    I was hospitalized for 5 days 3 weeks ago. I have preexisting conditions. Upon return to my apartment, I saw black mold on the concrete on the floor in front of the washer (previously affected by, I imagine, a leak, as the vinyl floor and particleboard is partially warped, partially missing, and concrete slab is exposed). I notified y landlord, the Hurricane Helene hit. No power for 6 days. Then returned home. There is green mold on my leather things, the furnished leather sofa, inside kitchen cabinets. My apartment was “fogged” and the ductwork “cleaned.” I cannot physically wash the entire apt down, and I was advised to wash all of my clothing, etc. after hospitalization and Helene, half of my clothes smell rank, as if left wet in a pile. Your strategy as an attorney is to, according to the first five minutes of your video indicate that my pre-existing conditions prevent me from any rights regarding my health in this situation. Am I missing something? How do I know that there is not black mold on all the concrete under the kitchen area? My kitchen sink flooded into the cabinet underneath a few months ago, I immediately addressed this issue And the plumbing was fixed. The cabinetry is buckled under the sink. Without lifting that material and looking underneath, How do I know there is not mold growing there affecting my Health? I had to be hospitalized for difficulty breathing, and since moving into this apartment I have started needing oxygen at night. Your defense strategy would be to say there is no way to link my increased health problems with mold. I just want to move out - break the lease. Is this a reasonable request? I look forward to your response.

    I have alway kept guard breeds dobies, rotties, working line german shepherds ect. After the first landlord I was able to tell prospective landlords call my current landlord plus I offered a heafty extra damage deposit.

    In texas whats the crawl space causing mold precautions that landlords have repsonsibility over. Vice versa what should a tenant do if they encounter a slumlord. As a landlord ive gotten questions from friends and family. Thanks in advance.

      When a rental unit is partially uninhabitable due to mold, your duty as a landlord is to go in an make repairs. The tenant needs to send a proper request in a method indicated in her Lease. If any landlord, slum or otherwise, is violating their lease, the tenant should do something to enforce their rights.

    My renter, her friend and i are doing our final walk. Closet rails has cockroaches dropings, i opened the microwave and theres live ones inside, also in ceiling light and bathroom tiles are all cracked, bugs trails outside, wood flooring all scuffed. Renter and her friend say its been like that for long time and after 2 yrs the foor is wear and tear. I took a lot of pic and bills from my pest company. But when i showed them to the judge abd how its on our rental contract .... I felt he was prorenter to no matter what i said or showed. Ernie its the jzdge who had no heart. He gv her bk all her security deposit and more. What can weLL do against judges????

    I only consider allowing tenants to have pets if they have been there a while and have a proven track record of caring for the property.

      Professional tenants with use a ESA letter from their doctor to force a pet into your property.

    Ernie! Buddy! Got a hypothetical.... Let's assume I need to send notice... Best way is usually certified + return receipt request along with regular, both sent at the same time... What if I'm dealing with a tenant that keep ripping up the post box? Can't get the certified + return receipt because he won't answer the door (also means I can't deliver into his hands), and as soon as I put down another mailbox, the box is removed. Can I just mail the notice anyways, knowing that it can't be received? Because I really don't want to do the whole posting inside the main entry door thing.

      First, can you prove that he's the one "ripping up the post box" and not anyone else? Was this witnessed or recorded somehow, and how many times has this happened?
      Second, as long as you're not the one tearing down the mailbox, and as long as you delivered the property with a mailbox, that's very likely the tenant's problem.
      Third, you could also employ an alternative method--UPS or FedEx as a CYA measure to prove to the court that you did everything (including regular AND certified US Mail) to get this notice to him.

      In Sacramento, sent by regular mail is enough. Whether tenant has received the notice or hasn't is not the landlords problem. Landlords are only required to mail out the notice. That's it. I've evicted four people and it works every time. I thought Texas would help out the property owners. I guess I was wrong. Texas is in the toilet.

    1999, Meril Lester of new york lived in her rental. 2015 she suddenly needed an emotional support parrot ... Now 3. The LL tried evicting her but LOST. She won $165K.this is not FAIR to other renters and to have 3 support animals and the govemt dictating our business. LL ct fees over $20,000

      Yes. That's a big part of the service that landlords provide is focused on the welfare of their tenants. Maintaining a habitable home for someone else isn't as simple as the average non-landlord might believe.
