- The plaintiff rented a room from the defendant. He says it was a nightmare situation because he couldn’t use the kitchen and the defendant diverted his mail. He claims she kicked him out of the apartment because he wouldn’t have sex with her, so he’s suing for a refund. The defendant argues the plaintiff was the one who came onto her.

One thing these cases teach me is that I do not want to be the age of these people and be so unstable in my life. I get that we go through things, but living in a bed with a fridge and a microwave is not it
Yeah, you have to wonder what these people did to alienate all of their family and friends to the point where they have to room with strangers. But I've know people like that. Usually they have drug/alcohol/mental health problems.

Enforce what? The judge ruled in favor of the defendant. The outcome would’ve been the same if she dismissed the case completely.
@@mikesteele05 Dismissing a case and rendering a verdict is not the same. It's not about the outcome. You can't apply harmless error here. In most states, you can't enforce an illegal conduct - you can lose your license that way.

Maybe, that is common practice for other young ladies these days 🤷♀️ because I see a lot of people claiming “Oh no it was all him”. But, when asked by the judge she didn’t deny coming onto him and she even admitted to it; Stating that she DID ask for the relationship to go further.
Myself (along with the judge, and others) consider that to CLEARLY be a mutual attraction and not “He was clearly the one who wanted to have sex.”, Just because she decided to take a video that day. NOW, ALL THAT SAID: HE CANNOT JUST COME IN TO COURT AND ACT LIKE A VICTIM, THATS WHY THE JUDGE GOT HIS 🙄.....
The Video served along side her own testimony as evidence of mutual attraction.
💁♀️ Moral of the story: I commented at the end of the case after hearing both sides of the case. You cannot claim someone is TOO disgusting to use your kitchen as a legal defense, and then in the same testimony admit that you would have accepted (and requested) intimacy.
The main reason I came to my conclusion, was the defendant’s blatant testimony that she was the one who asked the plaintiff “Where is this relationship going? We were eating pizza and one day I came home and he was in the living room. My bedroom, I watching him sit and watch 42 episodes straight of breaking bad”.
I mean...... she admitted that he was not below her standard’s enough to agree to an intimate relationship BUT he had to be an avid hand-washer in order to USE HER KITCHEN?
Based on her testimony AND heard in the video: She was not scared or taken abac by his hygiene habits...
She sat 3 feet across from him and spoke softly the entire time and she did say no. HOWEVER, she was also angry that he ended up leaving... 🧐

If I began receiving ANY UNWANTED/UNRECIPROCATED sexual advances, apparent nudity, or sexual harassment from my roommate: I would not hesitate and begin the eviction process, by sending an immediate eviction notice. Maybe, even call the authorities.
BUT AGAIN, that is clearly not the same standards that many other young ladies have set for themselves or their bodies. The idea of “So what if I consider him to be too unhygienic to use my kitchen, I thought that our relationship was becoming intimate” OR it is the same if we use your ‘argument’: “So what if I consider him to be too unhygienic to use my kitchen, he was totally the one wanting to have sex and yes I would have had sex with him” 🤭🙅♀️🤦♀️👁👋

What I saw were two depressed people, possibility on the wrong anti-depressants for their condition, that experience depression/anxiety/loneliness very differently from one another and that shouldn't have gone into any kind of agreement together but were desperate so they did. What would you like clarified exactly? In most but not all jurisdictions "landlords" of illegal units/apartments are not eligible to profit in any way from that rental so the deposit would go back to the "tenant" (who should not have been one). This decision surprised me.

I think it’s because she felt that he knew that it was illegal as well as it’s money already paid it’s different if she was requesting for back pay rent and he left by choice with no notice
Let’s use an example. The plaintiff sues a prostitute to get his money back for cutting the service short. The defendant (prostitute) agrees that she took money under the premise that she’d provide two hours of sexual services-and that she, in fact, stopped serving him after, say, 15 minutes. It may seem as though the plaintiff would be entitled to a partial refund-but, in reality, that’s not the case. The case will be dismissed because the plaintiff is playing with unclean hands to begin with by paying for sex. Specifically, any subsequent disputes become irrelevant because the arrangement was illegal to begin with.
