The reason they suing for monopoly is because yes they own the “game” but they can’t monopolize the competition side of it. Best example is the NFL doesn’t own football they own the league that people play football in. You can still create other football leagues like XFL etc. activision owns the game they can do whatever they want with the game. They can’t own monopolize the league and make it so no other leagues can exist but the call of duty leagues. If they don’t want competition in their game then they can remove private matches that’s within their right. They can’t own the game and then also monopolize the people who want to compete against each other whether it’s in the CDL or whether they want to create their own league.
Stop using professional sports to shoehorn this stupid argument to try and make sense of it.
Activision owns the game--the actual IP that is Call of Duty. People cannot simply take their IP and do whatever they want with it without their permission. That's not the same as a professional sports team. Stop. Being. Stupid.

@@niallkelly8210you got it a tad mixed up. Optic LA was immortals gaming. During hecz was with NRG and owned the huntsmen. Hecz bought the optic IP back from immortals and so NRG and Hecz changed the name to optic Chicago. Hecz and NRG had a falling out leading to the Chicago league spot being sold to the now Boston breach. Optic gaming merged with envy thus changing the branding from empire to OpTic.
@@niallkelly8210 Envy didn't own optic in 2019 it was Infinite. Hecz started huntsmen in MW2019 then bought optic back from Infinite right before cold war making the cod team optic Chicago. Now Envy owns the majority of optic though as a merged esports team.

What started to change my mind was a video I watched of Zinni when he was talking about when they GA’d snaking and he was talking about how different GAs change the tempo and competitive nature of the game! However I do think they take it too far and there is still a better middle ground that can be reached!

CDL was the worst thing to happen to competitive cod. CWL was incredible for viewership. Stick the game back on console. Back to friday Saturday Sunday events. Thursdays for the majority am bracket. Groups of 3 with am teams filtered in from thursday/friday for potential upsets. Double elim. 2 beat of 5 grand finals. 8-14 events. 2k and 5k online tournaments with Pro points coming back for seeding.

Ben is not a lawyer so I don't expect any expertise or good takes this time either. He doesn't know the law or the actual facts even though he may have read the document. All I know is that Hecz and Scump have proper legal counsels that found their case good enough to be worth the time and money to pursue it.

This lawsuit seems to be about it being unfair. I'm sure ATVI is well within their rights contractwise but f you both ask a ridiculously high price for a spot, have super strict rules for everyone and then don't do shit in return and make all decision based on your sole interest not taking into account the interests of the 12 teams who put 100s of millions into the league based on good faith Idk.. It won't be easy but cases like this have been won before.
The real thing is that the contracts were insane bit everyone signed them. They're claimed they were coerced into signing them. That though won't go through, zero chance they can prove that

I think professionals are crying about not making 500k a year but they don’t realize the financial correction has came to esports and it’s not going to be undone.
Like most monopoly cases the outcome is going to depend on how the judge defines a market. Unfortunately, its pretty hard to see a judge defining Call of Duty as a market, when it is a piece of IP directly owned by Activision, is just one of dozens of E Sports, and not even close to the biggest e sport by any means. Further OpTic is involved in a number of other e sports so they cant really say this hurting them in the e sports market as a whole.
I am guessing the judge will say look Activision owns the CDL and COD completely, there can be no competition in the Call of Duty competitive space from other entities without violating their rights as copyright holders. Copyright laws are fundamentally anti-competition and designed to ensure the control of the copyright owner. If you want to be part of their league and IP you have to play by their rules and if not then you have all the other leagues you can join or are already in in the e sports arena.
I could see Hecz argument if this was traditional sports but the difference is the MLB, NFL etc dont own the actual game of baseball and football and thus can be seen to be a competitive market where cod simply is not.
I like how people say COD league like its a separate entity, it's literally a subset of a digital game.. Call of Duty even the like trademark symbol is in the title. It'd be a monopoly if Activision made an ACTIVISION LEAGUE then limited its entire game library to be ran by them. Also it's funny how Hecz and Scump made their names into a shell company and make an LLC before sueing, just in case they get counter sued or something interpersonal happens to them Activision can't go and pursue them.
I’m hoping part of it is also that they know the league is nearly dead and they’re trying to push the dagger into it, everyone knows the previous set up with the cwl was vastly superior to franchising. It would be great to see a return to that style return with someone like Adam Apicella running the show. Went to two CWL events on back to back years and I had an absolute blast. Something the league lost when it franchised.

Not to mention Hecz etc were all big on CDL hed say how it was the future all the time (even calling people dumb that questioned it) when it first started and the stupidly high wages were nothing to do with the league etc

Here's the thing, your argument about the monopoly doesn't really hold water when you look at the bigger picture of eSports and Activision Blizzard. They can't really claim that and then have Starcraft 2 tournaments off on the side being run by ESL and OSC. As for getting money back, you have not considered that a lawsuit is only viable if they get a quick settlement or get Activision Blizzard to pay their legal fees. So to me, this is more than getting their money back. They want more than just money.

Im all for if theres strong enough basis to sue, then sue. But with this case here if optic, hecz, scump or whatever org or party is named in the suit, i dont think they should be in the league. Cant have your cake and eat it to. Plus if the cdl is so nefarious as to warrant a lawsuit, id expect that youd pull your team from the league for legal and moral reasons.

The lawsuit is flawed from the beginning, and mark my words it won't go anywhere, HECZ did this too late that for one, and second to have anything substantial back, they need a class action of all teams in the CDL, not HECZ and Scump, joining the 2 is ridiculous, this is just an attempt to get a ticket out for both, and fucking the other teams, and also comparing COD to other sports they based most of their arguments against ACTIVISION on that aspect, is ridiculous, COD is a game(you can make your own ball and play soccer but you can't make a DIY game by yourself), and ACTIVISION since their monopoly on the technology of COD as a game based on their IW8 engine, they can of course claim to get a cut on every revenue that is directly due to their game, the only thing that makes no sense is locking someone like Scump onto it, the guy retired, so unless he is paid by ACTIVISION to play their game, they shouldn't oblige him to anything, ACTIVISION is locking the whole production chain, to have a chance to break even, they need to all go on board, this thing is ridiculous, + what ruined COD and nobody is talking about it, is TWITCH, all about quantity and no quality even the videos on YT are crappy as hell, what do you expect just steaming the game for 8 hours a day, of course you're selling yourself to the devil, your YT channel will never grow, get some vues and stagnate, look at Scump followers he's capped, will never get to 5 millions, which is a tragedy if you thing that 100 of millions are playing WARZONE every day. Activision owns the IP, idiots. You can't take someone else's property and do what you want with it without their permission (usually in writing). The CDL only exists because of Call of Duty. The only reason the lawsuit exists because Optic thought they could ride the salary-paid gravy train like Overwatch Teams and it blew up in their faces.
Out of all the ethically dubious things Activision has done, this is by far not one of them.
It's just millionaires complaining they don't have more millions. $120 Million in 'damages' is just someone trying to fish for more money before the CDL tanks and Microsoft nukes it from orbit.
