    The way Shkreli went about the price hike was that he forced insurance companies to pay out big time, they didnt like that and went full force on him. He stated that if there were ever the case that anyone actually needed the drug and couldnt pay(drug was needed for a very rare disease), he would give it for free. The money collected from frau... Insurance companies were used to do research and development for newer drugs. With all the ire raised against Shkreli, they finally managed to pin him for threats against a presidential candidate for putting a bounty(obviously a joke) on Hillary Clintons hair. Of course, all of this smearing done maliciously against Shkreli by MSM knows no end, glad you're contributing.

    At one point you say "he is prohibited from replicating, duplicating or exploiting the album for personal gain" and then you describe how he was allowed to exploit it per the agreement. "For personal gain" is doing a lot of heavy lifting there I am not seeing a lot of profit in sending copies to 50 people for free. Discord is not a 'Normal Venue" and the agreement would have been broken and void for him once he was forced to sell it....for profit, to pay the state. I think he is slimy enough to wiggle out of this.

    PleasrDAO only owns the physical copy, Wu-Tang still owns the copyright. If Martin Shkreli would be sued by anyone over file sharing it would be WTG, but I doubt that'll happen precisely because of what the album supposed to protest especially considering who owns the only released copy it now.
    Can I sue someone that shares the a digital copy of the Clerks DVD, because I own a physical copy of the DVD? No, as I'm not the copyright holder. Could View Askew? Yes.

In Europe in multiple countries you are explicitly allowed to do a bunch of private copies of any media you own. You are just not allowed to sell them for profit as a business.

    The problem isn't that medicine prices are jacked. See, Pharma knows the people who need the medication have no way of affording it on their own. It'd be suicide to try and charge that kind of money. They do it because in the states insurance is one of the biggest scams going, both medical and vehicle. Medical especially. The reason medication and medical treatments, even simple hospital visits, are so god damn expensive is because insurance companies will pay it and the industry knows that. So they can rake in cash simply by price gouging everything. Which in turn makes medical insurance more costly than it needs to be because the insurance companies want to make money too. Car insurance is the same way. Rates are based on what other people do and not what you have done or do. Honestly insurance in general needs to regulated to prevent this kind of bullshit. It'd bring medical costs way down and avoid the situation where someone being saved from a stroke or heart attack, or some serious disease, aren't bankrupt over it. Some Aussie visited and went to the hospital after a snake bite. They got slapped with a ten thousand dollar bill for something that would have been free back home. It's fucking insane.

    I don’t know him. He may be a bad guy. What I don’t like is when the government goes out of their way to look for a crime because they don’t like something you do. In this case his medication prices were perfectly legal but the government in a effort to punish him started investigating him even though there was no probably cause to do such. This happens all the time and should be alarming to everyone.

      Well, they didn't just go after him because they didn't like the stuff he does..... he was an employee and party to a hedge fund company that committed crimes. They were investigating financial crimes in the company, which showed them he was working at the time the crimes were being committed and even further that he had knowingly participated in said crimes. So they had plenty of probable cause to charge and arrest and ultimately jailed him for committing crimes. The federal government does not go after people frivolouslly or with out cause. They have something like 98% conviction rate. If what you said was even remotely the situation many many rich people like skelly would've been taken down by now.

Prescription medications require a doctor in order to obtain. You need insurance in order to get a prescription or see a doctor without paying even more money. So if this was the price he made the insurance companies pay do you know who gets fucked with the cost? The people who need the medicine so the insurance company will charge even more to the patients. It's cute that you believe the bullshit Martin says but if that was true at all then it would've happened. His company still exists he just doesn't own or work there anymore.

      What i remember is that he only charged a ton for insurance companies, but gave it out for free to anybody without insurance. He claimed he wanted to use the proceeds to develop a new generation of the drug that had fewer side effects. Not sure if what he claimed was true though, and i can't say i trust my own memory since its been so long.

    "DMCA sucks, BUT." In regards to copyright, that "explicit" legally binding agreement is there for any copyrighted work. I think this album probably goes a step further by not allowing ANY COPIES, regardless of profit. Imagine not having a backup copy of the most expensive album's DIGITAL DATA? Whether or not the album gets leaked, the physical product is still going to hold a majority of its value cause of the history behind it. Burying its dissemination just removes it from the spotlight and cultural impact, in my opinion. This inadvertently getting Shrelly back in prison IS based, though.

    An .mp3 file is not a reproduction of the album. Best I know, it is an imperfect digitally compressed approximation of the album. How much legal utility this has, IDK. Also, I assume the original licensed album was on vinyl. Yes? No?

      Not my area of expertise, but I'm taught that CD's do not have files as a computer would recognize. Rather, they have a digital stream; one continuous stream. It takes specific software to extract a song and convert it into a file. The .mp3 compression is "lossy." So, from an .mp3 file the original portion of the CD digital stream could not be recreated. If anyone knows this better, please speak up.

      @@Provocateur3 That entirely depends on how the CD was made. It can be the normal CD audio format like you described, or it could just be a data CD with mp3 files pressed/burned onto it. Only the one who made the CD and the actual owner knows for sure. Also the "specific software to extract a song" is trivially easy to find, not at all a secret or illegal thing and widespread for decades now.

