      rather than coming to the crux, vinod punj's take away is success of the channel. Col Purohit was in jail for 9 long yrs, went through several coercion & tortures to admit the crime, which he never committed. This is well documented in this book & Mr Sibbal and P Chidambaram were at the helm of affairs

    Very fruitful discussion, I have myself experienced how conspiracy,false arrest can impact a person's life, one does not get a lawyer especially if you're poor to help and that false arrest not only affects the person but the lives of people associated forever damaging more lives.

    Something is rotten in the state Indian Judiciary. Where INDEPENDENCE of judiciary has become a shield to protect IMCOMPETENCE of judges. Today, our judges have become more executive minded then the executive. We need to have fiercely independent, morally upright and intellectually competent judges in Supreme Courts and High Courts to serve as role models.

      Judiciary has essentially become a new Jati. They marry each other, talk big things with each other, select each other to work in positions of powers under their authority. That’s the rotten thing. They tell us to be less castiest and they themselves have created their own.

      Our judiciary was never a completely independent entity, there is interdependence of all three pillars, also it is easy to sit and criticize a relatively powerless position in an authoritative regime.

    I agree gravity of offence can never be ground for denying bail, and cooperation also cannot be ground for denying. As far as accused does not interfere with investigation and tamper evidence and does not flee then the person is entitled to bail. To get remand police must tell to magistrate what police wants to do with accused. All interrogation must be in camera.

      when these provision of PMLA and Nyay samhita were not there; Mohd Atiq Ahmad, Mafia don, ex MLA & MP from UP got his first conviction for the FIR filed 40 long yrs back; would be happy, if they had address the lacunae of implementation of law there

    It is the most welcome stand I found from your discussion that every judge is referring to the higher judge for bail. It is a curse for the judiciary. Very very respect to all you legendary.

    To be honest, Mr. Rohatgi appears to be a man with good intentions at heart, with bonafide he became the attorney general during the first term of the government, but having seen what was coming in the next four years, he declined becoming solicitor or attorney general and went back to private practice. His legacy wouldve been tarnished by the cases Tushar Mehta is presently fighting for the government . But there are some invisible strings still at work on him. He appeared for the election officer in Chandigarh. Has anyone asked , how an election officer could afford Mr. Rohatgi to represent him when his fees is 10 lakh plus? Of course he was paid by the government to do damage control. But watching him come out on a neutral platform to say what he thinks is specifically wrong with the laws and the misuse of it speaks volumes.

    Respected degnatries, if a group of thoughtful individuals like you were apolitical, I believe India might become the most powerful nation on earth. You lose value if you align yourself with a certain political party.
    The moment has come, in my opinion, to take up arms against these political parties, whose influence has grown beyond our wildest dreams. Since independence, things have developed to the point where we have become obedient to these formidable forces.

What stopped you from amending the CRPC ? Would you like to publish the data regarding implementation of the Hon'ble SC directions in D K Basu, ( in letter and spirit) in the states where your party ruled ?

    Grounds of arrest should only be made in case of person committing a grave breach of law.
    Arrest & Bail must go hand in hand. Hence, bail must be mandatorily granted immediately after arrest.

    Bol Bachans. The primary problem is there is no time limit on the jurisprudence. Saying big things is easy for a person who is getting 60lakhs per day paid by a State Government. Good usage of public money.

    But opposition was more interested in boycotting the parliament rather than discussing the new law and that is the story in most of the new legislation brought in last 10 years!! Who is to blame for that?

    I feel that the constitutional benches should have the strength of 50% from eminent Sr. Advocates from Supreme court Bar and also a separate wing need to be formed with appointment of Addl. Judges only to dispose off the cases referred to constitution benches without any delay.

    Thank you it's a high time things n rule be amended also if petty matters be quashed at the complaint stage itself
    Sr officer hope goes through the diary everyday n is aware of the matter in its jurisdiction n keep an eagle eye on crucial / severe case matters also if I may suggest ever police station is clubbed together as our bank system where one deposits a cheque

    Sir ji, Frist chargesheets must be examined before the start of the case ie before going to एसडीजीएम it should be postmortem by one एडीजे,so that error of चारशीट्स must be removed
