    It pisses me off when someone even a friend uses an image & then crops and adds cheesy filters to it.

    Im so tired of share accounts. I really wish instagram wouldnt flood the explore page with then. It pisses me off. Especially all the woodworking ones who sell plans, and they are using others images.

    As someone who has his work stolen on average every 4 days over the last two years here's some advice:
    UK: Copyright is automatic. As soon as you click the shutter the image is your copyright. No registration is needed. If your copyright is infringed you can only claim back what the image would have licensed for.
    Europe/ Canada: I believe is the same as UK. In Canada though I believe you can ask for more and I currently have a case over there.
    USA: Be VERY careful here as if it goes to court your images MUST be registered with the US Copyright Office. 750 images can be registered for $55. There are two different sets of damages that can be claimed. Also be aware of things such as Fair Usage.
    As far as I am aware you are not under any obligation to put copyright or © on your images either. Certainly that is the case in the UK.

      This is exactly how I understand it too, although in the US they do recommend adding a © notice, but it's not necessary for legal action.

      @@TimEasleyUK this morning I found one in the USA that has used one of my photos. It was marked with © but they just cropped it. Thankfully they were stupid enough to leave part of it on there which puts them very deeply into it!!!

      In the US photographs are protected by copyright from the moment of creation. Taking the additional steps to get them copyrighted is a bonus step but you are not required to do that.

      @@moneekaayrenae That's not quite true. If you're in the US you need to register the works in order to file an infringement suit. You still retain copyright, but the amount you can claim is only what you'd normally charge for the photo, rather than anything involving damages. It's complicated and annoying.     You are more forgiving than I'am.
    I do go after people who steal or use my images without my permission, for me its the principle.
    I have one one taken off my website and the watermark removed, one company used my images off facebook but I contacted that company, turned out they really didn't understand the "rules" now they are a client.
    I don't post my good stuff online, the one time I don't mind someone using my images without paying are the times I donate my time taking photographs for charity organizations.

    Thanks for this video Brendan! I have this exact thing happen to me by unlimited-croatia (assume it's the same dodgy company). They've been reposting an image over and over for over a year, and giving me wrong credits in description. I messaged them, but they've just ignored it. I figured I couldn't be bothered to do anything more, but I'll try what you did 👍🏻

    It takes a couple of copyright strikes per day for over a month before an account gets banned. Learned that from one of my coworkers that "borrows" images everyday for promo spam accounts.

    There are countless times I fail to submit a report just because of the hassle I have to go through! It happened to me again this morning!Same thing, "Congratulations @Calvinseah", went through the process without second thought.
    By the way, the offended content isn't taken down immediately, it's just hidden from you. If you have copied the link to the content you can still see that it's still live on the account.
    Now I will see how long it take for Instagram to take it down.
    *Update: Instagram took it down after 10 mins I've reported, that's fast!

    I've become so suspicious of social media that I no longer share my best work on Instagram or the Internet in general. I even had a video stolen off UA-cam but they shut it down after I filed a copyright infringement claim. The time stamp was key.

    Calvin Klein stole my photo and posted on their instagram a month ago. More than 200 people commented on their post with my photo to tag me as photographer and Calvin Klein just ignored : (

    The last two times I copyright claimed my image stolen by others Instagram replied the image in question wasn't similar or the one I owned and took zero action. They we're identical. I have zero faith in Instagram doing the right thing or their copywright protection for users. Same has happened for Facebook.

      If IG or FB doesn't remove your image as they claim it's not the same, they are now liable for damages in federal court for registered images in addition to the actual idiot who posted it.

      Yep, I’d sue them both then. You could get a quick settlement from fb. This is their bread and butter and they aren’t going to risk their cash cow.

      Instagram is currently not helping me either. They keep asking me to send the url then they claimed there was no evidence it was promoted on Instagram even though I clearly sent them the link of the person who stole my picture and posted on her Instagram page.

      This is happening to me right now with Facebook. I sent them the link of where apparently some girl won a photo contest with my image and the link on my page of the original post. I also sent them a screenshot of the Lightroom showing the exif data and my copyright. facebook said they could not determine if I was the photographer.

    Well said. We spend a lot of time putting together our pictures/stories etc for promoting our own content so its hard when someone else takes credit for that image.

      Morgan Bardon It’s very hard. The issue is most people are just jumping on the social media bandwagon to bump their page views, nothing else. Most don’t even see value in taking images, they’re just wrapped up in a social media mindset...
      Now. If someone’s making money off something you’ve created, that’s not cool. That’s a plagerism and just a dick move.

