As a Brazilian I would like to express how happy I am people abroad likes Brazilian Miku and making fanarts of her. It is one of the best things that went viral this year. But hear me out: how about Brazilian Doki?! Regarding Xitter I will just say our current situation with it is... complicated to say the least. I don't miss the drama and crazy people shouting at each other at all, but I do miss all the nice illustrations and vtubers being silly there. We found refuge in other places tho, like one with a bluer sky to enjoy some peace for the mean time.

I don't know about that Turkey case but from what i gathered on this Brazil case, he is defending very despicable people with some cause. It seems the judge issued a legally questionable banning order and went heavy handed when X asked the legal basis for the ban.
The thing with Elon was that he always liked to trashtalk and consciously manipulate the value of things like NFTs or Crypto Shitcoins. (even with his own brands like Tesla) The problem was when he tried to do the same with Twitter, tweeting about how he gonna bbuy the platform, but then regulators stepped in and were like "you said, you would buy the platform... now do it!" Otherwise it would be market manipulation. After that he tried all kinds of things to reduce the price or cancel the process alltogether, but to no avail. In the end it wasnt so mucha bout his ego, but more about him having way too long success with obvious market manipulation.

Explaning a bit of the situation: Earlier on in 2024, the Minister of our Supreme Court, de Moraes, demanded that X suspended a list of profiles that were deemed "a threat to democracy", "inciting public disorder and violence" and other such arguments, which were deemed related to a not so peaceful protest that happened in January 8th of this year, when voters from the opposition of our current government invaded the Congress and vandalized some symbolic items to protest the victory of the current President, which was deemed fraudulent by them. X refused, since those profiles weren't breaking the platform rules, while Musk himself spoke up to criticize it as a being against free speech etc. So during middle August, de Moraes doubled down and not only stablished a 20k BRS (4k USD) fine per day in which the demands were not met, but also ordered the arrest of at the time X representative in Brazil: Rachel de Oliveira Villa Nova Conceição, claiming she was acting on "bad faith" by avoiding to being subpoenaed by the Supreme Court. The fine would eventually be raised to 50k BRS (10k USD) per day. Musk responded by closing down the X office in Brazil, which led to the current predicament of banning X in Brazil for "lacking a representative", which is a law that gets enforced according to convenience. One thing to keep in mind is that de Moraes does not have a clean record: aside from plagiarism accusations regarding a book of his, and "informal parties" with members of the Senate in a boat right before being formalized into his position, he also made a direct attempt at censoring a news media providing evidence of one of his colleagues wrongdoing during our biggest "corruption cleanup" operation, but was forced to go back on his decision by major backlash. He also froze Starlink accounts in Brazil to pay for X fines, which is a highly unethical decision, based on the fact that those are separate companies, with different share ownerships, and should not respond legally in the stead of the other.
@@affegpus4195 No they aren't. X is directly owned by Ellon himself. Starlink is a subsidiary of SpaceX, of which Musk only has around 40% of the shares.
Things that you must consider: 1) Brazil's laws don't allow ANY foreign company to act directly in the country (and therefore, profit) without a legal representation in the territory. This way, the company can't evade due processes regarding labor laws and/or the payment of taxes. Earlier this year, Elon closed the Twitter/X office in São Paulo and fired all the Brazilian employees, including the legal staff. HE DID THIS ON HIS OWN, therefore, he forfeited his right to keep a profiting business here. If he wanted to keep things running, he just had to hire a local lawyer. 2) Brazil's laws regarding h@te speech, r@cism, homophobi@ and politic@l violence, although not perfect, are WAY tighter and better than USA laws. There is no such thing as "absolute free speech" and discourses have consequences here. Elon was ordered many times to remove posts and profiles that promote those h@teful speeches. He chose not to do so and also, not to pay the fees for not doing so. He was warned. 3) Brazil is a sovereign country and Musk, even with all his money, is just a person. He can't just go about thinking he's above the law in this country or any other. As far as I know, Brazil is not the only country he has problems with because he doesn't know his place in a society. 4) Musk's "Champion of Free Speech" act is but a façade and a lie, like many other aspects in his biography. Like all billionaires, he only acts in his own self-interest and follows an agenda for his own benefits. Under his ownership, Twitter devolved into a cesspool of hate, bigotry, stupidity and mass manipulation. Whoever supports him thinking he gives a damn about you, know that you've been played like a fiddle. I am absolutely GLAD Brazil is finally resisting against the greedy and deceitful designs of that awful man.

