People keep stealing my SH*T! (and what to do about it)

  • As photographers, we unfortunately have the odd occasion when we have to deal with other people using our images without permission.
    This is often very frustrating, especially if it’s by professional organisations who should know better (or, even worse, other photographers).
    Luckily for me, this is something that often gets brought to my attention by Karl Taylor Education members who are familiar with my work, but when I set out to create this video, I was surprised by just how much of my work is being used without permission!
    Here I explain how you can identify websites or organisations using your images, resources you can use to learn more about the copyright laws in your country as well as the different steps you can take to safeguard your images.

    Jared Polin contacted me and said his photoshoot was set up by Sony at a press event in NY. However as I said in my video it seems everyone get's 'inspiration' from everywhere, maybe Sony got the inspiration from me or from the Gary Numan album :)

      I think you libeled Jared Polin. I believe you came across his photo at the Sony Press event and thought he copied you. He has a ton of videos, shoots totally different from you, has not a single thing in common with you, and with the hundreds of videos he has out there, it would be easy to take a few words and say he copied you. It would be wise to concentrate on the people that actually copied your work, but I am sure I can find videos before yours which have similar scripts. What you complained about is something I have heard from a million people before you when they are trying to sell some course.

      Karl Taylor Very interesting. The one thing that sets your channel apart from his and many other UA-cam channels is that his and those other UA-cam channels create subjects that have nothing to do with educating inspiring photographers about creativity, lighting techniques and directing. His and many of the other UA-cam channels boast about gear. And you made a rant video that I love about this topic. All these UA-camrs keep boasting about Sony vs Nikon vs Canon, how DSLRs are dead (like everyone should just sell/trade in all their DSLR equipment and convert to mirrorless) and which system everyone should buy. I will admit that I will watch those UA-camrs for entertainment purposes. I do not take them seriously. While on the other hand, there are some UA-cam photographers who are teaching, sharing knowledge and inspiring upcoming photographers that I take very seriously.

      Good afternoon Karl & team.
      Speaking of actually having the skills. I have a question about the lighting portion of your education platform:
      I’ve heard and agreed with your emphasis on the importance of the mastering of light. I’ve read what is included in your lighting section.
      Do you specifically cover calculating light intensity over distances when using modifiers?
      For instance, how to understand and thereby use f-stop values at distances?
      A typical example of what I mean is in the specs for a Siros 800:
      - flash energy: 800 J
      - f-stop at 2m distance, 100 ISO (6½ft)
      -- with reflector L40: 32 ⁸/₁₀
      -- with reflector P70: 45 ⁶/₁₀
      P.S. - I appreciate the fact that you shared your discussion with Jared. That shows good character.

    I love the light-heartedness approach to this serious topic.
    It makes it clear, that you understand that art *needs* inspiration and aspiration in the equal parts. But there is a clear line between inspiration and straight stealing.

    Karl, I’ve always loved your work and advice; you were one of the first people I came across when I started to learn photography, and what a great place to start. I guess a sign of your success is people wish to emulate you, as the saying goes, imitation is a sign of flattery.

      Um, no. I get that you're trying to be funny, but contrary to popular belief not many of us baldies actually give a sh!t, and are quite comfortable with having little to no hair. Even if I could grow hair like that, I'm pretty sure I'd still shave it all off, too.much hassle. 😂

    This is a real issue that photographers face all the time. The main problem highlighted is people stealing the photographers actual images. The similarity of image styles is a much more knotty issue. Jared Polin's comments about his video are similar but fairly generic. Any photographer doing a tutorial video is likely to say, "I will take you right into the shoot as if you are there/my assistant/sitting on my lap" etc. Equally with images, some are very specific (the Halsman Dali image is so particular that you will only ever pay homage), but some - most - so generic that the principle in copyright law that you can't copyright an idea, only the manifestation of that idea, rings true.
    How many whisky pictures looked like yours? Some were shot before you were even born. How much black perspex has been sacrificed on the alter of alcoholic beverages, back and side lit to subtly bring out the amber embrace of the magical liquid within? Well, the answer is lots. Those images are superbly executed but some of your examples are much more individual to you - to your style. Part of your USP is the 'event': the paint splash (an oblique reference to Harold Edgerton) or the bird of prey landing - all flawlessly realised. I'm sure many clients come to you for that skill in executing challenging situations. When people nick your actual image, then it becomes a problem.

    When I use images for "inspiration" they are (you guessed it) usually from someone else's work. However, they are for inspiration and not re-creation which is a big difference as the end results usually aren't that close.

