    I feel she was saying no, no, no for 47 seconds because he was carrying her towards the balcony. And he had mentioned chucking her off, so of course she was terrified. Him saying he would let her go home except she's been a bad girl, tells me everything. He could have opened the hallway door and put her out there, but he chose the balcony for a reason.

If the court got this decision wrong, then everyone who has ever been found guilty should be innocent then. Also it wasn't kidnap, she went to his house voluntarily as shown on the cctv..

    The fact that he was found not guilty after the recording explicitly reveals that Warriena begged to just "let [her] go home" and Gable straight up replies with, "I *would*, but you've been a bad girl." How on Earth could they think he was innocent!? He chose to trap and lock her out on a 14 story balcony instead of letting her go home like she begged multiple times! Unbelievable! Not to even mention that he audibly physically assaulted her while she apologized and asked to go home. I'm glad his full name and psycho face were broadcasted so that women can avoid this psychopath. The dude even had the audacity and presence of mind to stomach eating some freaking pizza after everything that happened. Pure insanity on so many levels.

      I'm so glad the law isn't decided by emotions. Even if one agrees with every point- she apologized and then begged to go home and he wouldn't let her. Up until he puts her outside and closes the door you think everything he did was wrong and everything she did was pure altruism- what then? Once she is alone outside on the balcony she has choices; wait even more than 27 seconds and maybe he will let her back in. Call out to other tenants or to people on the street- 17 floors is not impossible to hear. Grab a table or chair and threaten to smash the door.
      No. Instead she chooses to climb up and over a SAFETY RAIL 17 floors in the air and attempt to Nathan Drake her way to another balcony!? Gabe didn't force her to be drunk and he didn't force her very rash decision on that balcony. You want him to go to jail because he was "mean", that's one thing, you might also get a kidnapping charge to stick, though she was not out there long at all and she was throwing rocks and swinging a telescope piece- if she's not fully dressed and if she still has stuff to find but she's behaving like a lunatic, perhaps the idea was to let her cool off for a moment. It's not the worst idea.
      People keep citing the begging and "no!" repetition, but you never take into account that she switched over from aggressive, rude and threatening while actively assaulting to playing the complete victim. How does he know she won't just continue on the same if he puts her down? He chose to put a barrier between them- not a bad idea. It's his choice of barrier that is questionable, but any room in the apartment would Almost certainly qualify as kidnapping and throwing her into the hall would have interrupted neighbors and made a scene, so he thought "outside in fresh air"

His log about trying to pick up one of his tinder dates and carry them back into the apartment prior to her running home and blocking him gave an insanely weird impression. But his saying "you're lucky i haven't thrown you off my balcony" after having tried to get her out there every time she said anything disrespectful made his murderous intentions blindingly obvious. Definitely premeditated

      this recording is cut down. in the full recording you hear her screaming, him closing the door seemingly panting from the physical exhaustion AND THEN her distant, muffled screams. He wasn't near her when she fell so it isnt technically murder. Though i do wonder how he wasnt charged for involuntary manslaughter at the very minimum

    He was twice her size, a bodybuilder, possibly on steroids. She was not beating him up and he didn't let her leave when she wanted to. He also plied her with strong alcohol when she was already drunk. He orchestrated her death and the fact that he walked away Scott free is quite frankly astonishing

      I was thinking thr same thing! I don't know how they possibly could have found him not guilty after listening to his own recording!
      The other person who should be ashamed of themselves is Gable's father! The fact that he never sounded shocked, surprised or even alarmed during their call speaks volumes about what Gable has done in the past. Also, his father picking him up and bringing him home, knowing everything that just happened is astounding! There's absolutely no way that my mom would have taken me anywhere but back to the scene to talk to the officers! With this kind of enabling, it's no wonder that Gable is the entitled little bully he is!!

Yes that is the law and they can tell you that you need to convict based on the law and that the burden of proof is on the prosecutor but you don’t actually have to do that. If the jury decides to convict without “definitive” evidence that is legal. That may not have been enough evidence for the law but it’s enough for me if I was on the jury. The same goes the other way if there is video of a guy shooting someone and the evidence is clear, but I personally feel it was justified because the guy he shot hurt his child in the past, then I would not agree to a guilty verdict if I was on the jury

    It's very clear by the audio that he killed her. He was saying things like let go and yet you can hear him strangling her. He was saying things to make it SEEM like he was defending himself. Really putting on a show. It was SO obvious. He knew he was recording things.