1) This law doesn't apply to companies completely outside of Brazil having only services on the web. If that was a thing more than 90% of the internet would have to be banned. 2) Even though we have laws against slander, defamation and hate speech, none of them were used to back up the bans, in fact no laws were provided by the supreme court. You could also argue that they banned the accounts because of "fake news", but no laws to regulate them were approved. Judges also cannot ban whole accounts, they have to only ban specific contents (posts). The decisions violated both 220th article, 2nd paragraph of the Federal Constitution and the 19th article, 1st paragraph of the Brazilian Civil Rights Framework for the Internet. 3) Again, the bans are illegal, so Twitter didn't infringe any laws.

X was banned because they didn't had any legal representative on Brazil since the one they had resigned due to pressure of seizure of their bank accounts and prison and that's illegal, there was now broken law aside from this, and they're going way beyond with this, seizing Starlink assets too, the market is already reacting to this.

Brazilian laws are clear about the right of the defense and resources so the defense can work with the case, any kind of judgement and punishment without following those are considered tyranny by the Constitution. Under the hate speach law, some people that after fair trial ended up being banned, were unbanned by twiter personel, X was repeatedly inquired about this, but X never really did anything about it. Another thing is, statistics showed that twiter favored right leaning midia, wich violates our election law, so X was again inquired. The response of Elon was takin away their representative, meaning this could not be cleared up, or resolved. And as such, per the special datings in electoral law, alexandre de moraes sent the inquiry to send a representative or the services in Brazil would cease, since there would be no representation and X had violated brazilian law. If the law should be something different, then it doesn't matter untill those laws are modified, since brazilian law isn't made based on jurisprudence, the judge have only confered power based in those laws. Elon is very much in fault, for challenging the brazilian laws and norms, and is only getting consequences based on the law, wich was re-created after dictatorship in orther to protect the people, and as such, "standing against this constitution is the act of t hightest treason agains Brazil. First, just to make it clear, Elon doesn't care about free speech, he has accept harsher demands made by Turkey's president against his political opponents. Second, the Supreme Court isn't doing this because the elections are close. This is the culmination of a far longer process, that started about as far away from elections as it could. Third, the ban of the social media is a direct response to Elon firing his twitter employees in Brazil, including all of his legal teams. By the Brazilian constitution, foreign companies are required to have legal representation in the country in order to conduct business there. Since X has been disobeying legal demands (even ones they themselves said they would implement), it's clear Elon just refuses to cooperate, and thus a drastic measure has been taken in response. Would you rather foreign companies just be allowed to disobey Brazilian laws at their whim, like Elon was trying to do?

The judge is almost definitely corrupt. But Brazil has hate speech laws on the books, so it's totally legal for it to order content to be blocked or removed. Just like any content host would be if a court un Germany ordered a swastika posted by a German to be removed, same goes for Brazil and Brazilian posters. The existence of hate speech laws is one of many reasons why companies like to have hate speech be against TOS, because it covers their ass in terms of liability. Elon however only considers the word "cis" to be legitimate hate speech.
I'm brazilian but I don't really use twitter anymore, but like... don't people know what a vpn is??? The same day twitter was banned I wanted to see a specific tweet about some stuff that I was looking at, then when it wasn't loading I remembered the ban, and it took me like... 10 seconds and tree clicks to activate a vpn and see the tweet I wanted to see and carried on with my life, through out all of the shitshow that was the whole story behind the ban situation I never really cared for it me being a twitter user or not because VPNS EXITS PEOPLE!
Yea, VPN exist, but that weeds out 90% of the internet population. You're overestimating how tech illiterate or lazy most people are. Also, on top of that, there was supposed to be a fine for using X with a VPN of 8k usd per day (more than most people's annual income here). That part got scrapped because of backlash, and was mostly a threat, but it still puts to perspective how fucked up the intention of this ban is

Anyways, if you aren't making posts you probably won't be fined even if you access it with vpns.

Regarding Xitter I will just say our current situation with it is... complicated to say the least. I don't miss the drama and crazy people shouting at each other at all, but I do miss all the nice illustrations and vtubers being silly there. We found refuge in other places tho, like one with a bluer sky to enjoy some peace for the mean time.