      It's not so simple as you put it.
      Apologies for the long message but I think dumbing down an issue like this is bad.
      Daraprim is a toxic drug aimed at treating Toxoplasmosis, a parasite common in rats, cats and cat owners. One of its effects is that it changes the brain of the individual so they will become more prone to aggressive and risky behavior.
      The active chemical in Daraprim has potentially terrible side effects and because it is not such a common disease there has barely been research into new drugs.
      The problems of the supply-side
      A) By jacking up the price Shkreli argued that it poses an incentive for both his pharma company and others to fund research for new alternatives. An example of this happening was AIDS, which due to how huge of a problem it was meant that it was profitable to come up with solutions fast.
      B) Most medication in the U.S is provided by insurance companies that alongside pharma have the main power to determine pricing. Although this is not 100% the truth as it depends on the disease the medication is aimed to treat and whether said disease is a strong or weak area of focus by pharma and whether there are viable alternatives in said area of focus, the case can be (not necessarily should be) made that the Daraprim price hike impacted the insurance companies and not the customers/patients, particularly when the drug is a niche product (if, say, this was a common medication percentage-wise then the price hike would be much more noticeable for said insurance customers via their contribution payments).
      C) The reasons why medication is so expensive in the U.S are multiple, and government programs and regulation are to blame too. Some think the patent system allows companies to get away with charging insane prices (at the same time if there is no incentive for profit then companies will simply not invest in R&D because it would be an expense without payoff). Some argue that healthcare in general is extremely closed as a sector due to licensing and accredited requirements and that this creates an artificial oligopoly with too many barriers to entry. This allows the incumbent insurance companies to have barely no competition, which drives up their ability to charge high insurance payments to customers while preventing others from entering the market and driving prices down.
      Some point that Medicare and Medicaid, which are public spending programs, run at a huge uncontrolled deficit which means that companies in the whole of the healthcare industry are allowed to charge whatever they want because the taxpayer is footing the bill (now and in the future, similar to the problem of student loans which promoted by government enable Ivy League universities to keep raising prices year over year).
      On the demand-side
      D) The U.S, while a rich nation, also has some of the lowest life expectancies adjusted for average per capita GDP. It's the country with the most advanced healthcare technology while at the same time having huge problems with obesity and a tendency for relying really quickly on medication and being weak on certain regulations (Teflon, Forever Chemicals, Microplastics, Heavy Metals, Trans Fats). If Americans had a better diet (culture, less processed food) and doctors were less prone to overprescribe, then perhaps due to the lower demand healthcare would not be so expensive. Perhaps you would not have had such a huge opioid epidemic if doctors were more diligent, patients were more diligent, or the FDA had cracked down harder on companies like Purdue or their own officials then going to the same pharma companies they regulated.
      As you can probably see, whether you agree entirely or partially with the points raised, the issue of this price problem goes far beyond Shkreli, and to me whether what he did was wrong or not is not entirely clear, but I don't think it is just a greedy rationale. His company was also struggling and you will find no business in the world that can maintain operations by losing money. Sometimes raising prices is about surviving as much as it can be about being greedy.
      Issues are often more complex than our intuition tells us.

      @@Haydos That is how it works, though. You can write all you want into a private contract. If anything of it goes against a law, that part of the contract is void and unenforcable in court. For instance you cannot sell yourself into slavery. Even if you willfully sign a contract that states "I sell myself to X.". If X tried to enforce his right to you before a court he would be laughed out of the house. Because slavery is illegal.

They purchased that album fair and square just like any other buyer and have held (hopefully) honestly to the agreement of said purchase, then this sore loser who’s upset his Ill gotten gains was taken from him and purchased by another to cover his blunders is now freely distributing that album against the rules and agreement just to devalue the item because it’s not in his possession. If you truthfully still think this is fair just because the victims are “crypto bros” who have arguably done nothing to you that is publicly known.. your … your not somebody I want to keep watching.       For all we kow it could have been a shoddy data CD with mp3 files burned onto it in the first place. I somehow doubt this went through a proper CD press, as it is a unique piece.

    The feds rarely get involved in copyright stuff this small.
    Yeah the album sold for millions, but that's chump change in the online piracy world.
    It's also probably not going to grab any headlines.
    IMHO, this lawsuit is kinda screwed.
    The major problem i see, transfer of ownership.
    Is the original contract, if it actually exists, even enforceable?
    And, as the feds seized the album, was the contract legally transferred, or simply ownership of the physical album?
    Jodorowsky's dune book was an apres pro example here.
    I also think, based on various articles from the time, that Shkreli may have a get out of jail free card on this.
    From a press release in 2015, wu tang said that the album can't be commercialized, i.e. put on a streaming service for sale, or copies made for sale, but that it can exhibited publicly and be given away.
    Gonna be interesting to see how this plays out, looking forward to updates in the future.

    Countless artwork, such as the Mona Lisa, have many photocopies, but these copies do not affect the price or value of the original artwork.
    Similarly, this album can be copied a million times and distributed for free, but that won't impact the value of the original album. The original remains unique and irreplaceable, and digital copies do not diminish its value.
    Additionally, only the copyright owner has the legal right to sue for copyright infringement, not any third or fourth owner who bought the album from a previous one.

      Agreed, I dunno why WTC are getting their panties in a punch when the value sits on the physical medium holding the songs itself, NOT THE SONGS in the album. How many times do we see limited editions of things that the digital contents are the exact same as the non-limited, but the physical items in those editions are what justify the difference in price?

They have said themselves that it's unbearable or bad and from the bits I've heard of it online I would agree with them on that. The songs are not really that good. So in the case of this album the thing that gives it value is the rarity. Which begs the question of why make it in the first place? Make something good that people will enjoy and carries the same value despite being copied, rather than making something that's either meh or 💩 and is only worth something based on rarity.

    At my time of watching this video there are 8 comments. One is from the Upper Echelon, one appears real as it references the content of the video, and the other 6 appear to be bots posting random crap. I'm assuming this is some sort of scam related thing to make them seem like real accounts that have engaged with content. Maybe something you can do another video about. Edit: Glad someone cleaned them up but now I've seen the same scam accounts posting comments about Call of Duty balance changes in non-Call of Duty videos. WTF is with UA-cam.
