    This is one of my biggest beefs with the VA. You shouldn’t have to seek out help from UA-cam to make sure your claim was done right. This is why the VA is such a meme organization and why no one takes them serious.

      I worked for 40 years after my initial 30% serviced connected condtion. Never asked for an increase despite years of pain and treatment at VA and private hospitals and clinics. At age 62 I could work no further and filed for an increase. Was approved for TDIU but such a hard road. If I would have access to this type of info I would not have suffered so long.

      I believe that the VA is ran by the wrong people. I also believe that some people that should not have the percentages they have and now the VA is treating every veteran as a scammer. They can go pound sand, many VA employees never served this country and they have no right to judge us. Hopefully some day karma gets them.

    Great info in the video Dewayne! This exact scenario happened to me on my claim from this spring. The examiner made mistakes that the rater should have caught but the RVSR failed to send it back to the C&P examiner. The rater then continued to carry forward those mistakes and make his/her own mistakes. The DRO admitted on HLR informal conference that mistakes were made and sent it back to VES for a different doctor to attempt to correct it. This same thing happened to me 25+ years ago on my initial claim after exit from the military. The doctor did not grade my disability, so the rater gave me the minimum compensable. The decision letter from way back then gave the conditions needed to qualify for the next higher rating and said there was no evidence. However, there was plenty of evidence in my navy medical review board and orthopedic doctors who did grade the disability to qualify me for a higher rating. The rater ignored my military medical service records even though it was listed as evidence used. I didn't know how the process worked back then but I do now, and I will be filing a CUE claim that if I win will give me 26 years of backpay. All the evidence was there, I just didn't know until I got educated on how these claims work. I will be holding the VA accountable to pay me what I am legally entitled to. I won't give up on this.

    That’s exactly what happened with my claim. I requested a HLR and the HLR officer found a duty to assist error.
    I’m currently waiting for the new decision.

    Good information as always! I’m still at the BVA from 1998 with no break in the process. The VLJ has the claim now and probably scratching his head just like the others. Remanded 7 times for a claim that I was medically discharged for. Discharged from the Army with 20%, filed with VA and they denied SC for that very same thing I was MEB’d for. I have my entire claim folder and have went through all 5000 plus pages and highlighted each time I was seen for this issue and the many doctors giving the diagnosis. I’m so lost and frustrated at the same time. This has been going on way too long.

      Thanks for the support. 1998, are you sure it's still on the books and have you submitted a White House VA complaint. I have an old video on it. Where does that condition fall under the 5 ways of service connection. The percentage from active duty and VA is different. There is a lot going on with your claim.       It was moved to the VLJ on 09/2023 so still active but it was w/o movement for about 9 yrs then resurfed for another remand in 2021. I will let you know what the outcome is, whenever that happens.😒

    Great information. I got my rating decision a couple of years ago, but in the process of reviewing a negative decision letter. I went back to my original letter which was positive 70% and the decision letter stated that some of my evidence was not used as it was submitted on the wrong form. I submitted HLR and received positive letter stating my new rating would be 100%. I tell everyone read that decision letter carefully even if it's positive.

      @@charlenharis1204 I won because the DRO (decision review officer) overturned my denials, made service connection, and sent it back to the VSR to be rated. HLR it's either overturned or continued

    When you go back and look at your old denial with a better understanding of what you're looking at it is truly amazing of what we don't know. I finally got a copy of my C&P exam and it clear states my current foot condition was service connected. My rater stiil denied my claim 5 years ago. I just file a supplemental claim. Have you ever seen the rater just ignore the c & P exam?

    This is what I noticed a couple months back when I got denied for radiculopathy. They said I had no diagnosis for it but I submitted a couple different medical documents with it listed in it. When I looked at the evidence section, I didn’t see anywhere, where it was listed as something they used. My VSO looked back on the stuff he submitted and he can see the medical documents. We submitted a HLR and put in the notes to look for those specific papers.