    I always like the expression that goes: If you copy one person it's plagiarism. If you copy a bunch of people it's called market research. When I started my drone aerial video business in 2004 I had a friend that also started a similar business a few months later. About a year into this I decided to check out his website only to find him damn near copying my text nearly word for word. Talk about being pissed. I have caught a few people over the years using my footage as their own in their demo reels. It's just the crazy world that we live in. Love your content. A ton of talent and wonderful content.     Nice work brotha! I hear ya, I saw one of my images in a store. It was a small print on a plaque, they claimed ignorance as to its origin and I couldn’t prove it was mine on the spot so I let it go. I don’t post printable images so it was a mystery? Only thing I could think of was some computer tech taking liberties while performing maintenance on my laptop. What they fail to realize is, “You always reap what you sow.”

      it is very common that artists have similar ideas and make similar works not just for photographs even in larger scales for example short animation "Brain Divided" and the animated movie "Inside out" , I love Karl Taylor and his videos but we should not take it hard on other artist shooting photos with similar elements, even if they are inspired by our work we should not expect people to remember every inspiration they had and mention it, i'm sure it happend to everyone that you make something and you know you saw it somewhere but you just can't remember

    The light tube setup was from a Sony press event for the A7R IV. Many photogs shot that scene on that day.

    In the US you can bulk register your photos with the US copyright office. You need to do this prior to filing suit. It’s pretty cheap to do for any images you own the rights to.

      This is correct. However, the US Copyright Office (USCO) has *updated* its copyright registration procedure to register photographs.
      As of September 21, 2019, you can register up to 750 published OR unpublished images in one eCO Registration System (aka, on-line or e-Filing). You can NOT mix published and unpublished images in the same application. It cost $55 to register up to 750 images. Filing fees will likely increase in 2020.
      The new procedure *REQUIRES* each photograph to include an image title and image file name (and date of first-publication for published works) and that can take quite a bit of time to complete thoroughly and accurately!
      If you just want to register ONE image, published or unpublished, where you’re the sole author that’s not part of a work-for-hire arrangement (you created the image yourself; it does NOT include any third-party media; not created by a corporation), then it’s $35.
      To have the full force of US law for both US and international photographers, they MUST *timely* register their copyrights either BEFORE the infringement starts or within THREE calendar months of FIRST-publication to be able to pursue statutory damages and recoupment of attorney fees and legal costs against the US-based infringer (at the court’s discretion). If you miss that registration window, you can ONLY pursue actual money damages AND you can NOT recoup your attorney fees from the infringer, making it economically challenging (impossible???) to pursue US-based infringers without having a timely registered copyright in-hand.
      If your images have been infringed once, then they are susceptible of being repeatedly infringed: You’re still encouraged to get your photographs immediately registered to go after new infringers.
      If you choose NOT to timely register your photo copyrights, at the very least affix them with robust watermark LOGOS, metadata, image title, and other “Copyright Management Information” (CMI). Infringers who knowingly cover up, remove, or change any CMI to hide their infringements or induce others to infringe can be liable from $2,500 to $25,000 in statutory damages PLUS attorney fees PLUS legal fees (at the court’s discretion). The *GOOD* News: You do not have to timely register your copyright claims to pursue CMI violators.

    I will admit when you do walkthrough of how you do a shot I see what I have laying around to do similar shots and always credit you and usually link the video you do the walkthrough on this has been my greatest classroom.

      thanks Justin, yes as an educator in photography I recognise that people will use the lighting setups I show whilst they learn but once they reach a level they understand that depending on what is they have to shoot the setups will likely need to be tweaked or adapted to better enhance that subject, I believe it becomes an issue when its a direct replication with no credit to the original

    Best photography channel, solid contents, professional! No wander someone would do this. Many fashion designers have to spend months from nothing to the actual pice. It is the ground zero of knock off, copy, plagiarisms… Sue them? sure, they have hundreds of lawyers waiting, and they will make enough money from your idea before the case closed no matter what.

    Great references and despite of not having any impact in the industry, I've seen already some unfortunate consequences of not water marking my work! For instances, from a trial shoot, in which was just a test, saw later the use of those pictures by some that didn't showed any gratitude , what so ever. To be honest thought that they didn't like it...however, a few weeks later found those pictures on their social platforms!!! Sad! Cheers (Great wakeup call!!!)

    I've been saying this for years and it's only gotten worse and worse. All these photographers who spend ALL their time hocking crap or trying to become a "brand ambassador". None of their channels have anything to do with actually teaching anything or photography and they're constantly just rehasing the same shit from each other over and over cause the horse has long been dead. I remember when the art of photography podcast was actually about photography appreciation and teaching and not about sucking up to sony and hasselblad to get some free gear and sell silly jackets.

