Then he said, “she’s going to be very upset.” Again future tense. Rashy had not told Donna after lunch, but before the court readjourned in the afternoon. He was chipper and very upbeat.

Rashbaum should be sanctioned and reported to the Florida Bar Association. It started with Rashbaum with his failure to get a signed waiver PRIOR to speaking to Donna. It ended withnhis failure to notify the court and the prosecution.

As the adelsons are people who have used legal means to not paid others for services rendered, the whole situation is pretty rich. Charlie's action, through and with the advice of his appeal counsel, served the entire justice system. He just gave his mother her best shot at a vigorous, more successful defense, himself a better shot at appeal, and spared the prosecutors and judge a sure upset on appeal. If resentment or spite at Dan was part of his decision so be it. Donna may be devastated now, but Morris, in that short press conference, already demonstrated a firmer grip on the reality of the case and its optimum resolution, than we've seen. As happy as many viewers would have been with a train-wreck reprise of the "double extortion" defense and a swift guilty verdict, there was something grotesque about Donna's delusions about why Charlie was really convicted. It showed that her lawyer had not clearly explained the strength of the evidence, which means there was no reality-based strategy. I for one want to see a clean, smart, rigorous defense. In the jail calls after his conviction, Charlie was steeped in delusion, talking about the jury, Wendy's book, Georgia's southern accent, and how he got a "95" from Dan for his testimony. It sounds faintly like his appeal counsel may have given him a reality check that got through to him. Let's see real adults deal with in real facts in a court of law on this important case, and not a series of sideshows and pratfalls.
The Markel’s do not deserve all this drama - my heart breaks for them. 10+ years waiting for true justice and now have to deal with this BS. Just indite Wendi already ! I know everyone’s upset and miserable about last night, but honestly I think there’s a silver lining- this is the first time Charlie showed a willingness to screw his mother to save himself. I've been in business to business sales for 20 years and everyone knows you haven't closed the deal until they have signed on the line that is dotted. How a "lawyer" like Dan did not get Charlie's signature before representing Donna is unbelievable and the Florida Bar should look into this immediately.
I think when that text came in re drug deal gone wrong as a deflective excuse for the Adelsons- that is when Charlie, upon conferring with his new appellate lawyer really realized he need to be out for himself. The double extortion BS got obilterated.

But not Wendi, was offered a victim advocate within 3 hrs into her interview. 2 days after the “interview” not 5 hr Interview. , LE called her 2 days later and see hung up, and lawyered up. She testified she was worried about the safety of the boys, yet admitted she doesn’t watch, read or listen to the news. Wendi, then how will you know the developments of the case. I went through an unpleasant divorce, but I can’t name one person to LE that would take the life of my ex, just because of their loyalty. Apparently Wendi had a black book of names. She rattled off numerous people , her words not mine. Ironically she had laryngitis a week before the murder, so she avoided speaking to Dan about the school (why would she they were on the waiting list in Florida and she emailed Jeff a cease and desist letter to stay away. Why Wendi, because if Jeff dropped by the house and saw the house packed up, your cover would’ve been blown. I mean Ruth mentioned in her book (that she brought over toys from Danny’s house because your home was sparse. My Although I enjoyed your podcast since you didn’t realize that the world would hear for themselves how passive aggressive you are. It’s interesting that you accepted the job in Florida before your relocation was denied. So let me guess, you enrolled the boys at the school in Florida under the Adelson name, prior to Danny being murdered. Since there was a long wait list and school started earlier than September in Florida. Remember Georgia asked you on the stand, when did you enroll the kids into school. But she rambled on about Nancy Grace, blah blah. I bet Donna enrolled them in a Florida school under the Adelson name. And since your parents rented a home district of the school, it was a moot point to having the discussion about enrollment since yo had no intentions of signing the kids to a school in Tallahassee. Without legally changing their names, because it takes time. So clearly they have a connection at the school. But what school doesn’t require a court orders or supporting document and proof of the relocation . Since Wendi accepted a job in Miami before her relocation was denied, did she or Donna enroll the kids in that private school under the Adelson name. Mind you a school with a school with a lengthy wait list. Remember timing was an issue. Hence why she avoided her conversation with Danny about schools. Because she already had a plan and it she didn’t need to discuss jjjjhhuit with Danny.
Donna is obsessively unhinged enough to (allegedly) orchestrate the murder of Dan. This week made me realize that her irrational and fixated behavior re: Rashbaum is actually entirely consistent with who she is, and much of our incredulity comes from the assumption that Donna sees the world as most of us do.
I was away from STS for about 8 months, and I just came back to listen again. Great episode! It’s a ploy. Dan is aware there’s major COI. Dan thought the Judge would let the hearing proceed. Then when COI comes up, and DA is convicted they can request a reversal!
An attorney’s overriding ethical duty is to not mislead the court, and Mr Raushbaum’s conduct appears to be untethered to the rules of professional conduct, ethics and laws. Again, an attorney’s sworn ethical obligation is to zealously advocate for clients WITHIN the bounds of ethics. As an attorney, it’s embarrassing to watch.

