@@Rc3651 and this video is certainly bringing more attention to the guy than all the videos he tried to take down, combined. That actually may be the case quite literally since this video already has 3 times more views than the last one. I find it ironic that this is also example of the problem Jim has been lamenting: his non-Jimquisition videos get fraction of the views compared to Jimquisitions. Gilson got the former so next to nobody saw it but by escalating this he got Jimquisition and know everybody and their grandma are gonna know about it.
It's almost as though they've had to deal with this sort of thing before and they're ready to go again. I'm glad they acknowledge their privilege of being able to lawyer up and I'm glad they have that cause one day it might be Jim Stephanie Sterling who has to finally take all of this to court and set the precedent that liars on youtube need to be held fully accountable and youtube has to abandon their hands off policies and take an active role in cleaning their house. I almost want things to escalate just to bring the day of judgement closer... almost.

Yeah, this is why SOMEONE needs to chase and dog-down someone who tries this at some point. We absolutely need someone to set that precedent. I feel like it's the only way we are ever going to break out of this broken system. However, I totally understand Jim deciding to not be the one to do that. Clearly, they've got enough on their plate to deal with already, and while certainly amongst the more successful of UA-cam content creators, with even some level of industry recognition (just ask Randy), it's not like Jim's quite the behemoth or titan that someone like TB was or Pewdiepie is. Ideally we could do with someone who is an independent content creator, but is technically owned by some massive corporation, to be singled-out and targeted by someone who isn't aware of their connections - and then just let their limitless wealth parent company's army of lawyers take the malicious individual who made the false claim taken to town, and refuse any attempts at settlement. Make it as public as possible. Make an example of them. Establish that precedent without any room for doubt. Unfortunately, I feel like finding a massive limitless wealth corporation that cares more about doing the right thing, even just once, than making their limitless wealth irrelevantly more limitless, would be basically impossible.

I appreciate that Jim took the time to acknowledge not only that what Gilson did was wrong, but that if Gilson had attacked a smaller creator, without the resources to lawyer up or miss work, they, despite being innocent, would have lost their channel. UA-cam definitely acts on a shoot first, ask questions later basis. They don't even use human beings to verify misdemeanors. If a robot is offended by something you've done, you're punished. You can fight it, but most people don't have the time to, and Jim notes how unresponsive UA-cam was to begin.
I've literally tried many times to reach Google over the years of my gamedev career. I've ALWAYS got robot replies. Never once a human. For instance, my adventure game on PlayStore which was split into several apps (one per chapter) was suddenly removed 3 years after because of duplicated content (??). I complained about it. Then Google... reinstated half of the chapters. Like, chapter 2 and 4 but not 3. How could a human do this?! The truth is, no human did. It was all automated. In the end I had to restart my app from scratch. I lost all the data, ratings etc so my game is now making 1/10th of the revenue. Oh and Google considers that my new game BROK isn't mine when trying to claim my entry page. Despite giving them my ID card, my company creation form, and many screenshots of social networks - all the stuff they ask for. And when complaining... I only get automated replies. Going in circles. I gave up. Now I'm just crossing fingers to never have a real problem with Google.
I am even more impressed that Jim got fucking UA-cam to bitch out and capitulate. Perhaps UA-cam itself realizes they can't just scare people off with the threat of lawsuits, that they themselves are complicit in the false DMCA claims.
My adsense account was disabled due to being clickbombed on my website by an old friend I terminated said friendship with. Google have never reinstated it and found that I was the one in violation, because I never reported the clickbombing.. after finding out about it after my account was disabled. This was in the early 2010's. They still, despite any attempt at contacting them, give me back the same robotic "nope" response. I was learning game and web development and was going to put effort into a UA-cam channel, back when you actually had a chance. All of that is dead now because of Google's actions (or inactions)... and I'm basically living on the edge of poverty due to other circumstances in life. Yay, corporations.
That's pretty much what's happening. UA-cam wants people to be afraid of committing to going to court so that they'll just drop their disputes. No one running UA-cam wants to actually put the effort into policing this community. As has been demonstrated here, when someone pushes back and says that yes, they do want to pursue this legally, UA-cam backs off as soon as they possibly can so that they can continue to do nothing, because an actual court case requires effort. Burying their heads in the sand whenever #WTFU happens requires no effort. Waiting for criticism like this to go away requires no effort. Addressing any of this actually requires effort they reserve for appeasing their actual source of income, the advertisers.
Google's already trying to lay low what with all the antitrust monopoly lawsuits being thrown about. They'd be stupid to get tangled in a lawsuit now that would sway any more public opinion against them that could cost them the big lawsuit. The public opinion directly wouldn't play in court. But you get enough constituents pissed off and they start drawing the attention of politicians, any common sense goes out the door because politicians will happily make an example of you to cater to public opinion. Any company trying to stay under the radar would be crazy to try to gamble with that wild card.
Um, yeah, I've kind of noticed that this is how Google actually works. Like if you make it clear that you *would* be willing to go to court, they suddenly get very quick at solving problems.

