Jury Duty- Why they ask questions

  • The panel of people who are brought in for jury duty are not automatically assigned to a case. There is a 'deselection' process - in other words those who are seated at the front of hte group will most likely become the jury for that case unless they are stricken by the judge or attorneys. To decide who is excused from further participation the attorneys for each party in the case ask questions of the group and of individuals. That process is called the voir dire. In this video Michelle goes over this process & what the attorneys are trying to find out from the jurors.

    first time going to jury duty today and i was chosen as a juror!! im 21 years old and im sooo nervous for tomorrow >.

    I'm 52 and I have been selected twice for a jury panel and in both cases(criminal) during voir dire I was excused for cause. I don't have any convictions but I have been arrested for felonies in the past. I have also testified as a witness in two criminal cases; one being the victim. For some reason attorneys seem to find me at odds etc... lol Now I have been selected again and I expect the same result if I am selected for a criminal case. Despite the financial hardship, travelling in Los Angeles county during peak times will make this a miserable experience if I am actually asked to report to the courthouse. Thank God they have daily call in so my days aren't completely wasted if they don't need me that day.

      Thanks for sharing @John - It seems your status as a crime victim could play into the decision to strike you more than arrests which should not be considered. Let us know how it goes this time.

    My uncle is a superior court judge in a neighboring county in California--they always send me home, but then summons me back. Very annoying and inconsiderate of the court.

      Agreed- seems they could keep track of those things to not waste everyone's time. Please try calling in next time- at least to try to save the drive. Maybe your uncle and the other judges can work on this?

      HI @Rajwant You will be fine- if you are included on the jury and have any problems with words please ask the bailiff and he or she will help you.

    usually one shows up at the courtroom and soon the Ballif just say that the case has been settled out of court and you can go home.

      You'll be fine- just like a field trip when you were a kid in school- some place new to discover. If you think you want to try to get on the jury then maneuver up to the front of the group- those seated in the first 2 rows in the jury box (if they use it) or in the front of the room are the ones that will be on if strikes aren't used against them. If you've got a conflict with the days they will have the trial be sure to speak up!

    Thank you for the informative videos? Does the jury get the certified transcript or an audio recording from the hearing to review during deliberation? I just want to make sure I don't miss any information during the hearing. Would you recommend writing notes during the hearing?

      Hi Rosemary - happy to help. If you are interested in taking notes during the trial you have to get permission from the judge in advance. When the case is given to the jury to decide- you only get the jury instructions automatically. Anything else that you want to review or 'see' again you have to ask. The trial transcript is not done in 'real time' so you are only going off of your memory and impression of the witnesses and evidence.Great questions - some of this was covered in the Jury Duty #1 video in the FinelyRevealed jury duty playlist - so go there to see that video for more info.

    Potential jurors have been arrested for giving the 'wrong' answer so I recommend not answering any questions. You have a duty to render a verdict, not to answer questions from bozos.

      To clarify for others who may see this- the questions discussed in the video are during the voir dire process- BEFORE the jury is seated and the case has begun. There are not any questions asked of you once you are empaneled and sworn in as a juror except the jury verdict forms at the end. Except only for the occasional questions about time to start the trial, lunch and mundane things like that.

    If you don't want to do jury duty, can you refuse to answer questions?

      HI @Robert Don't be uncooperative - no need to stress. Sit in the back - answer the questions etc. Those in the front row will be on the jury. Enjoy and remember the process in the event you are ever in need of a jury trial for you or a family member!

    I have a question i just call the number on the reporting instructions and told me that o don't have report on the date the court gave me am I done with my jury duty service or not? Also if don't need to report do i need to go to the court to give my summons or not thank you.

      Hi Rythum- first you don't need to go at all. Second most places have 'one day' counting as service so since this was sort of a 'false start' then it won't 'count'. But- the way they pull names yours won't likely come back again for awhile.

      Except for the specific questions described as to whether anyone had prior jury duty service - whether they came to a verdict- had any problems in that process you are right 024DJF! The video covered the reason behind the individual questions (which vary based upon the facts of the case and type of case) and references the questionnaires given to each prospective juror and gives the subject matter that will be covered by various questions. New video coming.. :)

    The judge and prosecutor will barrage you with lies like 'they are only wanting to be fair' and that you are required to do this and that including rendering the verdict the judge tells you to.

      Don't be nervous - watch the other vids in our jury playlist and you should be fine. It's an inconvenience for everyone who is called. You'll likely just go in that morning and be done by lunch! Once you've served you are finished and can't be called for a year and depending upon where you live may never be called again.

    The US does not have an official language. And unless they changed the law since I took the test a handful of years ago, you *can* take the citizenship test with a translator. (just FYI)

      English Language ExemptionsYou Are Exempt From The English Language Requirement, But Are Still Required To Take The Civics Test If You Are:Age 50 or older at the time of filing for naturalization and have lived as a permanent resident (green card holder) in the United States for 20 years (commonly referred to as the “50/20” exception).
      ORAge 55 or older at the time of filing for naturalization and have lived as a permanent resident in the United States for 15 years (commonly referred to as the “55/15” exception).
