      @7:19. Uh, no. Today's law enforcement are not required to perform, in fact they are discouraged as a matter of policy from, performing, any medical care. This example can be used as a ruse to break the 4th Amendment protection by law enforcement. Remember: they are NOT medically licensed or trained. Performing CPR carries a whole host of sticky wickets, Remember the George Floyd case.

    I have been a Defense Attorney for 27 years. For the past ten years I have worked in the various stages of post-conviction proceedings in death penalty cases. My advice is pay attention to this guy. Everything he says in this video is legally correct, no matter where you live. If something varies from state to state, he tells you so. The only thing I would add is this: If it ever appears from the context of the situation or from the questions they ask that police suspect you of something, do not try to convince them it's not you. They will twist your words and use them against you. No matter what they tell you, reduce your vocubulary to one word: "Lawyer!"

      Well said.
      The mirandizement specifically declares the intention to use everything you say against you. I question whether the mirandizement itself is a 5th amendment violation as it places the subject into a state of absolute self incrimination.

      I learned that real young. A sheriff told me he had evidence and camera footage of me blowing up some motorcycles and 4wheelers. Told me just to admit to it.
      I was nowhere near that incident.

      Reminds me of an older video about not talking to cops. After the attorney spoke, he had a police detective speak as well.
      The detective explained how he got written confessions from younger perps by telling them that a "I'm sorry" note to the victim could help their defense. It was disgusting watching his smug satisfaction and pride at being deceptive. That video was single-handedly responsible for shifting my previously pro-police stance to something more akin to dealing with a potentially rabid animal.
      I think police are necessary and better than the alternative, but trusting them too far can get you bitten.

      @WOODLASE No, we should not get rid of states rights. All that means is that governmental power gets concentrated in DC.
      Just because the predominant culture places no importance on local and state elections, doesn’t mean that those elections are fundamentally useless and should be done away with. People just need to get more involved in politics near them rather than only caring about the presidential election.

    You left off the most important tip of all. If police show up at your door you do NOT have to talk to them. You don't have to answer your door. (Unless they announce they are there to serve a warrant). Then, you can demand to see the warrant through a closed window. After being wrongfully arrested 2 times in my own home I will no longer answer the door if police knock on it.

      I like the one safety step for anybody at the door. A locked, double latch plexiglas storm door, will prevent entry even when you open your steel main door. You can see the papers they hold against the window, but they can't come in. Houses with a vestibule used to be a thing. The door to the main house was shut, and quick conversation was possible in the shelter of that little coat and boot area. Too bad those are not common anymore.

      If the police have a warrant and you don't answer the door, they will kick it down. You don't have to talk to them but they are coming in regardless.

      ​@@nicolasmustaro751 YES! My son got a degree in Criminal Justice and emphasizes to never talk to the cops. My personal friend is an Arizona State cop who's highly trained in interrogation. He is adamant about saying never talk to cops, not even as a witness. His main reason is typical cops have so little training in PROPER questioning and interrogation that they're merely overconfident idiots.

      I very much learned the hard way to not talk to cops even as a Victim. It's been four years and I'm still outraged at how they rearranged my words to help the FELON get away with siccing a dog on me, on my property, and I got ripped up. Turns out the SOB goes to the Sheriff's church. (Who's the Sheriff??? The guy who's now running for US Senate for Arizona. He's run this county like a mafia and his friends are exempt from the law.)

      The way I’ve seen it, being a witness means that you’ve voluntarily offered to donate time out of your life to someone else’s court case.
      Depending on how far it goes, this means you have to take time off of work to talk to cops, the lawyers for the prosecution/plaintiff and the defense, and showing up to court for a trial to be grilled under oath.
      Sure, it’s better to be a witness than the victim or the accused in a situation, but it’s a hassle to have to go through all of that despite you personally having no personal investment in the outcome of the trial. You almost have to treat it like you’re donating to charity, which some people like doing…

    Great video Tom. I would also add if someone grants the officer consent to enter their home, that consent can be withdrawn at any time. Unless the officer (while in the house under consent) sees contraband, if the homeowner tells the officer I am no longer consenting to you being in my house, the officer(s) MUST leave. This ability to withdraw consent can be a VERY powerful tool to recover rights that are waived. Courts have said law enforcement can infer that consent to search a home was granted if the property controller was holding open the door, but when revoking consent it must be direct and unambiguous for the best way to survive a court challenge. A good statement to make is "I am now withdrawing my consent to search, and unless you have a search warrant, you are to exit my house immediately."

