    You CAN go to Liberty Safe and have them take your combination out of their records. This, theoretically, puts them on "Apple footing." Check out their website for more information.

      Assuming you believe they will actually purge the codes, or they're not backed up on hard drives somewhere. I think the trust is likely gone from a large portion of Liberty's customer base.

      A Few months ago, I had a hard choice between a Custom Made Fort Knox Executive or The Presidential from Liberty, I chose to go with Fort Knox. Now knowing what Liberty just did, Now Im glad I chose Fort Knox.

    If Liberty was actually compelled to provide the information they should have stated so in the initial press release. Boycott them into dust. Those safes are worthless now.

      There is no override to a combination dial. Just change out the pin pad for a combo dial. Problem solved.

    Boycott Liberty Safes. Period. A safe, once purchased from a vendor, is the sole property of the owner. Liberty has no right or responsibility to maintain records or grant access to a safe no longer in their possession.

      I first saw this back in the eighties, when it came out in trial that corvettes had a black box recording speed on all vehicles sold, solely for their own purpose to defend against claims against them, NOT in any way usable by the purchaser of the vehicle.
      At the time, it ruffled a lot of feathers, but today it seems so common most people don’t even care.

      In all fairness, when the purchaser is told that if they ever get locked out of their safe that they’ll need to furnish proof of identity before being Liberty will help get them back into it, how did they think this was going to work?
      That said, when I buy a safe, I bought the ENTIRE safe which includes the carpet inside, the shelves, the lock, AND everything to do with that lock including ALL the combinations.
      If the company had listed that they or the government wanted to cover 25% of the cost because they wanted to also own access to the safe in perpetuity, then I’d have nobody to blame but myself.

      Every Safe manufacturer would give out the combinations if asked by FLEO'S. We did it all the time, but many juries don't agree with the practice of asking n given combinations to convict someone. So it isn't very popular to do so, as the judges will routinely throw the retrieved items as unlawful concent n dismiss it as evidence. 😢

      Liberty was in a no win situation. Would the reaction be any less if they gave the access code after being served with a subpoena? Yea, it would have delayed the FBI getting into the safe for an hour or 2 at most. I think most of the outrage is over the fact that Liberty had these secret factory access code in all of their safes.

      @@daytonagreg8765 You clearly don't understand the limits of the warrant. A warrant was not served to Liberty, therefore they were under no obligation to provide the code. This is clearly not the first time the FBI has done this. They had them on speed dial, I would bet on it.

    I was very happy to see that you were presenting your take on this topic. Thanks as always.
    One thing is for sure, Liberty Safes has taken a huge hit. The 2A community is not likely to forget or forgive.
    If a Liberty Safe customer lives someplace that has safe storage laws, can they ever be in compliance with those laws, since they are not truly in control of all means of access to the safe? It's a stretch, I know.
    What are the other safe companies doing now?
    I personally changed the lock on my safe to a hybrid style with both an electronic and mechanical dial. I did it more as a failsafe and EMP protection. That breaks the trail of the safe manufacturer to my combination.

    What appears to have happened was the FBI arrested the suspect and had a warrant to search his home. Upon finding a Liberty Safe in the home contacted the company, stated they are the FBI, and asked for the code to unlock it then and there. Had they actually served Liberty Safe with a subpoena for the code (not the warrant for the property, the warrant to Liberty for the code itself) the process would've taken days because those have to be served in person...instead it took minutes.

    What I would’ve done, had I’ve been Liberty Safe is, I would’ve told the FBI to send the warrant that says I must turn over the information. Only then would I have given them the passcode.

      Correct. Not a copy of a search warrant for the property of XXX. But rather a warrant signed by a Judge to liberty safe for the combination to safe serial # xyz.. I might have 2 and they may not be on the same property so if they didn't get a warrant for the other property they do not have authority to receive that combination..

      @@andrewschliewe6392 that is concerning, but I always figured they along with every other manufacturer would. I mean they put in over ride codes in things. So at the very least with the fact that in this case we're talking about something where you're guarantee is that my property will be secure. The least you could do if you do have any type of override would be to require a warrant to assist.
      However I would be more interested in how to change the combination of key. Then they don't know because it was changed... Unless they have a master key/override

    Thank you Liberty for assisting me in choosing a safe. Liberty was my #1 choice bit that has changed. I’d rather select a company that values the privacy and security of its customers. Thanks again! Just saved me a few bucks and making a horrible decision.

      Apparently, you haven't been keeping up with the news. On Wednesday night, Liberty announced that owners can opt out of Liberty retaining that factory access code for their safe. However, then Liberty won't be able to help you get into your safe if something happens and you can't get into your safe.

