The only way he could have legally seized his gun was if the traffic stop had anything to do with the gun OR there was plainsight drugs on the floor of the car. The Trooper would have probable cause.
No he can take they weapon for the detention and disassemble it but it's for safety. Running it is something different but I can't find any case law on that.

A guy can go hunting and get stopped by a game warden and the officer doesn't act like a fool. Shotgun loaded with buckshot or a rifle loaded with high power rounds. Not scared at all.

That's why the Constitution and amendments should be a full time study from 1st grade to 12th. That should also cover general law.

Your teachers in the USA are not qualified to teach that subject. Perhaps some law professors are, not all of them -- but some poor high school teacher cannot be expected to cover the subject of constitutional interpretation with any competency. Even supreme court justices argue over it.

I then messed about with it from time to time over 30 years of dealing with the issues raised and found that the deeper you go, the deeper it becomes. Sometimes, there's no manageable standards at all.

Case and point, a prefatory/subordinate/dependent clause that contradicts the operative clause is grammatical contradiction. The clause that creates the contradiction, in which the clause demonstrates no operative value( it cannot stand by itself), is no longer a prefatory/subordinate/dependent clause; it derives is operative value from the operative clause.

A dead body or drugs would be illegal...so yes he would have probable cause to enter the vehicle in those cases... But a citizen who's legally and properly carrying a firearm does not give him legal probable cause. My grandpa was a cop for 22 years..

The courts will tell you flat out, “ignorance of the law is no excuse. You are to know the laws” but, cops don’t know shit about the law and violate laws all the time. They also get away with it too, more than not.
They need to be required to take basic law training! Start with the bill of rights and the constitution! Then get into basic damn laws of the city and state they are in! My word, if you’re supposed to be the authority over the laws and hold people accountable then your ass better know them yourself! And damn sure need to be accountable yourself when YOU VIOLATE THE LAW!
Immunity is ridiculous. I understand why they have some it but, it should be applied in a LIMITED basis, and not a freaking free for all basis. Write it up to cover the limited instances it is needed and warranted to have it; not a freaking blanket policy to cover everything, so they’re not held accountable for their mess ups.
Lastly, they need to be paying out for clear violations and not the tax payers paying it. They need to get some kind of insurance, like drs have when they make a mistake, and let them FEEL the punishment of their mess ups! They don’t give a flying flip about messing up because they don’t pay out and they get to continue being jerk-offs.

Depends on the state. In NJ you are allowed 2 and they have to be registered to your CCW. Then again we just got that right back 2 years ago and dems seem to be constantly trying to changing the law to make things harder.

Thus, in order for a directive to exit your vehicle to be lawful, RAS of the person being armed AND dangerous. Without any facts to support the suspicion, its unreasonable suspicion given the fact the 2nd affirms the right to keep and BEAR arms.

Only if you make your own and a gun made before 1968. Some guns before 1968 didn't have them wasn't required before the gun control act. I don't know if they law changed for homemade guns with the ghost gun problems a couple years ago. Wouldn't advise it because lots of cops don't know every law and you could be harassed. Unfortunately, certain states require that the class that you take and the firearm you qualify with Has to be the one that you can carry only. You cannot carry any other firearm, except the one that you qualified with. Tennessee used to be that way and they change that about 20 years ago.
