      I agree. From what I understand they couldn't find the bullet which killed Gabriel Cuen-Buitimea, so why accuse Kelly of doing it?
      I believe that was the reason for the mistrial. The prosecution couldn't prove it beyond a reasonable doubt.
      Waste of taxpayer money.

      The cops couldn't find the bullet which ended the life of Gabriel Cuen-Buitimea so they couldn't prove Kelly fired it. I believe that's why there was a mistrial. That doesn't mean that Kelly didn't shoot him, it means the State couldn't prove it. In the future I hope he thinks about what he's doing before he starts blasting on folks.

      The mexican consulate will demand the santa cruz county prosecutors re-file charges against the rancher.
      The rancher was interfering with illegal mexican drug smuggling commerce.

    Mr. Kelly deserves restitution and a national apology. This judge, prosecutor, and everyone involved should be put in prison. They are clearly working for the cartel

      I hope I’m wrong but, my guess is the family in Mexico will bring a civil suit against Mr Kelly. There’ll be a lawyer that will jump at that chance to represent them.

      No, that would be jury nullification. All but one member of this jury declared he was not guilty of violating a law, not that he violated the law but they're not going to convict. There is a HUGE legal difference.

    I am sure that Judge is pissed off--mistrial, if the state refiles, he is going to have to sit through the trial again, do you think he’s going to limit defense to five minutes to cross examine any of the parties!? I would suppose he learned his lesson. And how disrespectful that he did not stand when the jury came in and then left the courtroom. .

    Is Daniel gonna come back the 2nd time around? Doubt it. Is the detective going to magically become competent in the next 60 days (which is how long the state has to try this again)? I don't think so. Will the sherrif be around to take the stand, or will he be in Mexico offering his "condolences" to everyone who died crossing the border? Will the ME have to be forced to testify again? She gets so angry when her "expertise" is questioned, she refuses to even look in the general direction of those who question it. Will she remember her FULL report this time? Unlikely. Will all the reports that contain inaccurate information, like the "confession" Kelly never made, be corrected with new reports this time?
    Even the judge said a state witness was hostile and purposely being "obtuse". He couldn't figure out "what the hell was going on". I think we all know what's going on... The state needs to take the L & stop wasting taxpayer $ on this "case". It was embarrassing enough the first time around...
    And any juror who couldn't acknowledge reasonable doubt here-- what is wrong with you??

      @@donmiller2908I’m sure that’s all the state had… one juror. No way in hell there was more than that. We have RIGHTS to protect ourselves and our property. It’s ridiculous to think that anyone would find a man guilty when these cartels have been using his property as their underground highway for years to traffic, people, guns, and drugs. I dare any juror (that thought he was guilty) to go camping on that section of land and see how safe they feel with armed men coming across it, knowing they are breaking the law. I dare them.

      @@TamiFowler1 Everything you're saying about cartels using Kelly's land to traffic drugs, weapons and people may be true. It might happen everyday. It's possible that George Kelly himself has caught these people in the act and had irrefutable proof that would stand up in any court that they were trafficking weapons and drugs. You still don't have the right to use deadly force against them. George Kelly is not a law enforcement official in Arizona. Even if a duly sworn official were to catch these people in the act of trafficking weapons or illegal substances, he would not have the right to use deadly force, so why would Kelly have that right?
      Kelly had the right to defend himself, his wife and his property, true. But in his own statement to the cops he said the people were 100 yards away and moving away from him, away from his wife and away from his house. He himself told the cops they were so far away he couldn't tell if they were armed or not. So where is the threat?
      Kelly stated that he heard a shot which spooked his horse, so he fired in the direction of the people, but in the air. But Kelly himself told the cops he he could not say for sure that the shot he heard was even directed at him. It was later while he was again out on his property that he found a body. What I found to be ridiculous was that the body had been shot but there was no bullet, it was a clear in and out shot. So how could the law determine that Kelly had fired the shot? It should never have been taken to trial.
      I don't know what all of the issues were in the case, I believe there was a mistrial because it couldn't be proven "beyond a reasonable doubt" that Kelly was the cause of that migrant being unalived. I just know that he wasn't in danger, nor was his wife or his property at the time that Kelly fired. You can't use deadly force against someone merely because they are on your land.

    So all the attorneys heard the judge release the jurors from the adomition of the Court, so WHY are the attorneys *still* asking the judge to request that the jurors speak to them??

      Yeah, they could ask for a re-trial hoping to get a guilty verdict from a new jury. I doubt they will though. Trials cost money and with the outcome so uncertain? They'll let it go.