    The last time I used a digital lock safe was in a hotel in Belgium, where I mis-set the code, and the kid at the desk was promptly able to let me in with the hotel code. The pathway to hell is paved with good intentions, and I suspect that Liberty keeps those codes primarily for geezers like me who probably comprise most of their customer base. Great video as always Tom. I don't own one of their safes but I imagine they are good.

      The warrant apparently was to search the house and it's contents. The FBI had the authority to search the safe. Getting the code just made it easier. It would appear Liberty did not have to provide the code based on the warrant to search the house. Without the code the FBI would have used destructive means to access the contents.

    I know tons of programmers who are big 2A advocates here in Silicon Valley, we tend to not trust the government, Big Tech, or any other powerful organizations.

    Anyone who purchased a safe from Liberty was probably told this by install if they had it installed, I was... So it should not be a shocker that they have a access code if you lock yourself out. Now giving that to the feds is another story...

    What is currently troubling me is the information Langley Outdoor Academy shared today regarding Library Safe’s political donations to anti 2a democrats running for office recently.

      Why? they were gonna have to give the FBI the access code anyway. And now, Liberty has announced that if one doesn't want Liberty to retain that factory access code, they will remove it from their records. So going forward, this won't be an issue unless you didn't tell Liberty to delete the code from their records.

    Great segment , I will assume at my own peril that access codes at liberty are assigned by serial number and filed supposedly as a courtesy to their customers . Therefore the only way to protect yourself would be to go so far as buying the safe under an assumed name and after copying the serial number to a secure location , Destroying all identifying numbers on the safe so hopefully your contents will be secure from prying eyes .Keep up the good work Tom.

    And that is why I have always owned an iPhone, keep the software up to date and pay attention to the security settings. Apple also told the FBI to pound sand over their request for modified OS software to hack that iPhone. I salute you Tim Cook.

      Only reason that case was dropped was the FBI was able to crack the encryption and the phone without Apple's assistance. So your iPhone is NOT secure from law enforcement.

    Thanks Tom, I always enjoy hearing your professional take on these issues. Liberty safe is suppose to be selling security and that is not what they provided. And sadly they have known that they have not been doing this for quit some time. They need to pay the a high price for their actions, not only as a punitive measure, but also as a strong warning to others who may have or may choose to go down this same path. As a side note, it use to be a positive value to support law enforcement, but now that the Federal agencies have been weaponized and they are acting like storm troopers trampling the Constitution with a 2 tiered justice system, this no longer applies universally.

    A Safe is just an iron box. The part that makes it secure is the lock, which can potentially be replaced. I have no doubt that even if Liberty "shreds" your backed-up combination, that they still have non-destructive methods of opening the box. Some bright after-market company needs to start producing after-market, secure, locks. Oh yeah, and thermite packs large enough to slag the safe down if someone tries to carry it away.

    Specificity on a search warrant is key. Especially if it's an individual citizen and not a warrant for "the" corporation. If they (Liberty) choose to impose their policies instead of constitutional rights, FAFO!

    If I were in "Liberty's" position, I would advised law enforcement that we would be glad to honor any warrant that binds the company to provide the code to access the space they expect to find evidence in (and as a former cop, I don't even know how that would be structured or if it would be legal, or if a judge would even sign it, as I feel the legal onus is on the homeowner to allow access) or any subpoena issued to provide the information. Then I would have them deliver a certified true copy to our legal department for review.

      Or better yet, do like Apple did (which is about the only think I personally can say is any good about them but that's irrelevant), absolve yourself (Company) by not retaining records that could be obtained. Like Tom said, "you can't give what you don't have". Unless there is a law that obligates them to retain anything that could or would be related to personal privacy, the most ethical thing to do is move yourself from the situation right from the start but not retaining anything that could be sought be anyone.

      They legally should have gotten a subpoena (for Liberty), but instead went for an addendum to the warrant (on the individual's property). The phoned in addendum didn't mean squat (to Liberty), because it in no way forced Liberty to hand over confidential information-the warrant was still on the person in custody and the added property in question....(they basically would have had to seize & destroy the whole safe opening it).
      I wonder who the smarty pants at the FBI was that KNEW they had a back door code...and it's obvious they've done it before - this time they just got caught.
      As for a judge signing it, all they had to say was it was for J6th and it was a green-lit rubber stamp. But yeh, Liberty bad, they were too willing to fold on their customer.
      A real 'Bad Faith' moment.

    Love to see the affidavit for search, as to the specific places, persons and things to be searched for and seized. Federal warrants are frequently packs of perjurious lies, as is the BATFE affidavit for search at Waco on the Branch Davidians. I read that one, and it's bogus.

      That's not what the subpoena for Liberty is for. It's for the access code. What you are stating would have been on the original search warrant.