Thought occured to me it might be one of their kids, hence the crap development and layers of identity secrecy. I would be curious to know who owns the building Gilson based the company out of, because you'd need to have them on board to hide a bogus studio and handle the mail for you. Recently became a corporation myself to game the system and get access to some of the insanely gross advantages like cheap mortgages I discovered exist in my country. That P.O. box thing is 100% true, but you can work around it if the owner of the building handles the mail for you through an assistant or front desk.

I know it hasn't gone to court or set any legal precedence but your work fighting this stuff does lay the foundation for all creators and what we can do eventually. At least it's been tested that getting a good lawyer and threatening legal action can actually work. It's inaccessible for most but it's a little light in the murkiness of UA-cam copyright. @Mr D Like he said in the video, this channel isn't his world anymore and he's old and tired of fighting legal battles but he was still willing to go to court over this when he can actually walk away from it now. Yes it's in his interest to win the battle too but it's a battle we all benefit from, and there's no harm being appreciative of a positive effect someone else has on your life.
@@GamerZakh It's a very modern day scenario, especially in America, money makes right. If you have enough money you can get yourself out of pretty much any situation. But if you are lacking funds you can have any number of injustices piled upon you and be forced to accept them. Many governments outright refuse to regulate such behaviour, and will take the side of the corporation/wealthier party when push comes to shove. While I'm glad Jim won this, it isn't a realistic scenario for most people who might end up in this situation. Which is the point he made towards the end. We can be happy for Jim, but honestly I see this shit getting worse over the next few years.
I've also heard a number of other UA-camrs namedrop Jim's "Copyright Gridlock" move he pioneered to spite the copyright trolls. Jim's torrid love affair with Digital Homicide gets mentioned even more frequently, and I'm sure content creators took note of this one as well. Hell, at times I think Jim gets watched more by other UA-cam content creators than the general public... but either way he's definitely fighting for the little guys on this platform, and they notice. Thank God for Jim.

As small creators we wanted to thank you for making this video. The difficulty in dealing with copyright strikes, and as you mentioned the emotional stress of the process, is a lot. Thank you for taking the time to talk about it and also to describe how the steps to resolution have changed. In the past, when our channel has been hit, we've gone to the internet looking for direction and support and the information provided is not applicable to the new process. We both think it's really important and valuable when larger creators such as yourself speak up for the community at large.

It is a corporation. As such they give absolutely 0 fucks and will always follow the path of least resistance. An average content creator is weaker than even a relatively small business that makes a copyright claim, so they get pushed into compliance. A content creator with the resources to go to court might be stronger, so they get their way. It is truly amazing how far just mentioning that you have a lawyer can get you. I can't afford justice but i have a good friend that (barely) can. Whenever someone tries to pull some shit he just mentions that he will involve a lawyer and suddenly there is a solution for him. You just have no rights whatsoever unless you can afford to defend them.

Makes me wonder why developers like this don't just take the Tommy Wiseau approach and lean into the reality of how his games have turned out. Tommy was just so sincere with The Room, yet he realized he wasn't able to properly communicate his message through the film, so he leaned further into his own sincerity and accepted the reality of the film's impact.

