      The indictment is insufficient. First, a RICO indictment is subject to the heightened pleading standard because it is complex litigation. See, inter alia, Bell Atlantic corp v. Twombly 550 US 544 and Ashcroft v. Iqbal, 556 US 662. The indictment as presented only pleads merely conclusory allegations, which is fine in an information (e.g. the notice pleading standard) but not in a federal indictment. The indictment as charged therefore fails fourteenth amendment proceedural due process.
      However, the more troubling thing here is that RICO is correctly read as an enhancement statute because the applicable cannons of construction require that new statutes do not implicitly modify older statutes, such that we do not read RICO to create any new or distinct crime because under the RICO statute as currently enacted into law, that would then require an incorrect reading of an implicit modification of the applicable predicate statutes - something congress would have to explicitly write into the RICO statute, which isnt in the statute as enacted.
      It therefore follows that Because RICO is an enhancement, The governmemt must first charge and convict upon at least three predicate counts before the RICO count becomes actionable. See Apprendi v. New Jersey 530 US 466. The indictment is therefore due dismissed as a matter of law.

      It won’t be easy. Participating in an orgy is not a crime. Seeing some of the crime happening (and not reporting) might be a crime, but it is easy to get away with.
      To get anything serious, they must prove that each individual knowingly contributed to the criminal action and not just a bystander enjoying the orgy.

    He initially denied his actions when the lawsuit from Cassie made headlines, but then the video exposed him confirming her claims, then suddenly this man goes in to self-loathing mode. Diddy is not sorry for his actions, he is just sorry that he got caught.

      Diddy can now use his tremendous wealth to fake a death in prison to be transported to an island like Epstein. The extremely wealthy do not commit suicide in prison until they used up every option to get out. Epstein did not even have one court case. The two hour lapse in the security camera says it all. Also no one was allowed to identify Epsteins body but his brother, who did not want his wealthy brother in prison. Will this repeat?

      Literally. It’s not a crime for the rich, and even worse, being held for the poor can mean a loss of job and housing too. And obviously we need to hold criminals liable, but too often poorer people often get more falsely arrested simply for existing as a poor person.       Well, no, not everyone should. They should for violent crimes, but poor people are regularly jailed for minor crimes and have their livelihoods destroyed, and are coerced to plead guilty through such intimidation.

      How many crimes go unpunished or even written down because some cop somewhere decides to flex his authority by deciding it's not a big deal. How many people does it take before some bully with a badge decides it's worth their time? An uncountable amount. Just look at how many rape kits sit untested due to 'not enough money', but they always have the nice cars and new gear whenever they need it?     Back in the day - and I mean like mid 90s - I had the opportunity to go backstage and hang out with Puff Daddy and the whole Bad Boy crew. I'd had a long day, thanked the label rep for the opportunity, and went home. I think I made the right choice.

      Statute of limitations has to do with the possibility of evidence exonerating someone of a crime, including possible witnesses to their alibi, etc.
      As to why rape has those statute of limitations specifically, I don't know.

      Mostly assault charges are state laws rather than federal. The charge that was stated to be past the statute of limitations is the felony assault of Cassie Ventura. In California, where this crime occurred, felony assault has a statute of limitations of three years. In California, the statute of limitations for sexual assault of an adult is 10 years unless there is DNA evidence (in which case there is no statute of limitations). Starting in January 2017, rape has no statute of limitations in the state of California.
      Another lawsuit, the alleged sexual assault of Derrick Lee Cardillo-Smith in 1997 Detroit, was thrown out because 2nd-4th degree sexual assault in Michigan also has a statute of limitations of 10 years (or the victim's 21st birthday, whichever is later).

    A lot of people with money and power are like Diddy. Most just aren’t famous. There’s no career or attention benefit involved in prosecuting them.
    Every attorney, detective, or analyst three-steps-removed from Diddy’s prosecution can take credit for it on their resume as a calling card.

      I fully believe your point, though much of the behavior has statute of limitation issues, so were not prosecutable until recent changes to allow this prosecution. Aside from traditional wall of silence.
      However, this creates a precedent and a chilling effect on others who would do similar. Which is a win in that regard.
      I fully expect other famous people to be grappled by this in due time, but PD was especially egregious.

      Same. Even just doing trauma therapy has made me super fragile for weeks, and I just started. I also have like 3 kinds of PTSD from various life events and sustained ableism I faced in schooling. It’s not fun. Hopefully both of us hang in there. 💚

It can get better, but the healing can highly depend on your support and you as a person. Added differences if you are also dealing with it as a Neurodivergent person and need different therapy tools.

      We need to look at sexual abusive acts as on par with murder. Because it is a lifelong burden the victim is forced to deal with. It’s just hard to prove the more time goes by. Victims should have the right to seek justice no matter the amount of time passed. And the sentencing of such crimes should reflect the damage. Child abusers getting 2 years is a reflection on us as a culture. We need to hold these monsters accountable!

    All I know is that apparently this wasn't a surprise to pretty much anyone in the music industry (as sad as that statement is).
    The local morning show on a radio station that I routinely listen to actually had one person literally giddy that Diddy was finally getting held accountable, and everyone on the show seemed to have at least one story of his shitty behavoir "behind the scenes," so to speak.
    And I remember back when the search warrants were served, the same people on the same show were far more reserved, but all basically were like, this isn't really a surprise, nobody likes the a**hat.

    That is insane, the fact that we have a law where, if we stay silent about a felony, that in of itself is a felony. Yet, as Devon pointed out, Combs was not charged with most of the crimes his victims had alleged. Aside from the fact that just by reporting, you are making yourself a target. I am not a lawyer, so I might not know the reach or application of that specific law, but it seems it can be abused.

    My bf used to go to this gym (outside Detroit, closed now), and there was this bodybuilder who had tried to make it in LA after a successful career in Texas. He'd given it up, and told my bf and his friends that this sort of thing happened, and specifically name dropped P Diddy at one point.
    They didn't have any proof of the allegations, and knew this guy had worked in LA because he had photos on his phone of himself in bars with celebrities, including P Diddy. When everything came out, they were shocked that the guy had been telling the truth.
