    After a complete investigation into every person to ensure that fake documents were never used , then amnesty should be granted if no felonies were committed

    What are we gonna do with them? Amnesty does not mean citizenship , it just means they get permission to stay , get a green card or some kind of card to identify them as whatever, no government assistance of any kind, they pay a fine , taxes owed , etc

      It's hard to say because we haven't seen any proposed bill language, but that would be wonderful, we think.

      Hi Marisabel - if Biden followed the APA (administrative procedures act) he might be able to get DAPA put in place. We know he's said he wants to do something now we are all waiting to find out what that is. We'll let you know as soon as we find out more.

      Soneya, I hope things are going well for you. As we have said, there is no amnesty yet. We don't know anything about it or if it will even happen. Biden has said he would like a policy for the 11 million currently in the US without a status, if you are seeking asylum, you have a status. You are seeking asylum. As we find out more, we'll be sure to update. good luck.

    I have been here for 16 years and if US finds so hard to legalize daca kids that they have lived and educated here , imagine amnesty !If they really want to do something there is plenty of ways to do it since many have have jobs ,home, enough income to support themselves,and been here for more than a dacade. Doesn't matter how good and productive you are ,there is no way to fix your ilegal status,no way at all!

    Is it’s ok to to use the benefit with the prima facie like getting rental assistance without it affect u getting ur greencard because I have the prima facie determination but I don’t feel comfortable to take the government benefits because I do not want it to affecting me getting my greencard

    I was 19 at that time. Still an adolescenct. Young and knew nothing that I would face double jeopardy after serving time already for my offense.

      There are lots without a legal status who are paying taxes. As we mention in the video you will probably need to do that to get amnesty. thanks for commenting

    What about people with legal but non immigrant status? For example, f-1 students, do they can benefit from the amnesty? Or you have to be with no status at all?

    Hi, my friend came into the US in 1990 legally, but have over-stayed her visa since then. She was born in 1979, can she apply for DACA? From her understanding she doesn’t meet the age requirement? Thanks.

      Hi Tonkotsu, unfortunately she needs to be under 31 years old or younger on June 15, 2012 (born on or after Jun 22, 1981), as proven in her birth certificate (in English). In this video Andres talks about all the requirements - ua-cam.com/video/3Koi-wLE3is/v-deo.html

    How can we reverse orders of deportation for Laotian nationals? Been ordered deported since 1998 but am still here. Is there no path back to naturalization here in the United States?

      hmmm that's an interesting question S X. We haven't researched that particular question. There may be something that can be done based on your individual circumstances. And the amnesty *may* help but right now Biden hasn't released the entire written version only highlights so its hard to say 100%.       Not a lawyer, but probably. From the beginning of his presidency, politicians publically said they'd stand in Obama's way. Whereas with Biden, he's generally more liked by people on both sides. Plus he's more centrist and willing to comprimse a little more with the other side. Plus McConell has already said that immigration reform is long overdue. So he's open to listening.

      @@snatched.8135 Unfortunately, when Obama was in power, Biden was his VP. He requested many bill implementations from McConnell and McConnell refused. So I don't see that changing if Mitch stays in his position.

    To benefit from the Amnesty after the first 100days of Biden, a person could benefit if they had been in the US for 4yrs? Or for yrs? How long u should have been in the US to benefit? And will it cover people working in the Healthcare sector through out covid 19? What could be some of the requirements?

      We don't know. It is still going but the funds for it haven't been reauthorized. Hopefully there will be enough votes to knock the Republicans out of power in the Senate and more bills will go through. Since Biden was the one who helped pass VAWA we hope he focuses on it, too. As we find out more we'll let you know.

    Well explain thank you sir very profitable to my situation had my green card for pass 10 years while going for citizenship doing the interview asked if ever been married answered yes while my father put a petition for me as young child we don’t know if it will affect than I lost my green card for years now with a working authorization it’s so hard people just be careful and I know God is working on my side I went to so much in Jesus name the victory is mine Lord created the Heavens and the earth he’s giving me back all I lost happy New Years all Jesus is coming very soon stay connected in love for each other 🙏🙏🙏

    If amnesty is passed does that mean immigrants will be able to obtain residency? How likely is it that Biden will make it a priority? I still dont have DACA but my lawyer has mentioned going outside of the country to make it easier to obtain residency 3-4 months prior to the election. Im not too sure how safe that would be.

      Hi Gato, I think that is a really bad idea to leave if you are working toward getting DACA. There is no reason for them to let you back in if you don't have a legal status. I'd be interested to find out more about their reasoning. Yes, in the past, when amnesty was passed it allowed people without a legal status to get a green card and then citizenship. That is what we expect would happen but it is hard to know 100% until we see some policies written up.

      From what we have seen if there is amnesty and you have paid taxes, that should help. Of course, since it isn't in place yet it is hard to say 100%. As we find out more we'll let you know. good luck

Judge puts me on order off removal means deportation.my wife applied for me and i went to the interview,the officer said he decided to give the green card but i need to remove the deportation from the judge.he could not remove the deportation that's the affair.

      Hi Gurdeep, it depends on what you country you are from. You can always check the visa bulletin here - travel.state.gov/content/dam/visas/Bulletins/visabulletin_december2020.pdf (that's the december one). It looks like they are processing applications from 2008 for most countries. Good luck.

      It has applied to those with TPS in the past. We aren't sure right now...with the administration changing but as we find out anything we'll let you know.

      Sorry to be the bearer of bad news, he's not eligible based on current DACA guidelines. That might change under Biden.

      Hildenia, we agree. We recently saw that a Judge said ICE cannot detain people for more than 10 days without a hearing.
