      Sir. I have been diagnosed by the VA Psychiatrist and have been receiving treatment since 8/30/22 for PTSD, Sleep Apnea, Insomnia, Depression and Anxiety to the present (4/27/23). I have had a Higher Level Review on file since 3/09/21 for D&A as secondary to both knees (airborne special recon). I was just denied for Tinnitus and hearing loss a day ago. Reason given was no nexus for hearing loss even tho they confirm that my test was inconsistent and they confirmed the constant ringing in my ears. They used they info of my first term of service as “Peacetime” 1986-1989 but failed to include my time of 2000-2003! What would you suggest as the best course of action to take? I suffer daily from these symptoms but the VA seems dead set on denying me. Please advise. Thank you sir.

      I don't even get any VA benefits at all. I hate the VA. I saw what they did to ppl in Dallas Main VA Hospital..in the middle of the hood. All I get is ssdi. I will not deal with those people in that organization whatsoever, and I have schizophrenia, bipolar, ptsd, co-dependency sydrome, bad back and knees from driving M60A3 tanks...I was a 19E/19K, and I know you can't get VA benefits for this, but in the national guard had a range accident (thank god I didn't get hurt). Where a whole line of ppl were shooting at ME on the range, because the range safety officer, said we're done, walk out there and take the range fans down.I literally heard bullets zinging around me and dust as they hit the ground. If you wonder why I have all these problems, it's mostly from underground mining, because I was the explosives expert in an underground mine 650 feet below ground using anfo, 6 explosions a night, 6 days a week for 17 years.

Is there a rating for this issue.

    I served in the Marine Corps back in the 90's. I filed my first claim in Nov 2022 and was denied except for Tinnitus at 10%, first step. Even though my back was documented in my SRB, the C&P examiner said there was no service connection.
    I went and got an MRI for my back, which confirmed Lumbar radiculopathy and filed a supplemental claim in Sep 2023 with my medical evidence and lay statement, I also did it without a Nexus Letter. I was awarded 10% for Lumbar Radiculopathy and another 10% for Spasms.
    I'm now at 30% rating. I have an additional claim pending for Cervical Radiculopathy that I filed along with my lay statement and MRI and doctor's diagnosis. I'm confident I will get that and get to 50% and start working on secondary claims.
    Your videos are very helpful, and I was always embarrassed to file or say I was hurting, but after watching your videos, I realized I should not be embarrassed to file for a benefit I earned. Thank you.
    Update: I am now at 90% with insomnia, cervical radiculopathy and left shoulder pain.

Even in my Army personal file, there are multiple notations of being me not able to perform the PT test because of my back issues. Guess the VA didn't take that into consideration. HUNDO CLUB - I got credit for Plantar, and sleep apnea, but the VA wanted another Dr. to validate the sleep apnea, so I drove 100 miles and she substantiated the sleep study, so I got that too. I got depressive disorder and TBI. Also my VFW service rep loaded the list up with a bunch of other items to throw at the wall. Discharged to retirement with 100% P&T disability. It took work, a lot of appointments, SO be prepared to defend each item. Remember, to prove you are disabled tow that line all the way through.

      I was medically retired from the Navy in 2010. It took me over 9 years and a appeal to the board to get tdiu p&t. What I didn't know was when I got tdiu for 1 condition was that my other disabilities for major depression 70% qualified me for special monthly compensation (SMC). The VA is suppose to evaluate and grant it automatically if you qualify but we know how that goes. My tdiu counts my single disability as 100% and since major depression is 70%(over 60%) and not related to tdiu 100% it qualified me for the SMC. Make sure you get what you are supposed to.

    • @NavyNuke25
      @NavyNuke25 2 роки тому +2

      @BrotherBennett I would be willing to bet the all the denied service connected conditions you have could be claimed as secondary to a service connected condition. I deal with migraines on almost daily basis. I have headaches documented in my medical record here and there but never had a migraine in the service. They put them as service connected. Pain from service connected conditions can cause depression and anxiety. My advice is to find a lawyer who specializes in VA claims and let them figure out how best to make your argument. I had to go all the way to the board to get my ratings and the veteran law judge told me the same thing the ssdi judge did and that was there was no reason why I should have had to take it this far. My medical records proved everything I had claimed and they apologized for the 10 years it took to get it done. Stay strong and keep fighting for what you deserve.

    I wish I knew about resources like these when I initially filed my claim in the 2010s. But w/ the Pact Act I should be rated at 100% in the not too distant future. Since one of the countries I deployed to is on the list for the Pact Act & one of my claims correlates w/ it I should be good. When I called yesterday I was told that my claim was already in the decision phase, & they don't need anything further. I only filed my claim only a few months ago, & I'm surprised to hear that it might not take the 8 or so years that my initial claim did. The back pay was nice, but I don't want to wait because "it's my money & I want it now". 😂 Good luck to all the other vets out there.

      Just because you have a disability and it was diagnosed from a VA doctor, that doesn't make it a service-connected disability. Are you claiming that it is caused by a currently rated service-connected disability or disabilities? SA is very tricky and you'll need very strong and thorough medical evidence/research. The raters seem to love to deny SA if you try to get connected on anything other than obesity as an intermediate step. But obesity is not the only factor to get SA. Just because you're obese doesn't mean you have SA nor because you're skinny, you can't get SA. In my case, I'm on the latter end. My VSO read my latest C&P IMO for SA came in favorably. Now just waiting for the claim to get closed and hope the raters don't try to play stupid games. You need convincing evidence that will make the claim plausible to fall in your favor.

    I just had a C&P exam for my GERD claim and while the doctor was going over all the appointments I had she read back to me a diagnosis of bicuspid aortic valve that they discovered when I was at Walter Reed getting seen for my stomach issues. She recommended that I put in a VA claim for the heart issue. Do you think that falls under the "Chronic heart disease" claim?

    Hey Craig I have 80% for major depression and anxiety I was wondering how to increase it. I had shoulder surgery in the military as well but they gave me 10% for that

      @@69BTony is it fixed though bro? My surgery and recovery went smoothly until my range of motion seemed to get more and more limited. It hurts to stretch

    I like what you say and where you are going.. BUT I have severe Sleep apnea and they fight me saying it is not service connected. The gave me the sleep study along with the C-Pap once diagnosed but they still what me to prove it is service connected knowing it is impossible..
