Regular viewers will remember the interview Mikey aka Philly Drone Life gave on the channel, regarding proposed fines amounting to $182,000 from the FAA. Since then things have been a little quiet but following more controversial drone flights, it appears Mikey is once again in the crosshairs of the Federal government and finds himself in court action. In this video, we will analyse the case from federal documents and give Sean’s unique perspective.

    Sadly the FAA brought him up in violations in 2020 if i remember right. They said the potential maximum fine could be 182k, knowing the FAA they was hoping that he would stop and be 'safe'. But alas he kept on breaking the rules after the FAA told him off and tried to educate him. Mikey is in a very serious legal situation now of his own making.

    When I see one of the last video from Ken Heron when he is flying very close near people ( this video is now members only ), then I think where is your mind? Another FAA case??? He is not an ambassador for this hobby.

    That fine was for violations up until 2019....when they initially fined him. Don't think there is any new fines added to that.

    Thanks for the new gain to the audio! Else no watching.
    There droners trying to show off, there are those just not practising the rules..... They get questions about having the needed permits from air traffic control, fingers pointing out that they create more rules, more trouble for the entire drone community.
    One drone was flying in the wrong place at the wrong time, missed temporary restrictions (NOTAM?) and got his/her unidentified drone shot down! The protected area contained a large foreign military ship making a social visit...
    Here, in Sweden, the police have the gear needed to shoot down drones.
    Lots of immature comments in the chat.......

    I think a very interesting video would be- What if Mikey had his part-107 and flew those tall building or William Penn city hall from a visual distance and was more cautious and not doing anything reckless? How many of his really beautiful videos that show the beauty of Philadelphia would Mikey have been able to make that would have entertained all of us and kept him out of trouble? I would like to see portions of his videos with comments as to how they would have been legal if he was part 107 and flying VLOS in good weather. Maybe you could coordinate with Mikey and do something together.

    I wonder if you could cut a deal and use his platform for that deal. Maybe a community service trade, where all his videos become about Drone law in US what to do what not to do and so forth. And not related to that directly is flights don’t break all the rules. Could be something for him to look into.
    I am very familiar with someone who did get charges dropped for gun related issues just by creating a safety video for their platform to push the message out there for others .
    The government has worked with people, influencers, to drop or lesson charges in the past for other more serious events

      Hey Sean! The FAA have made deals with other drone creators before, especially early on in the warning stages. I think Mikey did mention in the interview it was discussed and rejected.
      Either way, I think with some good advice he could end up in a much 'better' position.

    The community does police our own but with individuals like Mikey is like that drunk uncle who refuses to take responsibility for his own actions.
    In one aspect he’s entertaining but if he’s breaking rules we shouldn’t pay attention to his channel.
    If he’s willing to take the responsibility and does what it takes to make the corrections then we should help through encouragement. For now he’s still that bad example who’s doing harm to the drone community so distance ourselves from him.
    It does hurt to see Mikey heading for self destruction all we can do is pray he finally takes responsibility and makes active efforts to get on the right track.

    Unfortunately, in the case of drone safety, based on some of the regulations the FAA has handed down, it is obvious that they are less interested in public safety then clearing the airspace for the use of big money commercial drone delivery services. I am all in favor of limiting altitude to 200 feet, opening up the ability to fly BVLOS and geofencing sensitive areas. But let people fly.

    What’s going on on my friend?😎 It’s been a long time. I haven’t done any UA-cam Drones since over a year ago or check all Drones in the media!. Busy with family, especially having young kids don’t really have time to fly or buy more Drones. It’s just sad that our friends for years in the media specially industry community just flying around having a great time that we had to go through this especially getting fined $200,000 observed!. at this point I think Mikey needs to go to a different country if you’re still willing to fly Drones!. or maybe he just need to find a new hobby!😀

    Hi Shaun, This person is making it hard for all drone operators. It gives the FAA an excuse to set new rules which as the USA is a member of JARUS like EU , UK and AUS so these rules will filter down in time like RID

    I grew up outside of Philly and spent a bit of my life working there as well, and I have to admit that Mikey's drones around William Penn are the best ever filmed. I don't know what statues inside of Philadelphia he broke with those flights? Maybe they are considered a National Park or National Treasure (yes, intended 😄). I love that he treated us to those flights! Hate to see him in this much trouble...

      His biggest regulation break is making money from flying a drone with a part 107 Certificate.