      Did you claim it as a direct service connection or secondary? I have a direct service connection for neck and back pain and recently had a C&P exam for Radiculopathy secondary to back and neck pain.

    I have your book and about to get 2 more as gift for fellow co-workers vets that found it extremely informative using mine in the office. My claim was just denied on the 12/29/23 migraines secondary to tinnitus. I had two solid statements, a IMO, FMLA, diagnosis and it got denied secondary and primary to Tera. I read the denial 100 times and see that non of my evidence is in the letter, just 2 DPQ’s both ACE and the IMO from the two VES c&p and other records. What a shame I tried my best to gather my evidence and non got used. Favorable finding is that Participation in a toxic exposure risk activity is conceded for diesel, jet fuel, AFFF, and oils but the c&p examiner states that non of that has any relationship or connection to headaches while on the Va.gov website it does lol. Oh wells back to the drawing board thinking of a higher level review on failure to utilize my evidence or something like that…… thanks for all this info this information on these small errors are gold!

    I just went through this for a disability and gave copies to examiner also and was denied.
    Went to higher level review and got it turned in my favor and DRO agreed they never looked at my evidence provided.

    I've had claim and appeal denials where the evidence section did not even list opinions from MD SPECIALISTS I submitted that were very convincing
    for my claim. (In one claim they didn't even list a favorable c&p exam result) In one series of denials they kept insisting that a nurse practitioner was right that my established sc condition was not at all related to my claim for a related secondary condition despite these FOUR MD SPECIALISTS expert opinions to the contrary.
    You got to love the VBA!

    100% P&T peripheral neuropathy (agent orange). Filed for an increase, SMC-L for aid and attendance, ONLY. To me, a simple ONE claim filing. Submitted 2680 by my doctor and affidavit from wife for help with ADL. Had a VES exam in Oct and now another VES exam probably end of Feb. I am assuming the rater is looking for changes in functions of extremities disabilities...and hopefully, finally a decision will be made. Either an L, another L, a probable O and maybe an R1??? Wish me luck. Thanks for your info, videos and help.

    Great info as always sir.
    I was denied Obstructive Sleep Apnea, secondary to PTSD even after a HLR revealed a previous DTA error. Under the evidence page, the rater never listed the IMO, Nexus ltr or private DBQ I submitted w/the original claim. The only evidence used was the CMP examiner’s negative opinion. The reason for denial was no Medical Opinion or Nexus to establish svc connection. The rater never acknowledged my evidence.
    How do I hold the VA accountable even after the HLR? I am reluctant to request an appeal because we all know, claims on appeal sit dormant for years. I’m confused at how the VA gets away w/such blatant neglect. Thank you for all your knowledge.

      @@anthonyosorio212 yes it's more than worth it. Using his lesson I took myself from 30% to 90% and the pending rating of a HLR on my back that I won the decision.

    I'm already service connected for headaches at 0%. I recently got my decision for an increase in rating and some other claims. Most of my other claims where approved and rated well. The headaches were continued at 0%, even with a Migraine Buddy log for 4 months, a personal statement and documentation from a treating VA provider. When I looked at the documents reviewed the log and my personal statement were not listed.
    I'll be filing for a HLR and see what comes of it. Worse case I'll do a supplemental claim with additional documentation.

      What fact or law would you be arguing on the HLR, just because you didn't get the percentage you wanted, does not meet you will win the HLR.     You do such a great job with your videos and information given, I give my thanks to a fellow brother in arms. I do wonder if you might have a thought or two about my experience today. I turned in 2 nexus, 2 DBQs, Buddy statements under supplemental to a 12 year old denial " Migraines/bilateral knees." New C&P exam returned favorable, adjudication awarded 50/migraine yesterday BUT as of today system reflects supplemental closed. No mention of knees. I had direct nexus link, DBQ w/cane/brace/instability/reflection issues notated by 2 independent doctors & during the C&P. I lost half left ankle already service connected causing abnormal gate. I'm blown away by case closed again without even a " zero 0 %" to at least SC my knees. Ive been in shock all day.