Victims of crime see everything that goes on in the courtroom. It's getting more ridiculous hearing these people being defended! As many other attorneys have noted in detail for nearly a year, a waiver could not possibly solve all the issues of a conflict. The conflict is fundamental. It's not "just" related to Charlie testifying, and isn't erased by a "yes" nod by the defendant, or two signed documents (waivers) that are both insufficient to relieve the fundamental conflict, AND revokable at any time - like.... right before the jury goes to deliberation??? There are so many possible scenarios of conflict - like the inability to counsel Donna on a possible plea bargain because of Rashbaum's prior dealings with Charlie. The conflicts were EVERYWHERE. This conflict should have been dealt with by the judge long ago, with strong insistence by the prosecution. Focusing on the waivers completely misses the main point. Again, even if there were signed waivers, this would very likely get reversed on appeal. Several attorneys were making this point loudly many many months ago. That eventually comes out in this discussion. Agree, the primary responsibility for that goes to the judge, and secondarily to the prosecution (not to relieve the incompetence (or worse) of the defense). Agree, it's not easy or pleasant to accept that reality, because this is clearly an exceptional judge, and prosecutorial team, but together they nearly wandered into a disaster of their own "making" or at least allowance. Ironically, they were saved at the 11th hour by Charlie Adelson's attorneys. The judge and the prosecution should send those lawyers a lavish thank you card.
Ive been following this case and STS - love the team and best guests! Im a lawyer in Australia, but not a criminal lawyer. I don’t claim to know the American system at all. From what i gathered, there was oversight by Rashbaum and team in obtaining the waiver from Charles but could they not be forgiven for assuming that mother and son were on the same team and Charles was never going to say anything to incriminate his mother, and visa versa? I know, im clearly missing something!

Dan had a plan he got a commitment based on emotions. He let them control the defense and he supplied emotional and limited legal support. After Charlie's trial, Donna had such a strong bond because he fed her bullshi!! So now it all caught up with him. Dan was WAY over his with Donna's trial and he welcomed anything to get out of it, SIMPLE!!
Someone should be watching Rashbaum's bank account for pay off. These people have a lot of money. Everyone has a price. This is another boost for Charlie's ego, controlling the entire process. I think when that text came in re drug deal gone wrong as a deflective excuse for the Adelsons- that is when Charlie, upon conferring with his new appellate lawyer really realized he need to be out for himself. The double extortion BS got obilterated.
I think when Charlie talked to a REAL lawyer, and not "Dan the Lawyer Man" he realized how much Dan screwed him over...

She was in control of this entire plan. Her family were mere puppets on a string. In a case like this, where an spouse is murdered , it’s y the Ex Spouse, that must be ruled out. But not Wendi, was offered a victim advocate within 3 hrs into her interview. 2 days after the “interview” not 5 hr Interview. , LE called her 2 days later and see hung up, and lawyered up. She testified she was worried about the safety of the boys, yet admitted she doesn’t watch, read or listen to the news. Wendi, then how will you know the developments of the case. I went through an unpleasant divorce, but I can’t name one person to LE that would take the life of my ex, just because of their loyalty. Apparently Wendi had a black book of names. She rattled off numerous people , her words not mine. Ironically she had laryngitis a week before the murder, so she avoided speaking to Dan about the school (why would she they were on the waiting list in Florida and she emailed Jeff a cease and desist letter to stay away. Why Wendi, because if Jeff dropped by the house and saw the house packed up, your cover would’ve been blown. I mean Ruth mentioned in her book (that she brought over toys from Danny’s house because your home was sparse. My Although I enjoyed your podcast since you didn’t realize that the world would hear for themselves how passive aggressive you are. It’s interesting that you accepted the job in Florida before your relocation was denied. So let me guess, you enrolled the boys at the school in Florida under the Adelson name, prior to Danny being murdered. Since there was a long wait list and school started earlier than September in Florida. Remember Georgia asked you on the stand, when did you enroll the kids into school. But she rambled on about Nancy Grace, blah blah. I bet Donna enrolled them in a Florida school under the Adelson name. And since your parents rented a home district of the school, it was a moot point to having the discussion about enrollment since yo had no intentions of signing the kids to a school in Tallahassee. Without legally changing their names, because it takes time. So clearly they have a connection at the school. But what school doesn’t require a court orders or supporting document and proof of the relocation . Since Wendi accepted a job in Miami before her relocation was denied, did she or Donna enroll the kids in that private school under the Adelson name. Mind you a school with a school with a lengthy wait list. Remember timing was an issue. Hence why she avoided her conversation with Danny about schools. Because she already had a plan and it she didn’t need to discuss jjjjhhuit with Danny.

Donna is obsessively unhinged enough to (allegedly) orchestrate the murder of Dan. This week made me realize that her irrational and fixated behavior re: Rashbaum is actually entirely consistent with who she is, and much of our incredulity comes from the assumption that Donna sees the world as most of us do.

