Was I TRESPASSED on PUBLIC Property?!?

    The laws in Ga are confusing. Waiting to see what that new bill entails. I’d rather deal with the DNR officer than local police.

    I am from and grew up fishing the waters in Pennsylvania and I'm sure there are differences in the laws compared to Georgia. There was a relatively famous lawsuit in Central Pennsylvania where I live concerning whether or not you could fish a certain stretch of a certain river. At the time of the lawsuit the water was posted and local trout unlimited chapters filed a lawsuit to allow fisherman access to the water. In Pennsylvania there is a law (which is as clear as mud) stating a property owner cannot post a waterway that is considered a "navigable waterway." What that means in Pennsylvania is if that stretch of river was ever used for commercial use or commerce trade It is then considered navigable and therefore can't be posted. What that entails is you may float through that stretch of water and you may wade through that stretch of water but you cannot access that stretch of water from the property of the landowner. If my understanding is correct you may stand on the bank below the median water line. If you pass above that you are considered to be trespassing. As I said this law is quite vague and confusing as to where the boundary is for trespassing on landowner property. What I quoted above is the best I could glean from what information I could find.

    I am resident of Georgia for 62 years, I never knew that we had so many stupid laws. Yes you are right Aaron they do need changed. God bless you sir and your family...🙏🙏🙏

    I use a hunting app that shows property boundaries and who owns the property. It's not perfect, but it's kept me out of trouble so far.

    "Trespassed FROM the bridge" implies you were fine until you left the bridge and the area under it (which is public).

    Unless it was a private road and a private bridge no you can't be trespassed from a public bridge or road, then you have the public easement which is usually 25 - 30 ft from the center of the road.

      On a lot of rivers in Georgia the owner owns the riverbed.

      @@gianttweety1969 That sort of stuff just should not be allowed, IMO. Same kinds of things going on in other parts of the country and the end result is the rich landed people are trying to deny the public access to the commons. Who can *own* the river or a portion of it? It belongs to all of us..

      @@gianttweety1969yes, i know this but if you watched the video he said he was literally trespassed from the bridge, thats what I'm talking bout. He said they got out of the river to bypass a rough section and thats when he was trespassing. Thats legit. But when he read the papers and listened to what the cops told him, it sounded like he was being trespassed from the bridge which can not be..

    This is why I am so glad I live in NC.....NC you have the state ROW which goes so many feet off the road. long as you stay within that you are ok, i fish georgia lot but Nc isnt as bad as Georgia on this stuff.

    That made no sense the land owner had you trespassed but the let you finish fishing but you can't come back without getting in trouble. What if you asked the land owner if you could come back again. He let you fish it that day afterwards.

    Just follow the law and yall will be fine. I don’t want people on my property either unless I know them. I’m sure it all came from some dimwit that trashed the area or something that made the owner mad. Just pay attention to those No Trespassing signs (like the one in the clip with the cop)

      The law is incredibly vague. Flowing rivers should never be considered private property and many states protect public access. Georgia is a good ol boy state and does not favor access.

    Police or sheriff deputies do not carry the power to check fishing licenses.

    Absolute garbage. If that’s a county or state road, you’re launching from a public right-of-way. The landowner’s only claim against y’all trespassing was when you were portaging over his bank at the rapid. He should have no basis to have you cited for trespass at a public road. I hate the direction things seem to be going in our state as it pertains to anglers’ rights.

    We are looking out for your safety, no that's just a ploy/excuse they use every supreme court has ruled police have no duty to protect anyone keep that in mind. Eventually they want to separate you from your money !

    Local Deputy dog 1st reaction call a game warden because he is out of his jurisdiction make calls on fishing . Go get back in his speed trap. Where are the no trespassing signs posted?