      @LTM They can only attempt to "seize" the residence if they find contraband, and have probable cause for a search warrant. My post was:
      1.) If consent was given
      2.) Up to the point of revocation of the consent, they did not find any contraband.
      Once contraband is found, it's game over as they will secure the residence and get a search warrant. They can't just "seize" a residence just because they want to. They need to articulate "probable cause" in order to get a search warrant. THEN they can seize the residence until a search warrant is obtained.

      @LTM Exactly why I noted the withdrawal of consent must be clear and unequivocal. It would also help to be taking a video of that withdrawal along with the officer(s) reaction. If they attempt to reengage to keep the consent going, it should be directly rejected and again stated consent is withdrawn and you are to leave my home immediately. If this is on video, it would be extremely difficult for a court to give the benefit of the doubt to the officer and allow the "consent" search to continue.

      Here is how that goes where I live........The cop shoots the homeowner, and states you appeared to be reaching for a gun....The cop then gets a big promotion,

    The lying part is definitely true. I was 19 years old and had the police at my house. They told me I was a suspect in a string of burglaries. They said they had multiple witnesses and everything. I told them bullshit and I haven't done anything. Which was true. They grilled me for like 10 minutes and then left. We lived in a very small town of about 10000 people. They just wanted to close the case and didn't care who they pinned it on. This was over 30 years ago. So they have been doing this shit forever. If you are innocent just stand your ground and do not talk anymore than you have to...🇺🇸

    Thanks Tom. Summary:
    1. Don't give consent to search. Consent can be specific words or even non-verbal. Speak clearly that you do not consent to a search. Make sure everyone in the house knows.
    2. Don't have illegal stuff in plain sight.
    3. Probable cause can be a warrant (written court order), or exigent circumstance (emergency threat to life or property, fleeing suspect, destruction of evidence)
    4. Police are allowed to lie and trained how to do it well. Do not talk with them.

    I had the ATF call me once and come to my door once. In each instance it was about guns I had bought new and sold legally to someone else. Eventually the guns showed up at crime scenes. Since I am in Illinois I was able to dig out the bill of sale (10 year record requirement). The two ATF guys who came to my door expected me to give them a hard time and I started out that way since I had no idea who they were. I stepped outside and talked and left them on the stoop while I tried to find the paperwork on said gun. It was fine, I was happy to cooperate but I do agree you really need to be careful. Tell you what, always have a lockable screen door in front your main door. Then you have “protection” from them just opening up a door.

    As a 66 yo woman who has never been in trouble with the law, thank you. Sadly I have little trust in police. It started when i was a pretty young woman. A policeman driving next to me on the street asked me my name. I ignored him. This angered him and he told me he could pull me over and get all the information he wanted, even if i was a virgin. All while driving down the street, i was so afraid but still ignored him. Thankfully it was an empty threat. So I appreciate you providing this information.

      When my sister was pregnant an off-duty cop and his friend came in the our work and was making very rude sexual comments to her. It irked her so she complained to the chief who said he'd "do something about it".
      Flash forward years and my sister gets pulled over at 2am for swerving and guess who walks up to her window.
      She refused to exit the vehicle and told him why she was afraid. He arrested her when another officer showed up.
      Of course there was nothing in his file but she had a good attorney so she beat it.
      Lesson; Don't Drink and Drive, and sadly, if you are in a position of authority realize that your actions also have big consequences.

    One time a cop showed up at my door asking about someone I let stay at my house for a few weeks. This person was down on their luck and needed a little help. About a month after they left/moved out the police showed up looking for them. They asked to search my house for a stolen item in relation to the person I let stay at my house. I knew 100% of their items left with them. I said NO you can't search my home. He pushed back with threats about if they find reason to believe its their they will get a warrant blah blah. I stood my ground and repeated NO. He left after telling me again about possible consequences. I felt guilty even though I had done nothing wrong. Its hard to tell them no but you must. Never EVER let a cop into your home without a warrant.

    As a kid of the 60s, we had cops for neighbors. I was taught to respect them, never to question their motives or actions. My teenage grandson has been taught way different! Minors cannot consent to allow them to enter a dwelling, we've impressed that fact on him. He knows not to open the door for them. Not because we're doing anything illegal, just to protect us from their lies. The drug war has provided low hanging fruit & unsurprisingly, has become the focus of their activities. Murder solve rates fell after criminalization of cannabis & is, overall, deplorable. Gotta chase that sweet Federal money & look towards asset forfeiture! Policing has changed & not for the better imo.

