My brother lost his truck driving job this way. He was autistic so even though he blew nothing on the field test, they still charged him. Because his speach was slow. He lost his job and truck. He lost everything. We were so proud of him for overcoming his challenges and Tennessee just threw my brother away. The injustice is simply sickening.
This example sounds bad but what people do not realize and the news conveniently leaves out that this is a problem when a driver - sober or not, is drifting off the road and may be too tired or chronic pain to where it’s not safe for all the other drivers. A sober driver can be dangerous too if not paying attention or not being able to keep a lane.

I also have balance issues so if I look up while standing I'll immediately lose balance. I also haven't drank in yrs. If I can't pass a field sobriety test it doesn't mean I'm drunk, it means I lost the genetic lottery. Imagine getting ticketed because your flaws make it to where you can't do roadside gymnastics. Maybe you have a problem since you know what those classes entail.

The guy clearly looked intoxicated, the fact is that there ARE a lot of impaired drivers, and these cops also deal with real deaths all the time. So a cop has to weigh potentially letting someone go and killing someone if he got it wrong. The guy couldnt stay in the lane, handed the cop his debit card, and couldnt walk.. it was a good judgement to get him off the road. A false arrest is better than a potential death

@paulg3012 My friend is a truck driver. He got a DUI but was sober as the day he was born. It took 5 months for the tox test to come back. So for 5 months, he couldn't work. He lost his pickup truck and got 3 months behind on his house payment. Not to mention the $3,500.00 he had to give to retain a lawyer.

Winning an award for making the most DUI arrests does not make him an expert at detecting drunk drivers; it makes him an expert at making arrests. If his arrest count is above the statistical norm of his colleagues, it's more an indicator that he's doesn't know what he's doing or that he is compensated by making more and is being devious.

I once had a cop in Middletown, CT claim that my car "reeked of weed". I told the cop he was either mistaken or lying because I was on probation and had 2 years of drug tests that would prove I don't smoke. And I would be able to pass a drug test on the spot. He still searched my car anyway and after 20 minutes of not finding anything, he let me go with a "verbal warning" for the air freshener on my rear view mirror. I found it very terrifying that he seemed mad that he didn't find any counterband in my car...
The hospital can tell me my cholesterol levels, blood sugar, etc. within minutes or hours, but it takes 5 months to get the results of alcohol? Riiiight.
@@Jeff.with.a_G Easy, you have the charge on your record, you have a court date, you can't challenge the field test and testimony of the officer in court with your blood test, hard evidence and so you arrange a plea deal to get out of the DUI so you can drive again and the county wins a case. Let's not forget that a DUI arrest results in a vehicle being impounded, thus the owner incurring expenses. Those 'consensual' conversation questions about your travel are to establish if you've been at a bar, or the wrong part of town, or maybe worthy of having the K-9 come and 'indicate' on command. If you rightfully don't answer them, all of a sudden you're an A-hole, "uncooperative," "not being cool with me," etc. If you're out late at night, you're a target. Ask all the shift workers who're just trying to get home. If you fit a profile, you're a target. Drive a beater & they'll be drawn to you like a magnet, they'll follow you, tailgate you in the dark hoping you don't realize it's a cop and then make the mistake of speeding up to create some distance, aggressively U-turn and race up to your back bumper to read plates with no RAS or probable cause (which should be illegal), etc. This is not America.

Unfortunately the police officers get credited for the DUI arrest even if the person is subsequently proved innocent. So they'll find any reason to arrest you. It's a perverse incentive.

That one lady, who turned out to be a nurse that had just worked 41 hours straight during covid, had her child taken away from her, as well. It took 9 weeks to get her baby back. And 5 months to get her test results back - which were negative. She is one of the ones that has ADHD. It's absolutely disgusting what he did to her.
At that point, you are impaired due to lack of sleep and should not be driving. If you've gone 24 hours without sleep, you're more impaired than someone at the legal limit.

At 41 hours, you're more kf a hazard than someone who is just barely over the legal limit. So she may have been sober, but she was absolutely impaired and should not have been on the road.

