- Wow. So Yuzu completely folded. They didn’t try to fight it. They just rolled over and gave up. They agreed to pay Nintendo $2.4 million. And that’s a huge blow to emulation.
But I found another company that Nintendo needs to go after. This company has habitually enabled piracy by selling products that are compatible with Nintendo’s own software and that enable wanton emulation of Nintendo’s own games. Not only that, but the availability of these products entice users to commit piracy. I mean, as we all know, EMULATION IS NEVER ACCEPTABLE. It says so right here. On Nintendo’s own website.

So what company would so brazenly violate Nintendo’s hardline stance against emulation and sell a device that enables end users to emulate Nintendo games?
Nintendo, of course.

Nintendo 64 didn't make enough games, specifically N64 didn't make enough 3d platformer titles for kids growing up in the 90s.
Nintendo deserves to be pirated at this point. Legacy doesn't mean you can be as anticonsumer as you want with no recourse. That's a damning sign of a corporation with waaaay too much pull. I pay for every single game I play, always have. But at this point I almost feel like it's my due diligence to send a message.
Legally only a museum or an official archivist can have a copy for preservation purposes. You do not have the right to do so, in fact you can only have back ups of games you personally own. And you cannot use that back up for any other purpose such as playing it using an emulator. Also you must get rid of any back ups of games you sell or don't own. These are current rules regarding game ownership according to US law.

The problem is that Nintendo is one of the few AAA companies that are still making fun single-player games. That kind of behavior needs to be rewarded. We need to vote with her wallets to get quality games.

After the claim was filed, I realised that Nintendo has never explicitly referred to their retro game rereleases on NSO/VC/their Classic Edition microconsoles as “emulation”. And now I see why-they’re framing emulation itself as this blanket term for circumvention, piracy etc. and labelling all of it unlawful while painting their own offerings as something different, something lawful. I wouldn’t be surprised if they see emulated versions of NES games on VC as Wii U games, or on NSO, as Switch games (“the Wii U/Nintendo Switch release of Super Mario Bros.”). They want to frame their emulated titles as native games and fan emulation as this unlawful menace consuming their property.
This is tangentially related to the REAL reason why they’re going after emulation that isn’t theirs, which you raised-it disrupts the watertight control they would otherwise have on supply of their games, which enables them to keep being IP landlords keeping rent high on empty houses while people are without a house on the streets. Emulation is the only true alternative for long-term preservation, but it’s the only one that doesn’t benefit Nintendo’s business strategy-even scalpers reselling at obscene prices benefits them by raising prices and making their official releases look more desirable in comparison.
Ultimately, Nintendo’s approach to its older offerings is all about restrictiveness and control, and that hasn’t changed. And this victory, even if it doesn’t set legal precedent, may have just emboldened them to go after more emulators.
On that note, however, I would have a little consideration for the litigants in question. Tropic Haze had a good reason to fold and go for a settlement given how much was at stake financially and how much less prolonged and tedious things could’ve been for them compared to months of exhausting litigation. Them “surrendering” was a choice they opted to make in light of their financial situation and resources in comparison to Nintendo-and if they did “roll over”, I don’t think they were blameworthy to opt for that choice.
If Nintendo wants to sue people profiting from emulation, or copyright violations like unauthorized sharing (which are very different things), they should sue themselves. Out of everyone in the world, the entity making the most profit from those things ... is Nintendo. They sell emulators and ROMs, including ROMs they almost certainly downloaded from pirate sites, complete with the headers and signature from the fans who originally created the files. Their emulators are almost certainly using code written by the emulation community. And whenever software "piracy" has been studied, results showed that it tends to increase profits for the copyright owners, not decrease... because it effectively functions as free advertising or a gateway drug.
Basically, Nintendo is making a pretty significant profit from the efforts of the emulation community. And to thank them, Nintendo steals what their fans built, sells it, and sues the people who made it. I can pretty much guarantee that in 10 or 15 years, Nintendo will sell a Switch emulator built from Yuzu's code. They won't publish the code even though the open-source license requires it. And they won't be taken to court for their crimes, because the authors won't have the resources to fight back.
@@ToyKeeper Oh, Nintendo has definitely taken it a step further on that front before, even if they haven't explicitly admitted to it. Remember when they hired PIs to stalk 3DS hackers and essentially blackmailed them into working for them to avoid a lawsuit? Nintendo knows how potent fan emulation and its developers are-why else would they feel so threatened by it? It's not profit from emulation in itself that Nintendo is opposed to, as the video here lays out well-it's the disruption to the tightly restrictive system of control over availability, pricing and demand that they want to have, which they're enforcing by way of their proprietary rights.
The lack of sense in going after "piracy" and other oddities of this copyright system definitely come of the incongruencies of applying the mindset and regime of a real-property landlord to digital property like video game software. Not that landlords were all that loved in their own sphere to begin with...