      Yeah exactly somebody I know who has several family members living with him. One is going through. Drug court is definitely his own worst enemy. He is going through and complying with everything through drug court. Even though it's not his drug court they're allowing unrestricted searches of the house. There are all kinds of stuff. He's griping about this whole time but I'm like you're the one allowing it. I told him to put a lock on his bedroom door for multiple reasons. One to give himself privacy and protect himself and his wife from just people walking in because he's got several family members living with him and many more that are trying to live with him. That whole got to do it. It's family mentality that a lot of people have. But yeah he is definitely his own worst enemy and not just through this. It's also other things. He will open his mouth and spill everything and then wonder why he gets in trouble

    Because of the LIES from cops over my 50 plus years, I don't talk to them without an attorney present. I'll NEVER allow them in my house without a warrant. And ONLY after I've read that warrant! I once had a cop try to pass off a restaurant menu (the kind left under windshield wipers at a Mall, etc.) as a warrant! I told him his "warrant" was only good at Kungpow Palace! And added he could leave my property! I filed a formal complaint that same afternoon.
    I'm NOT an excon, nor do I live in a seedy neighborhood. That jerk was harassing me for fun. He went too far that day, and because of my complaint never bothered me again. I learned then police were NOT my friend, and should NEVER be trusted!
    It doesn't help when I overhear them bragging and laughing about violating People's Constitutional RIGHTS! Because of this, I see them as little more than Hitler's brown shirts; agents of TYRANNY.

    Often times officers do not know the law they are enforcing or more correctly they try to enforce non-existing laws. Instead of learning "tricks" to entrap they should put more effort in learning the laws they are hired to enforce. This would go a long way in public relations and save the courts a lot of time and expense.

      Problem being cops are NOT expected to know ALL THE LAWS that they are enforcing.
      BUT we the public are expected to know each and EVERY law! Ignorance is no exception for us citizens! This is absolutely ludicrous.
      How are we the people to know all the laws. Should ALL citizens act like some, not all, of law enforcement, shoot first and beg for forgiveness later. I say yes to the latter! Plus my aim just might be better than the Gestapo! If the police would learn the law in school. Wait a minute.
      How is it possible to learn w/o going to a Academy for more 3 months. How come it takes longer to get a cosmetology license than to be able to have a gun, put people in jail, legally or not possibly ruining a person's life??

    Outstanding content. I worked for State Attorneys and civil attorneys for yrs.
    Just remember, the less sad, the better off. YET, ALWAYS BE POLITE. The different law enforcement agencies, especially today, will use your emotional state against you. If there's no warrant, I would add: NO, I am not refusing. I just want to check with my attorney.

    Thanks Tom! Good to know what our rights are. Wished we had you & UA-cam 35 yrs ago when 2 FBI AGENTS just walked right in to my home looking for information about my husband. I was 23 yrs old and petrified- they said they could arrest me on the spot if I didn’t give them this info…my husband at the time was apparently breaking a few SEC REGULATIONS and I had no idea. That was the day my attitude changed and my respect for authority! Anyway, people need to be aware of their rights so THANKS! Cynthia

      Affidavit will only be presented in the court and it is not attached to warrant at your door. By then Police have had entered, did search, obtained or manufactured evidence so the warrant will be justified. In judges eyes, you are already guilty because police said so.

      A warrant cannot be granted or created without a probable cause affidavit. Whether that affidavit is required to be presented to you at the time of the execution of the warrant is a different matter subject to individual states laws.
      Nebraska, for example, does not require it to be presented to you at the time the warrant is executed. Most states won't require the PC affidavit at the time of execution.
      They are required to be disclosed to the defense in trial, though.

    i opened the front door for the police, when i was much younger, in the 80's. We were talking, with them on the front porch and myself on the other side of the threshold. My 2 year old son was napping in the back bedroom and began to cry. My wife, instinctively, got off the couch and was heading to tend to him when the two cops decided, they now had an ability or reason to enter my home, because my wife had left the room, or was making an effort to. I was in my prime back then, but still, only 5' 8''145 LBS. so they did not expect to be on the loosing end, of a fight for my,threshold. they found there selves on there ass's and i spent a night in the, hooscow. released the next mourning with no charges. i think one reason they didnt want to press charges, because evidently, i was in the wrong. or. they were at least, in the right, according to the law, was because they were quite embarrassed at a little guy, bouncing them out of his home. it didnt take them long to sbdue me but it was worth it.

BILLIONS of people have relocated in the past couple decades, and it's changed demographics, values, and interests in a lot of places, and also required an increase in the amount of politicians and government employees by orders of magnitude. Technology has caged us well beyond the common imagination, as well, and the police have access to most of it by warrant. The scale, scope, and intensity of policing is unprecedented, far beyond the wettest dreams of the KGB or Schutzstaffel. In a very real way, we live in by far the worst police state ever conceived by humanity, it's just set to "stun" most of the time.

