Armed Amazon Driver Shoots & Kills Man Robbing His Truck, Will Amazon Fire Him?

- An armed robber targeted an Amazon delivery truck around 4 p.m. in Cleveland, Ohio. The armed robber attempted to forcibly steal the Amazon driver's delivery truck at gunpoint.
Despite managing to get behind the wheel, the carjacker's escape was short-lived as he ended up crashing the vehicle, as per the authorities.
During the incident, the Amazon employee discharged their firearm, shooting the robber, resulting in the suspect being fatally wounded.
The carjacker was declared deceased at the scene by responding emergency personnel.
In Ohio, you cannot use deadly force solely to protect property.
The law specifies that deadly force can be justified only if there is a serious threat to personal safety. For example, if someone is stealing your car from your yard without posing any threat to your personal safety, you cannot legally use deadly force against them.
However, if the situation involves a deadly weapon and poses a threat to life, such as in cases of aggravated robbery, you might be justified in using deadly force.
So, it's not really clear if this Amazon driver will walk away completely legally clear here. However, the fact that they haven't arrested him leads me to believe he should be good.
What I am worried about is this Amazon delivery driver being fired from his Job. Amazon's policy bans delivery drivers from carrying guns while on the job.

Amazon driver here, it’s actually a violation of your employee contract to carry a weapon on you when you’re delivering. They will most likely unfortunately fire him therefore. That doesn’t stop me. I carry every time I deliver because I’d rather lose this job than lose my life.
Why be a good worker for a company that doesn't value your life?
So.. the honest question.. if a "right" is federally protected.. why can people "privately" claim you can't do something "federally" protected? After all... I can freely speak anything... yet I can't freely ensure I'm safe?

As an Amazon driver from Cleveland this is the exact reason why I carry on the job. If rules are put in place to violate your rights then break those rules. Period.

Yep.... Amazon for sure has a "Policy" that you're NOT allowed to be Armed. These BIG Corps don't allow basic human rights.
And to be clear, if a person is "around" people, dealing with the public or even other employees, there's always the potential for harm, so company's should NOT be allowed to Restrict certain Rights.
For example, they can restrict "Speech" to a "degree" because such can directly effect the operation of the business, i.e. not allowing "Protests" etc. on property. But lawfully carrying a gun has ZERO effect on the operation of the business, thus businesses shouldn't be allowed to restrict these sorts of Rights.
I actually think we need a NEW LAW in the West in which nobody in Government or Business is allowed to restrict ANY basic Lawful or Constitutional Right, save as above which is standard in relation to Rights and the exercise thereof.
If such persons do attempt or restrict such rights, they are either Fired, Fined, and/or sent to Prison depending on the Offense.... The Citizen should NOT have to "continually relitigate" their basic Rights, being disenfranchised because they can't afford to fight back, or just lose anyway etc. Since we can no longer "Trust" those in Power, we need to be able to hold them accountable. And if they were, they wouldn't even DARE come close to restricting our Rights anymore, be it Civil Forfeiture, Social Media, Banks, etc. restricting or taking away Rights.
this is unfortunately what will happen. even though it was his own personal vehicle he was trying to defend. if people stop buying products from companies that protect criminals, maybe they will think twice.

That was my thinking. If they can't provide protection for their drivers then they shouldn't have a right to tell them they can't carry while out on public roads delivering. Lawmakers should make it illegal for companies to require employees that go out in public to be unharmed.
I drove for Amazon, but as a Flex driver. They prohibit firearms in their facilities where I check in and get my route/cart. I could not find language in their driver agreement that prohibited me from being able to defend myself while delivering. I am a private contractor in my own vehicle. This looks like it might be his car with an Amazon magnet logo on it.

Car-jacked at gunpoint? It's not about defending the packages or defending your car. When a gun is pointed at you it's about defending your life. And is the threat really over when the armed thief driving away in your car might also have your house keys, wallet, phone, and access to private information?
If they fire him, he needs to hire an attorney for a civil lawsuit. EVERYONE has the RIGHT to defend themselves, regardless of who they work for.

