Lawyer here. Court is not going to “force” Bernie to carry out his executor’s duties. Court is going to replace him and appoint a new executor or administrator of the will. It will be out of Bernie’s hands. Why they waited over 4 years to make a court application is beyond comprehension.

I had to get a Lawyer involved as my oldest brother who was executor to do things the Legal way, NOT the way he was doing to me personally.
The reason I didnt question anything and let him do anything he wanted…..My Aunt actually had spoken to a Lawyer she knew in case I needed one…..

Peggy $ A certificate for a paid for Casket that Mama bought after Daddy died (1982), that was valued around $1600. The reason for this discrepancy in Peggy’s amount being more is that it was easier to calculate that figure to the amount in the account. Also Brother #3 stated that he heard Mama say she wanted me to have it.
Yes… there is WAY more and it was devastating at the time… But I had Family support that I will forever be grateful to have had… He did NOT Crush and Eliminate me like he thought he could. He always said I was an extremely Strong Person…. Guess he didnt know HOW strong til he was on the Receiving end!
Yes, you’re exactly right. A lot of people in this situation aren’t aware of their options. They think if they wait long enough, the executor will finally get his act together.
If the father had a will done by a local lawyer, they could obtain a copy from that lawyer?
Instead of calling Ramsey, call a lawyer.
The thing is….The Caller doesnt he KNOW if the younger brother is Executor or the Parent even had a LEGALIZED Will! He us going on what the EX wife said 🙄
nor does he know if he actually is in the will or what percentage he will receive, sounds like the mom trusted the successful brother to take charge because the others are not fit to handle money.
It almost sounds to me as if the probate process was never even initiated in the first place and the brother hasn't sold the house because he can't.
He doesn't want to get a lawyer because he doesn't want to spend any money

he is worried about pennies: grass cutting and taxes cutting into his dollar value. meanwhile the property has most likely gone up in value by thousands.
This caller is full of it. The youngest was the only non-loser, and he's done with the other two.
Even if that’s the case, he has to show and honour the will. He can be done with them but he has to pay out their inheritance if they are beneficiaries. He feels like he’s entitled not to.
Also since he’s kept the house vacant for 4.5 years, he’s not playing with a full deck either.
That’s the feeling I get as well. Probably drugs and alcohol are why his brain moves at the speed of an abacus.

A lawyer will help him and also maybe sue the sibling for not following the edict of the Will and the Laws in that State for Filling a Decedents Death Notice.
The brother could be placing all bills in decedents name and paying… which IS illegal!
My Lawyer was able to MAKE my Brother follow the law and NOT do what he wanted to to me cause he was pissed at something our Mother did that I had ZERO knowledge… so he took his anger out on me

A fight over a will is typically expensive, but getting something is better than nothing.
Another problem could be if mom became a ward of the state and on Medicaid while in the nursing home. Medicaid could have a lien against the house that must be negotiated and satisfied before the house can be sold. Family can physically have control of home but must settle any liens before they can sell.
What negotiation? Medicaid would demand the house go on the market. The mother was definitely not a ward of the state.
After my mother died I stepped up for my father. Siblings did nothing. When he died I received his home. I had a home, so I gifted it to my brother, who was living in an apartment with bars on the windows. He complained that he would still have to pay taxes.
Then he sold it and moved out of state. It’s difficult to do the right thing when you’re the only one doing the right thing. Lessons learned.

Sounds like the caller just wants money and the younger brother doesn’t want anything to do with them. Caller literally has no idea if he actually has any claim to the home and mother clearly skipped them over. They should just move on. Caller waited over 5 years and now doesn’t even want to pay for a lawyer showing how little effort he wants to put into this.
Another reason to take care of yourself first. You don't have to fight over money with greedy siblings.
Sounded like Bernie had mom change her will before she went into the nursing home. The brothers don't get along so there's no weekends at Bernie's anymore
My inlaws are this guy and his family only her cousin is now living in the house and the grandparents died about 25yrs ago..theres still no lawyer involved..prob because all the estate went to paying taxes, maintenance and power Bill's for 20yrs of this house sitting empty.

I wish Dave had explained what it meant to be the executor on a house with liens. My younger brother was the executor on the house my father left for the two of us. It does sound like "Bernie" did not execute, but his job is a little more complicated than you see on tv. You need to take care of ALL depts owed BEFORE anyone can receive proceeds from the sale of the house.

The executor can claim expenses, paid by the estate. I was the executor for my parents, and I chose not to take any reimbursement for my expenses (travel expenses, etc). My uncle claimed expenses from my grandparents' estate.. he would fly to where my grandparents lived to visit his in-laws and claim travel, hotel, and food and would do, usually a minimal, something about resolving the estate. Personally, he disgusted me.

Can’t anyone go to the proper government office and ask for a copy of the Will? We had to file MILs original will with the court dept. once it becomes a government document I think anyone could go request a copy.

I wouldn’t fight with my siblings for my deceased parents house. This would not be honoring them. This wouldn’t be what they want. My siblings can keep it, they clearly need it more than I do. I’ll make my own. It’s just a house.

Walk away... I was appointed not only executor, had power of attorney in financial and medical issues. Parents didn't like my independence and threatened to assign someone else, then threatened to leave me nothing in conjunction with re-assigning to which I said 'knock yourself out and do what you want. Kiss my ass'. Haven't spoke in years and could care less what they do/did.

If the mother has been in a nursing home for five years then she may have had medicaid unless she was wealthy. In that case if he probates the will the state takes the house for reimbursement. If he doesn’t probate the willl he has the house to store his big boy toys until the state decides its time to take it little brother probably knows all this and is waiting on the other two to scrape up enough money to get a lawyer. in the meantime hes not paying property taxes why else would a financial successful person do that either A. he knows there will be no money in the end or B. he doesn’t need the money and he wants the brothers to get nothing