    This is great stuff. Do you know how many times I've told people to get the hell off of social media NOW, they don't, and it completely devastates the entire case not just in criminal stuff but family law as well. Best strategy in preserving your individual rights is don't trust people walking around in your house especially government anything and shut the hell up. Our Constitutional rights are primarily based on protecting your property and a huge right in that you have the right to say nothing.

      Find a lawyer that is not 'in-bed' with law enforcement, judges and district attorney. In some areas, most cities are run by the Boss Hogg, Sheriff Roscoe Coltrane, and the good'ol boy system, where it's the local government officials that are against the everyday voters. I plead the 5th, as if, I don't know, I can't testify, and I'm feeling sexually harassed, molested, and fondled by law enforcement's sexual predator style of approach..       Be aware of libel and defamation laws. Although defamation cases are hard to prove a wealthy person can sue you and even if they lose you lose too because you either have to hire an attorney or handle the case yourself.

    Good video and good information you have presented.I have gone through many police interactions while going through my divorce in 2015. Do not speak to them, do not answer their questions, if you have a lawyer call them, do not consent to a search whether they have a warrant or not because that will save your ass in court later. Make sure you have working cameras posted inside and outside your premises.That's what I have learned and continue to do to protect myself from law enforcement.

    The only thing any law enforcement gets from me during an encounter is the following: "Am I being detained?" If the answer is yes: "What crime am I being suspected of?" Just want to ask you some questions. I reply: "I don't answer questions, Am I free to go?" If the answer is no: "Charge me or let me go, period. "No matter what they say outside of "You're free to go," I always repeat the process until I'm charged or free to go.

    I just started watching your videos. Here are some things I'd like to find out about:
    1) I must have watched 50 videos about people claiming they don't have to produce ID unless there is probable cause for a stop. A detainment, they claim, is technically arrest. When, if ever, can I refuse to produce ID?
    2) If you are driving your car in a state that does not have a duty to inform, should you say you have a weapon license if you are carrying and they ask for your driver's license?
    3) You might watch The Lincoln Lawyer. In the season finale, the lawyer is pulled over and somebody stuffed a dead body in his trunk. Blood is leaking and the officer observes that. The lawyer refused to consent to search, but the police forced the trunk open and searched anyway. What would happen regarding the evidence (i.e. one dead body) in relation to the car driver /owner's legal rights?

    This was great to hear. I had people at my door with unclear identification. I did not let them in. They came over and over again, still did not let them in. In the end they called that they had been mistaken. Living in a city people try to get in your apt. I would like to hear more on this.

    One time an ATF agent came to my home to talk to me. I let her in, because it was the only time you should ever allow one in without a warrant. I was applying for a Federal Firearms License. As it has been said, the only time you should allow law enforcement to come in without a warrant is when you call them.

      Even when you do call them, you should still be cautious. A friend of mine had to call the police for a neighborhood disturbance and went to talk to the officers while wearing his sidearm. He went out in the street to talk with them and one of them asked if he had a permit and asked to also see his firearm. He complied... and of course he then ran the serial number. Turns out it was reported stolen, so they seized it. Fortunately they believed he hadn't stolen it and had just been sold a hot item, but he had to go through an ordeal to prove it, and of course was just out the money he'd payed for it.

      @@ensinitas I don't hesitate to wear my side arm around cops, but I make sure they're aware I have one and always have my permit on hand when I carry. Never just go running up with a gun in your hand or waving it around like an idiot, for sure. A little common sense goes a long way. Last time we had to call cops here for a problem with some meth head neighbors fighting, they arrived after one of them had stumbled onto our property after being attacked by his house mates, and I was not dealing with that situation unarmed. All I did was notify the officer that I was carrying as soon as he arrived, he looked at my permit and never batted an eye about it, and even told me since he was the only on there, it was probably a good idea to remain armed.

    I think the modern trend of having video doorbells and such is a great thing to have - eliminates a lot of possibilities of police keeping you talking, limits the amount they can see, hear, smell inside etc. In the video you mentioned also sound and smell - when you physically open the door they might smell something that MIGHT be vaguely similar to something else and then they get their "exigent circumstances". Or maybe when you open the door you look hangover and they start asking if you are on drugs etc. The doorbell gives you the ability to cut it short just by saying goodbye and shutting off the microphone and they don't see you or see/hear/smell anything inside your home.