      Knees fall under secondary to left ankle which was service connected in 2008. A direct nexus from Telimedical secondary to ankle trauma was given, personal DBQ with instability issues cane/brace and frequency was given, the CMP I was made to do was also favorable yet come days end they didn't even link bilateral knees as service connect with a zero. The adjudicator chose to not honor medical documentation from 2 doctors and from their own C&P exam doctor. I did not know the adjudicator has such power to over ride 3 doctors opinion. Only thing that make since to me is the adjudicator did my migraines before lunch, returned from lunch closed my claim while forgetting to finish the bilateral knee issues. Go figure.

      Update: This is actually getting funnier. Online decision letter became viewable today. First supplemental bilateral knees still denied based on lack of direct service relation, diagnosis, treatment. Also reflection c&p doctor checked "less than likely." All medical evidence properly reflected except now my Nexus letter is listed as DBQ. *** I highly doubt the c&p doctor reflected " less than." No way this is an error.
      *** My personal doc DBQ relates knees to abnormal gate do to ankle trauma in service. Braces,cane,topicals with limitations to standing, carrying weight, etc, etc.
      *** The professional Nexus from different doctor reflecting " more than likely."
      One part of the decision letter says what I made mention above. The second part of the decision letter says the exact opposite I do have diagnoses and treatment. What gives?? My thoughts are 2 fold. #1 C&P doctor hit the wrong box during submittal. He actually told me prior to leaving office if I had any issues about his report to contact his office.
      Second thought, slack adjudicator who didn't bother opening up any file besides the c&p exam. Quick denial if less than is reflected on a supplemental.
      Either or the report is hypocritical in its own words and it screams the lack of DTA.
      Sorry for such a long message brother but all info is good info to any veteran in need.

    This is want happened to me. The Decisions did not equal to the Evidencs reviewed on the C file documents. The ROM at the C&P I feel was not corret, he did use the proper device. The doctor wrote just enough to low ball me for passing the ROM. No way I could have moved greater than 15 degrees at the time of exam.

    Question, in your video you stated in your last scenario that someone had to look at your service medical records to determine that you needed a C&P exam. So, with that being the case, could you give me any insight on why someone would stay stagnant in the "evidence gathering" section of the process for months after their C&P exam?

    Thats exactly what i am saying, I was discharged on 1 Feb 1998, and develop Heart Issues that resulted in a Heart Attack in Dec 1998, and Operated on 13 Jan 1999, which is LESS than One Year after Discharged, and also makes me still Service Connected. When i file my claim, and sent TWO Copies of my medical Records, the VA said it wasnt Service Connected, Denied my Claim, and said they didnt get copies of my medical records after spending almost $80.00 out of my pocket to FAX to them so they could adjudicate my claim. It even states on the VA Web page and is well known that if you develop any symptoms within ONE YEAR after being discharged, it would still be considered Service Connected. SO I am very disappointed that the VA did this. I submitted a HLR, and its almost like starting a New Claim again with it taking over 5 Months to adjudicate. I also filed a Second Claim and its comes to my attention that the VA didnt even process, and CLOSED IT.

    Does "treated in service" include being seen and diagnosed by a civilian doctor with high blood pressure and given meds? My first bp rating that was over 160 was while deployed. After the deployment, I was returned to Reserves status. A year or so later was diagnosed with HBP.

    Great information! BVA Granted me service connection(SC), but with Remand for clarity on when SC began via Examiner. Is there a chance that the examiner can overturn that Grant?

    I had my C&P exam earlier this year and for mental health and I let my examiner know that in-between 2018-2021 I went to AA meetings due to Deployment related issues as well as peers opting in for the Remington Retirment plan. and I was indulging heavily into alcohol but when I went on my 3rd tour in late 2021-2022, I had cut on alcohol exponentially and I try not to go overboard but the thought still lingers. I guess my question is since I got help somewhat for 3 years with AA will they assume I'm cured and don't need an adequate rating?

