- If you are thinking about releasing a video you shot to a licensing company, you may wish to watch this video first. I'll share some thoughts on things you may wish to request and be aware of before you sign on the dotted line.

I would also like to add... please consider registering any of your viral content with the US Copyright Office. That way if people DO steal the content without a license (ooooh trust me, it happens... celebrities are even stealing mine) you have a good solid proof of ownership to swing around in case needed. 😩
This is GREAT and you may want to license this video because of its valuable info. It is obvious you are where you are today by not letting someone else push you around or take advantage of you. I love your presence of independence, knowledge and confidence. Hurray for the small businessman and congrats on your spider video.

Good video Joe. One thing you didn't cover which is very important is the legal liability clause in the agreement.
Read it very very closely. It may say that you are totally liable for any legal costs racked up by the licensing company that may arise out of use of the video. If it says that, it's a no deal situation.
I've been there and all was good until i read that clause. There's no way i would (possibly) bankrupt myself over a YT video.

Not always true. I went to university to become a teacher; there were some high level athletes who knew their sport well, (college &/or Olympic level), and couldn't teach it to save their lives.
Some people just can't fit the right words together to clearly explain what they do, and it's not because they can't do it.
What's funny is there's a old saying, just the opposite of your premise: 'Those who can, do, those who can't, teach.'
It's just as inaccurate as your premise.
Thanks for all of that information. I have nothing that has ever gone viral or even very popular but I have been approached by a couple of these companies wanting to handle my ad revenue. But I am not letting anyone but me get involved. My most popular video was set "not suitable for most advertisers" by youtube.

You really have to be careful, or they are the only ones to make any money.
This seems right on about publishing in general. I wrote a book in the '90s (don't buy it!) and there were a couple slightly wonky things in the contract, but hey, they told me "everyone gets these clauses", I needed the dough and, well, that was that. All these years later it's still on sale, having gone through 5 or so publishers (and an e-pub which isn't covered in the contract as they didn't exist yet) - and it's been around 3 publishers since I got a royalty statement, and in fact have never gotten a dime since the initial advance. The original publisher even reported negative sales one quarter - and somehow avoided the clause around book clubs and selling it on (they went bankrupt...) and the evil Elsevier has it now - but doesn't even know my address as far as I can tell, and there's probably no way to even prove I wrote the thing (now hideously overpriced as well as out of date). Joe and Frank Zappa were right about "hollywood accounting". I know as while they did sanitize the book of my contact info, they forgot the included code and I still get emails... Around 10 times as many unique return addresses as they claimed they sold...and not everyone bothers to write...
These guys are out to make money and are good at it. If you demand your share and aren't afraid that they'll just say no - you might get paid. Else they'll forget you. Forget the "lottery mentality" - there's no "score that sets you up for life" and it'd be boring anyway. Be like Joe and keep doing good stuff, because the fun is its own reward. Never forget, you are the goose that lays the golden eggs. If one gets stolen, lay another. If you can't well then, that one was just luck. Meanwhile, they can't lay them at all!

He has grown about 1/4" longer and fatter since i shot that video. he's still hanging around the computer, but has surrendered the deer stand USB for a place around back.
The people who want to license things have incentive to make sure as few people as possible know this kind of thing. Buyer AND seller beware...

Joe Pieczynski Funny story for ya. I was renting a house that had the washer and dryer in an outside extension of the house. I'm at a friends house when my wife calls me in a frenzy, screaming she was doing clothes and in her words "a giant f-ing tarantula crawled on her toes, she screamed and it reared up like a horse"! Lol! Needless to say, I thought for sure it was just a random spider. I live near New Orleans, tarantulas aren't native hear. So, I go home to assure her it's not a tarantula and be the hero and catch it and through it in the yard. She said it was still under the dryer. I lifted the dryer and nearly crapped myself. That big bastard reared up with four legs in the air ready for battle. It was about as big as a hockey puck. It must have been an escaped or released pet. Now every time she's screams about a spider, I hesitate to go to the rescue! Lol!

