    How Does the PACT Act Affect DIC Benefits
    What is the PACT Act?
    In 2022, Congress passed the PACT Act, which stands for Honoring Our Promise to Address Comprehensive Toxics. It is one of the most significant healthcare expansions in VA history. The PACT Act makes it easier for veterans with respiratory illnesses or certain cancers to obtain benefits if they were exposed to burn pits, Agent Orange, or nuclear materials.
    As part of a streamlined service connection process, the VA is also making it easier for the veterans’ surviving family members to receive compensation after the veteran's death. This is known as Dependency and Indemnity Compensation, or DIC.
    Evidence Needed in DIC Claims
    DIC benefits go to the surviving spouse, the surviving children, or the surviving parents. To receive these benefits, three things must be established.
    First, the claimants must prove the veteran had a service-connected condition. This does not necessarily mean the veteran was receiving VA benefits during their lifetime --- the survivor can try to prove a condition should have been service-connected, though it is more difficult after a veteran has passed away and cannot be examined by a physician.
    Second, a survivor must prove the service-connected condition caused the veteran’s death, or the veteran died in the line of duty. For example, say a veteran with a service-connected respiratory condition develops pneumonia and passes away. Though pneumonia is listed as the cause of death, the survivor can still prove that the original respiratory illness was the proximate cause of death. In other words, the veteran would not have died if not for the original respiratory illness.
    Third, the survivor must prove they meet certain eligibility conditions listed on the VA’s website.
