As my father was hospitalized I didn't take parking facility from the Builder. Later I had certain issues with Builder regarding payments, hence he wasn't giving me possession and told me to sign on stamp paper which had written that I can't ever park my Car in future in that building. After Society was formed I approached them and requested for Car parking. However they refused by showing copy of that letter which Builder had given to them during handing over process. There are people in my building who are holding 3 parking slots and refuse to let go of any 1 slot when I requested them for it. Legally Bye Law says every Flat is entitled to 1 Car parking. However in my case, I don't know what to do. Please advise.
Hello,
If society is having that letter and based on that not ready to respond, then you have to fight legally. Complaint to Registrar office first by keeping marked CC to society. In case no response then be prepare for legal fight.

Respected mam i have one query regarding open space parking,i have my own stack height parking, but my car is big and it doesnt fit on it .even this situation i parked my car on it with my own risk. One day i parked my car on society's open space and generally those dont have their own car parking, they parked their vehicle there.That one day when i parked my car on open space society took objection and told me to park on my own space,But my question is ,The open space is not anyones private space,if people who dont have their car parking and they can park their vehicle on open space then why it is restricted for other? In committee,most of the people they dont have car parking and they are making all rules in their own favour.Please guide me,whati can do
Owners has a allocated parking by builder or purchase stilt parking but if the flat is rented out .Is the tenant can enjoy the parking space for his car ? please elo rate legally. Also what is the percentage Rental members can enjoy parking slots in a society ? Please put in ur part II

I have a serious issue related to parking..... I live in a building and i own a parking my personal parking.. And the problem is the society has pass a rain water drainage pipe in the middle of the parking ceiling.. And when I said to remove it they said only the ground area is owned by the person not the ceiling that means society has the right to use it however ever they want and i is looking really very bad I want to know are they right or not is the person who owns personal parking has right and ownership on the ceiling or society

Builder provided Flat Numbers To Parking Now Secretary Is Telling That First Come Forst Serve Basis is It Right? Because We never Disturbed Anyone by Parking our Vechicle in Their Parking, we always park in Our Numbered Car Parking.
If you are having any evidence, that builder already allotted parking to you then present it in the Committee meeting, because sometime builder allotted parking and not informing to the society. So let it handle peacefully.

If they have proper agreement for this parking then can be shown to society. If not having then it is not valid
Members having garages don’t park within the garage & use it for other personal purposes except for parking their cars which causes shortage of parking in the common open parking area for other members
Can the MC allot a parking outside any members garage ?
Can a member park a car which is not his own name or any of his family members name ?
Parking allotment is coming under MC rights. So MC should take care and check at least one parking should get to each member. If you are having any query, you may write letter to MC before AGM and discuss in the AGM.

Agar unhe wo parking allotment diya hai to time set nahi kar sakte. Ek bar parking allotment ho gaya to time set nahi hoga. Aapko ye point aapke AGM me discuss karna padega.

As per Bye Laws, parking rules should be set by the Managing Committee. Some important points mentioned in the Bye Laws which needs to include while setting the rules. There is no specific rules mentioned for stilt parking, you need to check with your society's MC or help them to set the rules with the help of other general members.

Open parking space is alloted to some one but hi is not parking as he dont have the car and giving others to park the car so what should i do
Actually if a member is not having a car then they should not take parking, they should surrender. You may tell them to surrender or inform the society when he will park his own car there, if he is planning to keep it his allotted parking.

@@maheshkamath5965 Actually cash accounting not allowed, during the audit you will get bad remarks by the auditor and it would be problematic to keep clarity every time.