      Yes. He beat her up and thought he might get in trouble for her injuries, so he threw her over! That way her injuries would be thought to have come from her fall.
      Sadly he has lots of admirers. In the jury and in public. I even bet a young female jury member contacted him later to hook up! This is just the way the world is!! We are what we area!!

      So had he let her go, she would have still been alive today.

    I'm from Australia and this case was ALL over the news when it happened, it was so blindingly obvious that he was guilty. The national outrage was palpable. There were also multiple women who had met him/gone on dates previously with him, who came forward, all of their stories were eerily similar. It should also be noted that he had Warriena's phone in his pocket the whole time - he *finds* it while on the phone to his father afterwards. Violence against women in this country is not treated seriously at all, offenders are given so many chances - even just this week a 21 year old woman was stabbed to death in front of her 3 year old son, by yet another deranged man who had already shown so many red flags. They just don't care about us here. RIP Warriena

    He was definitely trying to throw her over when she was screaming “No no no no no!!” and he kept telling her to let go because she was gripping the railing. The terror in her screams is definitely that of somebody who thinks they’re about to die. That’s why she was facing outwards. Nobody trying to get down from a FOURTEENTH FLOOR balcony is going to do so facing outwards. Period! He got her over and she was gripping the railing and he just left her like that because he knew she’d fall. Not only did he actually mention throwing her off the balcony, but he tried several times to get her to look for her phone out there. He was TRYING to get her out on the balcony. Did police ever investigate the phone situation? Did they find her phone? He knew exactly what was going to happen and it’s exactly what he wanted. He didn’t even bother to look over. Anyone, I don’t care if they’re getting along or not, anyone would freak out at somebody falling 14 stories to their death right in front of them. He didn’t even do much as flinch, didn’t bother calling police or ambulance, and actually ate f*cking pizza. Again, nobody normal would have an appetite after that sh*t. He’s clearly sick! And the fact that the neighbor said they had heard screams just like hers weeks before….. he probably tried it then with another girl. He gets extremely aggressive sexually and it freaks girls out and they probably fear that they’re going to be r*ped so they try to leave and it pisses him off. He’s a straight up weirdo! It broke my heart to hear her screams. Those could only be described as the screams of somebody who KNEW they were going to die. And her saying “I just want to go home! I just want to go home!” is even more heart breaking.

      I love these arguments people have- so she’s drunk and not to blame for throwing rocks, he is drunk, getting hit by rocks and is supposed to assume if he puts her outside, she will jump! Was she even dressed? So he should throw an half dressed, wildly unreasonable woman into the hallway of his apartment building at that hour?
      I’m not saying he’s a good guy- he seems to be slime, but what he did was not beyond reason. She was behaving poorly and doing damage to the apartment - and I don’t care what size you are, rocks hurt. She also grab a piece of a telescope to hit him. So he put her outside to cool down. She wasn’t out there for even a minute and it wasn’t freezing, so why she chose to go directly over the rail is insane.
      It’s tragic. He didn’t make the best choices, but in no way did he cause her to climb over that rail and try some Uncharted move.
      In the end, he is SO LUCKY he had that recording because even with the evidence, people want to assume the worst of him and the best of her.

That's why with just the audio, I won't make a judgement on murder. If she climbed over to try n climb down, I don't believe her feet would've been facing out but rather toward the building.

Seems like your average person who wanted to document the wild things happening around them would opt for recording video more than those who would opt for only audio. Definitely wouldn't be my first instinct. I guess he was trying to conceal it, maybe? But at that point it seemed like she was drunk enough to probably not even notice the phone as much as if she was sober. His past also leaves me with some bias as well. They were both insanely drunk as well so nothing good could have really come out of it aside from her just leaving.

