Law | LLB student sentenced to life in prison for the murder of a police officer. Self-defense ?

  • Hey guys.
    Today, I canvass the story of Liqhayiya Tuta, a 2nd year LLB Unisa student who is currently serving a sentence of life imprisonment for stabbing and killing a police officer. His defence during his trial was that he acted in self-defense or putative private defense, in that he believed his life was in danger and was merely protecting his life. Unfortunately, he failed to prove that he acted in self-defense and was convicted of murder in 2018. The matter is currently being appealed in the Constitutional Court.

    Happy to report that the order of conviction has been set aside and Mr Tuta has been acquitted and released.

    The recent case of the school girl is just shocking. I went to go check if there has been any update posted by the spokesperson of the police ministry on twitter. There isn't any update since we last heard that the girl was released "unharmed" (I can only imagine the trauma she has experienced just from the sound of her screaming) and that the police officers are being investigated for their reasons for apprehending her and doing so in the manner they did.
    Being a women in South Africa is already so terrifying, there is no way you would reasonably believe that those men are police officers with one of them wearing a balaclava and the vehicle not being branded as a police vehicle.

    Interesting stuff :). One day if possible please talk about the current SA weed laws. i.e. The Haze Club, which has been fighting a previous raid on them by the police, as well as where cannabis clubs stand currently. Or anything related to such e.g. licenses, convictions, etc..

    My heart breaks so much for Liqhayiya, I really hope his appeal goes well and they reduce his sentence☹️ Also the intro video makes me so angry💔 How do you handle a child like that? I really hope they did not hurt her more than what we see on the video ☹️

    The opening clip of this video truly shook me hey😰😧 hearing that girl's screams tore me apart, it was not a pleasant sight to see. I wonder what happened or what did she do to be dragged like this💔🙊
    Shame man😢😭 what a sad story that of Liqhayiya hey. I went to the SAFLII website and searched for the case file but I saw it was too long for me to complete in a day, so I will read it and go through it at my earliest but by just what you relayed and summarised in this video I am fully briefed on what happened to him. What he accounted of the events that transpired that night was plausible enough for a self-defence explanation including his acts thereof after trying to defend himself. Anyone would've acted in that manner to protect themselves from such.
    Then I searched for the latest on his case and I found an article that he has since been released from prison and that he's been acquitted last year 04 Jun 2022! I am so pleased to have read this although I am also concerned as to how his life has been since then, he must be so traumatised and I wonder if his criminal record has been expunged so he can continue with his Law studies as he was before this mishap happened. 4 years down the drain like that is really not something to be smiled about.
    And Atli a quick question: Can he resume his Law studies after this ordeal? Will it not affect his career going forward?
    I hope you'll be able to share with us of the similar encounter you experienced back in varsity that you couldn't get to in this video🤍

      He’s conviction was overturned or cleared last year 🥹 yes he can study now coz it will not be on his record

      I worked on this case at the Con court. Something didn’t seem right to me so I tried to convince the judges to look at the matter closer so we can get a solution. I left the Con court before they finalised the matter but I asked a friend to make sure there was a hearing. And God came through shem. I am happy he is a free man 🙏🏾🤍

    I believe that the reason why the state won the case is because it was disclosed that he was intoxicated.

      He was actually not coming from a club when the incident happened. He was coming from his flat, walking his friend to his own flat at around 9pm in the evening. So he was not drunk.

    There was definitely an injustice, the manner in which the police were approaching them too was wrong especially because it was a suspicion and not that they had done something wrong 😑

    Wow what a sad story Atlegang,this is an indication of how at times most innocent people are sent to Jail because of their inability to pay private counsel.The system by its nature favours those with money,Jub Jub is out today because he had the money to take on the case.

      Atlegang does mention in the description of the video that the matter is currently being appealed in the Constitutional Court.

    So if a person has killed a lawyer will also that wrongdoer get a life sentence?
    Also if this boy loses his appeal at the ConCourt and probably be released on parole will he be able to expunge his criminal record after 10 year's?

      1. No to the first question
      2. There are certain criteria for expungement of a criminal period. He doesn’t qualify for expungement since he was sentenced to direct imprisonment and “committed” a serious crime.

      Self defence is suffice to exonerate him from being charged for murder, primarily the force that the police used was excessive to such an extent that the person who was apprehended had to prevent the imminent harm. Though his actions were unlawful in the circumstances.
      Further more, one of the elements of murder is lacking which is intention.

      It’s not immediately clear when the officer died. But the cause of death was penetration through the eye which reached the brain. It’s likely he died on the spot but I don’t know for sure
      I agree with you that intention was not there.

      I disagree. If you were intoxicated, which is not wrong, are followed by a suspicious unmarked car with suspicious individuals in the car, any reasonable person would run for their life because the individual would want to save themselves. Fright or flight, that's normal. I would never ever stop even in a marked vehicle at night, I'd rather we drive to the nearest police station due to the level of criminality in South Africa.
      I think the ruling was unjust and the student was prejuiced because the man who died was a law enforcer, however, procedure and due diligence was not followed even by the police men.
      Angaz kodwa. We all have our opinions and judgements on this case.

      But what are the cops doing in an unmarked vehicle and not in any police uniform. Clearly the young man is innocent in this case. They could have been fake cops for all he knew.
