With my songwriting method, every song I view in the “key of c”. I never use Roman numeral analysis from minor. I always do it this way. Key of c is all white keys. So I prefer this way as it’s simpler to teach and understand
It's called sampling and he didn't rip it off. He sampled the whistling and made the melody different whilst making it into something different. Nothing is original but there's a difference between taking something and making it into something different and ripping something off.

Avicii didn't write the melody for Fade Into Darkness it comes from Penguin Cafe Orchestra - Perpetuum Mobile, he sample that one from them.