I used to work there as well. Crazy policy.
Been driving a truck for almost 5 years now. In my experience virtually every big company has some kind of anti-second amendment policy.. this includes but not limited to, continental tire, Goodyear tire, Masonite doors, walmart DCs, walgreens DCs, CVS DCs, and on and on.
He was defending himself and not the crap on the truck. If amazon fires him, sue them.

I have my own business doing commercial refrigeration, cooking equipment repair, HVAC and electrical. I always carry. I have at least $10k of tools on my truck and work in the city of Rochester NY a lot. Lot of sketchy people everywhere

@@TrueHelpTV Well, they can't. However almost every state follows at-will employment so they can fire you for whatever they feel like - just as you can quit for whatever you feel like. You have the right to defend yourself and they have the right not to employ you because they're scumbags.

I'm a route driver delivering pharmaceuticals to pharmacies ... the employee handbook said "only if authorized", I figure the state and county authorized me to carry concealed, so i felt no need to mention the matter to my employer.

amazon policy is to not confront anyone. basically if you try to carjack a driver they will give you the keys to the company vehicle. in this case the minivan is the drivers personal car. his a amazon flex driver similar to uber drivers.

That's the very nature of violent crime, a car jacking is a violent crime. The criminal knew the risks, took them, and did not beat the odds.

I live in Cleveland. Multiple police officers have told me that it should be required that citizens carry to protect themselves. It’s either your life or theirs. Willoughby PD, Shaker PD, and Cleveland PD officers all told me this based on situations I was in… all within the last 10 months.
My company strictly prohibits firearms on workplace grounds. I carry 2 anyway. I deal with cash. I will make it back to my family every night.

As a delivery driver for Amazon, I want to give an idea of what may happen.
First, all drivers are contractors for Amazon, not actually employees of Amazon.
Amazon will not want this kind of publicity, and they may demand his company to fire him.
Amazon absolutely does not care at all about its drivers.
Amazon is not good place to work, they are bad, corruption interviewer too. I just give up a job because they told me give them paycheck for 5 year company, from beginning day to end. I wonder if they need employee or they are fbi want to fire employee. I give them a lot of info then they ask mores, I can not accept paycheck, because company deposit to bank, I think they are communist, corrupted peoplein hiring. Otherwise before that, they told me i was hired and give me exactly work day but after that they ask me bulshit question, I gave up.

You mean DEACTIVATE someone. He drives for Amazon Flex, he is a 1099 contractor. There are sets of rules and guidelines you agree to when signing up to use the app. They have to deactivate him or they would violate their own policy and open themselves up to lawsuits from other app users as well as anyone drivers use force against.
Yes - it should - but private companies are not required to adhere to the constitution. The constitution is written specifically to protect you from the government. Not any given company.
You need to get a better understanding of the constitution and the difference between public and private.. it blows me how little people know about the legal system that governs their lives..

@jeffreyb8770 So a year ago the Sheriff of Santa Rosa County in Florida told the press after an attempted break in and a home owner shot at the intruder, that he would prefer that home would have shot and killed the intruder and the said they have training ever other weekend. On the 1 year anniversary of this there had been ZERO home invasions. Criminals pick easy targets.

Amazon drivers rarely work for Amazon. Liability for driver behavior, including self-defense, would fall upon any of hundreds of regional subcontractors. Amazon does this not just to be insulated from liability, but to make the workforce harder to unionize (like UPS).

I may or may not carry gun firearm and my CCW with me in my semi. I refuse to go to eastern states like NY and NJ and western states that my company travels to on rare occasions. It's against company policy, and I will immediately be terminated if it's discovered I may be carrying. But I'd rather be fired than victimized, hospitalized or killed.