It's not the first time corporations have used public emulators themselves.
I think Sony did that for it's mini Playstation console launched a few years ago.
It's virtually guaranteed that, at some point in the next 20 years, Nintendo will sell at least one emulator based on Yuzu's code. And they won't publish the sources, despite legally being required to do so. And nobody will take them to court for it, because it's too expensive. And Nintendo won't even feel bad about it.
Part of the settlement was that yuzu had to hand over all of their data.. it's Ninuzu now.
@@JeremyPaulStilesIt's published under a GPLv2+ license, so the entire world has the right to use the code, modify it, sell it, make derivative works, etc. Nintendo had that right regardless of whether they owned the copyright, and so does everyone else.
I share your sentiment Gardiner! I will never give Nintendo another dime until they change, and they will have a hard time winning me back. I have gone from absolutely loving their software and hardware, to absolutely despise the company.
The amount of four letter words I have for the Eggheads at Nintendo is simply astonishing...
Luckily for them I have the entire Yuzu and Citra repo and source code including all sub modules required for a compilation, and all of the APKs and OS specific binaries.
The Yuzu/Citra team may be gone, but their project will never be erased from the internet. Nintendo knows this however, and their objective was simply to get it off of the mainstream and discourage any future large-scale emulator development.
The whole legal issues with the patreon and tears of the Kingdom working before it was officially launched is another story entirely, but I was sad to see this happen and furious with Nintendo.
So will you put those things online again? Or give it to someone who will?
the yuzu emulator didn't work with TOTK before launch until someone unconnected with yuzu made a patch and as far as I'm aware yuzu never directed people to said patch.
I really hope for Nintendo's sake that they never ever used any GPL software. And if they did, they published the source code. They wouldn't violate a software licence and steal other people's hard work, right? So... what OS is this little emulation box running on and where can I obtain the source code for it again?

BTW Sega, Atari and SNK in example are selling ROMs tied with an emulator in Steam.

even CAPCOM sell their old mega man games emulated on steam, many companys does it.
As a general advisement to people, please be mindful of the countless forks of Yuzu that are going to be popping up. When Vanced first got struck down, some of the spiritual successors were straight up malware preying on the excitement that 'the movement lives on.'

It sure would have been for the better if Microsoft just gave up after their first try though. Because if one company has made both console and PC gaming worse it's them.
But the cannibalising of SEGA is really in the end on them. SEGA got involved with Microsoft long before they eventually suffered the consequences of it.

What it was referring to though was actual innovation or improvement, and of course in the context primarily to the console space. Not secondary happenstance backfires from greed or corruption. I.E: Nintendo creating Playstation was most likely not the intent of Nintendo.
Nintendo sell roms now there's an idea that would actually solve everything 💯
That'll definitely help in the long run but piracy will still attempt to go after those roms because of Nintendo's prices. Some people cant afford to pay the price Nintendo gave them.
They already do sell roms. In some cases, the roms are bit-for-bit identical to the ones available on p2p sites, even including the header and signature from the fans who originally dumped and uploaded the cartridge. The community wrote the emulators and built the rom libraries, and Nintendo thanked them by suing them, taking what they made, and reselling it.
I keep forgetting about that! Nintendo is a hardcore emulating hypocrites! They hate emulators, but they made a SNES mini to emulate! Bro they need to go out of business. & it sucked that most fans don't see an error behind all this. 😓
If they can't change with the times it comes to reason they should stop. They have been around since 1889, they have had a good run... might be time for that company to just quit.

Yuzu runs games with a fraction of the load times compared to the Switch.
What they should have done was release a special dock with a GPU, extra ram, extra storage, and processing power built in.
Call it...the Switch Pro Dock. It would at least double the performance of the Switch when at home.