I forgot to put this in on my previous post. Not only do I want to see a warrant for the safe, specifically I would ask to see the warrant for the pass code to get into the safe. If they didn't have that, I'd tell them to go pack sand.
      I believe that warrant was illegal because it was too broad. The judge that signed off on that warrant, the agent that filed the application for it, and the agents that carried it out needs to be prosecuted and put behind bars for their blatant violation of people's Constitutional Rights.

The search warrant for the individual's home has standard verbage that includes the contents of any locked object on the premise. It would not have specifically called out a Liberty safe. And no one's constitutional rights were violated. You need to get of your high horse. Sure Liberty could have, in your words, pack sand. But that might trigger the FBI to investigate Liberty Safe. And getting the subpoena for Liberty safe to disclose the factory passcode would have been a formality. There is no scenario where Liberty does not give the FBI the passcode.

The scenario is they don't have a warrant, they don't get the pass code. Yes, for the pass code, the warrant has to be specific to that Liberty Safe. They have been abusing the warrants for a long time now, and it needs to stop before we lose our great Constitutional Republic. Nowadays, probable cause doesn't mean anything. Probable cause for a search warrant used to be a substantial bar to meet before obtaining a warrant. Now it seems judges rubber stamp any application for a warrant that comes across their desk. Cops or agents are bared from going on a fishing expedition by the Constitution. Which these broad and open-ended warrants allows police and federal agents to do. You wholeheartedly accept this abuse of power and support a police state.

    Unless fed boys have a warrant specifically covering that safe (i.e. the warrant specifically defines the specific places to be searched and the specific items being seized as the 4th amendment requires) I would tell them to go pound sand, any good will these people may have had is long gone at this point.

    I’LL NEVER DO BUSINESS WITH THEM NOW.
    A couple of thoughts.
    1. I was always under the impression that nobody is ever under a legal obligation to make a warrant search easier. If your car is locked and you refuse to unlock it, they would have to break out a window. If your home was locked, they’d have to kick in the door. Silly me, I just assumed if you wouldn’t unlock a safe they’d have to pick, saw, torch, or drill the safe open.
    2. Why couldn’t Liberty Safe just print out a complete list of every possible “unlock code” in existence but not collate them with names or serial numbers and then tell them “we guarantee it IS one of these numbers”. Again, nothing in the warrant says you have to make it easy for them.

    A suggestion from another safe manufacturer was to remove the serial tag from the safe. One may or may not retain it at a trusted location thereafter.

    I was a Narc for a few decades, and served thousands of search warrants. When the dopers had a gun safe, I would give them a chance to give the combo and spare the destruction of the safe. If they declined, destruction of the safe would follow. Usually we would call our safe locksmith, who would drill it, and set the tumblers. Almost always, we would seize dope, money and guns. And a few extra hours of overtime.

      When they arrived at his house and found a safe there then preceded to contact Liberty safe company and got the access code. Nothing was known prior to searching from what I have seen.

    Tom... Do you really think the end result would be any different? Law Enforcement is going to gain access to that safe if they have a Search Warrant, via a locksmith or a cutting device. Are we going to punish an American Company for a poor decision, that they seem to have realized? Should we expect them to fight the Courts after selling us a safe and making a few hundred dollars?

    An angle I've heard nobody cover: If the FBI wants to get into your safe, no matter who made it, it gets a warrant to that effect and does whatever it has to do to get into your safe. So you're left with a destroyed safe, and they get what they want. Or they enter the code, leave your safe undamaged, and get what they want. They're going to get into your safe if they have a warrant; it does not matter if they get the combo from you, the safe maker, or from nobody. If they get a warrant, they're getting in.

    Seems like Liberty was protecting the safe. A safe is far easier to break into than an iPhone. Sure you can destroy phone easily, but then data is lost. Even best safes are fairly easily cut open. I’m kind of amazed FBI was kind enough to get combo so as to avoid destroying the safe.

    A few years ago I was looking for a safe and leaning toward Liberty until I read "If you change your combination your warranty is void." So I bought a Sturdy Safe. Along with the safe I received the key needed to change the combination and instructions on how to do it. Sturdy Safes is the best, in my opinion.

      It doesnt cost that much to swap the locks out on these safes. They are all made to fit into a standardized footprint inside all the companies' safes. I don't even think Liberty makes their locks -specialized manufacturers do this and safe companies like Liberty buy them wholesale to build into their safes.

      @@michaelinsc9724 that depends on if they come with a custom program from the lock manufacturer for Liberty, or if the code is hashed to the serial number on each particular circuit board in the EPROM chip which is then connected to the serial number of the safe in Liberty's company records.
      There is still a lot we don't know how these passcodes are built into these electronic locks. They never shared this info with their customers which is a big part of the problem.

      @@michaelinsc9724 Back door master codes are maintained according to serial numbers on the back side of the locks. They are easily removed stickers; no serial number makes it very difficult to obtain the back door code.