Reminds me of the time I still ran my small channel with videos, disputing and then appealing "Content ID claims", and left with the frustration that claimants not having to prove ownership and/or being in the right ahead of a claim, or facing consequences for submitting bogus claims. Needless to tell, but I've never been taken to any sort of court.

Glad I'm not the only one who thought the, "Leave it," comment and Sony's decision to keep letting this happen, despite the legal ramifications of his theft from major, high-profile releases like Ori, made it feel like this is the result of nepotism at the highest levels of the corporation.
Nepotism is the only explanation I could think of for this. I also made similar comment. That's the most sensible theory to me considering the "drop it" line. The executive can't bring themselves to say no to the son for one reason or another and nobody else can say anything to that executive due to fear of unemployment. But the chance that some execs are being held to account by some kind of organised syndicate, letting them use the Playstation store as a front for a money laundering operation are still pretty high. UA-cam’s (and any other platform’s) obligation is to take down content as soon as they receive a takedown request (assuming they wish to retain their protection from litigation - Spoiler: they do). Their lack of liability is the entire point of the exchange, and once they have discharged their obligations they are off the hook. Any punishment is then down to litigation. Hate to be that guy, but the Spear of Destiny is another name for Longinus Spear, the one that finished off Jesus Christ. The reason why it was used in the expansion of Wolfenstein 3D is because some people believed that the nazis had at some point the afore mentioned spear in their hands, thus making it a fitting name for an expansion pack of a game about killing nazis. It seems like that works a lot, "if this isn't fixed you'll be hearing from my lawyer!" When I was getting screwed by the owners of the apartments I previously lived in I had to make that threat and they literally fixed their behavior within seconds. They kept charging me an extra $300 a month due to 'late fees' because they were claiming that my rent wasn't getting to them in time, I first tried to mend this by having them sign the check when they received it, I can't remember what the service is called but it's a special service you can pay extra for at the post office, regardless of this they kept sending me late fees, and charging fees and filing fees and examination fees, all kinds of fees which eventually got up to $900 one month, working minimum wage I couldn't afford this and I couldn't afford a lawyer but I finally got fed up enough that I called them and tried to talk to them about this behavior because it seemed like it was getting out of hand and they had just sent me another notice claiming they had not received my rent. Instead of talking about things like rational adults they just told me to pay everything or I would be getting evicted and sued, so I said "fine, I'll just see what my lawyer has to say about this," then hung up the phone, I wasn't hostile, I wasn't aggressive, I just said that calmly. Again, I was working minimum wage which was about $9/hr in that state about that time, we were so poor at that time that I can recall literally having to choose between getting diapers for my baby or buying her formula, so obviously there was no way I could ever afford a lawyer, they called me back within 20 seconds of hanging up the phone (I'm not being hyperbolic) and said "oh, I see on my desk here that your rent check's right here, we'll wave the late fee, we're deeply sorry about this and hope you have a nice day!" Which was actually hilarious to me since they had just been saying to me no more than a minute prior to this that "my type" of people just don't like "growing up and paying their bills," after that all the fees stopped, miraculously they could no longer find that I was in the wrong for anything, despite my behavior not changing in the slightest.
I am somewhere between "Hell yeah! Give that bastard a bad time!" and "It is unfortunately probably not worth the money, stress and effort to go after him...."
One day game devs and movie studios will learn that transformative criticism isn't the same thing as copyright infringement. In the meantime, the license holders will continue to abuse UA-cams tools and we'll all keep on doing this song and dance until we all die.

Yeah, this is why SOMEONE needs to chase and dog-down someone who tries this at some point. We absolutely need someone to set that precedent. I feel like it's the only way we are ever going to break out of this broken system.
However, I totally understand Jim deciding to not be the one to do that. Clearly, they've got enough on their plate to deal with already, and while certainly amongst the more successful of UA-cam content creators, with even some level of industry recognition (just ask Randy), it's not like Jim's quite the behemoth or titan that someone like TB was or Pewdiepie is.
Ideally we could do with someone who is an independent content creator, but is technically owned by some massive corporation, to be singled-out and targeted by someone who isn't aware of their connections - and then just let their limitless wealth parent company's army of lawyers take the malicious individual who made the false claim taken to town, and refuse any attempts at settlement. Make it as public as possible. Make an example of them. Establish that precedent without any room for doubt.
Unfortunately, I feel like finding a massive limitless wealth corporation that cares more about doing the right thing, even just once, than making their limitless wealth irrelevantly more limitless, would be basically impossible.

