can tell a police officer, "but I WASNT AWARE of the speed limit officer." It's her own dang fault and she shouldn't have been IN there after banning herself! She's lucky she got passed door security in the first place in order to PLAY that slot!
This is the casinos fault they should not have let her come in the casino and yet she hit a jackpot and can not keep her winnings i would get a lawyer and sue that casino for way more than that jackpot is worth.