I love this takeaway. Piracy is a service problem. I quit downloading music once I got spotify. I quit downloading movies once i got netflix. Now i'm being nickel and dimed to death and looking forward to sailing the high seas.
I stopped pirating Microsoft Office once I found LibreOffice.
I stopped pirating all but the oldest PC games once I signed up for Steam.
I stopped pirating Windows because I moved to Linux Mint.
The movies and TV shows never stopped, but just became rare as there wasn't that much I wanted.
Music has always been rare, as the vast majority of what I listen to was free to begin with (Go, Demoscene!), so no need for piracy or streaming.
id argue the way things ended is for the best, since settling out of court means no legal precedent has been set. challenging this in court and losing (which was a fair possibility even despite the bullshit accusations) would have been enough to justify nintendo in pursuing pretty much every single other emulator for their older systems
there's already a new version of yuzu out there. 6 replacements actually.
Let’s also not forget that they’re still charging launch day prices for launch titles or titles that came out early in the Switch lifecycle.
I grew up on Nintendo… it’s angers and saddens me to see them continue to abuse the market they had a hand in creating.
On the one hand I would love to buy Nintendo games and directly copy the ROMs onto my Steam Deck but their policies towards someone like me (no console = a pirate despite buying their games) makes it so easy to fly the black flag for their titles. Not that I do that, mind you, I only do it on the up and up.
On of the reasons why I still don't have super smash bros is because I'm a broke ass kid that can't justify 60 dollars on a single game.
Question: legitimately I've never gotten why people get mad about charging full price for games that came out years ago. It's a videogame not a load of bread breath of the wild will still run and play just as well as it did on launch day.
Keep in mind I think games are too expensive so I buy used games or games on sale.
Dropped the Switch like a bad egg when the Steam Deck came out and not looked back. 😊

They know emulation's the key to future backwards compatibility and hoping to ban fair emulation, want ancient games to be making them money forever.
That's all it's about. Plenty people paid multiple times over for some games since the c64/NES days-- we should be free to emulate them wherever and however we want.

The real question here is how many times can they get us to buy Super mario bros 3 before the market collapses?
Meanwhile, the market is flooded lately with cheap emulation boxes which offer a fantastic user experience and include the majority of all retro games ever made, and the ability to easily add more. Thanks to the efforts of countless people in the community, it's not even hard to build one. Take almost any standard hardware, add a screen and buttons and storage, install some open-source software, and add a copy of some nicely-curated game libraries... and the result is a lifetime worth of great games in a slick package, far better than any "virtual console" Nintendo ever produced. And you can get all this for $50 or less. Or even just do it on a device you already have, for free.

What you're describing has been possible for many years and isn't the point; they just took a big step towards taking the whole of private game emulation out of the picture looking forward, no matter what you own or paid up for.
For now yuzu looks like an outlier but they're looking to set a precedent, and others have already abandoned their own emulators in response.
@@interlace84I'd like to set a precedent. Copyright law badly needs a complete overhaul, shortening the time before works fall to public domain. Given how fast the world moves now, even 20 years seems like it might be a bit too long. And software patents should be even shorter, like maybe 5 years.

When I leaened about Yuzu shutdon I immediately cloned source code outside of Github and placed it in my private instance with the description "f u Nintendo, I'm in Russia, sue me xD".
Hope Suyu will get more coverage and stable development team to continue providing good emulation of Switch.

