There's another case where a woman died while in custody. Just as the cops were pulling her into another room where she subsequently died, security panned the camera away.
Family sued for wrongful death.
Case was dismissed due to lack of evidence.
Beyond disgusting. You or I would certainly get a felony assault charge. The prosecutors know these jailers so they get sweetheart deals.

What possible justification can there be for charging someone with misdemeanor assault who puts someone in a coma?
Misdemeanor assault in Texas is, I punch you and you get a black eye...nothing more. You feel pain. That pain constitutes "bodily injury". There doesn't even have to be a mark, but it's typically charge if there is a red mark on someone's face a few hours later.
Aggravated assault is either assault with a deadly weapon (doesn't apply here) or SERIOUS body injury. What counts as serious?
Broken bones. Putting someone in the hospital. Cuts that require more than just a few stitches.
A skull fracture WITHOUT a coma would qualify. A concussion requiring hospitalization would qualify. A skull fracture with a coma is open and shut an injury that goes BEYOND misdemeanor assault straight to aggravated assault. If you can prove someone threw the blow that fractured someone's skull and put them in a coma, then it is open and shut Aggravated Assault, a 3G FELONY in Texas.
This is what the charge should have been -- AGGRAVATED assault.
