- Officers with Florida Fish and Wildlife were on water patrol south of Peanut Island near the Rybovich marina when we observed a vessel heading south on the east side of the mooring field on plane in a posted slow speed manatee zone. We initiated a vessel stop to address the violation.We made contact with the vessel,and the operator of the vessel I told [REDACTED] the reason for the stop and informed him it was a slow speed zone he had violated. [REDACTED] had bloodshot and glassy eyes while speaking with him. I asked for his registration, Boater ID and Florida license. While he was doing this, I could smell an unknown alcoholic beverage coming from his person. I asked [REDACTED] about it and he stated his father had taken the boat out and spilled alcohol. I continued with the stop and asked for life jackets for the all 10 people on board. [REDACTED] entered the helm hatch and as he was showing me the life jackets I could tell the smell was coming from his person.I boarded the vessel and found under the back seat of the leaning post, a storage filled with empty containers. I had [REDACTED] board my vessel.I informed [REDACTED] that since he was [REDACTED] the age of 21 and there was probable cause to believe that he may have consumed alc that I was going to administer a portable breath test (PBT) to determine if he was over the .02 limit for an operator of a vessel under the age of 21 years old. [REDACTED] provided 2 breath samples on the agency-issued PBT. The 1st breath was .056 and the 2nd breath was .059. The vessel and [REDACTED] was released to his father and registered vessel owner.

I partly agree and partly don’t. I agree these “FWC” and “Sea cops” tend too “harass” boaters all day for no reason, Especially ones with girls on the boat. But Alcohol DEFINITELY has a smell. And it is illegal to operate a boat while intoxicated. It’s dangerous. And the smell it’s very obvious, i don’t know if it should be legal grounds for a search tho as people “lie”. Really a breathalyzer should be standard. But if it was that way the county wouldn’t be able too “generate” money off arrests. At the end of the day they(the FWC and Sea Cops) still play an extremely important role in keeping boaters, people, and the waters safe. And are needed. I just think the way they train them should change. And maybe some better evaluations for hiring. And these cops were good!

I lived in key largo for 20 years...I saw multiple boat accidents by spoiled kids like this...started getting real bad during covid. Parents let these kids get away with it. Trying to drive impaired is trying to do so in a vehicle that alot has to do with almost 2nd nature actions. You drive a lot normally these days just to go to the store and back, let alone the rest of your life.
Boating, boats do not have brakes, they don't stop right now. Boats don't turn instantly, can't jerk the wheel and dodge something.
Most operating a boat are at best just weekend users at best, some 3-4 holidays a year. The handling of a vessel is not anywhere close to being 2nd nature. Hell, I'm on the water 55-70+ hours weekly and it's still not 2nd nature to me, to many outside variables.

They can make a stop for a safety check, but in this case there was also a speed violation. The operator acknowledged that at 0:50.

States don't require you to register your boat, the federal government does. Those numbers on the bow are USCG issued.
Most states charge for the processing, what federal/state agency doesn't? My home state doesn't even do the registration for land, air, water, it's bid for and contracted to private companies. Wait times are less than 10 minutes, registration costs dropped.
If you've ever had to view the carnage of vehicle or vessel wreaks caused by drunk operators you'd have a far different take on your bullshit especially vessels where splintering fiberglass and jagged metals have access to flying human bodies. When Florida averages 800 boating deaths a year it's doubtful most FWC LEOs haven't worked one in their time, or seen accident scene photos. My neighbors son worked his first one his first year with the FWC. 9 overboard, 7 drowned, 6 were children. He's not the same free spirit he was before.
Did I drink sometimes when I was underage? Yes, I did. But I'd be embarrassed as hell if I was caught and had to face either of my parents.

When I grew up on the Intercostal waterway there in Florida, there were no manatees. They were on in the fresh water where they were place to eat the water hyacinths. Then they broke out in to the salt water, multiplied and multiplied. Now they have multiplied so much they are endangered.

Keep making excuses for illegal behaviour by these brats. The kid could have refused and been put down as refused/aggravated DUI. But he isn't as dumb as you would obviously be in the same situation. Understand that the implied consent law means if you refuse it is a criminal offence. A breath test is not "voluntary" it is compulsory, but you can refuse it so long as you are happy to wear the consequences.

When you sign for your driver's license you acknowledge the implications of a refusal. If you blow its 3-6 month suspension

@@sandwichman100 The boat operator was going to jail anyway. That was never a question. A DUI/DWI/BWI lawyer will tell you the smart play is to not do FSTs or blow. Don't hand the police evidence that will be used against you in court. You're going to court for sure, you're hiring a lawyer for sure; that money is spent. The only real question is how long will you lose your license for and will you have a DUI/DWI/BWI on your permanent record. All you need is one person on the jury to say there isn’t enough evidence to convict and it’s done. Yeah you lose your license for at least twice as long as you would have if you got convicted but you don’t have a permanent record that follows you for life and your insurance isn’t going up a huge amount for the next 5-7 years.