So is the media. Why wouldn’t they tell people that you do not have to consent to a field sobriety test? As much as they mention the tests in this story you’d think they would tell people that they don’t have to do the thing that made these innocent people get arrested. Best advice for being pulled over, invoke your first, fifth and sixth amendment rights. Get out your phone to record them or better yet have a dash cam, first amendment. Hand over your paperwork and license then say you are exercising your right to remain silent and to have an attorney present for questioning, fifth and sixth. Then shut up. Do not tell them where you’re going or where you’ve been. Don’t answer any questions at all. None. If they ask you to do a FST tell them that you decline. If they tell you that it’s mandatory refuse and ask for a supervisor. Police are not your friends they are revenue generators for the government and the prison industrial complex.
One thing they’re not mentioned is that there is no law requiring you to take a field sobriety test. Immediately Ask for an attorney and or a breathalyzer. Field sobriety tests are you testifying against yourself.
"Innocent until proven guilty", but you have to wait 6 months for your name to be cleared and you will be treated as if you are guilty in the meantime.
You know fully well if it was in the better interests of whatever law enforcement agency, city government, etc, that the results of any and all testing would be available in hours if not minutes. But the more pressing issue here is there is clearly some incentive for crooked cops to make substantial numbers of DUI arrests: whether of not they are legitimate. And on a footnote: why is it when you hear about crooked cops abusing people it has a bad habit of being in some backwoods Southern State? Some things never change.

Us police are a better version of third world countries that have similar length of police training. There are countries that you become police by attending police academy of 3 to 5 years. Being a police is a profession. Those countries like Finland have less police issues. It seems with US standards, they end up spending more per police with all kinds of training over time where they pay the experts huge amount of money

My neurologist runs me through "field sobriety tests" as they are the best way to catch any neurological symptoms that I may otherwise be able to suppress because the symptoms he's looking for can become symptomatic when under stress. Guess what a field sobriety test is? Stressful! So far, I don't have any symptoms that he's looking for during these tests pop up..... yet.....

Problem is nowadays if you refuse the field test then you are automatically giving up your drivers license. I know in my state that's the true, they added it a few years ago. As a diabetic it scares the hell out of me, I cant pass many of the field tests due to physical issues (cant feel most of my feet, sugar levels not under control, etc) so I'm screwed if they ever stop me. I cant afford a lawyer to fight for me, if its even possible now its in state law, to regain my license, also for a DUI conviction I lose my state RE license along with my reputation. I rarely drink, never drink n drive but if I have a diabetic issue & get stopped? I'm screwed.
@@HawaiianShirtGal most states the only test refusal that can be held against you use is the breath test at the police station. Not doubting what you are saying but would check with a lawyer. A public defender’s office may be able to clarify the law just in case. Police will tell you that can’t refuse or will be charged and lose license.

I know for a fact that I'd fail their tests, as I'm a senior who uses a cane and has balance issues. Scary.

@@SadieMccollough-mf3jl Yes, you can insist on a breathalyzer or blood test. However a breathalyzer will only detect alcohol. And even if you blow 0.0 the officer can claim you appear to be under the influence of something else. Then a blood test is the only thing that can clear you. It can take months to receive the results of a blood test , depending on where you are stopped. In the mean time, you have lawyers to pay for, court appearances to attend, a suspension of your license to deal with (this automatic in many states and an arrest on your record. As for being concerned over refusing a field sobriety test, that is your right. You cannot be compelled to take the test. Even if you “pass” the FST, because the test is subjective, an officer can say you didn’t. Either because they believe you didn’t or because they want to make an arrest. You could pass a FST, even by an officer’s subjective observation. But if an officer want to arrest you, all they have to do is say “Look’s like you were a little wobbly there.” A normal person might respond, “Well, I’m a little nervous.” or “I’m old.” Either statement could be used in court to imply even you didn’t think you passed the FST. Compliance has limits. Comply as far as you legally have to. Any other conversation can be used against you. Any other compliance that requires you to do something or say something might just be a violation of your civil rights and land you in jail for a crime you never committed.
@@bobthetitanic That’s why they cannot force you to take a field sobriety test. They are not reliable. Failing a FST is only a “possible” indicator of being under the influence. It gives an officer a reason to demand a breathalyzer test or blood test. You don’t want to give them any reason to demand those tests if you are not under the influence of anything.
A good lawyer for a lawsuit is expensive. The cops have a whole legal team and the government backing them up. So, you need a good lawyer. Truth is, justice is only for the wealthy. And even then, not all the time.
For what? Doing his job? He had many indicators that this man might be intoxicated. He had probable cause to arrest him. That it turned out that he was sober is from blood tests that the officer can not do on the spot. The real injustice here is that it took 5 months to get a result from a test that can be done in minutes in a lab.