    I honestly thinks he believes that if he keeps ignoring it that it will go away. He got into this because he ignored the FAA for over a year. He could have avoided the whole thing if he had originally responded to their attempts to contact him and correct the situation.
    He keeps playing the dumb and poor card that he doesn't know any better.

      Hey Felix! The original flights raised within the proposed fines are all live streamed. He showed his telemetry and that he was the pilot. 'Stu' came along as copilot after the fines.

    Because he lives on state benefits and doesn't have a lot of assets he probably thinks he'd immune to paying a fine because he just doesn't have the money.

    Courts typically want "lower level" legal mechanisms available to Regulatory Bodies to not succeed prior to hearing or adjudicating cases. Think of the hoops and appeals Trent Palmer went through outside the court system. I'm not sure that the FAA or Mikey have used every mechanism available to it (assuming it's true that Mikey never really heard anything back).

    The FAA’s pet peeve is flying without a part 107 license which leads to dangerous flying because he would’ve known had he gone thru the training instead of chasing views

      If he had a part 107, they would still fine him and also take the 107 away from him. While I do think safety is important I also think it's logical to not charge an arbitrary number for the test and training. Some countries offer it up for free or a small cost.

      @@krtz23 not necessarily especially if he got the clearance to fly there, film early in the morning when no one is there, etc. part 107 pilots do not take risks like that because it will lead to their license getting taken away

    Flying drones in major cities are tricky. You need license and permission to fly in certain areas and be very proactive about it. He lives within 3 miles radius of sporting stadiums, which makes it even more cumbersome. However annoying it is, no one is above the law, and the FAA is making an example out of him. And it's for good reasons, because drones are a huge security risk. In war zones, they are used as bombs. Imagine some Russian or Chinese spy who uses a drone to film major areas, government and military places, etc.

    How do you know that it was him flying that drone and how do you know that video wasnt old. All his videos shows that he's a damn good drone pilot without out incident and it shows that a 107 license is not needed to have good skills, before all these laws came about you learn to fly by practicinng to develop your skills, and whatever hobbies, sports, racing, fishing, what average person flies that good with a consumer drone beside fpv. Very talented.

    Hi shaun, Having been warn numerous times and offered counciling and guidance, I personally think he deserves all he gets he's not above the law ( no pun intended) he's hurting our hobby and making things harder for everyone,he clearly needs help and guidance of some sort.

    Faa needs to look at ohio drone repair. They do more dangerous crap than flying over people and near stuff. They set drones on fire while they are airborn. Do you know the damage this could cause.

    it encourages others to do the same it is so easy to buy a. drone without proper training and certification, it is so easy to do such acts even window viewing it will ban others who enjoy their hobby

    interesting thought experiment for all... drones & planes shouldn't meet but go too high & they can. Bird strike jet ingestion can take a plane down but lets assume a sub-250g drone didn't. Even without any fines would you care to pick up the maintenance & inspection charges for a commercial jet engine just to PROVE it didn't do any damage & was still safe to run?..... followed by a chorus of "IT WILL NEVER HAPPEN"... just like a titchy 249g drone doesn't have a chance against a super strong chopper main rotor blade & the drone will always come off worse with the chopper hardly even noticing anything... so no need to worry ....but that was noticeable dent that a drone DID put into that chopper blade & the post encounter helicopter maintenance costs WILL have been significant.
    If something went wrong above 120m what defence would you use? (& are the current rules nonsensical?)..... or is it easier just to stay well clear & ensure it cannot happen.

    Been doing it for 5 years without a problem. These drones, especially DJI, are super delicate. If you grab them wrong you break them. They're not going to hurt anything.

      That really isn't the issue. If idiots keep openly posting videos like this, it will lead to more and more regulation.
      If people ignore advice and letter from Federal agencies, they will end up in a world of pain.

      @@Geeksvana I thought there should be a reason for rules? Would you find it OK if you go to jail for jumping on a skippyball without a license? If there is anything leading to more regulations it is people accepting them blindly.
      And don't think you won't get any fines. Maybe you fly an inch too close to an empty barn you didn't see in the middle of nowhere. With Remote ID you will get the $1500 fine automatically in your mailbox. Lets see if you still believe the regulations for drones are reasonable.
      This guy hurt nobody. But they still want to destroy his life with this idiotic $182,000.
      They should worry about cars that kill 1.3 million people every year. Or guns that are the number one cause of death for children in shitty USA.