Based video. Yuzu also did their fair share of bullsh*t in this matter, but Nintendo claiming to fight piracy, but really just fighting emulation, which they do themselves, without any actual hit to piracy is just weak and stupid.
But you know, at least Yuzu did not lost in court. Because this would be even worse for the entire emulation world. This settlement is probably the best realistic outcome, other than Yuzu flatout winning over Nintendo, which they don't have the money for probably.
Adding to the moral authority stuff, I actually bought TotK, Legends Areceus, and Luigi's Mansion 3 (as well as some 3rd party switch exclusives) specifically to play them in Yuzu. I did this because Nintendo's games, while flawed, are still usually pretty fun, and I wanted to play them. However, I cannot play them on Nintendo's hardware, because using analog sticks hurts my wrist due to an RSI (I think; it hasn't been diagnosed) that the constant resistance from analog sticks trying to snap back to center when using them aggravates. Yuzu was a great workaround for this, since I could play Nintendo's games on my PC and use a Steam Controller configured to trackpad movement, meaning all I had to do was rest my thumbs on the pad to move without pain. But Nintendo's suit has taken this option away from me. As a result, I'm faced with either experiencing pain to play these on my Switch, or the games (which I actually paid Nintendo for) are now paperweights. This whole experience has severely soured me against Nintendo. Nobody wants to buy software that's going to brick itself, and now I have to accept that for me that will always be the case for Nintendo
They can't delete Yuzu out of your PC, you still have it. And if you need updates, you can get a fork version of it like Pineapple EA.
Good on you. Keep playing games on the hardware you want to play on. Because you paid, You are morally entitled to do so. Don't listen to what Nintendo or Nintendo fanboys think.

You can still easily access to the Early Access version of Yuzu. It works well. otherwise there's always Ryujinx that works well! so keep enjoying your games as you please

I have been gaming since 1975 and have a library of games and consoles going back that far, including NeoGeo. And I have no issue with people filing their mini consoles with ROMs.

This is exactly what I've been saying for awhile. If they want me to come back as a fan, they need to start selling emulators and their games on other platforms.
That intro got me thinking...In their stament Nintendo said that emulators allow people playing games on hardware that the games were not designed for. But...isn't the whole array of "arcade" games in nintendo's store doing the same. I've herd that they even use the same rom files as the pirated roms.
Like that time Nintendo got caught downloading roms to supply their Virtual Console content on the Wii. 😂
I fully support Nintendo wanting control, it's their product, they can do what they want with it. However, by not offering a solution to play content, they inevitably bring piracy onto themselves. People want your content, and if you don't give them an avenue to get it, they'll find their own. I'd even go as far as saying that Nintendo is ok with piracy on their old content, because they have no desire to make it available any other way.
Emulating a currently available console is why Nintendo is cracking down. They weren't going to make billions on snes roms, so it's not as critical.
Disclaimer: I'm not a lawyer and this is not legal advise. While you make good points I suspect that there will never be a successful anti-trust lawsuit against Nintendo. It would take a person/company with massive financial backing who's also willing to battle Nintendo for years with an expert legal team for a chance of winning. While I am disappointed that Yuzu's developers settled it was probably a far more pragmatic decision for them. It's easy for us to say that they should have stood their ground because we aren't the ones that would have to secure the funds for legal expenses and we aren't the ones that would have to deal with potentially years of the psychological impact that comes with a lawsuit. Also imagine what would happen if they lost: not only would it ruin them financially but it would set a new legal precedent that would make it even easier for Nintendo to go after other emulators.
AMD and Intel are also enablers for emulation.
Yeah at this point, Nintendo should go after Intel for producing equipment capable on running their copyrighted software

I always buy every new Nintendo console and the games I like to play but now Nintendo has convinced me not to buy their upcoming console and to instead emulate the games they'll be releasing for it. There are limits to what corporate behaviors I'll support and this is my limit. Great job Nintendo.
Absolutely true, especially the "piracy is a service problem". That's just what piracy is all about, ether something is not available legally or is to expensive.

People pirating Nintendo products is Nintendo's fault. I love how I can buy games on Steam and play them anywhere I want. Nintendo creates its own problems, and Nintendo's anti-consumer practices will prevent me from buying from them.
Nintendo are living in the past, Open Source is the future, and emulation is a key part of game preservation.

I agree with you 50%, Yuzu took money for allowing users to play unreleased games and they distributed their own roms. Emulation is one thing and I would love them to continue their work but they are guilty as hell.
I swear to god, the Nintendo Switch 2 will just be a NUC with a screen running Yuzu

Yes thank you. They've been up to this since the 80s with rentals in Japan. To this day the laws on video game rentals or even borrowing a game from your friend there are ridiculous.

More people need to keep talking about this. Drag Nintendo through the dirt, they deserve it. Thanks for the great video. I boycotted them when they sued Bowser, and put my Switch and all it’s games in the trash can outside my house. I encourage others to do the same, they have become a despicable company, hiding behind the smiles of their devs and mascots waiting patiently for your money.