I'm pro 2nd amendment, however if the Amazon Driver fired upon the vehicle from OUTSIDE of the vehicle, he may face charges as the suspect was fleeing (driving away) and posed no further threat to the driver. Also, he was in a residential neighborhood. What if his shot DID NOT HIT. Could it have injured a resident??? Due to this reason, I wouldn't have pulled the trigger. If the driver, somehow, was still in the vehicle, then it's self-defense.
As far as I am concerned, it should be MANDATORY for delivery drivers to be armed.
With certified gun training it can save your life and others when you are shooting whenever you're shooting a gun you have to remember where that bullet is going and you do not want it to kill an innocent citizen

I worked for several security companies after being medically retired from the military that had a strict no gun policy’s.All that policy did was to make me carry a sub compact sig p 365 in a pocket holster and leave my fnx 45 tactical at home. I now work for a security firm that’s all ex police or military and everyone Carry’s. At some post we even have shotguns and rifles. I live in Indiana and you can keep a weapon in your vehicle at work as long as it’s not federal property and there’s nothing your employer can legally do about it as long as it’s out of sight in your vehicle.I don’t think it’s a good idea to leave a gun in your vehicle unattended but I like having the option.

I´m so confused.....so, the owner of Amazon has decided that his Company should have a policy that dictates that emplyees can NOT legally carry a firearm while working. Hhm... that must mean that the Owner of Amazon has the same rule for his personal security detail...right?!?
Looking at the car he was a flex driver, and said he's been deactivated. He's done. I worked for an Amazon dsp and saw people fired/permanently deactivated for much, much less.
That's his personal vehicle. No company policy can make me let them take MY car. I wasn't defending packages
Yeah, agree! Plus Amazon is a shitty company to work for. So I’d much rather loose my job than my life. If you’re truly 2A, you’re carrying no matter what. It just sucks in some states they’re not too friendly with self-defense, like California. Amazon is a horrible company. The owner makes $40 million a day on average, but pays poverty level yearly income to most of its workers. Not only that, but most line workers have a hard job, with bad working conditions and basically no breaks. It takes 10 minutes to walk to your car or break room and ten to walk back. So your 20 minute break is not really a break at all. So fuck Amazon, definitely not dying for those assholes. Another driver was literally eaten to death by a pack of dogs. Definitely not worth getting shot or eaten by dogs for $15 an hour. Plus these people have to get expensive insurance, a pricey vehicle and pay for gas. Obviously some drivers are contracted and drive company vehicles, yet don’t technically work for Amazon. Than there are those who use their personal vehicles and therefor have to pay for all of that, just to make crap money.
My husband's company also says "no carrying" but it's his life, not theirs. I'll just leave that there. This driver obviously felt threatened.... He'll likely lose his job.

My dad was not a gun fan and quit his job as a mail delivery driver from post office to mail drop box areas where letter carriers picked up mail to be delivered back then because they came out with a policy for all such drivers carry a weapon due to an influx of mail delivery truck robberies. Back then, banks, jewelry stores, the USPS and other such facilities ‘required’ personnel, in certain positions/jobs be armed.
Boy, have we gone soft and cowardly since then and since WWII, the last war we’ve ever won. Sad times for America from what the Founding Fathers envisioned.☹️😢

This was related to a crime spree that included 2 other stolen vehicles, a stolen iPhone, a stolen iPad all armed robberies & culminated in attempted robbery of Amazon driver & their vehicle all by a group of 5 individuals working together in under 2hr period all at gun point & everyone robbed were in fear for their lives being threatened to be shot

Amazing! Typical miscommunication occurs whenever only a quarter of the story airs. Sadly, that sums up 90% of national news "reporting." If journalists had hearts, souls, and integrity like they used to, NONE of this would be happening to the lethal level it is today.
When competition becomes lethal and dishonest, we used to close the venue and jail the cheaters and relieve them of their stolen honors (like Olympic medals 🏅).

My work keeps asking me to do the delivery for them but like Amazon they won't let me carry so for me it's always a flat no.

