My wife was his next door neighbor through middle and high school. He gave her the creeps more times than she can count. Especially after he volunteered for a youth camping trip. I guess he was trying way too hard to impress all these younger girls to like him in the creepiest ways imaginable. My father in law actually went to his house and told him not to ever approach, talk to or even look at his girls.

It's difficult to understand this story without in-depth knowledge of the LDS faith. The LDS is a patriarchal system- the man, the husband, is the leader of the family both spiritually and financially. Whatever he told her, she believed. The LDS faith relies on feelings and emotions to instill and encourage belief. If he convinced her that he'd had visions of her death, and of her in the Celestial Kingdom, and that his girlfriend was meant to be his second wife, and her sister wife for eternity, of course she would work to befriend her and make sure that everything was as good as it could be for her children. Also, anyone who has ever attended an LDS meeting has seen first-hand how they're trained from childhood to "turns tears on and off" while bearing their testimony of the truth of the Church. That's all his testimony in court was- a different kind of testament meeting.

The local LEOs acted as though they had never investigated a homicide. My Rule #1 in ALL death investigations is "Investigate ALL deaths as a homicide until PROVEN otherwise." The reason being once you've released the scene, the body, the suspect, the witnesses, and the evidence you'll never get them back. I once spent two days at a crime scene (where I also slept) to process it. It turned out the victim had died from an epileptic seizure but I also had a crime scene of a suicide which turned out to be a homicide. Not every death is what it appears to be but only a thorough investigation will find the truth.

I know this isn't the biggest issue here, but I'm astonished that the PA prescribed ambien plus a muscle relaxer following an injury like this. Both medications cause sedation, and should not be taken together. Muscle relaxers cause so much sedation that they're usually enough to induce sleep on their own. That is terrible medicine.
I took ONE 10mg ambien 5 yrs ago & it knocked me out for 10 hrs! I was 59, have been resistant to medications as long as I can remember, always sleep at most 7 hrs, normally 6. Those are strong sleeping pills, Faylene was knocked out! Seems obvious that he gave her few drinks & the ambien! This is incredibly sad & distressing for her daughter. 🙏❤️
I took an ambien one night at bedtime which for me was 9 pm. My girlfriend had given it to me to sleep. I didn't wake up till the next day at 12. I will never ever take another ambien.

Ooof, I felt that! As a person who used to need, to be needed, I now understand that the unrelenting drive to help was mostly unconscious childhood conditioning. At least that’s how it was for me. It’s not attractive and I’m kinda embarrassed about it now, but I actually did help some people. However, it came at the expense of my health and relationships.

I don't know how many other people are aware of what is commonly believed about when an older man dates/marries a much younger woman, but typically its believed that since they have very little in common, or the same interests, or can have the same conversations, etc, the 2 main benefits for the man are of course that she is youthful & attractive, but more importantly, that a younger woman is much easier to manipulate & control. With that in mind, I find it very interesting that when he claims that he called 911, he says something to the effect of , "I know I called, with the very core of my being," & when his young wife talked about her faith that he wouldn't go to prison, she used the exact same language & phrasing, & combined with her statements that she is in "awe of him," that is exactly the sort of power dynamic an older man would love. She'll do what he wants, even deferring to him on most things, & using the same language is called mirroring, & like the word we draw it from, mirror, the idea is that victims may mirror the behavior of the other person, or you can use it in something like a police interview to make the suspect more comfortable, or many of those gross "seduction experts" in the Manosphere apply it to dating. Its a subtle way to trick the other person's brain into a "natural" sense of connection.

I don't believe she wrote those journal entries her daughter read because when they showed the originals the handwriting was different on every one of them. I know from writing in my own journals my handwriting never changed if so very little not as drastic as what I seen on here of hers. Two different cursive styles then all capital letters? Come on, she didn't write those. Yes their feminine but I bet the mistress wrote em after the fact because of what is said especially the last entry her daughter read. So I don't believe a word he says. I believe he drugged her with Ambien & muscle relaxers & when she took her bath that night the amount of Ambien & muscle relaxers he gave her kicked in & she went under. With two medications that relaxes your entire body & one that makes you drowsy well the muscle relaxers can make you drowsy also. No wonder she became unconscious & "drowned". He totally planned this. I also think he beat her up while they were in the mountains & she didn't fall. Just like what was stated she didn't have significant enough injuries for that type of fall from that height. Also his lawyer saying he took her to the hospital after her fall is incorrect it was stated that his doctor friend came over & looked at her & prescribed her the medications. Sorry this was so long but I just had to get all of this off my chest.

You don't have to, but it is preferable. Put it this way, if someone is on the bed and you can't move them, you do it there, don't waste time trying to get someone to help move them. In this case, he says he'd pulled her out of the bath, so no reason not to put her on the floor. In fact walking across a wet tiled floor carrying someone would be challenging.

This is why any attorney will tell you a jury trial is a crapshoot. Sometimes the jury is just as messed up as the people involved. There was one trial where one woke woman refused to convict a guy, who by DNA and a load of other evidence was clearly guilty, because in her words, "she refused to send another young black man to jail." The other 11 jurors all agreed he was guilty and the 12 woke woman also said she felt he was guilty but would not be the person to send him to jail. I want to say the guy was a rapist or murderer. It was on one of these crime shows. Very disturbing.

Justice should be blind. When you sit through a trial it truly comes down to which attorney put in the hours and was more ready for trial. Understand that most of the prosecutors in big cities see the case a day or so before the trial as they are overwhelmed. Some see it as they open the folder while standing at court. It’s the legal newbie’s back at the office that prepare the brief outline in the folder. Sad but it’s reality.