I don't know about that Turkey case but from what i gathered on this Brazil case, he is defending very despicable people with some cause. It seems the judge issued a legally questionable banning order and went heavy handed when X asked the legal basis for the ban.
The thing with Elon was that he always liked to trashtalk and consciously manipulate the value of things like NFTs or Crypto Shitcoins. (even with his own brands like Tesla)
The problem was when he tried to do the same with Twitter, tweeting about how he gonna bbuy the platform, but then regulators stepped in and were like "you said, you would buy the platform... now do it!" Otherwise it would be market manipulation. After that he tried all kinds of things to reduce the price or cancel the process alltogether, but to no avail.
In the end it wasnt so mucha bout his ego, but more about him having way too long success with obvious market manipulation.

Explaning a bit of the situation:
Earlier on in 2024, the Minister of our Supreme Court, de Moraes, demanded that X suspended a list of profiles that were deemed "a threat to democracy", "inciting public disorder and violence" and other such arguments, which were deemed related to a not so peaceful protest that happened in January 8th of this year, when voters from the opposition of our current government invaded the Congress and vandalized some symbolic items to protest the victory of the current President, which was deemed fraudulent by them.
X refused, since those profiles weren't breaking the platform rules, while Musk himself spoke up to criticize it as a being against free speech etc.
So during middle August, de Moraes doubled down and not only stablished a 20k BRS (4k USD) fine per day in which the demands were not met, but also ordered the arrest of at the time X representative in Brazil: Rachel de Oliveira Villa Nova Conceição, claiming she was acting on "bad faith" by avoiding to being subpoenaed by the Supreme Court. The fine would eventually be raised to 50k BRS (10k USD) per day.
Musk responded by closing down the X office in Brazil, which led to the current predicament of banning X in Brazil for "lacking a representative", which is a law that gets enforced according to convenience.
One thing to keep in mind is that de Moraes does not have a clean record: aside from plagiarism accusations regarding a book of his, and "informal parties" with members of the Senate in a boat right before being formalized into his position, he also made a direct attempt at censoring a news media providing evidence of one of his colleagues wrongdoing during our biggest "corruption cleanup" operation, but was forced to go back on his decision by major backlash.
He also froze Starlink accounts in Brazil to pay for X fines, which is a highly unethical decision, based on the fact that those are separate companies, with different share ownerships, and should not respond legally in the stead of the other.

Things that you must consider:
1) Brazil's laws don't allow ANY foreign company to act directly in the country (and therefore, profit) without a legal representation in the territory. This way, the company can't evade due processes regarding labor laws and/or the payment of taxes. Earlier this year, Elon closed the Twitter/X office in São Paulo and fired all the Brazilian employees, including the legal staff. HE DID THIS ON HIS OWN, therefore, he forfeited his right to keep a profiting business here. If he wanted to keep things running, he just had to hire a local lawyer.
2) Brazil's laws regarding h@te speech, r@cism, homophobi@ and politic@l violence, although not perfect, are WAY tighter and better than USA laws. There is no such thing as "absolute free speech" and discourses have consequences here. Elon was ordered many times to remove posts and profiles that promote those h@teful speeches. He chose not to do so and also, not to pay the fees for not doing so. He was warned.
3) Brazil is a sovereign country and Musk, even with all his money, is just a person. He can't just go about thinking he's above the law in this country or any other. As far as I know, Brazil is not the only country he has problems with because he doesn't know his place in a society.
4) Musk's "Champion of Free Speech" act is but a façade and a lie, like many other aspects in his biography. Like all billionaires, he only acts in his own self-interest and follows an agenda for his own benefits. Under his ownership, Twitter devolved into a cesspool of hate, bigotry, stupidity and mass manipulation. Whoever supports him thinking he gives a damn about you, know that you've been played like a fiddle.
I am absolutely GLAD Brazil is finally resisting against the greedy and deceitful designs of that awful man.
This so hard, the fact that Twitter was warned repeatedly for refusing to follow court orders before being banned is left out of much of the discourse lol
1) This law doesn't apply to companies completely outside of Brazil having only services on the web. If that was a thing more than 90% of the internet would have to be banned.
2) Even though we have laws against slander, defamation and hate speech, none of them were used to back up the bans, in fact no laws were provided by the supreme court. You could also argue that they banned the accounts because of "fake news", but no laws to regulate them were approved. Judges also cannot ban whole accounts, they have to only ban specific contents (posts). The decisions violated both 220th article, 2nd paragraph of the Federal Constitution and the 19th article, 1st paragraph of the Brazilian Civil Rights Framework for the Internet.
3) Again, the bans are illegal, so Twitter didn't infringe any laws.

