No, UA-cam, your dispute process does not "empower" me when it's the claimant who is judge and jury. Anyone can claim to own content in my videos, I can say "no, and here's why" and they can say "too bad" and block my video, make $$$ off of my work, or take my channel down entirely. You need to do better.

I once got I copyright claim of my own demo tape that me and my band released in the 90s... Never released on a record label, and we only sold it to like 50 local people on cassette! This was the first ever I uploaded it online! ;-) Their only purpose was to monetize it I guess. At least UA-cam belived me, but Its wierd to me that it is even possible to claim a demo. And then up to me, the owner, to prove that I own it to get it back. And not the other way around (But maybe the system has changed since then)

"Using even a small part of a song can result in a copyright strike" - So fair use doesn't exist anymore.
"Composition claims are eligible for revenue sharing" Yeah, they get 99% for 10 seconds or less of a 10-20 minute video I made.
"We built the dispute process to empower you to escalate problems to the claimant" Yeah, and then when I lose (which I will), I get a copyright strike.
UA-cam no longer cares about their creators. They only want to please the advertisers at this point.

If someone got a strike all because they said a name of a song or whistled the Jurassic World theme tune I think that is ridiculous and just taking away people's rights, if this escalates enough they could say literally anything you say is copyrighted. I think Sony Entertainment are already abusing the copyright system. UA-cam needs to do a bit more of a better job. But as a UA-cam creator, you can never be too careful.

Giving the "UA-cam Creators" channel a false copyright strike.

  • @artfxdnb
    @artfxdnb 4 роки тому +632

It would be nice if UA-cam could fix their copyright system so it doesn't flag my videos when all I'm doing is making music myself. Last week a video got claimed on behalf of Killer Tracks which is associated with Universal Music. They claimed the copyright to a part of my video where I was playing a single synthesizer note, yes you hear it right, not a musical composition but a single note. Not only was it a single note, it also was in a different key and in a completely different pattern and tempo, than the track I assumedly used according to the copyright claim. This happens a lot, I make a video explaining music production techniques in which all used sound/music is my own yet it still gets flagged for copyright.
Each time it costs me time to file a dispute and proof the content is mine and I own the rights, after which it takes another 30 days until I can finally see my revenue coming in, that is only if the claimant decides my dispute was correct, if they reject the dispute I'm in for another 30 days of waiting. In total it could mean I have to wait 90 days for my revenue even though it is 100% clear that I own the rights and there isn't even anything to base the claim on to begin with, yet I am the one who has to face the repercussions of it and not the claimant who filed the false claim.
So UA-cam, I'm going to ask this for the hundredth time now, you probably won't respond since you have never done so, but *_what happens to a claimant who files false claims?_* My channel can get terminated if I receive 3 strikes or if I file false disputes, but what happens when a claimant keeps filing false copyright claims? In my opinion, UA-cam should take a stance and protect its creators against this, which it is currently not doing.
Finally, something I have also spoken out about before, I want to talk about the "sharing your revenue" part of this video. I don't think *sharing* is the right word, to be honest since nothing of the revenue is shared. You lose ALL of your revenue the moment a copyright claim comes in on your video and you acknowledge that claim, even if the copyrighted material is only a small part of the content on which the claim was received. Sharing your revenue would mean that the revenue is SHARED between the parties involved since if you made the video, you still own rights to that video even if it uses copyrighted music. The moment you create a video you own the copyright on it.
So let's say you make a video with a voiceover AND you use copyrighted background music, then who owns the copyright? Well, in theory, there would now be multiple people who own the copyright. The video copyright would belong to the creator of the video, plus if he also did a voiceover he will also own the rights to parts of the audio. Since the background music was not made by the creator, that is owned by a third party and thus the third party owns a part of the audio copyright as well. So in this case only a third of the entire copyright belongs to the third party, yet because of their claim they get to keep 100% of the revenue. In this case, the best way to split revenue would be to give the third party its fair share of the revenue, instead of the full 100% like is being done now. It is not fair towards creators and its only playing into the hands of bigger record labels who keep filing claims because they know they will get 100% of the revenue. It has become a pretty good extra source of income for bigger labels at the cost of the income of creators. So can we agree that this is not "sharing revenue" but rather being forced to hand over all of your revenue from said video because otherwise, you face the consequences?