machining channels have an audience that is more specific than a news channel for instance. does that translate into higher revenue per view? for example, if Noga wanted to place an ad, Joe Pie's channel would specifically target machinists because it is almost guaranteed that is who is watching and that they would want a Noga product. where as a news channel might have 1% of the viewers who are interested in Noga products.
Wow, made a video of my english bulldog fighting the cat for his bed back and posted it for the family to see. I let my vet have permission to show it on his site as the cat the dog was fighting with was one of his office cats at one time. Not that I would have charged him for it, but, I had no idea there was so much behind allowing someone else to use your video. Thanks for the education.
These companies bank on your excitement and rarely follow up with the level of service during the courtship, afterwards. Maintain control and don't get taken.
Very good I wonder if any thing like a W2 is issued for taxes or is it up to the person to report income from these licensing agreements.
Bruce Kennedy If the payments exceed $600 in one year they will (should) issue a 1099.
Technically, it is $600 or more in one tax year. $599.99 or less, you are in the clear. Once it hits $600, a 1099 should be issued.

Hi Joe,
I'm making 5 (45 minute videos) on wellness for an organization to show to approx 130 employees. They are paying me one flat fee. I want to give them the rights to show it but I want to limit the time frame. Is 6 months appropriate to put on a license and would you recommend a percentage of the total cost for the 6 month license? This is my first time. Hope it makes sense. Thanks Joe.
If the video is exclusively your property, you call all the shots. Structure the agreement however you want. Monitoring its end use will be tough, so a monthly or term deal may be your best bet. Charge for the composition of the videos as well. The license fees may pale in comparison.

You didn't mention it, but it would probably be worth talking to an attorney who is knowledgeable about contracts dealing with licencing rights to look over the contract, especially if the revenue is potentially in the thousands of dollars. I guarantee that the licensing company has an attorney looking out for their interests.

A company called ARK.Media want to license one of my videos and while initially I was happy about the approach, I have since been trying to figure out exactly what's the best option for me. They want the 50/50 revenue split but of course there are some exceptions to this and I'm wondering if I will be at a loss because of this, Is there any way I can contact you directly to show you the details of this? Hope to get some answers, I'm working on a projects and most of the footages are from various sites but i paid premium for them (Subscriptions). Once i'm done with my project, can i licensed my video project which i download from other sites (motionarray, artlists, envato..etc)
You may get a copyright violation from UA-cam unless you have previously arranged a copyright / license agreement with the host channel. You may not be able to monetize the video and should post, in your video description, that some segments are still owned by the original source and you make no claim to ownership.

Hi Joe! Thanks so much for your video! I just received an email regarding the licensing of my wildlife footage. The company (an internationally acclaimed documentary production company) asked whether I would provide them with a licensing rate for my footage (which they found on my organisation's UA-cam channel) for all media non-exclusively, in perpetuity, WW (I believe this stands for worldwide). The request relates to one specific video, not the whole channel. This is the first time such a huge company has requested my footage, and I have a few questions regarding what I should expect from the agreement.
1. They asked for a rate, rather than fee, so I assume this means an ongoing payment depending on who else they license it to (i.e. to affiliated companies internationally etc.). How much should I charge?
2. Is it fair to ask for them to include my right for recognition (i.e. in the credits) in the licensing agreement?
3. Does "in perpetuity" mean that I waive my right to request them to discontinue using the footage? My initial perception is that since this is for a nature documentary, and therefore is highly unlikely to be reused or republished, it is a fair request. As I understand it, a non-exclusive license also allows me to retain my ownership and right to commercialization through other means.
I realise this is a long comment, and I would be truly grateful for your advice!
Greetings. I literally just went through this today with The Dodo. These documents they throw at you can be overwhelming to digest. Unless you have the next chewbacca soccer mom video, I have to guess you don't earn much for the video you have. Not unusual. The non exclusive part just means you are giving them permission to take, edit and use all or part of the video they are interested in. They will own, exclusive rights to any video they produce using your video. If they take your video and make a short 3 minute segment out of it, insist on a full channel link and an onscreen credit. This will drive viewers to your monetized platform to view the entire video, and put money in your pocket. It will probably help grow your channel as well. Its initially a scary proposition, but the exposure is always good. As for the cash, depending on how awesome the video is, you can ask for 2-5 hundred NON_REFUNDABLE 1 time upfront payment and 40-60% of the profit they generate fromm the use. Expect a counter offer if you throw this on the table. Perpetuity just means that their income stream doesn't end after your initial agreement terminates. If this whole thing scares you, ask for a time of agreement to be set so you can either cancel or renew down the road. If the company is really interested, they will engage you. At the end of the day, its up to you as to step through this door, but i'm pretty sure they will put your video in front of more people than you can, and exposure is always good. Good luck.

