I think the best part of this debacle was Georgia Cappleman's comment after Dan's withdrawal. When asked if the State wished to be heard regarding the withdrawal, Georgia commented, "I don't think I have anything appropriate to say ..." and the Judge responded "Well put". What a fitting response!!

She has a right to an attorney. If her attorney is removed or resigns, that’s not the responsibility of the court. Not sure she cld claim ineffective counsel as he won’t be representing her at trial but we shall see🤷🏻♀️
I love this judge, but I think it was an error to not address this earlier. Not an error that hurts the case, it just hurt the victims, which is awful.
He did address it a long time ago and warned against it however had he denied him to be her lawyer he would have risked the verdict being overturned. Defense lied by saying they had a waiver when they actually didnt. @EffSharp

My 81 year-old words. The relationship between Dan and Donna is and has been very strong. There is no way on this earth that he will stop communicating with her. The bond is too strong, and the temptation will be too great. The man has not shown, a propensity for making good decisions, so why change now.?
This is terrible. I know Donna has all the right to defense counsel, but this shoudl have been managed better by the justice system. The conflict was so glaring, the court shoudl have stepped in and stopped this shenanigans. My heart is aching for Ruth Markel. So terrible.
The judge did question Donna about waiving her rights. If I’m understanding things correctly, it was only when the prosecution announced that it intended to call Charlie that the fact that he hadn’t signed a waiver came to light. He never appeared in court where the judge could have asked the relevant questions and Rashbaum appeared to be certain that Charlie had waived his rights. This is not the fault of the judge or prosecutors. They have their own jobs to do. Spoon feeding the defence or tracking its every move are not part of their job descriptions. If Georgia had made the same blunder Rashbaum would have been all over her like a “rash.”
I agree. Her mistake was hiring him in the first place when he knew there was a conflict. Attorneys are there because their clients don’t know the law and they do. This was his tax-up. Perhaps she can sue him.

Tactical. This happened to me in family court. All my witnesses flew in from out of state, some from Canada. The petitioner didn't show up. Lawyer requested another court date. Witnesses came in again. Didn't get heard that day. Third try, my witnesses thought we would get bamboozled again and didn't come. I lost bc I had no witnesses.
Rashbaum had this planned from the very beginning. These three are so enmeshed and communicate constantly through Harvey. Offerman was hired months and months ago. Why didn't he bring it up then? Why wait till the 11th hour? Hope the Adelsons compensated Rashbaum to include ruining his reputation.

My opinion: The defense did this to try to set up an issue on appeal (for Donna) thinking that the judge would make an error, but it backfired because the judge didn’t.

the State gets its money back for costs, but I really feel for all the Independant reporters and watchers that travelled to Tallahassee to see the trial. took time off work all that stuff, that's a big burden of cost.

I know Donna has all the right to defense counsel, but this shoudl have been managed better by the justice system.
The conflict was so glaring, the court shoudl have stepped in and stopped this shenanigans.

The judge did question Donna about waiving her rights. If I’m understanding things correctly, it was only when the prosecution announced that it intended to call Charlie that the fact that he hadn’t signed a waiver came to light. He never appeared in court where the judge could have asked the relevant questions and Rashbaum appeared to be certain that Charlie had waived his rights. This is not the fault of the judge or prosecutors. They have their own jobs to do. Spoon feeding the defence or tracking its every move are not part of their job descriptions. If Georgia had made the same blunder Rashbaum would have been all over her like a “rash.”
Why wouldn’t Rashbaum rather than Donna be liable for costs incurred since it was his error?
I agree. Her mistake was hiring him in the first place when he knew there was a conflict. Attorneys are there because their clients don’t know the law and they do. This was his tax-up. Perhaps she can sue him.
She is only crying because she knows Charlie is so close, but she can’t talk to him. That’s about it.

I think it’s apart of they plan , I think rash wanted off the case and I believe they also wanted more time . Justice is coming tho. We have to wait a little longer . Bummer
I disagree. I think they did this hoping that the judge would make an error on appeal. He called bluff and Rash is off the case. It’s a mess.

Tactical. This happened to me in family court. All my witnesses flew in from out of state, some from Canada. The petitioner didn't show up. Lawyer requested another court date. Witnesses came in again. Didn't get heard that day. Third try, my witnesses thought we would get bamboozled again and didn't come. I lost bc I had no witnesses.

Rashbaum had this planned from the very beginning. These three are so enmeshed and communicate constantly through Harvey. Offerman was hired months and months ago. Why didn't he bring it up then? Why wait till the 11th hour? Hope the Adelsons compensated Rashbaum to include ruining his reputation.
I doubt they communicate through Harvey - no privilege. It has to go through Rashbaum.

My opinion:
The defense did this to try to set up an issue on appeal (for Donna) thinking that the judge would make an error, but it backfired because the judge didn’t.
Dan should have to pay the fees for this mess... Donna didn't neglect to get the waiver signed .. Dan is a bit of an idiot .. I'm not sure what Donna thinks she is missing out on .. this might be the best thing that has happened for her

the State gets its money back for costs, but I really feel for all the Independant reporters and watchers that travelled to Tallahassee to see the trial. took time off work all that stuff, that's a big burden of cost.
A lot of pressure is put on the other defense counsel. Dan Is an excellent attorney. Excellent Defense counselor.
Rashbaum needs a bar complaint for this. Highly unprofessional. But he will still get paid. She has got to be SHELLING OUT MILLIONS for these attorney fees. It's costing her more money to do this, every day = more $$.
