@m rapacki What are you looking at? There looks to be a three way split towards the top, they cut the two limbs extending beyond the wall on their side which so happens to be the larger branches on the fork and would have most of the leaves. Most likely the house and other trees blocking some of the light encouraged the tree to grow to the only open space directly over the neighbors yard. Also this pic HAS to be late fall or early spring Im thinking, the owner said it was alive and the neighbors wouldnt have cut it if it wasnt dropping leaves so its NOT dead and there are no leaves on any similar branch or tree in pic, only the evergreens have leaves. Once the spring opens up and the leaves sprout it obviously wont look like before but itll be better than it looks in the pic
@m rapacki He said he originally PLANTED it about 23 ft from the line, that tree grew off at an angle towards the neighbors where it forked and spread out over the prop line. But honestly is hard to tell anything for sure from the one pic. This tree should survive this though and I do agree with you its best to at least talk to your neighbors before doing something like this. Its just common respect
I can sympathize with the plaintiff saying the tree isn't dead. We have a neighbor who has a large tree like that. It's easily 4 or 5 stories tall. Earlier this year, we had a cold snap and trees all over were falling apart and damaging fences. This tree was no exception, and after the springtime, when all the other trees were green with leaves, this one sat bare. I thought it was dead, and would only be a liability to the new fence we had paid half to have put up as a result of their tree breaking and smashing the old one. But sure enough, toward the end of spring, beginning of summer, that tree, like all the rest, was green with leaves.
Old and diseased trees can still get leaves. There's a huge, gnarly tree behind the fence of my neighbors' and twice in 10 years, two sections of that tree fell over into my back yard. These sections both were large enough to have killed somebody. They sawed and haul them away, yet the main portion of tree remains which may or may not fall into my yard. But why take chances? They know it's dangerous, yet allow it to stay.
Re the it must be dead because "everything else all around it is green" was the stupidest thing I've ever heard Judge Judy say. Everything else all around it was clearly conifer. The tree might have looked dead but it's winter and it had been cut (chain sawed) back almost to the trunk, way past the fence line and she'd already established it was deciduous. Once spring arrives it will get leaves and grow back some small branches but it's always going to be a weird shape because of the way it has been butchered. It wasn't an old tree even, he'd only planted it 23 years ago. Don't people with pools also usually have pool covers so that leaves, bird droppings and general dirt and detritus don't get in their pools? Even with those branches cut off they will still get leaves in their garden because the trees shed most when it is windy. Just rake them up and use them as a mulch.

An arborist would tell this judge that what this gardener did was butcher this tree. The Judge is not an expert in trees. Many trees lose their leaves and look dead but come spring grow and have leaves that make it look like a different tree. Also if this tree was dead, then there would be no need to cut the branches over leaves getting into the pool (which is why the gardener was called in the first place).

I personally don't know much about this law but usually the people who cut down the trees without permission are fined from 80k - 450k dollars... It also depends on what type of tree it is If it's for example a 100 year old pine tree on your property, the person who cut it down is in another world of fucked. This is per tree btw if for example someone cut down like 5 or 8 trees that would stack up lmao.
The defendants have air rights that extend literally to space over their property line. They can trim any branch or limb that extends into their property, at the property line.
@@RobertLinthicum while that is true, they cannot cut down a trees limbs or otherwise if it will kill the tree. That’s why arborist have to go through training on how to properly trim all different species of trees and follow guidelines. Killing trees makes them more of a liability in the long term and trees are quite expensive when it comes to cost of replacing.
The plaintiff should have hired an arborist to get the value of the tree and could have provided documentation, including the health of tree. If you are going to go to court, you don't do it by the seat of your pants.
I had the same problem with my tree. I offered that my gardener would clear the leaves at the neighbor's, the tree was beautiful and everybody was happy.
You are only allowed to trim the part of the tree that is in your own yard. Many trees leaf out late. Rose of Sharon and Hibiscus don't leaf out until super late either.
If the tree was dead it wouldn't be dropping leaves in the pool. The tree wasn't pruned, it was hacked to a nub. Everything around it is green because they are cedars which are evergreen. Judge is too hasty, guess she has better things to do. Not a good reference for that professional tree pruner, you'd be nuts to hire him after that.
This is the first time I've heard of someone cutting down a neighbor's tree and getting a judge that says "You didn't need permission." Does Judge Judy not know about Tree Law???? Or what?
No one noticed that literally every other tree was a cypress, and the tree that the "gardener" butchered is obviously deciduous. Shame Judy, you even asked what kind of tree it was...
