After this situation they will stand on their own feet and start working and earn money. Court should find out the incapabality of wife first and then decide the maintenance. My friend faced same situation.. it was an arrange marriage.. soon after marriage exactly 15 days she goes to her parents home and filed many fake cases.. still case if going on .. the boys parents are fighting depression now leave about alimony which she takes and lives with her boyfriend now . However when asked what happened to my friend, he says she did it in a planned way and after marriage she threatened him with rape case if he touches her .. 15 days she lived in a seperate room .. now she is happy to get alimony soon after the divorce.. zero regrets..

I hope you will share someday that Alimony laws are gender neutral. Men can and do claim alimony too. Also, claiming alimony is not equivalent to getting it. The wife is unlikely to claim or get alimony if she is employed well enough to maintain herself. So what is stopping men from not getting into this problem by marrying working and financially capable women? You cant hope to marry a woman financially dependent on you so that you can control her and then whine about paying alimony. The problem doesn't stop here that women can earn there own money since past few decades so lets stop this. I'm unmarried but turning 30 this month. For past year im applying for various jobs and the biggest reason of rejection is im old and may get married soon. Way too many women get rejected on the basis of marriage and if this not then pregnancy and age factors need to be considered too. If we apply these stop of maintaining the alimony thing then we need to enforce laws to make them join job more easily.

In any profession (except arts) take for example Medicine, and Engineering the bottom-most fellows from that field ie Dr's or Engineers vehemently object to misconstrued ideas/theories, bring immediate correction, and help make great strides and advancements in that field. But fellows from the Judiciary, the advocates, especially the ones from India only know to masturbate over apathy. God alone knows what they do in the bar fking council. They are the first officers of the courts. Why haven't they bought a mandatory review or debate to refine existing laws? Simply interpret laws and if required create more laws to complicate interpretation, take fees, eat $hit, and sleep.
Reality and law are different. First a daily labour does not mean, one get work all days and even paid on time, else labour courts have been empty. Secondly, able body men- kaam karo, must mentain wofe; physically fit women, you can live separately,take rest, take away children,show helplessness and no need to work, the husband must work for you as if he is servant in the name of moral obligations fully forgetting, unless unable to earn, applicable for children's, elders in true sense only and only in extreme cases of others. This minimum wage is misleading, because if that is so, while india is employed in that minimum age and why against women, it cannot be presumed in same manner as minimum wage is gender neutral. The whole drama must stop atleast in urban areas, for rural areas, one can understand but if one live seperate without any sensible reason(as reason are always there), then one must be shown door to make justice then mercy to prevail.

In a recent judgement, the Madras High Court has ruled that women seeking alimony should “maintain discipline as she was expected to maintain during the subsistence of her marriage”, suggesting that having sexual relationship with another man after divorce would jeopardise her chances of getting alimony.
The high court ruled that a divorced women would lose all claims to maintenance if she commits any breach of the sexual obligation she had before the dissolution of her marriage. Invoking Section 125(4) of the CrPC, the judge pointed out that, legally, an adulterous wife cannot claim maintenance from her estranged husband and said that the law would apply in the case of a divorcee too.
If being sick,he can provide Rs 2000 as maintenance to his wife,then logic says Wife is capable of earning basic source of income working as domestic helper.

My friend faced same situation.. it was an arrange marriage.. soon after marriage exactly 15 days she goes to her parents home and filed many fake cases.. still case if going on .. the boys parents are fighting depression now leave about alimony which she takes and lives with her boyfriend now . However when asked what happened to my friend, he says she did it in a planned way and after marriage she threatened him with rape case if he touches her .. 15 days she lived in a seperate room .. now she is happy to get alimony soon after the divorce.. zero regrets..

Thats why i decided to be single years back. I am having a life man . Having 2 vacations a year and saved enough for retirement which will be 15 years early than i shoud have if i have a family (say 60) . Didnt have to pay for kids education.

I hope you will share someday that Alimony laws are gender neutral. Men can and do claim alimony too.
Also, claiming alimony is not equivalent to getting it. The wife is unlikely to claim or get alimony if she is employed well enough to maintain herself.
So what is stopping men from not getting into this problem by marrying working and financially capable women?
You cant hope to marry a woman financially dependent on you so that you can control her and then whine about paying alimony.

Amishji... Maintenance stops if the divorced wife remarries. So will this not encourage such women's to go for live in as that the maintenance dosent stop. Please throw light to your audiance the status of maintenance if the wife goes for live in. Also in which scenario maintenance stops for male and female child's.

The problem doesn't stop here that women can earn there own money since past few decades so lets stop this. I'm unmarried but turning 30 this month. For past year im applying for various jobs and the biggest reason of rejection is im old and may get married soon. Way too many women get rejected on the basis of marriage and if this not then pregnancy and age factors need to be considered too. If we apply these stop of maintaining the alimony thing then we need to enforce laws to make them join job more easily.

In any profession (except arts) take for example Medicine, and Engineering the bottom-most fellows from that field ie Dr's or Engineers vehemently object to misconstrued ideas/theories, bring immediate correction, and help make great strides and advancements in that field.
But fellows from the Judiciary, the advocates, especially the ones from India only know to masturbate over apathy. God alone knows what they do in the bar fking council. They are the first officers of the courts. Why haven't they bought a mandatory review or debate to refine existing laws? Simply interpret laws and if required create more laws to complicate interpretation, take fees, eat $hit, and sleep.

Reality and law are different. First a daily labour does not mean, one get work all days and even paid on time, else labour courts have been empty. Secondly, able body men- kaam karo, must mentain wofe; physically fit women, you can live separately,take rest, take away children,show helplessness and no need to work, the husband must work for you as if he is servant in the name of moral obligations fully forgetting, unless unable to earn, applicable for children's, elders in true sense only and only in extreme cases of others. This minimum wage is misleading, because if that is so, while india is employed in that minimum age and why against women, it cannot be presumed in same manner as minimum wage is gender neutral. The whole drama must stop atleast in urban areas, for rural areas, one can understand but if one live seperate without any sensible reason(as reason are always there), then one must be shown door to make justice then mercy to prevail.
We need gender-neutral laws, and the stance of the Supreme Court is also in favour of the wife in most cases.
When wife n children stays with husband he decides with mutual consent about the living standards completely depending on the financial burden as well the education of children depends on mutual consent of both then how come one entity decides the maintenance?