@@appeartechbd I hear you. It's obvious with recorded music, but w/ production music, this is the cancer I feared would spread over time, not if, but when. If they just made it easier for people to pay a reasonable fee or have ASCAP/BMI/SESAC/other PROs to support using music on alternative media like YT maybe people would be able to not feel so paranoid or feel they are in the wrong. YT is now owned by the big media, despite being owned technically by Google.
It's the modern day cable company, going against Hulu and Netflix. It's not the UA-cam I remembered growing up when it launched in 2005 it was like an international public access network on steroids, where the major media companies negotiated licensing deals. *Google is a lazy engineering company that refuses to learn how to negotiate with the big media outlets. They always cave into their demands!*
People are probably going to other outfits and then deal with copyright on their own. I'd rather do that, than fighting with a bot or someone who treats "users" like numbers. I feel worse for people who pay into UA-cam to get their content out, they should come first.

The same companies file claims against my videos over and over again and again. Is there any way I can get these companies to stop filing false claims against me? They even reject my responses which requires me to then to a very specific and detailed defense that ultimately results in the companies dropping their claim. Why do THEY not have to provide THEIR contact information so I can respond directly and work it out? Royalty free simply means it does not attract royalty fees for each time the track is played (each video view in this case).
I would first look to the licence you have paid for and check whether there are any limitations in the licence that might explain their claims. For example, they might limit the licence to not be used on UA-cam or not be used by creators with more than X subscribers.
If that isn't the case and there are no relevant limitations then you should contact them directly. It's weird that you discuss in your comment the lack of contact information in their claim but one assumes that you have contact information for someone you a paying to use their creative works. Right?

Every so often a claim is made from a track I've used (not claimed by Epidemic, but by a label), it hardly ever happens, but if it does, it's done by the music label of that song. I just dispute the claim immediately and discuss my creator account that I have with Epidemic *you link your youtube account with your Epidemic account through the Epidemic website in your profile settings *this helps to avoid these issues). Anyhoo, any claims (which have been few, are eventually dropped. I can't recommend Epidemic Sound enough! The copyright rules on UA-cam are simply unfair. For those of us that review or react to songs and music videos we don't stand a chance. We work hard to provide informative and honest reviews and reactions and provide extremely entertaining content for the viewers and yet we do not reap the benefits because of these strict rules. Music publishers should look at videos like this as free promotion. It is not like we are just uploading their music for all to hear rather than buying the song. In these scenarios the publishers are not losing anything and only stand to gain. I wish UA-cam would reconsider the rules surrounding use of music in reviews and reaction videos because we as content creators in this niche are a huge part of UA-cam's success and we bring in a lot of traffic. We work extremely hard on the videos that we produce and it would be great if we could reap the rewards and actually make a substantial living out of this without having to branch out through other revenue streams. Thank you

The amount of times I’ve had content claim thrown at me concerns me as I put a lot of time and effort into creating my original music only to be told someone else owns the rights to it and if I don’t take it down I’ll receive strikes against my name etc. I tried standing my ground once only to be threatened by action from the person claiming it was theirs. I backed off for fear of someone adding a strike to my account but still annoyed to this day as it was my own music creation and sounded nothing like the song I was being accused of using. I legitimately purchased the composition rights to do a cover of a song. Some whacked out 3rd party targeted my channel and claimed copyright revshare even though they are not the copyright holder. I submitted a claim dispute to youtube, explaining all of this and providing documentation of the true copyright. Claim denied, no explanation other than saying the phony copyright claimant rejected my appeal. We uploaded a Guitar cover of song "A" or say title "A" on youtube in June 2016...
We got copyright claim from few claimants on sharing basis for song "B" or say title "B" for first approx. 30 seconds part from total 5.55 mins video....
Later youtube said that if we "Trim" the claimed part of video, our said video could be copyright free...so these claimants very next day changed their claim from 30 seconds part to WHOLE video i.e. changed their claim from 30 seconds to 5.55 mins...and when asked youtube has no answer for this...
    now further another twist..
in this year i.e. in 2019 after 3 years these FAKE Claimants changed their claim title itself...in other words they were claiming on title "B" earlier but now they have started claiming on title "A" i.e. the song cover which we have uploaded...so my question is that how could they claim on the cover which we never covered ? i.e. they claimed on "B" but ours was "A"...and now how can they change / shift their claim later or after few years from "B" title to "A" title ? they did it because they realized in one of our comments (like we r commenting here now on creators' channel) that the claim they are claiming is not on our uploaded titled cover but for another one, so they changed their claim from "B" to "A"...and the worst part is that these fake claimants are increasing day by day....every 3 months i find new claimant for the said cover...how is this allowed i wonder ? several attempts to write to youtube has yielded no results yet....we always get the standard replies and ready made copy paste rules & regulations from support people..so i request your good self to actually look into these problems, work in this direction & implement sound & positive steps to enhance faith in people....i am sure scenario will change...there r tons n tons of fake claimants from all over....the videos u r uploading r of no or little help...we all know all these norms...sorry if hurt..thanks for reading long comment