    This is actually a great example of how Instagram don't act on genuine valid reports and don't take copywrite seriously. Your image is still on their account, still advertising their service. Instagram have done nothing despite telling you it's been "dealt with"
    (when it seemed to you to disappear, it's likely Instagram just blocked that image from you, rather than removing it)

    This was helpful. I’m a fitness influencer and use my IG as advertising and motivation to help build my coaching services. Recently I’ve been battling with Facebook after finding out someone has been using my images to catfish women. This person has scammed over $600 out of one women. It’s gotten to the point where I didn’t know what to do. Filed the DMCA, explained my situation and within 12 hrs, Facebook had access to the fake account removed.

    I agree with you completely, it's your work your time, money, effort and energy. You are a profession and do this for a living, you have every right to the earnings from your work. I would have like to hear you say you were monetarily compensated for the use of your photo, you deserve it.
    Years ago a fellow craftsman saw a unique piece of functioning woodwork/artwork i was just finishing and asked me If he could have a copy of the plans to make one for himself. Reluctantly I agreed, but with the stipulation that he build only one for himself and that he not build anymore, that he did not post or sell my plans, that he not make any to sell or give away as I was planning to make and sell them on my website. Almost a year later not only did I find he was making and selling them on ebay, he even used my pictures from my website since they where much nicer and showed better detail. I sued him in small claims court and won a judgement against him for $3000. i had a tough time proving our verbal agreement, but once he admitted to stealing my website pictures and did use them without my permission the judge agreed that he did infact steal my intellectual property and had no permission to reproduce them. he was issued a cease and desist order and to pay the max. $3000 in compesation. I have yet to see a penny of the $3K. Winning it is one thing, trying to collect the money from a civil judgement was damn near impossible without more lawyers and fees.

    Why don't you just give this case to a lawyer? Much easier and a standard rate for this kind of usage is around 150-600USD respectively your standard rate.

    Brendon, both examples are profiting by marketing your product (images) for their commercial gain. The first one, has published your name which I can see a trade off.

    Well Brendan I was in this situation countless times. What amazed me that there were few accounts that didn't bothered to credit me, mention me, and the worst, almost all images on their feed were mine. I can't say that Instagram (their employee) didn't reacted in a couple of hours but what annoyed me is that they wanted proof (link to mine images) of all the stolen photos. Once I had to copy/paste 50 URLs. I get that they need to do that for 2 or 3 or 5 photos, but when you see that someone took all the images, I think that the ban was the only solution. Or to freeze the account until they (owner of the account) deletes all the photos he/she stole.
    And this topic always makes me a bit mad...

    Hey i am a part time photographer i did a free photoshoot and asked the client to give me credit on instagram and tag me. Now he's not responding. The whole reason for the free photoshoots is to grow my audience and to start charging my clients later on. But my image is getting tons of likes without me being credited. And i haven't posted that picture so i wanted to ask that can i still report that image or not? I can prove that i took that picture... Is is in my DSLR SD Card and i can share screenshots of me sending him the image on whatsapp.

      Alasdair MacKenzie they make a lot of money by people uploading other creator’s content. So it’s not in their interest to change things. That’s why we need to be vigilant about reporting this and not letting people get away with it. Some personalities make millions from their social media activity, they can afford to pay for photography.

    I’ve always been concerned about this. I started “branding” my images on Instagram last year to make it more difficult for them to do this. I see a lot of new accounts reusing the same images over and over again. I know they are trying to build the account so they can sell it. Building someone else’s account is not why I post.

    There are licenses to specify exactly the artists' will. Why don't you use Creative Commons on your content? CC attribution non-commercial exists exactly for the scenario you described with Starbucks. Instagram doesn't allow you to specify a license. But flickr does. We were so better off with that... it's like we took several steps back and forgot there are better alternatives.

    I have an online business and I was going through my tags right before I made my Instagram ad and I saw my tag on someone else’s page. I clicked on it and went through their page and saw that they stole my picture of me wearing my necklace that I was promoting and tried to pass it off as theirs. I reported it to Instagram and exposed them all over social media.

    I'm an aviation photographer and have the same problem. My pics have been stolen and used for everything from being published withOUT me knowing it, stickers, T-SHIRTS! and put on other web sites with watermarks removed and that photo claimed to be taken by said other person.