Breathalyzer!? No smell of alcohol? I was pulled over at 3am working Doordash. He wanted to arrest me. I had a taillight out. The cop was so bent on my getting charged that even though I fixed my taillight, and had just got my tags 3 days prior so I didn't believe it was out. All other cases of a tail light are dropped after proof of getting fixed. But because I stood up for myself and spoke back to him he made sure I jad to pay the ticket and even showed up to the extended hearing of my disputing the ticket. I had to pay a $50 fine all because I wasn't a drunk driver like he initially thought. I moved into a lane, changed my mind because Google maps was being stupid, and then moved back into the lane, all with my blinker on, then moved into the right place to turn, with my blinker on. All legal. Only problem was it was 3am. And he had a quota.
I have several relatives who are cops or were cops and they’ve all told me and my brothers the same thing. Never submit to the field sobriety test. Cops will ignore medical conditions and will fail you on the most minor things. The test isn’t to prove your sobriety it’s so the officers have more to charge you with.
I'm a retired lawyer and took many DUI defense courses. The instructors all recommended that a person never take a field sobriety test. Absolutely don't. Better to deal with the consequences of an administrative suspension of your license than a DUI charge. Cops are out of control in the United States now.

The field sobriety tests are literally pseudo-science heavily influenced by confirmation bias. There have been several nonpartisan studies done over the years on their effectiveness to determine if an individual is intoxicated and over and over, they are found to be only "mildly sensitive" as a determining factor. Sober people will often "fail" these tests due to a combination of nerves, environment and physical limitations.
Never EVER take a “field sobriety test”. Just shut your mouth and require a blood test. The field stuff is waaaay too subjective and easy to fail. Make them PROVE their case, and never talk to police about anything ever.
If you’re actually sober just take a breathalyzer, otherwise refuse everything. I’ve had a DUI lawyer tell me this, refuse everything, yes they’ll take you in, but by the time they administer a blood test at the station there’s a better chance that you’ve sobered up to under the legal limit

All the roadside FSTs/PBTs do is offer them an opportunity to collect evidence to establish probable cause, so there's absolutely no benefit to taking either one of them.

This happened to me in Ohio - I dont drink at all - car was towed - cop was a TOTAL ASSHOLE - had to go to court - the judge was a TOTAL ASSHOLE - had to pay outrageous court cost -
It doesn’t matter. They can arrest you anyway and claim they had sufficient evidence. Then claim the courts will decide as they say to themselves “at least he won’t kill anyone with his car on the way home.” They suffer no consequences for their mistakes but innocent people will and that’s the way the system wants it.

Revocation of licence does not apply to FST refusal, only when refusing further tests. If this was for alcohol only, then the guy should've been allowed to take the breath test on a calibrated analyzer.

When refusing FST exercises, it gives probable cause to arrest for further investigation. The guy should have been offered option of calibrated breath test, or blood draw. LEO either did not offer, or jumped to conclusion of drugs involved to get a subpoena for the blood draw, which takes about 10 minutes to get. If it was for alcohol only and failed to offer the breath test, the LEO is in big trouble.
@pana You signed for your license and in that agreement you can't refuse the breath or blood tests without it being treated as guilty. You can refuse the dog and pony tests they run through. Refuse the breath test and to lose your license and it's taken as an admission if guilt in court.

My 23 year old son was pulled over for going too slow on a local street late at night. He'd had a drink or two but blood test results later on showed he was under the limit. The officer claimed he failed the field sobriety test. After hiring a lawyer and taking a DUI class the charges were reduced. His insurance company dropped him although there was no accident, property damage, or claim. Lesson learned: make no statements and don't take a field sobriety test.
FSTs aren't to determine whether you're intoxicated. They're designed to make you fail and give officers "probable cause" to charge with DUI where that probable cause doesn't actually exist
In most states, it is also a chargeable offense to refuse and will result in automatic suspension of your drivers license, so don't listen to this fool!