@@childrenofgodstudios I literally just tried to upload a stupid remix in which I used Frist of the year of Skrillex for 1 minute editing the sound and the video and mixing it with other songs. I just wanted to experiment something I never did, have fun and see what people think about it and maybe show it to some friends, so I uploaded it on a channel with 4, yes 4, subscribers that clearly doesn't allow me to monetize it (as I neither want to for sure) and the video got instantly claimed for this minute and got shut down and inaccessible in the whole fucking world. Just cause I wanted to see what I could do.

Also, UA-cam may adjust the video quality to help improve viewing conditions - for example when there’s a slower internet condition. You can still change it yourself from the menu (settings) then select quality: yt.be/help/JXPZ

Good Q&A session. I watched it to the end. And just like in the other videos, you failed to address my question. Example: I am visiting Las Vegas. At night I go to the Bellagio Hotel water show and take video of the fountains. The Bellagio plays background music as part of the show. I posted my video on youtube and got a copyright hit. Why? I must assume that the Bellagio paid the music creator to use their songs. So the music is paid for. I am unable to separate the music from the sound of the fountains and the crowd. So my only alternatives are to remove the video or replace it with some youtube free music that does not match the motion of the fountains. Or, no sound at all. The Bellagio paid to play the music so that we could hear it as we record the water show. Like some people have stated below, if this type of copyright hit is continued, then one can never record the street signs on the Las Vegas Strip since they belong to the Hotels. Also, one can not record people walking down the strip without getting a release from everyone you pass. In my case, the action of the Bellagio Hotel does place the associated music in the public domain.
Please try to address this next time.

Look at how academic writings which are now has two versions, either the consumer has to pay or no need pay to read it; which is all dependent on the choices of either the authors or publishers.

Hi, giant music nerd here to talk about the first question. I can play a melody im a different key, technically Im playing something different. Music copyrights only claim the melody in that key, and music copyrights in general aren’t that powerful. You’re just giving them way more power than they legally have.

I used someone's video without permission, I inserted my own music into that video. And finally the original owner of the video asked UA-cam to delete the video, and I got 1 Copyright Strike. UA-cam says the "Copyright Strike" expires after three months, but after three months now I still have 1 Copyright Strike?

Thanks for reaching out - besides waiting for the copyright strike to expire after 90 days, you also have to complete Copyright School. More info here: yt.be/help/fhTF. If you've already completed the Copyright School and you still have an active strike, let us know.

Here is a solution- Send the suspected videos to the copyright owners to review it. They will employ employees to review those. It will also make a new job sector for unemployed people. Then copyright strikes will no longer be UA-cam's responsibility. You cannot rely on AI. It will surely make mistakes and make innocents suffer.

Somebody needs to make a big song so if UA-cam rewind uses it, then they would get copyright claimed

The problem is there are people sampling things or downloading beats and then claiming UA-cam ID

*Use music from the UA-cam audio library because it is 100% free and you can still place adverts on your videos. Don't trust people who say that you can use certain music as it is copyright free because it is you taking the risk when you use it in your videos.*

Copyright law is stupid asf. It should only be used for taking large chunks of a song and uploading it in its raw form. Nobody should get copyrighted for remixing 5 secs of an unreleased track

  • @superiorresidencesofpcbact3886

My question is this. I purchased 'UA-cam Movie Maker' that includes lyric videos. My impression was that uploading a lyric video to a song using this program would cover music licensing. But I put 2 videos up and, on the info, make it said there was a claim but the owner gives permission to use the music. After it was published, I received a copyright strike. So that does mean I wasted my money buying the UA-cam Movie Maker if I am still not allowed to upload video lyrics? I see so many people load up video lyrics and wonder how they do it.

I came here to learn how to license a cover, and stay out of the 'strike zone'
    I learned nothing.