Joe, I'll comment here so my comment will not get drown in the spider video. You wrote "no comments about insect please". From what I heard about UA-cam videos, and I might be wrong, is that the UA-cam algorithm ALSO rates the popularity of a video by the number of comments and replies, and the number of votes either up or down (regardless). They want to see that the video creates engagement of the viewers. That means that the video is not boring, but is "interesting". You get UA-cam to rank your video higher this way. So it's a good thing they keep commenting that it's not an insect.
Do you know anything about that? Correct? Incorrect?
Oh and BTW, It's not an insect. :D

Hey Joe! so i have a video that is starting to blow up! I got an offer from ViralSnare that they want to exclusively manage my video! They are offering a 60% revenue! What are your thoughts on this? It seems like there is no papers that i need to sign! I need to upload my video to their link and they will take care of the rest! I really would appreciate an answere! Thank you!
Once this is done, all youtube adsense revenue re-directs to them. UA-cam will see them as the video owner. Without knowing how much they are making, you'll never know if you're being compensated correctly. If you don't have termination control 100%, or short term renewable agreements, I'd pass.

You can protest that decision and ask for a manual review. It takes a few days, but if the video is clean, they will reverse it. If your channel has strikes, thats a different subject.
That is the thing, it shows no strikes. The letter they sent me of copyright or reuse of something that is not shown? I had posted a few of the Podcasts I was part of but, they are podcasts that I am on. I already tried to call for a review but, they now claim I have to get 4000 hours of view time this year before they will review it and my view hours keep going down. How that is possible I do not get?
@@NOSLEEPATALL They are very sensitive about copyright infringements. Someone reported it. if the podcast is not your podcast, it is a copyright infringement. In your creator studio, you have the ability to clip out the offending material. Then request the review. If you have to use a clickbait picture to get the hours required for the review, do it. i don't agree with that tactic, but play the game. Was this on one video, or your entire channel?
Joe No clue, I followed the rules and went looking for the problem video or videos and have no strikes on my account anywhere? Wrote that to them and the review rules were given to me. I have way over 10 million views but, all of a sudden everything stopped so I have to post stuff on FB to try to get views up. That way I get my review or drop YT and go Vimeo or host on my websites?
@@NOSLEEPATALL At the very least, they should identify the material reported so you have a fair shot at deleting it. I've heard of this before. A few of my videos got caught in an algorithm that was flagging videos for no reason. They reversed their decision, but it was a pain in the butt. Maybe music, language, background product shown. Small things will get you.

No, but that doesn't mean he's not legit. Do your homework before you sign and remember, they came to you for something you have. Don't accept the first offer if you do decide to license it.

I am a long time subscriber to your channel and enjoy the videos that you produce. However, because of the policies of youtube and their direction of not allowing free speech of many groups including conservative view point, Christians, libertarians and free thinking contributors I have decided to unsubscribe for all the channels that I view, and delete there apps from all my devices. This is not a reflection on your content which I like very much but a statement of action against youtube. I hope that you will post your videos with other providers that will not deny or restrict your freedom of expression in the content you produce. There is a new site called real video that will provide just that but whatever new site you post videos I will look forward to watching them again. We all need to stand together and not allow a handful of people or companies to dictate what is truth or what content we are allowed to view no matter what your view point is. I am going to post this message with each channel that I subscribe to just let them know that the issue is not with you but with youtube. Thank you for all the great content and the work you put into your channel, Hope to see you elsewhere on the net...

Mark, Any video I have ever posted is available to view on my Google plus page. If UA-cam policy states certain material will jeopardize my ability to cover the unrestricted material, then I will gladly relocate it. Just type in Google Plus, then my name on their search block. Too bad you unsubscribed. the move I made was to assure the survival of my channel without community strikes.

You are cutting your nose off, to spite your face. UA-cam/Google is a company, they have no legal obligation to guarantee free speech, nor any other constitutional right. The government, nor it's agencies can not infringe on our rights. The same does NOT apply to businesses, or individuals.
You notice Joe mentions 'strikes'. That is because THAT is the only way to protest a company censoring, the is no other recourse.