I had some dude try & attack me on my route when I drove a garbage truck. He opened the door & tried attacking me, I pulled my gun out & he ran away. They fired me. Buddy's wife said she I did the right thing & she woulda shot em. The cops said I was 100% legally in the right & that they woulda shot em as well. Still got fired. Safety first people second.
Here in NJ ,the law says we must surrender the vehicle and the packages and our lives if necessary. I cannot use deadly force to protect your property
This just happened in Cleveland Ohio as well but it was a subcontractor delivering packages for Amazon. Ohio City is where the shooting occurred. Carjacker was shot and killed. Can I gat a Hell Yeah?

Any establishment or company that removes a right from an employee or patron should be held completely liable for any damages that could have been prevented if the victim had all their rights.

Sounds like if you ran Amazon, you would take one of the largest companies in America, and run it into the ground with non-stop litigation. You should start up a delivery company where you not only require employees to carry firearms but incentivize when people use those firearms. Would love to hear how that company turns out.

a Dominoes delivery driver in Lafayette, Indiana died a few years ago after being lured to a house and was held at gun point by two teens, a male and female, he managed to pull out his concealed weapon and shot the kid but just after the kid fired a shot and missed, the girl picked up her bf's gun and shot the driver then fled. This happened not far from where I lived and it was a few blocks away from the girl's house, the girl is still awaiting trial for murder. The owner of that Dominoes urged their drivers to carry if they have a CCW. Now I don't entirely remember but the mother was unaware of what her daughter did and when she found out, did not take her daughter's side. Fyi the girl was black or Hispanic the boy was Hispanic, and the driver was white. She will see jail time. Attempted robbery and manslaughter. She was 16 or 17 at the time and will be tried as an adult.

You have a right to defend yourself in the right manner
Point blank (pardon the expression), when a criminal presents a firearm during the commission of a crime, DEADLY self-defense should be JUSTIFIED.
It is not irrational to believe a carjacker driving off with your vehicle, can easily turn back around to have their way with a victim, kvll a victim, re-rob a victim etc.
The fact this is even debated is INSANE.
You hit the nail on the head. The only reason that Amazon fired their driver was to avoid liability from any civil action against Amazon. Terminating the driver was their message that they did not endorse, recommend, or support the driver's actions. This would open a whole Pandora's box of civil litigation against all concerned. We will find out eventually all the details of this shooting incident over time.
Then sue them for infringement of constitutional rights
Then either A: Amazon drivers would all quit because they too can become under attack from a thief and Amazons stocks will tank and they'll get their Bud Light moment.
B: Drivers would be too scared to say anything because they can't afford to lose their job and if they become a victim or much worse Amazon would try and find a way around coming under fire from a lawsuit from the driver's family.
A buddy of mine is a combat veteran, he was working for Spectrum out of Indianapolis, he told his boss on day one to not send him out to any area with high crime since he wasn't allowed to carry his sidearm. His boss told him that's fair as he explained to his boss that if it came down to using his hands to defend himself that he'd most likely go to jail because a simple beating of the perp wouldn't be good enough for him.

Amazons policy probably says to just let it happen. They have insurance for a reason. They will probably fire him because they don’t want to be associated with someone who used force against a thief.

If you are robbed by an armed criminal, you legally have the right to defend yourself. Never expect a criminal to have morals to not hurt you.
For Ohio, personally, I'd consider someone stealing another's car life-threatening. Their car is stolen so tbey can't go to work, they can't go to the store to buy food (depending how far away they live), they're at risk of losing their home/apartment because no job = no money, all this shit might make someone suicidal leading to a definite threat to their life. Imagine punishing law abiding citizen instead of criminals.

It sounded like the person in the 911 call reporting the incident was not happy the Amazon driver protected himself and shot the carjacker. It was the part, ".. and the Amazon driver shot him" which stood out.
There's no guarantee a robber/carjacker won't harm you. It's good the driver protected himself.