The LDS is a patriarchal system- the man, the husband, is the leader of the family both spiritually and financially. Whatever he told her, she believed. The LDS faith relies on feelings and emotions to instill and encourage belief. If he convinced her that he'd had visions of her death, and of her in the Celestial Kingdom, and that his girlfriend was meant to be his second wife, and her sister wife for eternity, of course she would work to befriend her and make sure that everything was as good as it could be for her children. Also, anyone who has ever attended an LDS meeting has seen first-hand how they're trained from childhood to "turns tears on and off" while bearing their testimony of the truth of the Church. That's all his testimony in court was- a different kind of testament meeting.

The local LEOs acted as though they had never investigated a homicide. My Rule #1 in ALL death investigations is "Investigate ALL deaths as a homicide until PROVEN otherwise." The reason being once you've released the scene, the body, the suspect, the witnesses, and the evidence you'll never get them back. I once spent two days at a crime scene (where I also slept) to process it. It turned out the victim had died from an epileptic seizure but I also had a crime scene of a suicide which turned out to be a homicide. Not every death is what it appears to be but only a thorough investigation will find the truth.
That defense attorney is AWFUL! I would never hire him. Brown-noses the jury and then gets called out and gaslights them "I'm not pandering!!!" Talk about yikes.

I know this isn't the biggest issue here, but I'm astonished that the PA prescribed ambien plus a muscle relaxer following an injury like this. Both medications cause sedation, and should not be taken together. Muscle relaxers cause so much sedation that they're usually enough to induce sleep on their own. That is terrible medicine.
I took ONE 10mg ambien 5 yrs ago & it knocked me out for 10 hrs! I was 59, have been resistant to medications as long as I can remember, always sleep at most 7 hrs, normally 6. Those are strong sleeping pills, Faylene was knocked out! Seems obvious that he gave her few drinks & the ambien!
This is incredibly sad & distressing for her daughter. 🙏❤️

I took an ambien one night at bedtime which for me was 9 pm. My girlfriend had given it to me to sleep. I didn't wake up till the next day at 12. I will never ever take another ambien.

I don't know how many other people are aware of what is commonly believed about when an older man dates/marries a much younger woman, but typically its believed that since they have very little in common, or the same interests, or can have the same conversations, etc, the 2 main benefits for the man are of course that she is youthful & attractive, but more importantly, that a younger woman is much easier to manipulate & control. With that in mind, I find it very interesting that when he claims that he called 911, he says something to the effect of , "I know I called, with the very core of my being," & when his young wife talked about her faith that he wouldn't go to prison, she used the exact same language & phrasing, & combined with her statements that she is in "awe of him," that is exactly the sort of power dynamic an older man would love. She'll do what he wants, even deferring to him on most things, & using the same language is called mirroring, & like the word we draw it from, mirror, the idea is that victims may mirror the behavior of the other person, or you can use it in something like a police interview to make the suspect more comfortable, or many of those gross "seduction experts" in the Manosphere apply it to dating. Its a subtle way to trick the other person's brain into a "natural" sense of connection.

I don't believe she wrote those journal entries her daughter read because when they showed the originals the handwriting was different on every one of them. I know from writing in my own journals my handwriting never changed if so very little not as drastic as what I seen on here of hers. Two different cursive styles then all capital letters? Come on, she didn't write those. Yes their feminine but I bet the mistress wrote em after the fact because of what is said especially the last entry her daughter read. So I don't believe a word he says. I believe he drugged her with Ambien & muscle relaxers & when she took her bath that night the amount of Ambien & muscle relaxers he gave her kicked in & she went under. With two medications that relaxes your entire body & one that makes you drowsy well the muscle relaxers can make you drowsy also. No wonder she became unconscious & "drowned". He totally planned this. I also think he beat her up while they were in the mountains & she didn't fall. Just like what was stated she didn't have significant enough injuries for that type of fall from that height. Also his lawyer saying he took her to the hospital after her fall is incorrect it was stated that his doctor friend came over & looked at her & prescribed her the medications. Sorry this was so long but I just had to get all of this off my chest.

This is why any attorney will tell you a jury trial is a crapshoot. Sometimes the jury is just as messed up as the people involved. There was one trial where one woke woman refused to convict a guy, who by DNA and a load of other evidence was clearly guilty, because in her words, "she refused to send another young black man to jail." The other 11 jurors all agreed he was guilty and the 12 woke woman also said she felt he was guilty but would not be the person to send him to jail. I want to say the guy was a rapist or murderer. It was on one of these crime shows. Very disturbing.

Justice should be blind. When you sit through a trial it truly comes down to which attorney put in the hours and was more ready for trial. Understand that most of the prosecutors in big cities see the case a day or so before the trial as they are overwhelmed. Some see it as they open the folder while standing at court. It’s the legal newbie’s back at the office that prepare the brief outline in the folder. Sad but it’s reality.

Exactly! Why write a prescription for something they have to phone you first before they fill it.And then the husband seems totally unaware he was supposed to phone first. And why a prescription for 2 drugs that would combine so badly, for a friend’s wife . So many bad prescribing choices..That assistant should have his prescribing rights revoked.

It's odd that he didn't call 911. It's odd that the bedroom door was locked. He's whiny in court, but he was very aggressive in the car with his friend.

I did think he was guilty, but a "gut feeling" should not be something you get prosecuted on. This is horrible! What is with innocent till proven guilty?
Same. Unless 48 hours is intentionally leaving a giant piece of evidence out of this piece, I think the only reasonable conclusion is not guilty.
I found an article stated 8 years later he was arrested and only got 5 years for manslaughter.
