He knows the horse he is dealing with. If anything, at horse college - they tell us to stand close to their behinds especially when doing things like this, brushing or cleaning their private areas, you press against them or stand close to them. This man knows what horse he is dealing with. If it was sensitive and aware of its back legs, he wouldn't go as close.

Horses kick if something surprises them from behind, but that horse knew that the man was there and so far he hasn’t been scary.

I'm not so sure this is not a trained horse. The guy flails his arms when he's talking, to an untrained horse, that would freak the horse out.
Seriously! For a horse that has never had a saddle on, that horse would not be okay with being girthed up AND hard tied.