    I made a picture for a merchandise competition and I ofcourse was wearing a longsleeve from a band. I posted the picture on Instagram with the band tagged both in the picture and the description. My face was ofcourse in the picture and I was still 16 at that time. They posted the picture on both their Instagram and Facebook (I don't even have Facebook) with no credits to me. And the post was like this longsleeve is still on sale get it now. So it was commercial. I messaged the band that I was happy they liked the picture but asked if they could give me credit. They dodged the question very weird. And I sent them a message again and they still doged it. Then I emailed their manager. Explained what happened and asked if he could give me credits on the picture or delete the picture. I didn't get a email back after 2 weeks. In this time I also reported it on Instagram but they didn't do anything about it. I decided to email their record label. And formally explained what happened again and asked if they could give me credits or take down the pictures. I didn't get a response for over a week. After this I sent them another formal email that was almost the same as the last one but with me explaining how they are violating my rights and if I don't get any response back I would be forced to take legal actions even tho I didn't want that because I supported them as a label. Then finally I got an email back after just a few hours from the actual CEO. And it went something like this: are you serious threatening to take legal actions because you aren't tagged in an instagram picture, no wonder you haven't got an email back, get over yourself and just report it. It wasn't a formal email but just that. And i also wrote in the email I already reported it but Facebook and Instagram didn't do a thing. After all of this shit my friends helped me by commenting on the picture saying they should take it down. Not only because they stole my pictures but also because I am a minor. And after all this drama I still feel bad about this. And I no longer can listen to their music and the band from the CEO (yeas the CEO is actually in a band himself). And because my face was in the picture I am still afraid till this day they are going to give me crap if I ever go to a tour with multiple bands and them being one of them. I hope someone can maybe give me advice. And BTW now all the picture are taken off by Instagram and facebook

    Honestly these are great tips. However it seems as though insgram doesn't even try to remove stolen images.
    I tried filing a DMCA file and they don't do any action.

    Why wouldn't you reach out to them first to seek compensation? They may be interested in using that image for other marketing mediums. Now you have a new client. If not then copyright strike them.

      Yeah it was for an iPhone case. Since it was in a different country it was much more complicated. In the end they were reimbursed but not as much as they would have liked due to extensive legal fees.

    Instagram is so disappointing... Yesterdey morning i've posted a picture from Osorno volcano, in Puerto Varas. I have almost 2k followers, and i've got 90 likes in the picture. Yesterday night a repost account with 1k followers reposted my picture, with the same #'s, and immediatly got to explore page, and got 400+ likes till now... So in addition to the instagram let people steal images, it still shows more the account that stole an image....

    Hi Brandon, we are lucky, in Canada, you press the shutter, you have automatically the ownership of the copyright of the photo, since the law change in 2012 in Canada. Think in the states you have 3 month to register your photo for copyright. in Europe , some country if you use continuas shooting ( not sure of the therm ) , it's not consider art, so you can't copyright your photo ( base on some cases )
    it a complicated subject. I agree with you, we should all have a line that we need to keep. thanks for sharing your story. love this.

      ​@@cnlicnli as a US citizen you are bound by all international agreement US as sign, international copyright too... so I am protected cause US need to respect and recognize canada copyright protected materiel... like Canadien has to respect and recognize US copyright materiel. ( my english is not that great, not my first language, but I think you will get the idea ).
      There is a lot of jurisprudence ( precedent ). check with a lawyer if you need more info, I'm not but those are the base we learn in school about international law.
      Tony and Chelsa have made a video about them taking to justice an Australien company that took there photo without permission... verry interesting, check it out

    Good insight. I'm currently going through this process right now, although the account still has the image up. I've submitted this report but got feedback from Instagram that it needed further review despite including link and original JPEG to Instagram reporting process. The image even has watermark on.
    The offending account obviously doesn't care either as they blocked my account previously when I asked them to include photo credit and continue to post my images among other photographers.

    Interesting video.... there is a flip side to this. Your example of a cup of coffee, the Starbucks logo on the cup is owned by Starbucks. Back.... in the day of film... photographers needed release forms of products, like the Starbucks coffee, when displaying photos either for money or not. Photographers don’t realize some of the items that they post to social media are copyrighted items, which require a release form.

      Be Starrs no, you needed a release to use it for commercial use. (Ie for selling it as a stock photo).

    Someone who makes his living shooting photographs must copyright his work. If he then takes a public position where he may or may not enforce his rights depending on how he interprets the uses of theft, he practically waives any right to complain about such theft.

