What Sammy talked about in respect of hearing the lawyers on the application is right and settled law.
When applications are accompanied with written legal submissions then there is no need to hear lawyers in moving the application.
The principle in pleadings and Affidavits are clearly settled that a party can not plead law but only facts.
In moving the application by the applicant, the position of the law is then cited to back their application and argument and the Respondent also has that same opportunity to oppose with their legal Authorities.
What's most striking is the fact that the judge admitted the application is a novel kind which required the parties to make submissions backed by their legal positions.
The judge was respectfully wrong on few things in her ruling on the matter especially when the Judge had a good opportunity to espouse a new position of the law where there are no precedents.
Justice should be justice!!!
Thank God the world doesn't run on lawyers but scientific laws like the world would be a mess

What do you think about this young man's submission after hearing the cross-examination of the accused? I am not a lawyer, but I could predict what is happening today. The young man now wishes that the tape and the WhatsApp messages had not been admitted into evidence. The powerful AG tricked all of them and now the case appears to have been seriously damaged by the NDC party and Japka. Isn't it?