      @@DewayneKimble I submitted evidence from both my military and medical records and an NJP for alcohol related issues while in service. NJP in 1988 and 5 years later where I spent 6 weeks in the Navy's 4 week Alcohol Rehabilitation Center (ARC). In 1988 they misdiagnosed my alcoholism and I quote, "didn't want to give me a 30 day vacation". I can't see how that doesn't meet the criteria of the 5 ways for service connection. My claim is in and they haven't scheduled me for a mental health C&P yet. I just finished the Audio C&P this week. Sure my alcoholism was self inflicted, I own that! But I didn't need the extra five years of what could have been avoided, divorce, possible discharge, DUI's etc. I'm tryin to claim items under Major Mental Disorders.
      To Baby Boy - you are never cured! I've been sober almost 30 years now. Go back and stay this time.

    This is a human issue, I work in a Air Guard Finance office. People submit travel vouchers without looking at them.
    The people getting paid for the travel just pushing their stuff through. Then certifier just pushes it through with the same mistakes. We are the ones that catch these things.
    The individual either doesn't care or never had decent leadership to train them. The leadership responsible for taking care of their people either doesn't, is to busy to check, or never learned thus extra job that puts them in charge of taking care of their people. Yet people get angry at us when we have to reject the vouchers because they are done incorrectly.
    Examples:
    No paperwork, no receipts, claiming numbers that don't match documentation provided.
    It becomes worse when you never meet the person your life is reduced to papers in a packet. So the mondset needs to be, is this reviewer going to understand what Im submiting. Having someone review it helps. I think thats a thing some people can not see far enough to consider. My job makes me have to consider that daily.

    I have one I dont think anyone can top...In February of last year 2023, I filed a claim Migraines secondary to service connected major Depressive Disorder and 6 months later I got my decision letter in the mail that said I was denied for my Migraines secondary to Degenerative Arthritis Lumbar Spine!! They even wrote in the description about how Degenerative Arthritis Lumbar Spine cant give you Migraines. So basically the C&P examiner AND the VA rater didnt even read my claim that I applied for and rated AND denied my claim for something I didnt even apply for!!! Its amazing this would go all the way through the VA claims rater and the C&P examiner . They even gave me favorable findings that i do indeed suffer from Migraines but denied my claim because THEY put something other than what I applied for....I did a higher level review about a month ago and you would figure this should be a no brainer to an experienced DRO....but it could take 6 months??

    I think majority of the time, these claims are sitting on a disk somewhere. I was told all they needed was my DD-214 to receive my decision. I uploaded it and it has not moved for weeks.

    With sleep apnea, the evidence was listed as reviewed except it took two appeals and a Judge to rule in my favor after waiting 6 years. There is no reason for reviewers and contract examiners to do the right thing and financial incentive to process claims as quickly as possible. At least we know how it should wo🎉k

    Yo good video sir - at your old office Sir - Every claim that i filed the rater sent the claims back to the examiners telling them your opinion doesn't match the veteran medical evidence examiner returned the claims back with no reply then the rater just denied all the claims dro did the same thing the year was 2011-2012 - Now i pay for my IMO's and DBQ's because i know for a fact that the VA is going to deny any claim that i submit - from 2011-2023 i got a negative opinions from all of them Sir i just cancelled 2 exam for Jan 4 i told them in person never schedule me with another VA employee examiner again i told them Ves or QTC only - That way i take all my evidence or i will pay a company with good standing with the BBB -

      ​​@@DewayneKimble but how are these people allowed to mess people over and just away with it??? People's livelihood is dependent on those raters to do their job proficiently. These things are more often than not, done on purpose to screw people over. No one truly cares until it's them! Smh...my condition was overlooked and I have the prescription history which lists all 3 scripts from the VA for the exact issue smh like come on. This causes way too much back and forth for no reason. It's already stressful enough as it is.