    Is it possible to use other photos of other users give the caption for whose it is and tag them. But use my own lightroom preset? I don't want to do something that is not right to do.

    I had someone steal my image and used the same hashtags as me and that was how I found it. When I looked her up she worked for a marketing firm. I was pretty shocked. When I reached out to her she blocked me. So i filed a copyright infringement and they removed it from her profile in less than 24 hrs

    Brendan, they have done the same thing with one of my images for Unlimited San Francisco. They actually repost it all the time. It even has the same caption as the one you showed. I would complain, at the same time I figure it is helping me attract followers on IG. So I guess I am torn if I should do anything about it...

    Q. What r d guidelines for old photos floating on internet eg. I do a Google search for marylin monroe n find one. How do I know whose d original photographer if it's not mentioned. N d photo says it's under common creative license

    What if these turkeys block me - I've DMed them, and filed a copyright violation with IG, nothing happened and they've taken lots of photos and they dont seem to care.

    Great advice mate, I’ve had about 10 of mine taken and re-popped and I’ve messaged and miraculously they have credited me. I haven’t filed yet but 1 individual hasn’t changed or credited so really useful info and I reckon I will be doing this!! Cheers Jase

      Jason Kennedy and what has credit gotten you? Just ask for money or file a take down. We need to be harsher about this kinda stuff. It hurts as all.

    Exactly!!!!!! Im on the same page. I dont have time to argue with pages on ig for stealing my images. Instant report and ig is very fast and effective in removing the image. If this pisses people off they're in the wrong. I do think its crazy though that people think they can take anything they so desire to benefit themselves. They obviously do not appreciate or respect the artist

    I'll make you laugh a little bit: some weeks ago I posted an image on a facebook group. A "Sir" copied and turned it into BW and reposted as is it was shot by himself. I recognize it, i wrote a private message and the answer left me with my mouth open. "You did the photo, but I did the re edit, since the fact the the re edit into BW got more likes than the original, means that my re edit works better, so my vision of your photo is mine. No way!"
    It was like throwing gasoline on fire… I let you imagine the hell I unleashed. This tought me that no one is safe when post an image over a social media. Sad but True!

      Fire back then.I would leave a message on his FB space saying this douche is a fraud by stealing tour property.Then you leave your link where everyone will check it out. Trust me,everyone will go and believe you.You probably have to do few times until he gets tired of you.Fight for it man.I would do it.Send message to FB team as well.Serves him right to mess with you.😉

    I agree to a point, but if the image was special and not just a caption shot , in order to protect copyrights , you are required to defend them, or they are void, Hence why they cannot revoke Dan Snyders for the Washington Redskins , because he actively defends it against violations.

    Other than happening to see your image on another account how would you know it was taken? Is there a tool other than doing Google image search on all your images?

      Reverse image search, there's also some websites where you can upload your images and they track them for you.

    My images are stolen EVERYDAY on insta ( no credits)..I'm tired of filling in report forms. Don't know what to do :(

      That's the battle. And maybe the option is to stop posting. If Instagram doesn't respect users, and original content creator's, we should stop using the platform.

    An “influencer” got Instagram to take down a video I posted where I DISCUSSED the “influencer’s” photo...Yes, a video of ME talking about a photo. Yes, you could see the photo in the video, I was holding my phone in my hand with the photo displayed. And Instagram sided with the “influencer” and removed MY content without question...

    I don't use Instagram because (unless it's changed) Instagram has the right to use your images anywhere in the world for whatever they want and it can also give those rights to a third party without asking you. Is that not just the same as what the person you carried out the copyright infringement did to you? The only difference is out of the kindness of their hearts Instagram did something about it , I guess if it was they that used your image they wouldn't do anything, that's just a guess tho.

    I've seen facebook editing groups where people have been illegally removing copyrighted watermarks and logos and worst of all most times they are stealing the images from a business page Ive been calling people out for doing this and I've even gone as far as taking photos and then I will go and then contact the owner of the photos and i will attached the evidence of them stealing their photos and than having the copyright watermark illegally removed there was a person on another site who said he steals other peoples work that they have spent days working on and then he will then go and sell the same image for a small profit its absoluty disguting

I didn't know about that account and one day my friend asked me '' do you have another account " I don't know what to do. I already reported ti Instagram. That person is looking girls for eskort through my pictures. (sorry for my english) I hope your instructions will help me.