That's what i was thinking. "It looks dead because it's dead, everything else around it is green" they're green because they're evergreens... like tf xD
Judge Judy is clearly not aware of Tree laws. You do in fact need permission to cut down branches another person's tree even if they are hanging over onto your property.
The trees in the background are coniferous. It looks like it's Autumn or Winter so his tree wouldn't have leaves. Either way, they've made a mess of limbing the tree.
In my state, you are perfectly within your right to prune branches that hang onto your side of a property boundary. Those branches are *your* property, but you cannot cut down the tree if it is planted off of your property.
In UK law you can prune from the boundary, but legally the branches (and fruit etc) are still owned by the tree owner, so should be offered to the owner. In the real world , no-one is going to offer or want prunings. But I guess the law is there if the wood has value as timber or firewood. Or has fruit.
I don't know all the factors or understood the case correctly but I would just but some net covering for the pool because I like trees lol. I came from a tropical country so a shade from a tree branch is also good
Clearly judge Judy has little knowledge on plants 😂😂😂 he clearly stated it is a variety that loses its leaves and she’s going to argue that it’s dead? 🤦♀️ Also MOST places you can only cut up to the property line when it comes to trees. Don’t let your neighbors bully you. What’s on your property is yours.
Well I know not to click on to this channel again, do you think people are going to keep watching your videos when you cut them off before they're finished?
Ok so my parents have a pool with neighbors trees whom were closer to the fences than this guy's trees. Admittedly, they hated leaves in their pool too however, this was why, during storms during the spring and summer, my dad would cover his pool to avoid the leaves and he would close his pool for the year just as leaves would start to fall in autumn. There were several larger overhanging branches that were trimmed occasionally and he was legal to do so in my state as long as it was over the property line. Needless to say, when the tree died from disease in 2019 and the neighbors had to cut it down, he was happy to help front some of the cost of removal lol, especially because it would permanently rid his pool area of leaves lmao. He had even called a landscaper to clean his yard each year after all the leaves fell, not because he was too lazy to do so but because he was a teacher and sports coach and had more important things to do. I personally will note that since the trees removal, he actually misses the natural shade sometimes to the point where he had to buy a small gazebo for the back area of the pool where its shade used to fully cover. He still doesnt have regrets that the tree was removed though. This case has me dumbfounded.
I regularly see a lot of trees like that where I live and they do actually still bloom with leaves every spring even with branches cut off like that. In fact, cutting off extra long branches is a regular process for trees lining the roads (at least where I live) to prevent motor accidents from branches suddenly snapping with weight and falling on top of moving traffic.
as usual Judge Judy is a bit wacky. SHE is claiming the tree is "dead", where none of those involved on either side suggest that. Who's to come to a conclusion here when very little is shown!?
Plaintiff was right tho, this is a case where JJ was wrong. If the tree were dead, it'd have no leaves which feeds back into the original issue with the case.
They only had a right to prune to the property line... looks like they pruned all the way back to the trunk which if the tree was 23 feet inside the properly line, would be WAY overstepping their rights.
"Is it a deciduous tree? Does it lose its leaves each year?" "Yes." (Looks at picture) "It looks dead! All the other trees are green." That's because it's deciduous and has lost its leaves whilst the other trees remain green in winter. Moron.
Tree law is one of the most controversial laws there is. You can trim a tree over and up to property line as long as you don’t damage or kill it. They killed this tree and should have to pay.
Actually, any tree branch - no matter how high the tree is, that hangs over the fence line or open property line, is fair game for the neighbor to trim. My neighbors tall tree branches hang over my garage. Causing green mold to grow on my garage roof shingles, because the roof doesn't fully dry because of the constant shade the tree branches cause. So, I climbed on my garage roof, and cut branches. My neighbor called the police, but the cops informed my neighbor that anything over my fence belongs to me. So did the judge, when my neighbor took me to court. So believe it when you hear of a tree law.
To be on the safe side, I checked with the codes department before I trimmed a bush back. I gave my neighbor the opportunity to do it themselves first to be nice. It had grown to almost 5’ onto my side of the property.
In Texas if a tree grows onto your property you may cut it back to the property line and even if that kills the tree you are within your rights to cut the tree.
In Florida you cannot cut down a tree on someone else's property! I sued the ever loving shit out of a person who cut down a 100yr old red oak on my property and WON.