      Before fining him, they spoke to him many times, tried to work with him. I am all for attacking over regulation and heavy enforcement but the fines came after many ignored attempted to mediate.
      The fines are also proposed fines and if he responded properly and via a lawyer, they would have removed many of them. If you take a look at other FAA fines, the total proposed is always FAR higher than the amount they pay.
      This case isn't an indicator of the system as Mikey is unique in terms of his actions. Most people would have taken steps to protect themselves and perhaps not post the flights. Mikey continued to poke the bear and tried to go viral with the drama.

      @@Geeksvana Mikey is unique in terms of his actions. Indeed. So were the brother Wright. Maybe they should have stopped them with a $182,000 fine because it was so dangerous? One of the charges Mikey got is flying a drone at himself! He is still alive.
      Did you know that the first cars had to have two helpers walking in front with flags to warn people? What happened to that rule? Cars kill 500 children a day!

      @driewiel this is just about the most social media reply comment I have read this week. Nothing Mikey is doing is even remotely for the benefit of you or anyone else. He does not care about the hobby, only desiring to go viral. I know the man very well and spoke to him several times a week at one point.
      This is not the person to see as a trailblazer. He has no clue what he is doing from day to day and there is very little he wouldn't do to go 'viral'.

    The FAA sends the FBI which has nothing better to do than harass the operator of a sub 250 gram quad while hundreds of commercial planes and passengers fly over my house at less than 3000' MSL, doors on planes are blowing off, passengers are being sucked out of plane windows, engine fires, multiple mishaps on taxiways at airports and millitary helicopters fly at tree level with ADS-B turned off. Less not forget the MCAS debacle, that was not the first time the FAA let a commericial jet company or operator 'self inspect' which ended in crash. Off the top of my head I can name 3 crashes that are the direct result of the FAA's willness to turn their heads when big money is involved, Fine Air Flight 101.... 4 dead (cargo plane), Lion Air Flight 610... 189 dead, Ethiopian Airlines Flight 302.... 157 dead.
    That is the FAA who harrases quad operators and has moved the goal post multiple times.
    Shall we now discuss carjackings and theft in Philadelphia? How about the unlicensed quad and motorcyle gangs? What about the bicycle gangs that by the hundreds drive straight into oncoming traffic on Market street after dusk in an attempt to intimidate drivers?
    Not to worry, the FAA and FBI are busy combating drones which if there is a total failure it may give you a paper cut.

    I'm trying to figure out where all of the victims are at? Meanwhile an airplane actually landed on a highway in the states recently with actual injuries. Not to mention 100s of deaths from that Boeing Max fiasco.
    Yet this guy gets fined $182K. He likely doesn't have a penny to his name or at least not enough to afford $182K.
    While I do not think it's ethical nor right to fly above the clouds - I don't think a huge fine from that and a series of that is ethical. Besides all of the popular "pilots" does the same thing. Instead of being fined, they get praised on social media!

      His downfall was ignoring a Federal agency and the poking them with continued flights.
      The fine level was proposed and many of the infringements, all $1500 adding up the headline figure, would end up being removed.
      This is actually more a story of what happens when someone refuses to engage with the legal system, as much as the drone issues.

    So what are the chances that they downloaded all these videos could he not delete the videos and there evidence is now gone.

      The videos were taken from UA-cam originally, along with data supplied by UA-cam in terms of when they were originally live streamed. That was the kicker for Mikey. The live streaming gave them a point of time for the offence and made so many things worse.

    The spotter when flying FPV rule is silly & wholly unnecessary, hence it is usually disregarded.
    All in all, most of the consumer drone regulations are ridiculous & unneeded overkill. There have been ZERO deaths & very few serious injuries caused by consumer drones. The regulations are a solution in search of a problem.

      It is safe, the regs are overreacting, but he does not have a change agenda or strategy. Philadelfia is an old, historical city, where the U.S. Constitution was written, and the first capital of nation. But the architecture is pretty mediocre. Been there several times. The airport is not that near, and over a river.

      No, his actions are proving how a foolish person doing stupid things with drones will have to eventually pay a price. Not only that but it also demonstrates how continuing to do these idiotic stunts and broadcasting it on the internet is hurting the hobby/industry for the rest of us that fly by the rules and don’t do stupid stuff.

    I think all his flights prove beyond a shadow of a doubt how safe the drone hobby is.
    However the rules are the rules.........can only poke the Bear so many times

      Yes, it is a really tough one, and I struggled at points to separate the two issues in terms of this kind of action causing more problems optics wise but also being level in terms of enforcement and punishment as he isn't a hardened criminal etc.
