- On November 17th, 2023, FWC Officers Allen and Ross were dispatched to Wisteria Island following reports of a man illegally harvesting two young queen conch, an endangered species in Florida. The perpetrator had even brazenly filmed himself in the act and boasted about it.
Before delving into the video evidence, it's important to provide context about Wisteria Island. Often likened to a tropical "Mad Max" scenario, it exists in a legal grey area regarding ownership, with neither the Bernstein Family nor the Federal government conclusively established as its rightful owner. This ambiguity renders enforcement of private property laws practically impossible, exacerbated by the absence of no trespassing signs from the Bureau of Land Management, which has overseen the island since 2011.
Despite claims of Wisteria Island being a peaceful community, the presence of law enforcement armed with assault rifles suggests otherwise. In this particular incident, the individual in question was apprehended and transported to Stock Island Jail, facing charges including resisting arrest without violence and offenses related to harming an endangered species.

You have to establish a victim first. If it's public land, the state would be the victim. if it's privately owned, the owner would have to press charges. Since the landowner hasn't been legally established, there's way to charge for that.
I think you'd be shocked at how much of that probably just washed ashore and was collected to use in improvised camps. Many beaches worldwide have trash all over them that's washed up.

I remember when Sunset Key was undeveloped like Christmas Tree. Before they cut down all the Australian pines. Development on such a tiny island sucks. Wonder if all the homeowners are self insured since Florida’s insurance rates have gone sky high. I live on the mainland of FL, in a national forest and mine went up so high I just canceled. Figure if the old cabin burns down or blows away and I’m still alive, I’ll still have my land/septic/well and put in a tiny home. I can imagine what it would be on a small island with no real protection from the elements. Sunset Key has an elevation of 10 ft above sea level vs my town’s 65.
We cancelled ours as soon at it was paid off.

I never knew this about the Queen Conch. I didn't even know what it was called, but I have a shell somewhere in storage that we had in the house since I was a baby. That makes me deeply sad and I guess I never knew how they were harvested/killed. I don't think I even knew they were living creatures. I'm editing this because it was also always displayed in the house with two real baby conch shells that I always keep on my nightstand. I feel so sad :(

When I EOS’d from the Navy at Mayport, FL., I had applied with the Florida Marine Patrol and the Wildlife law enforcement. Was actually hired by both along with the Florida State Police. As it drew nearer to actually getting out, they all sent me a letter that it would be awhile before training began and the State Police said it was a couple months off but, ALL rookies are stationed in the Miami Dade region…this was the time of the Cocaine Cowboys and Scarface type of extreme danger. So, the day I got out, I just raised my hand again and went straight into the Army. While in basic at Ft. Nix, my spouse received letters from the FMP and the post office (as a mail carrier in Daytona)…damn, another instance of f*cking up. 😦🫤🫡

I used to camp on islands like that in Sarasota Bay with my brother for fun. We took his canoe and usually some friends and stayed overnight. Those islands are generally infested with rats. During the day I don't know where they go but at night we heard them everywhere in the bushes. So we put out bait and shot them with BB guns. My point is that the dude's ratty tent probably really is ratty.
You can also find rattlesnakes on the islands. They swim across the bay from one island to another sometimes. Plus there are raccoons and you never know what else.

🏝The island is called Christmas tree island it's off of Key West. It used to be a lovely little spot to stop and snorkel. There's a neat little wreck right off the island you can see its Bones still. To see the island in this condition is really disappointing. Thanks for posting.🏝
