I think one of the biggest issues in getting accurate ratings for mental health is examiners not having input from significant others who can often report more accurately than the veteran can. Mental health is a big challenge to self- report, as people will often diminish their symptoms. Those of us who love our Vets need to be able to speak in appointments and make sure they are seen and heard.
Absolutely! Submitting a "buddy/lay" statement from a spouse or loved one is something I always recommend to everyone. It's very important, in addition to the veteran's own persona statement
I'm currently at 50% PTSD and 40% Back Injury, plus 10% tinnitus. I recently applied for TDIU because a) I lost my TS security clearance (which I held for 26 years) due to seeking treatment for PTSD and b) I cannot sit for more than about an 45 minutes without discomfort or more than about 90 minutes without severe pain due to my back injury. My doctor for the last 18 years has gotten me excused from jury duty on three occasions because I cannot sit in a jury box for more than an hour without creating a disturbance. (Okay, I know someone will make a joke of that last comment, lol.) The nexus to losing my security clearance due to PTSD treatment is that every job I ever held since college required a TS clearance. I thought about pursuing a new line of work, but cannot perform a full day's work due to my back injury. Even taking laying down breaks, I'm only good for about three hours a day. I have had zero earned income since 2011 as a result. Does this seem like a valid argument for TDIU?
TDIU has very specific requirements, and fortunately you do seem to meet the requirements! Your specifics certainly line up near exactly with the purpose of TDIU, and if you write a well written personal statement in support explaining all of this, in addition to your other evidence, I believe you have a strong case.
I am scheduled for my PTSD MST C&P via video in early December. I am diagnosed by the VA, and I get treatment from the VA. I believe that based on my symptoms, I should be correctly rated at 70%. Based on the new criteria, I may be more correctly rated at 100%. If my assumptions are correct, I will apply for an increase after the new criteria become official. Thank you for the video. Very much appreciated.
@TheVeteranCoach I am 63 and I've been out since 1985. Until last year, I had no idea treatment or disability was even available to me. However by watching many videos, reading the 38 CFR, and following the rules for applying for disability and having an in-service event, a current diagnosis, and a nexus, I think I'll be ok. I would give it up in a heartbeat if I could go back in time and not have been assaulted though.
I'm glad you finally found the information and direction you needed, it's a shame we aren't taken better care of when in, and especially after we get out. I understand what you mean, sending you healing *virtual* hugs.. feel free to message if you have questions
i hear the phrase "filing for an increase " everywhere however there is no va forms to fill out using that term anywhere i wish someone would explain that and how you actually file for an increase ?? what is the actual process and what is the VA form number to use ?? when i was awarded my rating there were no options to file for an increase ,there were only 3 review filing options , supplemental claim, higher level review and appeal to the board.
If it's been longer than one year since your award, you will file an increase online. You will begin with the EZ form like a new claim, and select the option that states (a service connected condition that's gotten worse)
See 1:18 in the video here, it's a small preview of what the screen will look like when you get to that point in the process for an increase request > ua-cam.com/video/aP5_131HqJo/v-deo.htmlsi=9h6tH-ro_QjsUdhr
@@TheVeteranCoach ,so you actually use the same form to file a "new claim" even if its for an increase ? is there a section of the form that states that "increase ' ? i plan on filing for an increase after the new MH criteria changes hopefully in April. is there a time limit on filling for an increase after you were awarded ? thank you
I filed my secondary intent at the end of July but switched from anxiety/depression to MST after regular therapy and all statements and med records are processing. But its 40 years later and im a widow now after 33 years and all witnesses have passed. Im trying to stay positive, really need help
Feel free to email me any private questions, laura@theveteran.coach I know the process is hard, but it's worth the fight, and we will help guide and support you however we can ❤️
I am a Vietnam Vet 75 years old. I don't work. I am 70% for PTSD. Under those conditions what is the best road to take? I still can't sleep and I am pretty much house bound. I'd like to go to 100%. I also have 60% due to prostate cancer. I had my prostate removed by surgery.
You qualify and could apply for TDIU if you aren't earning an income over 12k per year (disability/retirement not included). That could be the path of least resistance for you at the moment

You can submit lay statements from anyone that can speak on your challenges of daily life.

Buddy/lay statements are crucial! I always recommend submitting spousal statements in particular

So what about people who are one hundred percent service-connected for PTSD with bruxism? At a hundred percent P&T? @TheVeteranCoach

You've got the right idea! I wish you the best in your exams, I know they can be daunting but stay encouraged and in the fight 💪

Good to see you back will you come back regular. I hope so. Thanks

I agree 100% 🇺🇸, the VA needs to adjust out mental health ratings without all the BS of filing claim after claim after claim. when does it stop 🤬

Best of luck to you.
So does one file now or wait? I've got an intent on the burner and would hate to lose the back pay.
@NoMoreLibs if you're rated for MH and are warranted an increase, you can certainly file that in your intent to file.
Do you offer Nexus Letter Service?
I don't, but I could share a recommendation based on specifics. Email me if you need direction> laura@theveteran.coach
How about someone that has a 70% rating now thats over 75Yrs old, is there a new criteria that needs to be met in that situation
Is the 70% all for mental health or cumulative with other conditions? It depends on the specifics of the case
If I have 40% mental health for depression and anxiety is there anything I need to do. Will it be grandfathered in. Thanks
If you think you qualify for an increase, you'll need to file online. Since you're already service connected, it's a fairly easy process!
There’s no 40% mental