She probably wasn't even used to that hard liquor and it makes some people mean, but even if she was mean, he should have just waited for her to sober up, and if she got to be too much put her out the front door and lock it. It’s very plausible that he could have tried pushing her over facing out, which would have occurred during her screaming No over and over, she grabs onto the railing to stop the fall. He walks inside leaving her there, slams the door and locks it. You would still hear him inside and her muffled yells for help outside, then her ultimate fall. It’s the prevailing theory for those that believe he’s guilty. Also, there’s no way the dude could have reacted quickly enough to grab her unless he was a superhero. He wasn’t on the floor beneath her, he was two floors down. She had already passed the balcony directly below, and was picking up momentum as she rocketed passed the next balcony, even if reacted in that split second and reached out in an attempt to grab onto her, there’s no way he could have gained enough grip to hault the pull of gravity, and move her onto his balcony to safety. Even if he did grab on or get an arm stuck onto her in that split second, the force of her body falling would have probably pulled him off the balcony to his death as well. Dudes an extreme weirdo loser. I bet every single woman left him completely unsatisfied and creeped out beyond belief, which is why he could never have a girlfriend.

    I believe he carried her to the balcony and put her over it, she grabbed onto the railing and he left her dangling. This explains the 47 seconds of her screaming no repeatedly. She was terrified.

      Yeah if her feet were away from the building that means she was facing away, holding onto the railing from behind her. She was probably stuck and too drunk to work out how to get back over, and too scared to go back over the railing because he was probably still there basically refusing to let her get back. So she keeps saying no like no leave me alone just let me go home. It also explains why the neighbors couldn't figure out what they were seeing. Because if her feet were facing the building it's be obvious she was falling off and needed help. But facing the other way would mean she's stupidly trying to get down the wrong way

    The several times he said, in a menacing tone 'You don't understand do you....' He knew he was recording himself so he was careful with his words. But the meaning behind it was 'you don't understand how dangerous I am. What I'm capable of' ... A normal man does not threaten to throw someone of the balcony (twice). Her cries of No were haunting. I grew up going to Surfers on holidays etc., and have family that live nearby so was interested in this case. I also know that tradie / aussie tone and the meaning behind it, so I stand by my interpretation. I fully believe he should still be in jail for murder. It is incomprehensible he is free.

    Dude made mostly every woman he came across uncomfortable. He was not charming nor did he have a way with words.
    I believe he felt emasculated from not being in control of the situation. To have a women fight him not only angered him but made him feel weak. He didn't throw her into the hall, call her a Uber, call the police, he kept her in the apartment and I believe he didn't attend to let her go until he felt he had gotten "even".

Immediately before he slams the door, she lets out a louder, longer, more panicked and pleading scream. I think it was the moment she realized this wasn’t just some kind of sadistic joke, and that he was actually leaving her there and walking away.

      This is what I wondered too. He took her out, put her down on the wrong side of the railing and then left her knowing she wouldn’t be able to get back to the right side but that it would give him time to get inside and away from her before she fell so he could show he was nowhere near her and honestly be able to say he didn’t push her or throw her off but he’s still 100% responsible for her falling. There was no way she was getting back to the balcony without falling even if she was sober and facing the building instead of backwards!

    It took 46 seconds because she was resisting him in a fight for her life, as he dragged her to the balcony, held her over the side and eventually let her go! I don’t think she was out there by herself at all, and the audio does not prove that he wasn’t with her. He could have simply set the phone down.

    That was one of the most infuriating “not guilty” verdicts that I have ever heard of in my years of consuming true crime stories. There is zero chance that he didn’t murder this woman. I’m in shock and disbelief that he got away with it considering the damning recordings. She said she would leave and even begged him to let her go home. All he had to do was get her out the door. He had something to prove. Locking her out while she was standing in the balcony would have been forgivable and cause reasonable doubt, but we can clearly hear that isn’t what happened.

    You can tell everything in the tone of his voice. He is saying all the right things, but in the most relaxed tone ever. If an innocent human being went through what he described, they would be hysterical. I've noticed thats where a lot of guilty criminals mess up. They think that being calm makes them appear innocent, when in reality its the exact opposite. Innocent people freak out, and raise their voice and ask the police questions if they're being interrogated. I've watched enough true crime to know that the calm ones are usually guilty.