1 : where did you see a angry man ? 2 : where is part 2 ? why there is no part 2 ? I want to know how it ended ! Edit : there is a sort of part 2 , it's called "Man Says Neighbors' Gardener Hit Him with a Rake"
This is a rare failure from Judge Judy. You can only trim branches that go over your Property line. Also if the tree were dead it wouldn't be able to make leaves (obviously).
We have these disputes in the UK also! If I plant or have a tree, then it is MY responsibility to maintain it so that it does not cause a nuisance on a neighbour’s property. Having had myself to deal with an irresponsible neighbour whose tree caused me a nuisance, I can very readily sympathize with the complainants in this case!
I had 4 healthy palm trees for 20 years on MY property in Florida. New neighbor buys lot - within a year all trees are gone except one (removed by him for his view of a lake). Property line clearly shows trees on MY land. Will unfortunately have to pursue in court. What a headache!
Why most of the cases are not shown to the end? Very frustrating. Thought this is in a few but it seems to be the norm. This probably would stop me watching the channel.
Did she seriously ask him if the tree was coniferous (like the green pines in the picture) or deciduous (like the tree with yellow leaves that had clearly fallen off) and they say the tree looked dead because everything around it was green? What a joke. Retire madam, you're clearly senile.
The other trees are evergreens. The tree in question is a conifer. Conifer trees do not have leaves year round, and they do look kind of dead until spring.
First off, if the tree dead why do you need a gardener to clean up after the tree. He clearly hack away at that tree. Also where I’m from your not allowed to cut trees that below to other people property. Also some trees are protected, so you would need permission from the council.
It's not dead....
It's also NOT 23' from the fence!
Unsubscribed due to frustration at not getting any outcomes in these clips.
You are only allowed to trim the part of the tree that is in your own yard. Many trees leaf out late. Rose of Sharon and Hibiscus don't leaf out until super late either.
If the tree is dead, then why are they complaining about the leaves falling in their pool?
If the tree was dead it wouldn't be dropping leaves in the pool. The tree wasn't pruned, it was hacked to a nub.
Everything around it is green because they are cedars which are evergreen. Judge is too hasty, guess she has better things to do. Not a good reference for that professional tree pruner, you'd be nuts to hire him after that.
My heart would absolutely crumble into pieces if someone cut down my 200+ year old tree. Poor man.
Dead trees need to go dangerous
They didn't cut it down
don't plant a tree so close to the property line
@@whdbnrm302320 feet is not close
This is the first time I've heard of someone cutting down a neighbor's tree and getting a judge that says "You didn't need permission."
Does Judge Judy not know about Tree Law???? Or what?
I doubt she even knows bird law. #AlwaysSunnyInPhiledelphia haah
You have a weird name, in a good way.
Right?! I was like, wtf?
so half of the episode? Hmm
2:30 mr.sanchez licking his chops hungry for some of judge judy LOL
Ahhh, isn’t it winter time and didn’t she establish the fact the tree is deciduous ? Where’s the rest of the story? 👎
Hello how are you doing?
No one noticed that literally every other tree was a cypress, and the tree that the "gardener" butchered is obviously deciduous. Shame Judy, you even asked what kind of tree it was...
My thoughts exactly. The plaintiff could have called her out on that, since it was already established. It didn’t look dead, it just looked bare.
0:50 she clearly asks if the tree is Evergreen or Deciduous.
That's what i was thinking. "It looks dead because it's dead, everything else around it is green" they're green because they're evergreens... like tf xD
Judge Judy is clearly not aware of Tree laws. You do in fact need permission to cut down branches another person's tree even if they are hanging over onto your property.
And you don’t know anything about property laws lol 😂 if it’s on my property and causing a disturbance I have the right to cut it
that depends on where you are. different places means different laws.
Can you post a link of that law as it pertains to the place I live, which is Taiwan. I'm guessing not. Assuming a law is universal = all Americans.
Judge judy was so wrong for that!
Judge Judy can you please upload the completed cases? Respect our curiosity!
Pretty much the rule everywhere....
In UK law you can prune from the boundary, but legally the branches (and fruit etc) are still owned by the tree owner, so should be offered to the owner. In the real world , no-one is going to offer or want prunings. But I guess the law is there if the wood has value as timber or firewood. Or has fruit.
Their complaint was that the tree was dropping leaves into their pool. How can a dead tree produce leaves?
Tree wasn't dead...it was February....it has lost it's leaves....plus that looked like some pretty drastic cut
I like how she said the tree was dead even though it was still alive
Tree whisperer.
Its so annoying that it is cut short.... WE WANT AN ENDING
The other video about this case is called “Man says neighbors’ gardener hit him with a rake”
@@allisonchristian5678 thank you.... nice to have an ending
Unsubscribed due to incomplete videos!!