Brazilian laws are clear about the right of the defense and resources so the defense can work with the case, any kind of judgement and punishment without following those are considered tyranny by the Constitution. I am willing to think you made this as a honest expression, so i will send a very quick resumen of the case.
Under the hate speach law, some people that after fair trial ended up being banned, were unbanned by twiter personel, X was repeatedly inquired about this, but X never really did anything about it.
Another thing is, statistics showed that twiter favored right leaning midia, wich violates our election law, so X was again inquired.
The response of Elon was takin away their representative, meaning this could not be cleared up, or resolved.
And as such, per the special datings in electoral law, alexandre de moraes sent the inquiry to send a representative or the services in Brazil would cease, since there would be no representation and X had violated brazilian law.
If the law should be something different, then it doesn't matter untill those laws are modified, since brazilian law isn't made based on jurisprudence, the judge have only confered power based in those laws.
Elon is very much in fault, for challenging the brazilian laws and norms, and is only getting consequences based on the law, wich was re-created after dictatorship in orther to protect the people, and as such, "standing against this constitution is the act of t hightest treason agains Brazil.

First, just to make it clear, Elon doesn't care about free speech, he has accept harsher demands made by Turkey's president against his political opponents. Second, the Supreme Court isn't doing this because the elections are close. This is the culmination of a far longer process, that started about as far away from elections as it could. Third, the ban of the social media is a direct response to Elon firing his twitter employees in Brazil, including all of his legal teams. By the Brazilian constitution, foreign companies are required to have legal representation in the country in order to conduct business there. Since X has been disobeying legal demands (even ones they themselves said they would implement), it's clear Elon just refuses to cooperate, and thus a drastic measure has been taken in response.

The judge is almost definitely corrupt. But Brazil has hate speech laws on the books, so it's totally legal for it to order content to be blocked or removed. Just like any content host would be if a court un Germany ordered a swastika posted by a German to be removed, same goes for Brazil and Brazilian posters.
The existence of hate speech laws is one of many reasons why companies like to have hate speech be against TOS, because it covers their ass in terms of liability. Elon however only considers the word "cis" to be legitimate hate speech.

The same day twitter was banned I wanted to see a specific tweet about some stuff that I was looking at, then when it wasn't loading I remembered the ban, and it took me like... 10 seconds and tree clicks to activate a vpn and see the tweet I wanted to see and carried on with my life, through out all of the shitshow that was the whole story behind the ban situation I never really cared for it me being a twitter user or not because VPNS EXITS PEOPLE!
Yea, VPN exist, but that weeds out 90% of the internet population. You're overestimating how tech illiterate or lazy most people are.
Also, on top of that, there was supposed to be a fine for using X with a VPN of 8k usd per day (more than most people's annual income here).
That part got scrapped because of backlash, and was mostly a threat, but it still puts to perspective how fucked up the intention of this ban is

@@srsrerror7761 while that technically is the case, it's questionable whether the brazilian government has the infrastructure to properly track vpn usage and access of twitter, never mind whether that fine will actually be enforced in any cases but extreme ones. Anyways, if you aren't making posts you probably won't be fined even if you access it with vpns.

He made it very clear in his own tweets that this happened because he didn’t like the supreme judge of Brazil due to being a corrupt official who is demanding to censor Twitter

Look dude, the thing about Elon standing up to a censorious judge is incredibly obvious BS when you see how he rolled over for India and Turkey literally just demanding their dictators’ political opponents be censored off Twitter. He agreed to do it and justified it by saying “it’s either that or Twitter gets banned in those countries, what do you want?”
The Brazilian judge asked for 7 right-wing accounts pushing disinformation to be restricted, and Elon pitches a fit. India and Turkey demand left-wing political opposition be censored, and Elon is happy to comply. Elon’s politics aren’t complex or nuanced - he’s just a shill for the far right.
