Isn’t all these tack on fees charged by the trustee essentially legal fee shifting? In a judicial foreclosure state I suppose attorney fees and court costs can not be shifted to the plaintiff ie the borrower.
The plaintiff would not be the borrower in a lien theory foreclosure. The plaintiff would be the lender. All of the fees would become an additional lien on the property which would be satisfied first at the foreclosure auction.