First of all the Gardener should be doing that type of tree work. That sort of tree work needs to be done by a properly insured Arborist
Her answer was inappropriate. You can tell that she has an attitude. Thinks she can do whatever she wants.
I agree, I want to see the whole case
Please upload the whole thing
How can a dead tree cause a leaf problem? That doesn't really make any sense.
Weird that this Judge is an ‘expert’ on everything! Even school children know the difference between a dead and dormant tree.
She is an expert, owns her home and knows more about trees than you do.
I wanna see the full episodes pls
We need part 2 and 3 .. stop leaving me hanging!
That’s why I don’t watch her show. She makes a call that the tree is dead and that’s that . Pure BS
Well I know not to click on to this channel again, do you think people are going to keep watching your videos when you cut them off before they're finished?
Tree is not dead. You'll know when it's dead, trust me. Tree are tougher than houses. Hell tougher than vehicles.
I always thought tree arguments were
the most petty arguments btwn neighbors
Poor tree! It hurts to see those cuts. 🥴
The other trees around are pine trees. They're always green. That tree was NOT dead. It was trimmed horribly wrong though.
So what was the point of this?
as usual Judge Judy is a bit wacky. SHE is claiming the tree is "dead", where none of those involved on either side suggest that. Who's to come to a conclusion here when very little is shown!?
What the heck was the purpose of posting this video?
Tree: clearly has no leaves on it
Plaintiff: it's just the lighting
Moron.
Right?
She can be dumb sometimes, that’s a really good example lmao
According to him the tree isn’t dead 😂
@@kimberlytaylor5886 You are a rare one. Many neighborhoods need people like you. Considerate and respectful. That shit is missing these days.
full version please.,
Who is doing this inCREDIBLY bad job editing these things???
In Texas if a tree grows onto your property you may cut it back to the property line and even if that kills the tree you are within your rights to cut the tree.
They actually butchered that poor tree.
I would have been equally dismayed...
In Florida you cannot cut down a tree on someone else's property! I sued the ever loving shit out of a person who cut down a 100yr old red oak on my property and WON.
Gardener did the Texas Chainsaw Massacre
Why are all these cases being cut off? It's annoying.
Thank you for letting us know the outcome ..... NOT! ....
The lighting 🤣🤣🤣
1 : where did you see a angry man ?
2 : where is part 2 ? why there is no part 2 ? I want to know how it ended !
Edit : there is a sort of part 2 , it's called "Man Says Neighbors' Gardener Hit Him with a Rake"
is there a part 2?
Unsubscribe. Not fan of short clips
Lol - she’s looking at picture and sees green spruce trees in background and thinks the deciduous tree is dead because it has dropped its leaves
My wife is Filipino, this is how Island people are, they don't talk trash, they listen, and are respectful.
Come on JJ, it’s obviously a deciduous. What time of year was the picture taken? Are we left hanging? Where’s PART 2???
Where is part 2?
There was no leaves on the tree because the pictures were taken in late fall or winter.
It's a bright sky and this man said it's the lighting lol
I had 4 healthy palm trees for 20 years on MY property in Florida. New neighbor buys lot - within a year all trees are gone except one (removed by him for his view of a lake). Property line clearly shows trees on MY land. Will unfortunately have to pursue in court. What a headache!
So what was the outcome? Good idea for a story but it has no ending.
the picture might be from near winter? leaves gone, but nadle trees still green as always
Why most of the cases are not shown to the end? Very frustrating.
Thought this is in a few but it seems to be the norm.
This probably would stop me watching the channel.
Where's the rest of the video showing outcome??
Did she seriously ask him if the tree was coniferous (like the green pines in the picture) or deciduous (like the tree with yellow leaves that had clearly fallen off) and they say the tree looked dead because everything around it was green? What a joke. Retire madam, you're clearly senile.
So, what was the resolution????
Gardener looks like Nixon.🤣🤣🤣
The other trees are evergreens. The tree in question is a conifer. Conifer trees do not have leaves year round, and they do look kind of dead until spring.
I wish I hadn't watched this, now UA-cam is going to have Judge Judy recommendations. My gawd.
If the tree was dead, how was it filling their drains and property with leaves???
First off, if the tree dead why do you need a gardener to clean up after the tree.
He clearly hack away at that tree.
Also where I’m from your not allowed to cut trees that below to other people property. Also some trees are protected, so you would need permission from the council. It actually hilarious how much rights they have.