I appreciate that Jim took the time to acknowledge not only that what Gilson did was wrong, but that if Gilson had attacked a smaller creator, without the resources to lawyer up or miss work, they, despite being innocent, would have lost their channel. UA-cam definitely acts on a shoot first, ask questions later basis. They don't even use human beings to verify misdemeanors. If a robot is offended by something you've done, you're punished. You can fight it, but most people don't have the time to, and Jim notes how unresponsive UA-cam was to begin.
I've literally tried many times to reach Google over the years of my gamedev career. I've ALWAYS got robot replies. Never once a human.
For instance, my adventure game on PlayStore which was split into several apps (one per chapter) was suddenly removed 3 years after because of duplicated content (??). I complained about it. Then Google... reinstated half of the chapters. Like, chapter 2 and 4 but not 3. How could a human do this?! The truth is, no human did. It was all automated. In the end I had to restart my app from scratch. I lost all the data, ratings etc so my game is now making 1/10th of the revenue.
Oh and Google considers that my new game BROK isn't mine when trying to claim my entry page. Despite giving them my ID card, my company creation form, and many screenshots of social networks - all the stuff they ask for. And when complaining... I only get automated replies. Going in circles.
I gave up. Now I'm just crossing fingers to never have a real problem with Google.
I am even more impressed that Jim got fucking UA-cam to bitch out and capitulate. Perhaps UA-cam itself realizes they can't just scare people off with the threat of lawsuits, that they themselves are complicit in the false DMCA claims.

My adsense account was disabled due to being clickbombed on my website by an old friend I terminated said friendship with.
Google have never reinstated it and found that I was the one in violation, because I never reported the clickbombing.. after finding out about it after my account was disabled.
This was in the early 2010's. They still, despite any attempt at contacting them, give me back the same robotic "nope" response.
I was learning game and web development and was going to put effort into a UA-cam channel, back when you actually had a chance. All of that is dead now because of Google's actions (or inactions)... and I'm basically living on the edge of poverty due to other circumstances in life.

That's pretty much what's happening. UA-cam wants people to be afraid of committing to going to court so that they'll just drop their disputes. No one running UA-cam wants to actually put the effort into policing this community. As has been demonstrated here, when someone pushes back and says that yes, they do want to pursue this legally, UA-cam backs off as soon as they possibly can so that they can continue to do nothing, because an actual court case requires effort. Burying their heads in the sand whenever #WTFU happens requires no effort. Waiting for criticism like this to go away requires no effort. Addressing any of this actually requires effort they reserve for appeasing their actual source of income, the advertisers.
They do that so they can freely destroy small content creators who lack the knowledge and resources to defend themselves.
Google's already trying to lay low what with all the antitrust monopoly lawsuits being thrown about. They'd be stupid to get tangled in a lawsuit now that would sway any more public opinion against them that could cost them the big lawsuit. The public opinion directly wouldn't play in court. But you get enough constituents pissed off and they start drawing the attention of politicians, any common sense goes out the door because politicians will happily make an example of you to cater to public opinion. Any company trying to stay under the radar would be crazy to try to gamble with that wild card.

It's a very modern day scenario, especially in America, money makes right. If you have enough money you can get yourself out of pretty much any situation. But if you are lacking funds you can have any number of injustices piled upon you and be forced to accept them.
Many governments outright refuse to regulate such behaviour, and will take the side of the corporation/wealthier party when push comes to shove. While I'm glad Jim won this, it isn't a realistic scenario for most people who might end up in this situation. Which is the point he made towards the end.
We can be happy for Jim, but honestly I see this shit getting worse over the next few years.
I've also heard a number of other UA-camrs namedrop Jim's "Copyright Gridlock" move he pioneered to spite the copyright trolls. It is a corporation. As such they give absolutely 0 fucks and will always follow the path of least resistance. An average content creator is weaker than even a relatively small business that makes a copyright claim, so they get pushed into compliance. A content creator with the resources to go to court might be stronger, so they get their way.
It is truly amazing how far just mentioning that you have a lawyer can get you. I can't afford justice but i have a good friend that (barely) can. Whenever someone tries to pull some shit he just mentions that he will involve a lawyer and suddenly there is a solution for him.
You just have no rights whatsoever unless you can afford to defend them.