Not saying that's an excuse to get violent, but what I think happened is he was doing things to piss her off, taking her phone, you can hear hitting& objects being thrown, (and we don't really know who was doing what, we just have his word and I'll take that with a grain of salt) Who knows what else he was doing to make her mad so that he had an excuse to push her off the balcony. Unfortunately we only have audio and no visuals, we can hear him saying things like "I should never have given you so much to drink. Im injured and you don't have a scratch on you. This is bullshit. You're lucky I haven't chucked you off my balcony." He got her drunk, and then made remarks to make it sound like she was being violent on the recordings and then threw her off the balcony. She screams "No, I'll leave" and he still continues to drag her onto the balcony. Why didn't he just let her leave? I think he knew exactly what he was doing. 7 years later and he has more allegations. Dude is a creep.

    She was saying " let me go home". She did NOT jump. He dangled her off the balcony & let her fall to her death in a disgusting fit of rage. He had just replied "too late for that" when she said just let me go home. He didn't even see her as a person, like all the women he "dated". Then she starts with no and it seams dramatic but then you can her hear continuing to say no when they're on the balcony so there it's probably no don't kill me. But what is 100% proof, no guessing, is that the hairdressers underneath see her dangling while she is saying things that he recorded before he clearly closes the balcony door. So when yoi combine these 2 things it's 100% and he should have been convicted, don't understand hiw they did not reenact simultaniously what they heard/ what he recorded, crazy.

    Just from the recording, it should be obvious for anyone with half a brain , what really happened. When she said NO for 47 second, he was carrying her toward the balcony , had her by the hands and she was trying not to get over the railing with her legs getting clingy. After 47 seconds he got her legs over the railing and put her hands on the railing , knowing she will cling to it , all this time she was with the back facing the building. Then he went inside and after 30 seconds she couldnt hold on anymore. That is why, he wasnt with her at the time of the fall . Prosecution was trully incompetent or really stupid. I cant believe this is possible, quite outrageous

      This is the most accurate statement I’ve read on this horrific incident. If her hands were on the very top of the railing, rounded metal, she could’ve held on and climbed back over. The problem is, her hands were gripping the cement part of the terrace which is much lower. It was only a matter of time she would lose that grip.
      The only part that I’m completely confused about is your comment reiterating that her back was facing the building. That’s incorrect. Her back was facing the street. In the graphic image from the neighbors terrace 1 floor below, you can see the front of her feet dangling off the terrace, which means her back is not facing the building. What am I missing ? Thanks

      This is why "you were always understanding he was innocent FOR SOME REASON" , that reason being, YOU ACTUALLY LISTENED TO THE FULL RECORDING prior to her fall, that's what made it clear he was innocent , fear files made sure to cut it out and narrate it instead.
      From the start he wasn't being objective at all, at every step he put made "innocent" but very suggestive questions or comments taking you by the hand it order to lead you to the conclusion he wants you to reach
      So yes, most ppl who watched this that hadn't known this case very well would end up being led astray like you were . You should make your own decision, not just let some skewed representation of things decide things for u
      Toastee had several hobbies caring for animals he had rescued, I don't remember the name but you can find it, however he was presented as a pure predatory criminal "TOWERING X height Y pound" compared to the "timid,small frame, x pound and y height"
      Anyway if you want another channel that stays neutral and doesn't manipulate the evidence, there's betters that stay objective on this case
      All this to say if things had happened as the fear files is trying to portray, there would have been an unanimous decision to find him guilty of murder

    He clearly wasn’t in fear for his live he could have called the cops at anytime! The recording is chilling. When he wouldn’t let her leave because she was a “bad girl” made me feel physically ill. He definitely gave her too much alcohol on purpose to take advantage of her and then kicked her in the balcony while highly highly intoxicated and terrified clearly so terrified she felt she needed to climb off the balcony.

I wouldn't have to be drunk to be terrified that someone didn't shove me out the front door and instead locked me on a balcony, after not letting me leave. I probably would have tried climbing down the balcony as well in that situation. He obviously wasn't terrified of her or he would have let her leave or tossed her out of the door.
