RGT 85 looks stupid here. On what grounds can Nintendo Sue Soulja Boy? Soulja Boy doesn't manufacture the products, and Nintendo knows it can't win any suit against a chinese hardware manufacturer, or it already would have done so year ago. The products are drop shipped, so Soulja Boy isn't a retailer. Even the Souljawatch site uses Shopify for its ecommerce engine. Soulja Boy doesn't own that either. Soulja Boy more likely than not simply signed a licensing deal for the use of his name and likeness, which he fully has a right. With the success of the Nintendo Classic hardware systems, they would struggle in court to prove any losses due to these products. RGT 85 doesn't know what he is talking about, but hey, he's getting views.

I'm not a businessman either, but I can do simple math. Soulja marked up a $100 Chinese console and is selling them "on sale" for $150. That's a 33.3% profit. $5 million in sales = $1.67 million in profit--even less when including his own costs. Nintendo settled with the ROM site for what, $12 million? I'm guessing he's going to lose 8 figures because of this, minimum. He doesn't need a PR guy, he needs a bankruptcy lawyer.

However since this is Soulja Boy literally making a profit off of selling some of Sega's game without permission, I don't think they will take this lightly. Nintendo on the other hand love to take people to court. Majority of the time they have the right to do it but at some point they should take a chill pill once in a while. I think the CD-I licenses scarred them too much.

Nintendo is the IRS of gaming. They WILL find you at any cost.
In order to maintain a copyright you have to protect it if you stop fighting peoples use of your copyright material you lose the right to claim it as copyright. This is something Nintendo does way better than most other businesses in the industry. They know they have to fight every ROM and other "misuse" of there copyright so they do; its worked quite well alot of gaming companies have actaully lost the rights to their own games by allowing them to enter the Public Domain, Nintendo on the otherhand have actaully managed to maintain a high percentage of their IPs copyright status by fighting so ruthlessly to defend them. I believe in that respect they are considered the Industry Leaders.

You are missing one point... Why would the sue him... yet? They will wait for him to make more money - and THEN sue him for copyright infringements... The more money he makes, the more they will get when they sue him. Just wait and see! LOL
Nintendo will sue him as soon as they can. If they do not they will lose their own rights. That is how trademarks work, if you don't defend them, you lose them. And during that, they will bring a separate suit to defend their copyrights. All of those cases where you have heard about a company waiting to sue to get more money, yeah, it doesn't work like that. It only LOOKS like they waited, but they were gathering a case together, dotting all the I's and crossing all the T's.
Right now, as we speak, there is a legal team working overtime to put together their case in such a way as it cannot be defeated. We will know when things have gotten real when an injunction is filed to halt the sales of the products, which will definitely be approved, and Mr. Boy will have to comply. At that time he will realize what he has done and he will have much regret.

They could give him permission today to sell the consoles and yank permission a month down the road and he'd need to stop selling the consoles a month down the road. You don't lose trademark or copyright protections simply by not enforcing them at every turn and you are quite free to enforce as you see fit without losing protections afforded to you by either. So maybe you should learn a little bit about law Daniel instead of spewing absolute garbage from your mouth. Copyright and trademark law are something that is always up to the rights holder to enforce as they see fit and you don't simply lose the license by not enforcing in all instances.

All of the companies that he has violated HAVE to respond in some way, through a court system. Copyrights have to be defended or you lose them. So if they do not go after him for this, they are, essentially, giving him permission. He is pretty screwed right now, he just doesn't realize it yet.

In THIS case it's not a card, it's the facts. Is he wrong for selling the consoles? Yes. But just like with disparity in sentencing (black males getting harsher sentencing for the same crimes whites commit), or the harsher punishment in school for black students over white students, all these white UA-cam channels are 100% bitching about Soulja boy because he's black. Whether they wanna admit it's racism or not, whether it's conscious or subconscious. That said Soulja boy is a dumbass and he's definitely got it WRONG when he talks about the legality of the console. It would be the craziest plot twist if it was actually true though.

I hadn't heard of Soulja Boy before this fiasco. At first I thought it was just kind of a funny thing he was doing and that it'd blow over really fast due to all the copyright issues. However seeing these tweets makes me realize I don't want to know anything else about Soulja Boy. Based on his own words he is obviously a bigot and based on his actions he doesn't respect other people's hard work and rights to their intellectual property. At this point I'm cheering for Nintendo to come and humble him a bit.

freedustin - Paid for console with included “free SD card with rom” is still a violation of copyright law. It’s in the name “copy” not sell, profit etc. The violation is the act of copying it. Copy a movie and give it away. You’re still committing a crime.