    I used to follow Jared Polin, watch his videos, and learn from him. I waste hours and weeks learning from him and 0 inspiration because I have not seen 1 video about his work, all I see his afro, stupid T-shirt (I ShOoT rAw) and criticize other photographers, until one day a friend of mine showed me a youtube video of shooting whiskey bottle that shot inspired me to the level that I said YES! that's what I'm looking for, and here I am proud to be Karl Taylor student and there's no shame about it.

Ufff, I have also found my photo, it was written my name as copyright on photo but someone was used PS to crop a photo and upload on webste... anyway..     “Send them an invoice” 99% they won’t even respond, and due to different international copyright laws, it is almost impossible to get your money if this happends over seas. You would need lawyers, translators etc that all need to be paid as well. Tony Northtrup did a video about a little while ago.

    To be fair I’ve never heard of darrin haddad
    Until this video..Yet my style of photography is very very similar with the bold colors. When we as artist and creators get influence from the internet we almost never know who made it but it registers in our heads and we go with it.
    This happens everywhere with music, design etc.

    Stealing a picture is one thing but copying educational material is a hard thing not to do, my profession is health and safety and everything I have in my keynote presentations was all stolen from UK and local regulations and ACOP’s, when giving a presentation about light and ISO I bloody well hope you all give the same information as the light doesn’t change from one person to the next..

      @@VisualEducationStudio Everyone takes inspiration from you Karl. When it comes to cool concepts and how to get that impossible shot, you pretty much invented the wheel. But do we actually have the copyright to the composition and design of an image? What about if the colours are changed, or the subject posed slightly differently. We do not have a patent on the image as this would be impossible. Is this not the inevitable outcome of showing everyone for a decade or more how to shoot your work. I'm not saying this is right, but simply spit balling.

    Hahahahaha , its very good sign Carl, never mind , there is a big deference between a creative mind and copy cat mindset , you will always have a steps forward while they will be only following, actually its the story of human being, when I was singing in weddings there was this guy who was always copying me, but I was so happy cause he pushed me to have always new ideas

    But a question, is a periodic google search for the image a routine you use to find if people are stealing your work?
    Even if it's subject I'm not looking for information on, yours and Gavin's videos are ones that I'll watch just for pleasure or to see what you're doing. Cheers to you both.

    The problem of photography these days is trash talking and using this term (I can do much better job than him/her) and ends up copying a shitty version of original concept or remix , the solution for that is use social media as a power tool to spread more than those guys/girls to let everybody knows that this is your original work , the thing is that those shitty people became the so called (Social media influencers) and us photographers who are really doing the job should spread more than those fake photographers , the problem is universal to be honest

    Genuine question - did you license the use of the album cover images in this video, or the snippets of music? If not, are you expecting a C&D notice or invoice from the record company?

      The majority of music in this is clearly stock music, the album cover images are clearly being utilised under ‘fair dealing’ and as for the music from the albums only 2-3 seconds were used also clearly under fair dealing. They clearly know what they’re doing. You tried to call them out and you just made yourself look like a idiot. Shut up and sit down

    The conclusion of Karl Taylor’s video uses approx. three-seconds of Gary Numan’s “Cars” sound recording. I see that specific usage as being less Fair Use commentary and more of way for Karl to “esthetically” end his video. And to make his point about finding new photo inspirations from his music album covers, Karl should have dropped in a still image of an album cover (that he admires and that supports his concluding video commentary) rather than re-play the “Cars” music track!

      We did include the Gary Numan album cover (and a Sinead album cover) earlier in the video to give example of how they may have inspired my own work. It would have been odd to repeat it again at the end.

    So straight up ripping someone else's work is wrong, but what about recreating the image? And is so how different must it be before it's accepted as not a rip off or copy?

      I suppose it depends on the purpose. In the one example of Darrin Haddad's shot I explained to my audience that this was a complex shot and I wanted to demonstrate the techniques on how it is possible to reproduce it. On the Philipe Halsman 'Dali Atomicus' shot it was an historical reproduction for the BBC of this very old and famous image. In those contexts I think it is acceptable as the original creator is always credited, in many ways I suppose it like a musician doing a cover of someone's song. I would also add that amongst professional photographers there is a lot of 'inspiration' and many similar shots, either by coincidence or simply the ideas are just re-spun slightly differently. Often the photographers don't even have a choice as an art director or advertising agency will come with a brief and say 'I want this' and what they show you is another photograph or idea that they want you to replicate but with their product. I think it can be considered not a rip off or copy if it brings something new or an additional element of difference to the shot.

      its even worse then u think. Some stock photography sites might not even check if photos are stolen or not and people might buy them thinking its good (while not doing their research themselves.. ). That would be a serious legal maze to go through.