Plus you can ask your blood to be drawn to test for the alcohol. You don't have to take your breathalyzer. That may take a while but once the results come as a negative, everything gets dropped.

Edit: You are not legally obligated to entertain a field sobriety test when an officer pulls you over. Had a seizure 4 years ago and my right leg is still a mess . If I did the walk a straight line part I would fail . One cop messed up a ladies life because he decided her Canadian licence was not valid in his state ( so said the officer ) Have had two run ins with cops and did not take any of their BS and trick questions 😂 . One told me to sit in front of car in side of hiway . I laughed at him and refused . Had a few choice word for him and that was after he threatened to cuff me ! Some should not have badges and would probably do a crappy job doing parking enforcement !
The absurd time it takes for the blood test to come back is not incidental to the problem. It is the cause of the problem. Cops know that most people will end up taking a plea deal because they can't go 8 months with a suspended license and they need a car to work. Why in the heck does it take the state the better part of the year to process a blood test that the private sector can complete in a matter of days? Aren't citizens entitled to a speedy trial? What allows the state to purposely collect evidence in a way it will be withheld from the defense for an unreasonable time.

My brother lost his truck driving job this way. He was autistic so even though he blew nothing on the field test, they still charged him. Because his speach was slow. He lost his job and truck. He lost everything. We were so proud of him for overcoming his challenges and Tennessee just threw my brother away. The injustice is simply sickening.

This example sounds bad but what people do not realize and the news conveniently leaves out that this is a problem when a driver - sober or not, is drifting off the road and may be too tired or chronic pain to where it’s not safe for all the other drivers.

I also have balance issues so if I look up while standing I'll immediately lose balance. I also haven't drank in yrs. If I can't pass a field sobriety test it doesn't mean I'm drunk, it means I lost the genetic lottery. Imagine getting ticketed because your flaws make it to where you can't do roadside gymnastics. My friend is a truck driver. He got a DUI but was sober as the day he was born. It took 5 months for the tox test to come back. So for 5 months, he couldn't work. He lost his pickup truck and got 3 months behind on his house payment. Not to mention the $3,500.00 he had to give to retain a lawyer.
He wasn't an "expert." He was a bully with no accountability.

Winning an award for making the most DUI arrests does not make him an expert at detecting drunk drivers; it makes him an expert at making arrests.
If his arrest count is above the statistical norm of his colleagues, it's more an indicator that he's doesn't know what he's doing or that he is compensated by making more and is being devious.

I once had a cop in Middletown, CT claim that my car "reeked of weed". I told the cop he was either mistaken or lying because I was on probation and had 2 years of drug tests that would prove I don't smoke. And I would be able to pass a drug test on the spot. He still searched my car anyway and after 20 minutes of not finding anything, he let me go with a "verbal warning" for the air freshener on my rear view mirror. I found it very terrifying that he seemed mad that he didn't find any counterband in my car...

Let's not forget that a DUI arrest results in a vehicle being impounded, thus the owner incurring expenses. Unfortunately the police officers get credited for the DUI arrest even if the person is subsequently proved innocent. So they'll find any reason to arrest you. It's a perverse incentive.

That one lady, who turned out to be a nurse that had just worked 41 hours straight during covid, had her child taken away from her, as well. It took 9 weeks to get her baby back. And 5 months to get her test results back - which were negative. She is one of the ones that has ADHD.

At that point, you are impaired due to lack of sleep and should not be driving. If you've gone 24 hours without sleep, you're more impaired than someone at the legal limit.

At 41 hours, you're more kf a hazard than someone who is just barely over the legal limit. So she may have been sober, but she was absolutely impaired and should not have been on the road.

Best advice for being pulled over, invoke your first, fifth and sixth amendment rights. Get out your phone to record them or better yet have a dash cam, first amendment. Hand over your paperwork and license then say you are exercising your right to remain silent and to have an attorney present for questioning, fifth and sixth. Then shut up. Do not tell them where you’re going or where you’ve been. Don’t answer any questions at all. None. If they ask you to do a FST tell them that you decline. If they tell you that it’s mandatory refuse and ask for a supervisor. Police are not your friends they are revenue generators for the government and the prison industrial complex.