Makes me wonder why developers like this don't just take the Tommy Wiseau approach and lean into the reality of how his games have turned out. I also made similar comment. That's the most sensible theory to me considering the "drop it" line. Their lack of liability is the entire point of the exchange, and once they have discharged their obligations they are off the hook. Any punishment is then down to litigation.
Not only might they not wish to take fines, it is entirely outside their legal responsibility to do so - I am no expert, but it might even be unlawful, just as it would be in certain jurisdictions for an employer to fine you for committing a crime outside of your work.
It is the equivalent of suggesting McDonald’s should take fines for someone stealing your fries.

The craziest part of this to me is that Sony still hasn't taken down any of Gilson's games, and I doubt they ever will at this point. Whatever power Gilson has over Sony is mysterious and vast, and I hope that Jimphanie Fucking Sterling Son can solve the mystery someday.

Its interesting. Sony was willing to take down Cyberpunk 2077 because it didn't meet their standards of quality, but Gilson's games have so much quality that they threateningly advise anyone looking into him to back off because they so desperately need his games on their storefront? I'd almost agree with the tax scam angle; that would explain why he gets a free pass from Sony, they likely work high up in the company or are cutting the company in on the scheme. But what I don't get, is if you had a successful scheme - if your shitty games were falling into the realm of lighthearted meme - why the fuck would you draw this sort of negative press and undue attention to yourself? Surely that has no outcome other than exposing whatever the operation is, if there is one.
Honestly even if your efforts are through exhaustion of dealing with these unfair systems and claims, the fact that you are continually willing to legally defend your self and create precedents to defend rights of content creators is really admirable, god bless Jimsterlingson

It seems like that works a lot, "if this isn't fixed you'll be hearing from my lawyer!" When I was getting screwed by the owners of the apartments I previously lived in I had to make that threat and they literally fixed their behavior within seconds. They kept charging me an extra $300 a month due to 'late fees' because they were claiming that my rent wasn't getting to them in time, I first tried to mend this by having them sign the check when they received it, I can't remember what the service is called but it's a special service you can pay extra for at the post office, regardless of this they kept sending me late fees, and charging fees and filing fees and examination fees, all kinds of fees which eventually got up to $900 one month, working minimum wage I couldn't afford this and I couldn't afford a lawyer but I finally got fed up enough that I called them and tried to talk to them about this behavior because it seemed like it was getting out of hand and they had just sent me another notice claiming they had not received my rent. Instead of talking about things like rational adults they just told me to pay everything or I would be getting evicted and sued, so I said "fine, I'll just see what my lawyer has to say about this," then hung up the phone, I wasn't hostile, I wasn't aggressive, I just said that calmly. Again, I was working minimum wage which was about $9/hr in that state about that time, we were so poor at that time that I can recall literally having to choose between getting diapers for my baby or buying her formula, so obviously there was no way I could ever afford a lawyer, they called me back within 20 seconds of hanging up the phone (I'm not being hyperbolic) and said "oh, I see on my desk here that your rent check's right here, we'll wave the late fee, we're deeply sorry about this and hope you have a nice day!" Which was actually hilarious to me since they had just been saying to me no more than a minute prior to this that "my type" of people just don't like "growing up and paying their bills," after that all the fees stopped, miraculously they could no longer find that I was in the wrong for anything, despite my behavior not changing in the slightest.
I am somewhere between "Hell yeah! Give that bastard a bad time!" and "It is unfortunately probably not worth the money, stress and effort to go after him...."
One day game devs and movie studios will learn that transformative criticism isn't the same thing as copyright infringement. In the meantime, the license holders will continue to abuse UA-cams tools and we'll all keep on doing this song and dance until we all die.
