- The Supreme Court on Wednesday sought a reply from the Centre on a PIL seeking gender and religion-neutral uniform grounds of succession and inheritance for citizens in the country. A three-judge bench headed by Chief Justice S.A. Bobde issued notice to the Ministries' of Home Affairs, Law and Justice, and Women and Child Development on the plea filed by Advocate Ashwini Kumar Upadhyay. The plea argued that succession and inheritance are crucial, as they impact the right to life, liberty and dignity, guaranteed under Article 21 of the Constitution. The petitioner contended that discriminatory grounds of succession and inheritance not only reinforce patriarchal stereotypical notions but also contravene principles of gender justice, gender equality and dignity of women guaranteed. This is the fourth PIL in the last three months on issues that constitute together the spectrum to be covered under the Uniform Civil Code. The earlier three PILs deal with issues of uniform adoption laws, uniform divorce, maintenance and alimony law, and a uniform, gender neutral, minimum age for marriage. All of these petitions contend that even after 70 years of independence, there is discrimination on the basis of gender and religion, and the court cannot remain a mute spectator to the denial of these basic rights. So what is the answer to enforce equality end discrimination on different grounds. Will a common civil code help remove disparities, And if yes, is it time to move towards its implementation?

@@zeaybaanoorie528 Mam, it's not a bill also yet. UCC is given as a direction to the state, in the DPSP, Part IV, Article 44. It has not been taken up since independence, due to various reasons as the panelists mention above.
What happens in future, remains to be seen.

The secular marriage law, that is, Special Marriage Act, is filled with provisions causing unnecessary hassles to the individuals opting for it. Why on one hand, we talk about UCC, and on the other hand, make civil marriage so complicated? Shouldn't civil marriage be as simple as marriages under personal laws?

I am a migrant now living in Bangalore . Mother is from Karnataka married to father of Andhra Pradesh. We resided in tamilnadu I did my studies there. I did a diploma in civil engineering . At age of 30, migrated to Bangalore.that is education rights nor govt job rights (I could not able to transfer employment registration from tamilnadu here they refused). i have tried several times seat in engineering colleges only payment seat available that too for tamilnadu guys 4 years , for karnataka guys 3 years.
As we are migrants I got job opportunities from newspapers not by any reference , so I got odd (or) irregular jobs not related to the civil field.
I got opportunities in mechanical piping, steel structures, soil testing .offshore jobs, even computer related jobs .
I am aged 51 married 40 with 2kids now .
If we stay certain years in the USA or UK or any other nations except the gulf we will get education rights even permanent residency.
In India only in gujarat if we stay for 5years we will get free seats.
In Delhi also same for 3years
Why not in other states it generally affects national integration and poor migrants are not able to achieve education.
Also I heard people spend a lot of money for education to Their kids for doing education abroad for employment opportunities .
If we concentrate we can give that education here like we created software parks here , like if we think of education parks also along with manufacturing hubs.
Few states give rights based on mother tongue , this will affect migrants rights .
Vocational training may be affected to this policy , since for example UP guys are good in painting ,gujrat in carpentry, tamilnadu in masonry, Orissa scaffolding and roof shuttering in , Bihar construction activities .etc
So I think border lines give full stop for management quota for Indians who can target NRI or foreigners .
Local languages should be focused for child development not to give burden to poor migrants.
This will affect largely if India needs to facilitate manufacturing hubs to the whole world, since the poor are the backbone for such companies who are mostly migrants from other states.
Sri narasimha rao, and sri manmohan singh liberalised education policy in order to make India encapsulate human resources opportunities.
But here in India ,education institutions owners made it into business established laws with the help of politicians and sold education for making money.