      Speaking of being asked if you're on drugs, as a teen I always had a sleepy look on my face where even my friends thought I was constantly high. I never touched drugs or alcohol growing up. I had some officers at my door and one accused me of being high, cuffed me, and took me to the back of their car. Me being a teen and having no knowledge of the law let this all happen because I thought I was complying with the officers. In the end they found my siblings, afraid and hiding in the closet with my dog, who was barking the whole time.

      Most police do not care about you and if the police are spending any time with you then most likely it's because they're planning to give you a ticket or give someone nearby a ticket. Most police will ignore you when your car breaks down unless that police officer recognizes your situation as a way of giving you a ticket.
      Most police blindly follow orders and do not care about skyrocketing crime... in fact many police intentionally avoid real criminals.

    It's a shame our law enforcement has become what they are today. In my whole life I have seen them go from feeling they are out to work for the people
    to now working for the government and not having to answer to the public. Some county police are still old school but that's the exception.
    Unfortunately most people don't have much trust in them anymore.

    I was in a courtcase where I told the judge that the officer was 'not telling the truth'. He said to me; "Do you mean that one of Culver City's finest would lie in court"? I knew that I was doomed.

      Same here. I got placed as the main suspect for an arson/burglary case I had nothing to do with. Cops took me off the street, seized my vehicle, my property and my phone, got violent and made numerous false statements on the discovery report to make me look like the perp and I got indicted on 19 felony charges. I also tried the whole “this is false” and “what about my rights that were very clearly violated in the process of this investigation” thing and I got told to get fucked and it doesn’t actually matter. Unfortunately now I have to view any potential interaction with LEO as a threat to my freedom because it’s the safer that way, I’d suggest others be respectful to law enforcement but don’t let your guard down for a second.

    I'm a law-abiding citizen, and what is sad and frustrating is when criminals are not getting caught just because police officers don't have enough resources or are not worth the trouble. Also, when innocent people get convicted just because prosecutors, police officers, etc. do not do their job well or just want to close the case regardless if beyond a reasonable doubt is met or not.

They do not have a money problem, they have a clear agenda with the power of the state behind them.       The police are a tool of the state. Nothing more, nothing less. They aren't heroes and they aren't devils. Saying you support the police is like saying you support hammers. When in reality it's the person and intentions wielding the hammer. Is it a carpenter or someone committing murder? Is it a just Government, or an unjust government? That pretty much decides what the police will do because I can assure you the police will always choose themselves, and their easy cushy jobs and privileges over the cattle, at least that's how they and the elite see us.

    Great advice! Many people still look to their manners when a LEO knocks on their door. Politeness and respect for the officer doing their job is hard wired in many people, particularly those that grew up under a different time when officers were recognized as members of the community and by extension, they are there to serve and protect. These days, one must be able to critically think and understand that speaking up or stating those key phrases may be their best legal course of action. For example, let’s say a regular everyday family has a knock on the door from a LEO regarding their teenage minor. As a parent, working and doing what good citizens do, may be oblivious to what potentially may be going on with their child. Some young folks are good at projecting their good behavior to their parents, who may be none the wiser. LEO is granted access across the threshold, after all, that parent has no expectation that anything is out of the ordinary. Fast forward a few minutes and suddenly the officer is radioing for a K-9 unit based on smell, something they see or whatever.

    Step 1: Don't talk to cops. Step 2: Have a lawyer on speed dial. (I do) Step 3: (N)ever open your door for anyone you are not expecting. Don't care what they say. Step (4): Have security cameras set up everywhere. Make sure some are hidden and/or out of reach. Step (5): Don't leave shit laying about. Hide it when not in use, and in wierd places.

      also during an event its best to HIDE your camera footage untill you and your lawyer are ABSOLUTLY CERTAIN it will help your case.

      An important point I'd like to add is that make sure if you have an internet connection and IP cameras connected to it, that you have a backup power for the internet and/or any security cams, and that the router is also hidden. The first thing police do in my country when they gain access to your property is to cut the Wi-Fi so they can do whatever they want and trash your home without any repercussions.

    My favorite is, DON'T TALK TO THE POLICE. From my favorite LawTuber. Many times they do not have a warrant. Have a camera system check the front door.

    NEVER open your door to the police. Once they get a foot in the door (literally) you won't be able to shut them out. Also NEVER go outside to "talk" to the police. They can violate your right much more easily once they can get their pig paws on you.

      Two or more cops, it's an arrest. Definitely don't open the door to them EVER. if they are asking, they don't know . If they are talking to you, it's to arrest you or try to.

      I keep a loaded firearm at my door that is not visible from the exterior. I keep my hand on that gun when I am at my door when speaking with anyone I do not know personally. If I try to close my door, regardless as to who you are, I will use my gun to remove you immediately. If you are with multiple people, I will remove all of them as well.