Waivers aren’t worth anything much. IMHO, Rashy should have realized this could happen and told Donna that he could not be her lawyer. More than likely, he wanted the money…..😢

Who the hell would hire the guy who couldn't get her son off? She seems to make decisions based solely on emotion. In any case, at least she's locked up until this mess is worked out and then she's off to prison. Even a good lawyer couldn't get around all that evidence.

It’s a ploy. Dan is aware there’s major COI. Dan thought the Judge would let the hearing proceed. Then when COI comes up, and DA is convicted they can request a reversal!
An attorney’s overriding ethical duty is to not mislead the court, and Mr Raushbaum’s conduct appears to be untethered to the rules of professional conduct, ethics and laws. Again, an attorney’s sworn ethical obligation is to zealously advocate for clients WITHIN the bounds of ethics. As an attorney, it’s embarrassing to watch.

Perhaps it’s dawned on Charlie how much his mother has screwed up his life.
Charlie has been cut loose from his overbearing mother and found out he can make a decision without consulting mom.
Donna cried on cue. She knew to brush the hair from her face for the camera to pick up the tears. He was smiling, Charlie was grinning in his mug shot. Victims of crime see everything that goes on in the courtroom. It's getting more ridiculous hearing these people being defended! How Rashbaum was allowed to walk away without any repercussions, is baffling. Charlie has been playing this game for over a decade now...he has nothing to lose.
Kathy is so right on about Dan Rashbaum. He’s right on Joel’s tape lying. He’s sleazy and Coollady I agree with your husband that Rashbaum also knows where all of the Adelsons body’s are burried. It is also true that he just purchased a 1.5 million dollar mansion in Miami with Donna’s retainer!

It was a misrepresentation by Dan to say he had a waiver. An oral waiver is not a waiver. In the end he should be out anyway . Alex should be out too.imho

As someone with no law experience I could see how odd he would also represent Donna. To not have a signed waiver I have no words but I would never have allowed him to represent Donna if I were judge. Bc it’s worthless anyway, at any moment Charlie can pull the plug. That radhbaum was permitted to represent her makes me think something nefarious is happening here

As many other attorneys have noted in detail for nearly a year, a waiver could not possibly solve all the issues of a conflict. The conflict is fundamental. It's not "just" related to Charlie testifying, and isn't erased by a "yes" nod by the defendant, or two signed documents (waivers) that are both insufficient to relieve the fundamental conflict, AND revokable at any time - like.... right before the jury goes to deliberation??? There are so many possible scenarios of conflict - like the inability to counsel Donna on a possible plea bargain because of Rashbaum's prior dealings with Charlie. The conflicts were EVERYWHERE.
This conflict should have been dealt with by the judge long ago, with strong insistence by the prosecution. Focusing on the waivers completely misses the main point. Again, even if there were signed waivers, this would very likely get reversed on appeal. Several attorneys were making this point loudly many many months ago. That eventually comes out in this discussion.
Agree, the primary responsibility for that goes to the judge, and secondarily to the prosecution (not to relieve the incompetence (or worse) of the defense). Agree, it's not easy or pleasant to accept that reality, because this is clearly an exceptional judge, and prosecutorial team, but together they nearly wandered into a disaster of their own "making" or at least allowance. Ironically, they were saved at the 11th hour by Charlie Adelson's attorneys. The judge and the prosecution should send those lawyers a lavish thank you card.

Ive been following this case and STS - love the team and best guests! Im a lawyer in Australia, but not a criminal lawyer. I don’t claim to know the American system at all. From what i gathered, there was oversight by Rashbaum and team in obtaining the waiver from Charles but could they not be forgiven for assuming that mother and son were on the same team and Charles was never going to say anything to incriminate his mother, and visa versa? I know, im clearly missing something!
No, in the U.S. justice system there are no assumptions. If it is not documented then it did not happen.

Very sad for Donna to lose Dan who has represented her for so long. He feels relieved of the burden but she must feel terribly betrayed and abandoned.

Dan had a plan he got a commitment based on emotions. He let them control the defense and he supplied emotional and limited legal support. After Charlie's trial, Donna had such a strong bond because he fed her bullshi!! So now it all caught up with him. Dan was WAY over his with Donna's trial and he welcomed anything to get out of it, SIMPLE!!

Someone should be watching Rashbaum's bank account for pay off. These people have a lot of money. Everyone has a price. This is another boost for Charlie's ego, controlling the entire process. Donna is NOT the victim here. Of course he got information via his lawyer sister whose husband was the victim here. The entire family is getting away with it.
My bet: I think we are going to see Donna try to take a plea- IF the State will give it to her. But I'll bet she tries with a few months of sober reality without Rashbaum by her side . She is on her own now-utterly. I'd love to be wrong because I would also like to see justice play our in a trial.
Maybe she'll be able to retire to VietNam at 95 and have the last laugh, or the last cough, or whatever.

I think Dan was taking a huge gamble that Georgia would drop Charlie from the witness list. That would have benfited Donna. Unfortunately for her and Dan, Georgia wasn't playing!
