Jone's team was TRYING to get a mistrial. It was his only way out of this particular trial. He had already lost because he refused to turn over information, so his only hope of trying to start over from scratch is getting it declared as a mistrial. No lawyer would behave like his have unless they were intentionally trying to throw the case. The opposing council was smart to bring it up in an attempt to get out ahead of their plan. I read that in Texas punitive damages may not be higher than compensatory damages. The 45 million awarded in punitive damages are likely going to be reduced to the amount awarded in compensatory damages.

Jone's team was TRYING to get a mistrial. It was his only way out of this particular trial. He had already lost because he refused to turn over information, so his only hope of trying to start over from scratch is getting it declared as a mistrial. No lawyer would behave like his have unless they were intentionally trying to throw the case. The opposing council was smart to bring it up in an attempt to get out ahead of their plan.