One thing they’re not mentioned is that there is no law requiring you to take a field sobriety test. Immediately Ask for an attorney and or a breathalyzer. Field sobriety tests are you testifying against yourself.

"Innocent until proven guilty", but you have to wait 6 months for your name to be cleared and you will be treated as if you are guilty in the meantime.

You know fully well if it was in the better interests of whatever law enforcement agency, city government, etc, that the results of any and all testing would be available in hours if not minutes.
But the more pressing issue here is there is clearly some incentive for crooked cops to make substantial numbers of DUI arrests: whether of not they are legitimate. And on a footnote: why is it when you hear about crooked cops abusing people it has a bad habit of being in some backwoods Southern State? Some things never change.

You should never take a field sobriety test, most dui lawyers will tell you this.
Problem is nowadays if you refuse the field test then you are automatically giving up your drivers license. I know in my state that's the true, they added it a few years ago.
As a diabetic it scares the hell out of me, I cant pass many of the field tests due to physical issues (cant feel most of my feet, sugar levels not under control, etc) so I'm screwed if they ever stop me.
I cant afford a lawyer to fight for me, if its even possible now its in state law, to regain my license, also for a DUI conviction I lose my state RE license along with my reputation. I rarely drink, never drink n drive but if I have a diabetic issue & get stopped? I'm screwed.

A public defender’s office may be able to clarify the law just in case. Police will tell you that can’t refuse or will be charged and lose license.

I think I've heard that one can insist on a breathalyzer or blood test instead, but I'd be concerned about the immediate consequences for refusing to cooperate with their demands. I know for a fact that I'd fail their tests, as I'm a senior who uses a cane and has balance issues. Scary.

Yes, you can insist on a breathalyzer or blood test. However a breathalyzer will only detect alcohol. And even if you blow 0.0 the officer can claim you appear to be under the influence of something else. Then a blood test is the only thing that can clear you. It can take months to receive the results of a blood test , depending on where you are stopped. In the mean time, you have lawyers to pay for, court appearances to attend, a suspension of your license to deal with (this automatic in many states and an arrest on your record.
As for being concerned over refusing a field sobriety test, that is your right. You cannot be compelled to take the test. Even if you “pass” the FST, because the test is subjective, an officer can say you didn’t. Either because they believe you didn’t or because they want to make an arrest. You could pass a FST, even by an officer’s subjective observation. But if an officer want to arrest you, all they have to do is say “Look’s like you were a little wobbly there.” A normal person might respond, “Well, I’m a little nervous.” or “I’m old.” Either statement could be used in court to imply even you didn’t think you passed the FST. Compliance has limits. Comply as far as you legally have to. Any other conversation can be used against you. Any other compliance that requires you to do something or say something might just be a violation of your civil rights and land you in jail for a crime you never committed.

That’s why they cannot force you to take a field sobriety test. They are not reliable. Failing a FST is only a “possible” indicator of being under the influence. It gives an officer a reason to demand a breathalyzer test or blood test. You don’t want to give them any reason to demand those tests if you are not under the influence of anything.

For what? Doing his job? He had many indicators that this man might be intoxicated. He had probable cause to arrest him. That it turned out that he was sober is from blood tests that the officer can not do on the spot. The real injustice here is that it took 5 months to get a result from a test that can be done in minutes in a lab.

Breathalyzer!? No smell of alcohol? I was pulled over at 3am working Doordash. He wanted to arrest me. I had a taillight out. The cop was so bent on my getting charged that even though I fixed my taillight, and had just got my tags 3 days prior so I didn't believe it was out. All other cases of a tail light are dropped after proof of getting fixed. But because I stood up for myself and spoke back to him he made sure I jad to pay the ticket and even showed up to the extended hearing of my disputing the ticket. I had to pay a $50 fine all because I wasn't a drunk driver like he initially thought. I moved into a lane, changed my mind because Google maps was being stupid, and then moved back into the lane, all with my blinker on, then moved into the right place to turn, with my blinker on. All legal. Only problem was it was 3am. And he had a quota.
The test results were purposely withheld for months, the test itself is completed in a matter of minutes and a report is generated.
Exactly, a BAC test is run on a GC is a couple of minutes, it's super quick.