    I’m a desert storm veteran 12b This is my first time filing a claim. I went to my county, VO officer, and they set me up with counseling for PTSD. I’ve always had bad back I vaguely remember putting I had lower back pain on my files when I left but I have no copies of it. I have a chiropractor records for 15 years that I’m getting together with the doctors note will that help my case?

    Question submitted a supplemental .. it went PFD ready for Dec last week.. now they say the claim is with the VA Rating team.. What does that mean? How should I expect the claim to be done?

    What if they never sent the list of evidence used to make their decision on a supplemental claim, and are actually proposing to lower your current rating due to them saying your condition is improving but all the evidence that you gave them proves otherwise? Is that normal on supplemental claims to not list the evidence? Isn't that the point of a supplemental claim is you have more evidence to prove a different decision than they originally gave?

      If you received a rating decision, the evidence is listed there. Does the evidence show evidence that is in the diagnostic code criteria for the condition they are proposing to reduce.     NO Rational reason was given, they said it was denied because it was NOT Service Connected and they didnt have a copy of my Medical records when i had sent them TWO Copies, and AGAIN, it happen less than one year out of the Service. I Feb 1998 - 1 Feb 1999. It happened in Dec 1998, and Surgery 13 Jan 1999. PLEASE remember, the VA didnt work as good as now as it did in 1998. When such a condition developed, there is not much time to drive around to find a VA Facility that is miles away.

    I filed my claim for back issues that I was being treated for in the military, up until my release date. The claim was filed prior to the start of Covid. I never received a response about the claim. After Covid started to calm down, I checked on the claim and the response I got was that it was denied because I didn’t show up for the scheduled exam. What exam, I never received any information on a scheduled exam. I was told that during Covid they just pencil whipped a lot of claims to get them off the books. How can I check if I was one of them?

    Most videos say that radiculopathy is a secondary. I was service connected for Lumbar spondylosis with disc bulge and radiculopathy in one 20% rating. Is that correct?

    Is the Ace Exam good or bad? There's not much info out there on Ace Exam!
    I went to C&P exam then two weeks later they sent the same claim for Ace exam review.
    They told me they were going to compare my C&P exam with the Ace Exam.. I'm like I never heard of this. I wish it was more info out here for Ace exams. Oh well

    Why does the VA make it so hard to get what you have earned while you were in? Why must we have to be at the mercy of other people who have no idea what we as soldiers went through? To me it’s so unjust. We should be informed on how to exactly put in a claim and everything should be just so by guidance. We are misinformed, under informed, and we in a lot of ways treated like second class citizens. And I don’t mean any disrespect to you, I just know I filed a claim a couple months ago and I am sure I did it wrong and will be denied because I have been out so long. I have lives with ailments for years without knowing I could be service connected for things I have been living with because when I got out I knew nothing about service connection. No one informed me. I was being treated for PTSD while I was in but was never service connected when I got out in 2001. It’s so sad how veterans are treated. Just so sad.

      @@DewayneKimble thank you sir! I will get the book and read it front to back! I am a VA nurse, I was in for 12 years. Gulf war vet, a lot of back issues. Mental health issues, sinus, and chronic URI’s with BIL knee issues. Yet, only 30%. Filed a new claim and from what I have been hearing you talk about my claim was a waste of time because I am sure I did not do it properly. One thing in my side though is I do have medical evidence in my service records and also basically my VA records as I went straight to the VA when I got out. I have the evidence, I just hope they find it, see it, and really review it. By me not knowing I have cost myself $1000’s of dollars over the years! I have one question to ask you..If I get a PTSD service connection rating, can I go after back pay due to being treated while in but never being service connected after I was out? Thank you for all you do to help! And I wish you a happy and healthy 2024!! Thank you sir!