I have several relatives who are cops or were cops and they’ve all told me and my brothers the same thing. Never submit to the field sobriety test. Cops will ignore medical conditions and will fail you on the most minor things. The test isn’t to prove your sobriety it’s so the officers have more to charge you with.
I'm a retired lawyer and took many DUI defense courses. The instructors all recommended that a person never take a field sobriety test. Absolutely don't. Better to deal with the consequences of an administrative suspension of your license than a DUI charge. Cops are out of control in the United States now.

The field sobriety tests are literally pseudo-science heavily influenced by confirmation bias. There have been several nonpartisan studies done over the years on their effectiveness to determine if an individual is intoxicated and over and over, they are found to be only "mildly sensitive" as a determining factor. Sober people will often "fail" these tests due to a combination of nerves, environment and physical limitations.
Never EVER take a “field sobriety test”. Just shut your mouth and require a blood test. The field stuff is waaaay too subjective and easy to fail. Make them PROVE their case, and never talk to police about anything ever.
If you’re actually sober just take a breathalyzer, otherwise refuse everything. I’ve had a DUI lawyer tell me this, refuse everything, yes they’ll take you in, but by the time they administer a blood test at the station there’s a better chance that you’ve sobered up to under the legal limit

All the roadside FSTs/PBTs do is offer them an opportunity to collect evidence to establish probable cause, so there's absolutely no benefit to taking either one of them.

This happened to me in Ohio - I dont drink at all - car was towed - cop was a TOTAL ASSHOLE - had to go to court - the judge was a TOTAL ASSHOLE - had to pay outrageous court cost -

It doesn’t matter. They can arrest you anyway and claim they had sufficient evidence. Then claim the courts will decide as they say to themselves “at least he won’t kill anyone with his car on the way home.”

Revocation of licence does not apply to FST refusal, only when refusing further tests. If this was for alcohol only, then the guy should've been allowed to take the breath test on a calibrated analyzer.

Just remember you can't refuse the breathalyzer with some consequences but you can 100% refuse a field sobriety test since that is 100% subjective.

When refusing FST exercises, it gives probable cause to arrest for further investigation. The guy should have been offered option of calibrated breath test, or blood draw. LEO either did not offer, or jumped to conclusion of drugs involved to get a subpoena for the blood draw, which takes about 10 minutes to get. If it was for alcohol only and failed to offer the breath test, the LEO is in big trouble.
@pana You signed for your license and in that agreement you can't refuse the breath or blood tests without it being treated as guilty. You can refuse the dog and pony tests they run through. Refuse the breath test and to lose your license and it's taken as an admission if guilt in court.

My 23 year old son was pulled over for going too slow on a local street late at night. He'd had a drink or two but blood test results later on showed he was under the limit. The officer claimed he failed the field sobriety test. After hiring a lawyer and taking a DUI class the charges were reduced. His insurance company dropped him although there was no accident, property damage, or claim. Lesson learned: make no statements and don't take a field sobriety test.

Plus you can ask your blood to be drawn to test for the alcohol. You don't have to take your breathalyzer. That may take a while but once the results come as a negative, everything gets dropped.

Edit: You are not legally obligated to entertain a field sobriety test when an officer pulls you over. However, it is Illinois law that anyone who gets behind the wheel of a motor vehicle has given implied consent to testing.

Had a seizure 4 years ago and my right leg is still a mess . If I did the walk a straight line part I would fail . One cop messed up a ladies life because he decided her Canadian licence was not valid in his state ( so said the officer ) Have had two run ins with cops and did not take any of their BS and trick questions 😂 . One told me to sit in front of car in side of hiway . I laughed at him and refused . Had a few choice word for him and that was after he threatened to cuff me ! Some should not have badges and would probably do a crappy job doing parking enforcement !

The absurd time it takes for the blood test to come back is not incidental to the problem. It is the cause of the problem. Cops know that most people will end up taking a plea deal because they can't go 8 months with a suspended license and they need a car to work.
